WHEREAS, Kahuna Hills Second Add9.tion final plat was
approved by Spo}cane County Commissioners on the 5th day of
June, 1984;
WHEREAS, the final plat contained a dedication of a
utility easement five feet in width adjacent and parallel to
the southezly boundary of Lot 1, Slock 1, Kahuna Hills

WHEREAS, the southerly bounaary was relocated by
consent of the adjoining owners of the common boundary

I. GENERAI, INFORMATION

Location: The proposal is located adjacent and east of Carnahan Road
between 12th and 16th to the southeast of Spokane City; within
• Section 23, Township 25N, Range 43 EWM, Spokane Couaty, Washington
Comprehensive Plan: URBAN
History: The Hearing Examiner Committee approved this proposal in
January 1980. Julp 1980 change-of-conditions request was approved
with Hearing Examiner Committee modification. Two one-year time
extensions have been granted, 1981 and 1982. The February 1981 time
extension included approval of a redesign for a cul-de-sac. March
1982 the first half of the preliminary plat with 14 lots was final-
ized with over $200,000 spent so far. Additionally, the sponsor
indicates that substantial progress toward finalizing this proposal
has been made; as the outer boundary has been surveyed, $50,000 has
been spent on blasting and rough grading Kahuna Drive, a sewer line -
has been installed in Kahuna Drive, road plans and profiles are
completed for the remaining portion of Kahuna Drive, 13th Ave.
centerline and profiles have been surveyed and drafted, sewer plans
have been completed aad are being reviewed for City-County sewer
hook-up, community sewer drainfield design has been approved, and
design and calculations are complete for the last half of this
proposal, but not yet approved by Spokane County.
Proposal: The sponsor is requesting an "extension of time" of the
preliminary plat approval to divide the remaining 10+ acres into 25
lots for single-family dwellings and to change the zoning on the 10+
acres from Agricultural Suburban to R-1.
II. SPECIAI, INFORMATION
The Planning Department is recommending that all preliminary plat approvals be
brought into conformance with RCW. 58.17 regarding the amount of time allowed
before a preliminary plat must be finalized. State law currentl.y allows a
preliminary plat three (3) years (without any new conditions) and allows one
extension of time for one year, if the sponsor requests the additional year;
however, this 4th year may have new conditions added.

The County Utilities Department is recommending conditions be added to reflect
the current adopted water and sewer policy, since the remaining portion of
this preliminary plat is within the Priority Sewer Service Area (PSSA).
Staff finds that this preliminary plat constitutes "fill-in" development for
the Urban Category, for the Valley Sewer since the proposal is within the
PSSA, and for the existing public services and facilities of the near vicinity.
No other additional conditions of approval are being recommended by the re-
maining departments.
III. CONDITIONS
If approval is granted, the following cotiditions are recommmended.
PLANNING CONDITIONS
1. Those conditions already attached to the preliminary plat of record.
2. That the preliminary plat be given conditional approval for three (3)
years to April 1, 1986. The applicant may request a one (1) year
extension of tirne by submitting a written request forty-five (45) days
prior to the above expiration date. Such applications should demonstrate
the progress made toward finalizing this preliminary plat. If a time
extension is not requested in a timely manner or a time extension is not
granted, then the preliminary plat approval is NiTLL &VOID.
UTILITIES CONDITIONS
3. The owner, his heirs or successors shall join and particiopate in any
petition or resolution which purpose is the formation of a utility local
improvement district (ULID) purstrant to RCW Chapter 36.94, as amended.
The owner, his heirs and successors shall further agree not to oppose or
protest any legal assessments for any utility local improvement district
(ULID) established pursuant to RCW Chapter 36.94, as amended.
4. Any water service for this project shall be provided in accordance wlth
the Coordinated Water System Plan for Spokane County.

A. INTRODUCTION
This matter having come before the Spokane County Hearing Examiner Committee
on March 4, 1983 and the members of the Committee present being Ron McVicker,
Chairperson, Lynn Tennican and Rich Skalstad.
B. PROPOSAL
The sponsor, The Kahuna Land Co., is requesting approval of an Extension of
Time for PS-1362A-79, KAHUNA HILLS 2ND ADDITION, and Zone Change ZS-262-79,
Agricultural Suburban to R-1, for subdivision of lOt acres into 25 lots for

A. Historp
The Hearing Examiner Committt approved the plat in January, 1980 The
spoasor requested a previous Change of Conditions heard on July 25, 1980 which
were approved as modified by the Committee. Now the sponsor is requesting a
review of a revised plat.
B. Location
Kahuna Hills lst Additioa is located on the south wall of the Spokane Valleq
adjacent to and east of Carnahaa Road between 12th and 16th Avenues.
C. Proposal
- Project site is 16 acres subdivided into 39 lots for single family use
The sponsor indicates it is necessary to change the road system due to top-
ography to satisfy the request of the County Engineer The redesiga will
result in Kahuna Drive and Aloha Court having cul-de-sac's and that the lot
design will have to be changed accordYngly NOTE No additional lots will be
created as a result of the redesign.
D. Environmental Review
That the proposal is exempt from the provisions of the State Environmental
Policy Act, Chapter 43.21C RCW, pursuant to WAC 197-10-170

PLANNING DEPARTMENT
1. The Planning Department has reviewed the revised preliminary plat and
recommends that Lot 11, Block 1 and Lot 7, Block 1 be redesigned
providing for a more usable front yard in said lots, and that Lots 7-11,
Block 1, be allowed access from -Kahuna Drive.
HEALTH DISTRICT
1. The Health District has recommended changes in coaditions #12 and #13 of
the Heariag Examiner Committees Findings & Order signed July 28, 1980 as
it relates to sewage disposal and aew lot awnbers.
COUNTY UTILITIES DEPARTMENT
1 The Utilities Department recommends changes in their conditions to

' PRELIh1INARY SUBDIUISION AND ZONE RECLASSIFICATION - CHANGE OF CONDITIONS
I. GENERAL INFORMATION
A. Location
Kahuna Hills lst Addition is located on the south wall of the
Spokane Valley adjacent and east of Carnahan Road between 12th
and 16th Avenue. ,
B. History
The Hearing Examiner Committee approved the preliminary plat on
February 29, 1980. The sponsor requested a Change of Condition
to be heard on June 26, 1980, however, due to improper legal
notification, it was continued to the July 25, 1980 Hearing.
C. Proposal
The sponsor is now requesting new changes of the original condition;
to provide for the redesign of the preliminary plat creating (2)
two additional lots, relaxation of setbacks from the right of
way, access to the lots, specific phasing approval and to allow
minor lot line modifications upon filing of the final plat. THe
sponsor is also requesting R.I.D, for construction of certain
roads, temporary improvements,
a change in roadway improvements and the deletion of storm
drainage design. In addition, the sponsor has modified the
original request to reflect the redesign of the plat in regards
to the use of septic tank usage on (3) three lots (those being
Lots 9, 10 and 11, Block 1) rather than the request for septic
tank usage on (2) two lots as requested in the June Hearing.
II. ENVIRONMENTAL REVIEW
That the proposal has been subject to the review of the provisions
of Chapter 43.21C. RCW, the SEPA Guidelines (WAC 197-10) and the
Spokane County Environmental Ordinance (SCEO), a proposed declaration
of non-significance has been issued at least fifteen (15) days prior
to this date, the official file, written comments and/or public
testimony contain information regarding assessment of the proposal's
adverse impacts to the physical environment.
III.COUNTY REVIEW OF THE CHANGE OF CONDITIONS
Specific conditions have been prepared to address the sponsor's
request for the Change of Conditions. However, the staff feels that
the redesign of the plat has not been sufficient to warrant many of
the requested changes

I. GENERAL INFORMATION ~
A. Location
On the south wall of the Sgokane Valley adjacent and east of Carnahan Road
between 12th and 16th Avenue.

- Lot size = 12,600 sq. ft.
C Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates resideatial usage of this
area, as well as all aearby surrounding lands, with no density designation
D. Land Use Analysis:
1. Existing Laad Uses
The site is tree covered with slopes exceeding 15% and has outcroppings of
exposed bedrock. The area has experienced subdivision activity with
residential uses occurring to the south and west
Directly south aad adjacent to lbth Avenue is Riegal Heights Planned Unit
Development with s2ngle family residences on lots from 14,000 sq. ft to over
k acre Across Carnahan Road and south of lbth is the Kahuna Hills Addition
with single family uses on lots of 18,000 sq ft and larger. Other
developments in the area are generally along 16th Avenue to the southeast such as Sloan's Addition and Heather Park Addition ;
A triangular piece of property controlled by this applicant, located between ~
this proposal and Carnahan Road, has recently undergone a review for zone ~
change to Multi-Family Suburban with approximatelq 35 to 40 residential units.
This proposal was denied by the Hearing Examiner and is currently under appeal ~
to the Board of County Cortunissioners. ~
Property directly east and north is vacant with a large gravel pit located on
the southeast corner of Eighth and Carnahaa Road. '
2. Compatibility with Existing Land Uses ~
~
The area is developing for residential use, and the sponsor has proposed an
exteasioa of that use The proposal presents some difficulti site locations
due to slope and rock outcroppings, which may require some lot redesign to
facilitate individual house placement The lots are generally smaller than
the adjacent hillside developments, but the use as proposed does appear to be
compatible to existing developments.

II. SPECIAL INFORMATION ~
A. Circulation
The County Road Engineer has examined the proposed preliminary plat, providing
several conditions, including that sidewalks are requzred and that Rahuna
Drive be constructed as a collector arterzal with a 35mph design speed. These
coaditzoas and the requirement for a stub road out to the narthwest will
necessitate a redesign of the plat The spoasor has submitted a letter to tbe
staff objecting to the engineering conditions.
B. Sewage Disposal
The Spokane County Health District has conditioned this proposal to include a
public sewer system and required that an on-site sewage management system is
required. Lots 15, 16, 17 and 18, Block 1 have been designated as a drain-
field site on the preliminary plat map The plat is situated peripheral to
the Spokane Valley Aquxfer and the Heaith District has the followzng comments
on possible impacts:
Impact Discussion
a. The plat sponsor has proposed 38 lots on 16 acres. Each lot is to be
served by a public water system and provisions for a public sewer system.
This raises the question of significance of the impact on the groundwater
in the area and possible alternatives for sewage disposal
b. In the course of the conduct of the Army Corps studp, Dr Todd consid.ered
tppical soils, natural and sewage disposal recharge to the groundwater,
and the effect of contiaued urban development in the Spokane River Valley
upon the quality of the groundwater In sumanary, he concluded that.
1. In normal precipitation years subsurface disposal of sewage
treatment effluent does reach aad recharge the groundwater
2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portioa) are mostly removed by the deep soil layer
above the groundwater and "minor dlssolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, whxch are taken up by the plant roots," will be less
than the total found in septlc taak effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up Co 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mgJl. The forecast year 2020 maximum incremental
coacentratioa is 101 mg/1 above the natural background
- - - The analytical results of the forecast impact of year
2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
iadicate that the present impact on groundwater quality is
already a substantial proportzon of the ultlmate level.

c. Currently, results of chemical anaiysis show the total nitrogen coatent '
of the groundwater as in the range of 2 8 to 4 4 ppm. A projected ~

incremental increase usiag Dr. Todd's expected 8 6 percent would result ~
in a range of 3 04 to 4.78 ppm. Current Federal and State drinkiag water '
standards permit up to 10 ppm. ~
d. Alternative sewage disposal methods that would not recharge the ground- ,
water have the following general characteristics:
1. Collector aad central treatment systems discharging to surface
waters would require at least tertiarq treatanent and perhaps more to
obtain a permit for the discharge from the Department of Ecology.
These systems are aot currently economically available for thxs
project.
2. Sealed systems, whether indivldual or community, depend on
evaporation for liquid removal These systems require more land
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety ha2ards associated with them and relatively
poor community acceptance Land, installatioa and operational cost
are generally more expeasive than those for septic tanks and
drainfields.
C. Draina&e
The Couaty Engineer reports that the preliminary storm drainage plan submitted
by the applicant indicates that on-site stortn drainage provisions will
adequately handle surface water runoff. However, final construction plaas
should be reviewed and approved by both the County Engineer and Health
District prior to the final plat filing.
D. Water Supl r
The proposal is located within the recorded service area of Washington Water
Power Company. ,

The District advises the staff that adequate system capacity, and a desire oa
their part to serve, exists for the provisioa of water for domestic, fire aad

Residential while the Riegal Heights PUD was left as Agricultural zoning Given
the proposed use and lot size it appears consistent to zone this proposal to Single 0
Family if approved Some redesign of the plat will be necessary particularly Lots
10 and 11, Block 2 to allow single family frontage requirements to be met for
cul-de-sac lots.
IV. ENVTRONMENTAL REVIEW
An Environmental Checklzst was submitted by the sponsor and has been reviewed by
the Planning staff. No significant adverse environmental impacts were judged to
exist.
Slight adverse environmental i.mpacts were identified o❑ the checklist in the
following categorzes: earth, air; water; flora, fauna, noise, light and glare;
iand use, population, housing; transportation/circulation; public services; ~

If approval is granted, the following conditions are recommended. ~

~ That the plat be designated as indicated on the prelzminary plat of record '
and/or attached sheets as noted.
. That a statement be placed in the dedication to the effect that no more than
one dwelling structure be placed on any one lot, nor shall any lot be further .
subdivided for the purposes of creating additional lots or building sites
without filing a replat.
3. That appropriate provision be made that the following described property be
held in trust until the continuatioa of the streets be dedicated or deeded: A
1' strip at the ends or edges of all streets that terminate or border the plat
boundary (Temporary cul de sacs are required when streets terminate at the
plat boundaries.)
4. That appropriate street names be indicated
5. That appropriate utility easements be indzcated oa copies of the approved
preliminary plat for distributioa to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.
6. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, an the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certzfication wzll be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the fiaal plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and ia accordance with a time schedule. The time schedule
will provlde, in any case, for completion of the water system aad iaspectioa
by the appropriate health authorZties prior to application for building
permits within the plat. The contractual arrangements wzll include a
provision holding Spokane County and the purveyor harmless from claims by any
lot purchaser refused a building permit due to the faiiure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water spstem as approved by County and State Health authorities and the local
fire district and purveyor will be installed wlthin this plat, and the
subdivider will provlde for individual domestic water se rvice as well as fire
protection to each lot prior to sale of each 1ot
7 That a certificate of title be furnished the Planaing Department prior to the
filing of the final plat. ~

9. That a declaratioa of Non-Significance be issued, in accordance with
Section 11.15 340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11 15 340.
NOTE: The official file contains an ennironmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
10. That coaditional approval of the plat by the County Engineer is given subject
to dedication of right-of-way and approval of the road system as indicated in
the preliminary plat of record.
11. That plans, profiles, and cross-sections as designed to County standards
showing proposed street centerizne and curb grades be submitted to the Countq
Engineer for approval prior to construction and/or the filing of a final plat,
road plans to be prepared under the direction of a licensed Professioaal Civil
Engineer.
12. That drainage plans and design calculatioas showing the alignment of drainage
facilities be submitted to the County Engineer and Spokane Couaty Health
District for approval prior to construction and/or the filzng of the final
plat Drainage plans to be prepared under the direction of a Iicensed Pro-
fessional Civil Engineer.
13. Construction within the proposed publzc streets aad easements shall be
performed under the direct supervision of a liceased engineer/surveyor, who
shall furnish the County Engineer with "As Built" plans and a certificate in
writing that all improvements were installed to the lines and grades shown on
the approved construction plans and that all disturbed monuments have been
replaced.
14. No construction work is to be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
is subject to inspection and approval by the County Engzneer
15. All construction within the existing or proposed publ2c right-of-way is to be
completed prior to filing plat or a bond in the amount estimated by the County
Engineer to cover the cost of construction of improvements, constructioa
certification, "As Built" plans, and monumenting the street centerlines shall
be filed with the County Engineer.
16 No direct access from lots to stub road connections until such roads are
constructed to County standards and establzshed as County roads.
17 Road design, construction, aad drainage control for half right-of-ways and

hereinafter referred to as "THE DEVELOPER".
WHEREAS, TNE DEVELOPER has made application to THE COMPANY to extend
its water pipe lines to provide water service to a development or tract of
land in which TNE DEVELOPER has interest; and
WNEREAS, THE COMPANY desires [o make such extcntion under and subject
to its rules and regulations as filed with the WASFiINCTON TRANSPORTATION
AND UTILITY COMMISSION.
WiTNESSETH:
1. The DEVELOPER agrees to advance to THE COMPANY the sum of $ 9427. ,
the estimated cost of the extention and $ 2304. , the cost of service
la[erals as established within the current rules and regulation filed with
the WASNINGTON TRANSPORTATION & UTILITIES COMMISSION,upon execu[ion of
this agreement. Tt1E DEVCLOPt:R further agrecs [ha[ if rock Is encoun[ered
during excava[ion and rock removal by means o[her [han normal excavation
prac[ices are required THE DEVELOPER will be required to advance an
additional amount equal [o the additional cost of installing the water
mains [hrough the rock bound area.
2. The advance will not bear interest.
3. TNE COMPANY agrces to install the main cxtention as shown on attached
map within 90 days af[er the execu[ion of this agreement and the advance
has been made contingent upon availability af labor and materials.
4. The estimated costs of the main ex[ention and service laterals were
made April 30, , 1984 and will be null and void af[er 90 days unless
a written ext~.~nc ion is gran[ed by THE COMPANY.
5. It is unders[ood and agreed be[ween THE COMPANY and THE DEVELOPER that
beEore any wa[rr mains will be installed all new proposed streets shall
be cleared, subqracied, and clearly staked Eor location and grade.
6. Tl1E COMPANY agrees that in the even[ the developer does not own all of
the property frontiiig the proposed main extention any subsequent
customer applying for service from the main extention wfthin 5 years from
the date Lhe m.ain extention was installed will pay TiiE COMPANY for reim-
bursement to TIiE DEVELOPER inltially advancing the cos[ of the main
ex[enc.ion, that porcion of the cotal main extention cost as any sub-
sequent customcr"s frontage property to be servzd from the main extention

bears to the total frontage propcrty to be served by the main ex[ention
as determined by Tt1E COMYANY.
7. It is agreed between THE COMPANY and TIif DEVEI.OPEft that the title to,
and ownership of the mains, tittings and valves, and all other equipment
which are installed by either THE DEVELOPEK or THE COMYANY, whether in
private or public right-of-way, or in the land of TNE DEVELOPER or his
successors in title, shall be, and is vested, in THE COMPANY.
8. THE DEVELOPER hereby gives, grants, bargains, sells, aliens, releases,
eofeoffs, conveys and confirms to THE COMPANY an easement and right-of-
way over the streets served pursuant to the agreement until their
acceptance by the appropria[e governing body, for the purpose of
installing, maintaining, repairing, extending, replacing or removing
said mains, services and appurtenances.
9. TNE COMPANY retains and shall have the right to extend any main exten-
tion pu~uant to the terms of Chis agreement, continuously and/or
laterly, in private way, or in proper easements fn and to lands,
streets, avenues, or highways, and THE DEVELOPER shall not, by reason
thereof, be entitled to any refund for such extension(s).
10. THE DEVELOPER agrees to furnish THE COriPANY two site plans of the
area to be served, which plans must have been duly approved by the
required governing agencies.
11. It is further agrced that the DEVELOPCR shall be respons2ble to pay
for:
(a) Any damage to the mains, valves and fittings caused by any
means, including, but not limited to, heavy equipment such as
[rucks, graders, [ractors and/or cement mixers, during the
construction period of streets, curbs, storrn sewers and
buildings.
(b) The costs of the location of mains, valves and fittings due
to errors in street grades, and/or property lines during the
construction period of streets, curbs, storm sewers or
buildings, or other construction necessitating changes of
water main loca[ions.
12. Prior to installa[ion of the mains, the DEVF.LOPER shall cause all
street lines and grades to be established, and any relocation or
raising or lowering of the mains or their appurtenances due to a
change in line or grade, shall be at the sole cost of the DEVELOPER.
13. Prior to the installation of service laterals, pEVELOPER shall
stake the desired location of the service both for alignment and
grade, and any service lateral Iocation as may be requested shall
be done at the sole and additional cost of the Depositor.
14. T"he DEVELOPER does hereby agree to indemnify the Company for any
damages not directly caused by the Company to curb boxes, curb

boxes, hydrants and the mains, prior to thc acceptance of [he stree[s
by the municipality, if said streets have not alrrady been dedicated

15. This Agreement shall be binding and enure to the benefit of the respec-
tive heirs, executors, administrators, successors or assigns as the
case may be of the parties hereco, but this Agreement may not be
assigned by the DEVELOPLR without Lhe prior wriC[en consent of the
Company.

Recommendations are as circled.
(1) Pursuant to the Board of County Commissioners Resolution No. 80-0418, the
use of on-site sewer disposal systems is hereby authorized. This authoriza-
tion is conditioned on comp1iance with all rules and regulations of the
Spokane County Health District and is further conditioned and subject to
specific application approval and issuance of permits by the Health District.
The owner, his heirs or successors shall join and participate in any peti-
tion or resolution which purpose is the formation of a utility local im-
provement district (ULID) pursuant to RCW Chapter 36.94, as amended. The
owner, his heirs and successors shall further agree not to oppose or pro-
test any legal assessments for any utility local improvement district (ULID)
estabiished pursuant to RCW Chapter 36.94, as amended.
Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County.

(4) There are no recommendations concerning the method of sewage disposal as the ~
project is outside of the 201 sewer study area.
('5) Water service as approved by the Spokane County Health District and/or the
Washington State Department of Social and Health Services.
(6) Each dwelling unit shall be double plumbed for connection to future area-
wide collection systems.
(7) A dry sewer connection to the future North Spokane Sewerage System is to be
constructed. Plans and speci,fications for the dry sewer connection a,re to
be reviewed and approved by the Utilities Department prior to construction ,
(8) Located within the Critical Water Supply Service Area but not within any '
purveyor's district. May be serviced by an individual well owned and oper- ,
ated by lot owner.

PRELIPIINARY SUBDIVISION AND ZONE RECLASSIFICATI4N - EXTENSION OF TIPiE
I. GENERAL INFORMATION
A. History
The Hearing Examiner Committee approved the plat in January, 1980.
The sponsor requested Change of Coaditions heard on July, 1980,
which were approved as conditioaed by the Committee. The sponsor
requested an approval of a revised plat aad a one-year extension of
tune aad the Committee approved this with added conditioa
February 1981.
Now the spoasor indicates that the first phase is 98% complete and
is currently being reviewed bq department staffs. The delay has
been due to topography, geological conditioa and design problems
with drainage, sewage and road grade. These have been resolved and
the sponsor requests another one-year extension of time to
March 1, 1983.
B. Location
Kahuna Hills lst Addition is located oa the south wali of the Spokane
Valley adjacent to and east of Carnahaa Road between 12th aad 16th
Avenues.
C. Proposal
Project site is 16 acres subdivided into 39 lots for single familp
use. The redesLgn was necessary to change the road system due to
topography to satisfy the request of the Couatg Eagineer. No addi-
tional lots were created as a result of the redesign approval.

I. GENERAL INFORI`1ATION
A Location
Kahuna Hills lst Addition is located on the south wall of the Spokane Valley
adjacent and east of Carnahan Road between 12th and 16th Avenue.
B. HISTORY
The Hearzng Examiner Committee approved the preliminary plat on January 29th,
1980 The Sponsor is now requesting a change of the orginal conditions to
provide for individual on-site systems for Lot 1, Block 1, and Lot 1, Block 2
whereas the Orlglnal condition required public sewer for all lots within the
subdivision.
C. PROPOSAZ
The sponsor of the plat is requesting that condition #41 of the Hearing
Examiner Committee Findings and Order be changed to read as follows That a
statement shall be placed in the plat dedication that a Public sewer system
will be made available to the following lots, Block 1, Lots 2-18 Block 2,
Lots 2-20 and that Lot 1, Block 1, Lot 1, and Block 2, are hereby
authorized*the use of individual on-site systems
II HEALTH DISTRICT RECOrIlKENDATIONS
The Health Dzstrict has conducted on-site investigations of the lots in question on
May 9th 1980, and concludes that individual on-site drainfields may be utilized
The Health District has recommended three conditions be added to the Findings and
Order if the change of condition is granted.
TII. CONDITIONS
1. Those conditions as contained in the Findings and Order of the Hearing
Examiner Committee dated January 29th, 1980 for Kahuna Hills First Addition
2. Amend condition #41 to include the statement except
Indivldual on-site drainfield systems may be utilized on Lot 1, Block 1 and
Lot 1, Block 2 of sub,7ect development.
3 Lot 1, Block 1 and Lot 1, Block 2, shall be required to install side sewer
piping to the street curb and shall obligate coanection to the street sewer
collection system when an area-wide sewer becomes available
4 Unless the Spokane County Utilities Department should require that said lots
be connected to a"wet" sewer, the Health District shall not require "wet"
sewer at this time

We have encountered unexpected rock, underground springs, incomplete engineering
data. Drainage posed a major problem, necessitating extensive testing. Two
redesigns of the plat have already taken place because of the severe steepness
and the inability of ineeting engineers requirements for road grades and inter-
sections. Seemingly insurmountable problems are about to be overcome to hook up
with the City sewer. I have changed enr,ineers, which caused delays. Staff
cutbacks not only in County but subcontractors have caused material, labor and
time dela,ys. M,y excavating subcontractor has gone bankrupt, creating additional
problems. I have run out of space, but cauld go on.
