On Monday, September 11, I submitted to you as Attorney for the
applicants the original application for zoning hearing together
with the area map and list of owners prepared by the title
company as well as a list of owners of property in the surrounding
area signed by more than 60 per cent of the property owners You
checked the list, approved the documents and issued a receipt for
the $123 00 f iling fee which I also delivered to you represented
by Mr Scott' s check in that amount
We also submitted two pictures of a portion of the affected area
wh ich portrays the land occupied by Mr Scott and operated as
Ace Auto Wrecking
All of the property in Block 4 is cleveloped and there are existing
buildings on most all of the land ancl no new or further construc-
tion is contemplated by either Mr Scott or the other three
businesses situate thereon, namely, The House of Aluminum (Broad-
way Development Co Washington Auto Carriage Co ('Warren Siria)
and B& B Truck Repair (Bernard L Flood)
Therefore, it is my understanding that the photographs of the
area to be rezoned under the four ownerships above stated will
serve in lieu of a plot plan or sketch

al zoning? Z'he undersictned Petitioner, James H Scott, gurchased Lots 4,
51 6, 19, 20 and 21 and the West 13 feet of Lot 3, all Block 4, TOWN OF YARDLEY,
about 1956, having been advised that the property had been zoned in the classi-
fication of manufacturing and since then has been engaged in the business of
selling used automobile parts, including the storage of automobile parts on
the premises, as well as wrecking automobiles Later, Petitioner became aware
of the fact that the property had a zone classification of Restricted
Industrial and therefore Petitioner obtained a Special Use Permit consistent
with the business to which the property was being used• However, to avoid
future legal questions relative to selling and storing automobile parts and
operatinq a wreckinQ yard on Petitioner's Property which requires
Manufacturing zone classification, Petitioner requests this zone change

2. VVhat facts justify the proposed zone reclassification based on the advance-
ment of the public health, safety, and general welfare ?
Al1 other propertv within a several block radius in all directions from
.the sub]ect property presently has a zone classification of manufacturing
except for five blocks in the immediate area and present useage in mose
of the immediate area can be best utilized for uses consistent with the
manufacturing classification
3. What effect will the proposed zone reclassificatfon have on the value and
character of adjacent property?
That nearly all of the ad3acent property is presently occupied by old
established businesses either in the industrial, wholesale or
manufacturing classifications, and the proposed zone reclassification
should have no effect on the value and character of adjacent property
4 Can a reasonable return from or reasonable use of the property in questlon be
secured under the existing zone classification?
As to Petitioner James H Scott's property, it is doubted that a
reasonable return can be expected if auto wrecking were not allowed
on the property under strict interpretation of the present classification
A plot plan or sketch must be attached containing the following information
(a) Scale of the drawing
(b) North point
(c) I11 dimensions of property, existing buildings, and proposed bufldings
(d) Location of all existing and proposed buildings, or additions, with
dimensions to the nearest property line.
(e) Off-street parking area
(f ) Defined points of acce s s and egre s s
(g) Date of the drawing.
