FINDINaS AND ORDER REGARDING PRELIP1INARY PLAT PROPOSAL AND ZONE RECLASSIFICATION,
PE-1350-79, University Park; ZE-235-79, Agricultural Suburban to Multiple Family
Suburban.
WHEREAS, The Sookane County Platting Hearing Examiner Committee did, after
public hearinq on November 29, 1979, take action by motion that the preliminary
plat be known as University Park, (File I4o. PE-1350-79) be denied without prejudice;
and,
WHEREAS, J. Grant Person, North 2206 Pines Road, Spokane, Washington did
request a special hearinq before the Board of County Commissioners to present
evidence and testimony against the motion of the Hearinq Examiner to deny without
prejudice the above described preliminary plat and zone reclassification; and,
WHEREAS, The Board of County Commissioners did hold a public hearinq on
February 4, 1980 t'o consider the Findinqs and Order of the Hearing Examiner
and testimony and request of the plat sponsor, objectors, and other interested
qarties; and,
IJHEREAS, At said hearing opportunity was afforded those favorinq and those
opposinq the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spoka.ne County, havinq fully considered the
testimony given, the Findings and Order of the Hearing Examiner, the environmental
checklist, and all other evidence presented, and further having personally acquainted
themselves with the site and vicinity in question, does hereby find that the con-
clusions of the Hearing Examiner were generally valid and sufficient.
NOW, THEREFORE, The Boar`d of County Commissioners does conclude that the
qreliminary plat to be known as University.Park and zone reclassification upgrading
to Multiple FaiTlily Suburban should be and hereby is denied and further recommend
that a zone reclassification to Two Family Residential would be appropriate for
the site.

This being the time set by the Board of County Commissioners of Spokane
County, Washington to render its decision concerning the request of
J. Grant Person, North 2206 Pines Road, Spokane, WA for the above
captioned preliminary subdivision and zone reclassification; and
The Spokane County Hearing Examiner Committee having heard the above
request on November 29, 1979, did deny without prejudice said application;
and
The Board having conducted its own public hearing on February 4, 1980,
at the request of the applicant, Pir. Person, and after visiting the site
and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to deny the appeal for Multiple Family Suburban zone and did
further determine to approve a zone reclassification to either R-2 or
Agricultural Suburban.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting for~h more
definitively the Board's action in this matter.

Hearing, February 4th, n Uniiversity Park Subdivision (PE-13 -?'9), xe xant
you, as their legal ad iser, to be arrare of our sserious erns relating to
this pro ject, _
Accoxding to Resolution #79-0338 (adopted by the Board March 12, 2979) the
origfnal plat application became a part of the official recorrd of the
Appellate Hearing. That f3rst application specifically stated txo bedroam
units would be built. Based upon that plat proposal, the Hearing Examiner
Camnittee denied the project and recammended the County Commissioners deny
also. The proponent's representative, Stu Deysenroth (at some point betxeen
the Plan Canmission and Board of County Cammissioners' hearings) changed
the pro ject substantially Wf th no notice to a.d,jacent property owners or
numerous petitioners of record.
We, and our attorney, properly prepared our appeals case based upon the
original plat application information. We then found ourselves in an un-
tenable position xhen the proponent, at the Appellate Hearing, made it clear
he had moved froQn Plan "A" to Plan "B", In order to negate this quantum leap,
Resolution #79-0338 and an Appearance of Fairness must corne into play, We
are entitled to due process and a"reasonable" length of time to revieM
projects that may seriously jeopardize our environment and gropertp values
and, in this case, we have been given neither.
Plan "A" xas for two bedroan, 800-1,000 square foot living units. Each unit
xould 'oe discharging 320 gpd of sexage into a 1500 gallon septic tank and
355 feet of drainfield, much of which would be pe.ved over and subject to
extensive vehicular traffic in violation of WAC 248-96. Minimum setbacks*
frontage and lot sizes could not be met rrithout questionable manipul,ation
cg varianees, walvers, casements., trsde-offs of right,€x-gf-MaY: shared drive-
ways and the vacating of 10 feet of already dedicated 'roadway.

Plan "B" (first publicized at the Appeal Hearing) was for one bedroom, 700
square foot living units discharging 220 gallons per day into a 500 gallon
septic tank and 266 feet of drainfield. In the space of several xeeks the
design formula had been changed fram 80 gal./person/day to 60 gal./person/
day. Public xater lines were moved, neo+ easements added andt in fact, the
entire plat xas totally revised.
It is appalling to us that xe taxpayers of Spokane County are literally
paying the salaries of the agency staff rrho have spent inordinate aaounts
of time t.rying to juggle boundaries and stretch regulations to develop and
justify a pro,ject so clearly in conflict with good planning an;d eacisting
development North of 32nd (a designated major arterial and natura.l buffer).

This is spot zoning at its worst and a density of over 13 units per aere,
which even requires awaste management plan, is indefensible in an area of
large lots and predominantly single family hamea. To use Ca.stle SubdSvision
(South of 32rtd) and its nex corner apartment canplex as a pcrecedent to
support additiorzal multi-family development is extremely dangerous in light
of the public record of that disaster area. Recent pzoblenss of rax sexsge
surfacing in adjacent property oxners • yarde and baseaenta necessitated
total replacement of the community drainfield (built to Health District
specifications) ard no}r the new apartment has been added to an alreadp
overloaded system. Such blunders are precedente We don't need to repeat.
We are also concerned xith the additional 10 feet of right-of-Kay, on 31st,
so crucial to this plat. It is tot,ally illogical arcd of questionable
legality to be holdirig subdivision hearings prior to the hearing to vacate
the designated right-of-xay. Until you knox if tha.t vacation is even feasible,
the a3equacy of fron+.,age far multi-family lots ie unknoxn and the hea.rings
xe have already attended xould appear to be poceroature.
A copy of this letter is being forwarded to the Plan Commission so they xill
be axare of recent developcnents, not only in the University Park plat, hut in
design starbdasrds for on-site sewage systems as well. We xill a18o mail a copy
to EPA to determine xhether HUD funds are to be expended in ary pbase of t,his
project and to request their assistance in determining the legality of deBign
criteria used for the rraste disposal system. This site is located cm the
fringe area of our Sole-Source Aquifer, in Sprirtgdale soils tated pQar to
marginral by the Depe►rtment of Ecologq for septic tanks.
This entixe experience has been a revelation to us as xe are nvx acutelY
arrare of conflicting regulations, prefer8ntial treatment and a Countq
gavernment that has been grossly negligent in Flanning f= its citizens
and to protect public health. Me intend to use every avenue of appeal
available to us to see that the mast stringent standards are adhered to
and that Building Permits are not issued until every condition of approval
is met.

6. That the land in this area is suitable for the proposed Multi-family zoning
classification.
7. The Hearing Examiner Committee finds the proposed Multi-family Zone
classification with density as proposed is detrimental to the general
purpose or otherwise harmfull to the public health, safety, and welfare.
8. That the owners of adjacent lands expressed disapproval of the proposed
Multi-family zone classification.
9. The following are additional findings of fact considered by the Hearing
Examiner Committee:
a) The density of the proposal is incompatible with surrounding area,
especially Single Family Residential, due to traffic and parking
problems generated by the proposal.
D. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds
that the application of J. Grant Person for a preliminary plat, University
Park and a Zone change as described in the application should be denied
without prejudice.

Gentlemen:
The preliminary plat map prepared bq Adams, Benthin & Clark, Inc., scale
1" m 20', and received by our office on September 27, 1979, identifies
the size and location of the proposed 4-plex and garage structure on
each of the 3 lots.
With allowing a 12-inch variance on the 25-foot side yard setbacks,
each lot would be capable of providing sufficient area for a maximum
of 300 lineal feet of drainfield including the required alternate
drainfield area. Preciae location of structures and other developments
on each lot will be required to maintain this capability.
At the time of buildi.ng permit application, the occupancq rating and
final desigh for each dwelling unit vill be determined op the basis of
3.6 gallons per lineal foot of drainfield irith a 35-inch tiride trench
and a 24% reduction for any drainfield beneath a hard surface or parking
and drivewaq area.

I. GENERAL INFORMATION
~
A. Location ;

The proposal is located just south and adjacent to 31st Avenue, north and
adjacent to 32nd Avenue, east and adjacent to University Road.
B. Proposal
- .87 acres subdivided into 3 lots for single family use
- Lot frontage = Varies from 90 feet to 145 feet
- Lot size = Varies from 12,330 sq. ft. to 13,000 sq. ft.
C. Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density designation.
D. Land Use Analysis:
1. Existing Land Uses
The proposed site is currently vacant. The site is flat with scattered Pon-
derosa Pines. The site is a portion of Block 53 of an old subdivision (Kokomo
Townsite, Lots 10, 11) 12, 13, 14, and 15). The site is essentially a vacant
lot surrounded by a variety of residential uses.
To the north of the proposal across 31st Avenue i-s a duplex and a si.ngle
family residence. East of the proposal are single family homes and duplexes.
South of the proposal is University Village which is now under construction
with apartments in 18 unit building complexes. To the west of the proposal is
predominately single family with some duplexes.
2. Compatibility with Existing Land Uses
The proposal appears to be consistent and compatible with surrounding
residential and multiple family uses.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has examined the proposed preliminary pl.at of record
and required conditions for the satisfactory developaient of the proposal.

B. Sewage Disposal ~
I
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means; including on-site septic tank disposal, treatment plant and
sewage lagoon. For economic reasons, and to provide the most realistic
alternative, the applicant's engineer feels on-site septic tanks should be
utilized. .
i
The Spokane County Health District has authorized the use of individual on-site sewage systems for each lot within the plat. The District states that ;
an on-site sewage management system should be created. The plat is situated
over the Spokane Valley Aquifer and the Health District in their examination '
of the possible impact on groundwater quality from this proposal have the
following commeats:
Tmpact Discussioa
a. The plat sponsor has proposed 3 four-plex lots on .89 acres. Each lot is
to be served by a public water system and its individual oa-site sewage
disposal system. This raises the question of significance of the impact
on the groundwater in the area aad possible alternatives for sewage
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background.
- - - The analytical results of the forecast impact of year
2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater quali.ty is
already a substantial proportion of the ultimate level.

c. Currently, results of chemical analysis show the total nitrogen content ~
of the groundwater as in the range of .82 to 3.43 ppm. A projected '
incremental increase using Dr. Todd's expected 8.6 percent would result :
in a range of .89 to 3.71 ppm. Current Federal and State drinking water
standards permit up to 10 ppm.

d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
1. Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps more to ~
obtain a permit for the discharge from the Department of Ecology. ~
These systems are not currently economically available for this
project. ~
2. Sealed systems, whether individual or community, depend on
evaporation for liquid removal. These systems require more land
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety hazards associ.ated with them and relatively
poor community acceptance. Land, installation and operational cost
are generally more expensive than those for septic tanks and
drainfields.
C. Drainage
The County Engineer reports that the preliminary storm drainage plan submitted
by the applicant indicates that on-site storm drainage provisions will
adequately handle surface water runoff. However, final construction plans
should be reviewed and approved by both the County Engineer and Health ,
District prior to the final plat filing.
D. Water Supply
The proposal is located within the recorded service area of Model Irrigation
District #18.
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrigation uses.
E. Fire Protection
The proposal is situated within the recorded service area of Fire District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient size for fire protection as a condition of
final plat approval. The District also requests that they be allowed to
review and approve final fire flows and water plans.
F. Schools
Proposal lies within the boundaries of Central Valley School District #356.

G. Parks
The report "Planning for Parks" (revised 1976) indicates that this ~
neighborhood would require a community park of 21 acres in the vlcinity of the ,
Bowdish Junior High School site.
H. Unique Environmental Features j
None have been indentified. ~
I. Cultural Resources
None have been indentified.
IIT. ZONING ANALYSIS
The proposal is currently zoned Agricultural Suburban, as is all the area east of ~
University Road and north of the site. This area was block-zoned Agricultural ~
Suburban within the Kokomo Townsite Subdivision. West of the site is zoaed ~
Agricultural. South of the proposal is zoned Multiple Family Suburban with R-2 ~
zoning adjacent to the Multiple Family Suburban zoning to the east. The proposal ~
as presented would most appropriately be zoned Multiple Family Suburban. This I
zoning would be consistent with the zoning to the south. The proposal will require that the lot adjacent to 31st Avenue acquire 10 feet into the existing right-of-way
to meet minimum zoning requirements. The sponsor is pursuing vacation of this
strip of land through the Engineer's Office and is a recommended condition of
approval. ~
IV. ENVIRONMENTAL REVIEW B
An Environmental Checklist was submitted by the sponsor and has been reviewed by ;
the Planning staff. No significant adverse environmental impacts were judged to
exist.
. ;
Slight adverse environmental impacts were identified on the checklist in the `
following categora.es: earth; air; water; flora; fauna; noise; light and glare;
land use; population; housing; transportation/circulation; public services;
utilities; and energy.
The Planning Director issued a proposed Declaration of Non-Significaace, and it was
circulated to other agencies of jurisdiction.
V. CONDITIONS:
If approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.
2. That a statement be placed in the dedication to the effect that no more than
one dwelling structure be placed on any one lot, nor shall any lot be further
subdivided for the purposes of creating additional lots or building sites
without filing a replat.
3. That appropriate provision be made that the following described property be
held in trust until the continuatioa of the streets be dedicated or deeded: A
1' strip at the ends or edges of all streets that terminate or border the plat
boundary. (Temporary cul de sacs are required when streets terminate at the
plat boundaries.)

5. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.
6. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the water system and inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purveyor harmless f rom claims by any
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
7. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
8. That the preliminary plat be given conditional approval to December 1, 1980.
9. That a declaration of Non-Significance be issued, in accordance with
Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving actioa in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
10. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat by the
County Engineer.
11. That plans, profiles, and cross sections showing proposed street centerline
and curb grades be submitted to the County Engineer for approval prior to

12. The drainage plans and design calculations showing the grades and alignment of ~
drainage facilities be submitted to the County Engineer for approval prior to '
construction and the filing of a final plat. '
13. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who shall o
be responsible for perpetuating all evidence of the location of survey ~
monuments which may be distrubed during construction and who shall furnish the
County Engineer with "As Built" plans and a certificate in writiag that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.
14. No construction work is to be performed with the Public Right of Way until a
permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer. ,

24. There will be no phasing of the project, and the plat will be finalized in its ~

25. That the project sponsor is responsible for requesting an extension of time to
review any preliminary plat approval. All extensions applied for may subject
the project sponsor to new conditions required by Reviewing Agencies.
26. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declaration
of Non-Significance. ~
27. That a public water system serviced by Model Irrigation District, and ,
including fire flows, serve each lot prior to the sale of the lot. ~
28. That final construction plans for on-site storm drainage facilities be ~
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
29. That the plat dedication contain the statement: "Use of private wells and ,
water systems is prohibited.
30. The plat dedication wil coatain a statement to the effect that: "The public
sewer system as approved in County and State health authorities and the local
fire district and purveyor will be installed within this plat, and the '
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot."
31. A scale-drawn plot plan showing the location of septic and drainfield lines,
including replacement lines, shall be submitted to the County Health District
prior to the signing of the final plat.
32. The dedicatory language of the plat will state that each lot is authorized the
use of an individual on-site sewage disposal system.
33. An on-site sewage management system shall be created and approved by the
Spokane County Health District prior to filing of the final plat. Dedicatory
language of the plat shall include the statement, "Each lot ownership shall be
a member of the on-site sewage management association."
34. That the proposal will require that the vacation of a 10 foot strip along 31st
Avenue be accomplished through the County Engineer Office prior to final plat
approval.
35. That the site plan be ia accordance with the preliminary site plan submitted
by the sponsor and be approved by the Zoning Administrator.
36. That a landscape plan and bond must be submitted before building permits are
issued. This plan shall be approved by the Zoning Administrator.
37. That lighting plan shall be submitted and approved by Zoning Administrator
prior to issuance of building permits indicating that lighting from any
exterior lighting fixture shall not extend over the property boundary.
38. That resideatial building materials be used to maintain the character of the
area. .
39. That the fourplex units be restricted to two stories.

A. INTRODUCTION
This matter having come before the Examiner Committee on November 29, 1979,
and the members of the Committee present being Kenneth Kennedy, Chair-
person, Abby Byrne and John Culler.
B. PROPOSAL
The sponsor, J. Grant Person, is requesting approval of a preliminary plat and
zone change, PE-1350-79, University Park and ZE-235-79, Agricultural Suburban
to Multiple Family Suburban for subdivision of .87 acres into 3 lots for multipie
family units and there being present, the following applicant or representative:

2. Topography, soils, and water:
a. This project lies in a relatively flat area between University Road
and Bowdish Road. Local drainage ways are insigni`icant. It is
located over the Spokane Valley Aquifer.
b. Surface soils are classed as Springdale gravelly sandy loam with 0 to
20% slopes. They have a septic tanic filter field limitation of slight
w~th possible contamination of groundwater.•
c. Geologically the soils are glaciof luvial deposits; stream-laid sand
and gravel; contains some boulders in places, includes some undifferent-
iated glacial deposits. The lower terrace remnants have probably been
reworked by streams. These geologic structures yield moderate to very
large amounts of water.
d. The data from 4 Vera, 2 Modern Water District and 4Model Irrigation
District #18 wells shows the wells are 99 to 183 feet deep and have
static water levels varying from 77 to 145 feet below the surface. The
highest total nitrogen level was 3.43 ppm. The Model Irrigation District

#18 has indicated that it can supply domestic use water for the plat
upon completion of agreements with the deve].oper.
3. Impact discussion:
a. 1'he plat sponsor has proposed 3 four-plex lots on .89 acres. Each lot is
to be served by a public water system and its individual on-site sewage
disposal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for sewage dis-
posal.
b. In the course of the conduct of the Army Corps study, Dr. Todd consid-
ered typical soils, natural and sewage disposal recharge to the ground-
water, and the effect of continued urban development in the Spokane
River Valley upon the quality of the groundwater. In summary, he con-
cluded that:
(1) In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All dissolved salts in secaage effluent caill be carried to
the groundwater. However, bacteria and detergents (phosphate
portion) are mostly removed by the deep soil layer above the
groundwater and "minor dissolved constituents such as phos-
phates, which are Icnown to react with soil particles, or ni-
trates, which are taken up by plant roots" will be less than
the total found in septic tank effluents.
(3) "The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum incremental con-
centration is 101 mg/1 above the natural background. The ana-
lytical results of the forecast impac"tof year 2020 when com-
pared with the present impact, both measured in terms of le-
achate volume and dissolved solids concentration, indicate that
the present impact on groundwater quality is already a suU-
stantial proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content of
the groundwater in the range of .82 to 3.43 ppm. A projected incremental
increase using Dr. Todd's expected 8.6 percent-would-result in ranges 0.89
ppm, to 3.71 ppm. Current Federal and State drinicing water standards per-
mit up to 10 ppm.
d. Alternative sewage disposal methods that would not recharge-the groundwater
have the following general characteristics:

(1) Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps
more to obtain a permit for the discharge from the Department
of Ecology. These systems are not currently economically
available for this project.
(2) Sealed systems, tahether individual or community, depend on
evaporation for liquid removal. Some, such as lagoons,
have safety hazards associated with them and relatively poor
community acceptance.
4. Recommend that :
a. The iinal plat shall be designed as indicated on the preliminary plat of
record and/or attached sheets as noted.
b. Appropriate utility easements shall be indicated on copies of the prelim-
inary plat of record for distribution by the Planning Department to the
utility companies, County Engineer, and Spokane County Aealth District.
Written approval of the easements by the utility company must be received
prior to the submittal of the final plat.
c. The dedicatory language of the plat will state that each lot is authorized
the use of an individual on-site sewage disposal system.
d. An on-site sewage management system shall be created and approved by the
Spokane County Health District prior to filing of the final plat. Dedic-
atory language of the plat shall include the statement "Each lot owner-
ship shall be a member of the on-site sewage management association."
e. A plan for water facilities adequate for domestic use, domestic irrigation
use and fire protection use shall be approved by the water supplier
(purveyor), and fire protection district will certify, prior to the filing
of the final plat, on the face of said water plan that the plan is in con-
formance with their requirements and will adequately satisfy their respective
needs. Said water.plan and certif ication will be drafted on a transparency
suitable for reproduction.
f. The purveyor will also certify prior to the filing of the final plat on a
copy of said water plan that appropriate contractual arrangements have been
made caith the plat sponsor for construction of the water system, in accord-
ance with the approved plan, and in accordance caith a time schedule. The
time schedule will provide, in any case, for completion of the water system
and inspection by the appropriate health authorities p,rior to application
f or building permits within the plat. The contractual arrangements will
include a provision holding Spokane County, Spokane County Health District,
and the purveyor harmless from claims by any lot purchaser refused a
building permit due to the failure of the plat sponsor to satisfactorily
complete the approved water system.

g. The plat dedication will contain a statement to the effect that: "The
public sewer system as approved by County and State health autliorities
and the local fire district and purveyor will be installeci within this
plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lot prior to sale of each lot."
h. A scale-drawn plot plan showing the location of septic and drainfield
lines, including replacement lines, shall be submitted to the County
Health District prior to the signing of the final plat.

additional 6.5 feet for University Avenue on the West side of the

South side of the plat, and draar the North boundary of the plat
10 feet into the existing riglit of iiay for 31st Avenue. Please
remember that the modification of the North boundary was necessitated
to meet minimum zoning requirements on a lot by lot hasis. Our
engineer will be checking with your office immediately as to the
proper procedure for vacating the above mentioned South 10 feet

Sewerage Alternatives
Following is a brief analysis of three alternative means of sewage disposal for
the project.
Sewage treatment plant with drainfield
This type ef sewage treatment has been determined to be unfeasible
for small developments such as this due to space requirements and
economic considerations.
Individual septic tanks with community drainfield system
This type of system would involve the installation of three septic tanks
(one for each building) with one community drainfield for the disposal of
sewage eff luent from the septi c tanks. Wh i le th is type of system has
proven to be satisfactory in many instances, it is more economically
advantagous when used on moderate to large developments and provides no
other advantages over individual drainfields for a project this small.

Individual septic tank - drainfield systems
This would consist of three individual septic tank drainfield systems -
one on each lot. These have been proven to be the simplest most
cost effective alternative for small projects such as this. Ultimate
construction of a comprehensive sewer system for the val ley wi II
some day check the one draw back of this and of the other sewage
disposal systems discussed, i.e. ground water pollution.
Recommendotions
Each of the systems discussed wovld have similar impact environmentally
speaking. Thus, we recommend individual septic tank - drainfield systems
for each of the three lots. This would be the most economically feasible
olternative. We also recommend the installation of double plumbing with
provisions made to hook the three buildings to future sewer (ines. It is

and thus the future connections should face one of those streets.
