Environmental Impact: A topic of discussion at this Hearing may be whether the Hearing Examiner Committee has adequate information to assess the adverse Environmental Impacts of the proposal. V. Seipp, South 717 Pines Road, Spokane, WA, did request a.special hearing before the Board of County Commissioners to present evidence and testimony against the motion of the Hearing Examiner to deny the above- described preliminary plat; and, WHEREAS, The Board of County Comrnissioners did hold a public hearing on February 11, 1980, to consider the Findings and Order of the Hearing Examiner and testimony and request of the plat sponsor, objectors, and other interested parties; and, . U. Seipp ) This being the time set by the Board of County Commissioners of Spokane County, Washington to render its decision concerning the request of F. V. Seipp, South 717 Pines Road, Spokane, I-JA for the above captioned preliminary subdivision Replat; and The Spokane County Ilearing Examiner Committee having heard the above request on November 29, 1979, did deny said application; and The Board having conducted its own public hearing on February 11, 1980, at the request of the sponsor, Mr. Seipp, and after visiting the site and reviewing the testimony; and The Board being fully advised in the premises did determine, based upon the testimony submitted at the public hearing and other evidence available to the Board to uphold the denial of the Nearing Examiner Committee and deny the appeal of Mr. Seipp. The Board instructed the Planning Staff to prepare Findings and Order, for execution by the Board at a subsequent meeting, setting forth more definitively the Board's action in this matter. GENERAZ IiNFORMATION A. Location The proposal is situated north of Mansfield Court and east of Bessie Road extended and south of the Burlington Northern Rail right-of-way. B. History The proposal is Lot 1 of the plat known as Sylvia Court Addition. Sylvia Court Addition was heard by the Planning Commission on October 14, 1977. The Planning Commission did forward the matter to the Board of County Commissioners with no recommendation. The Board of County Comrnissioners did approve the preliminary plat with the conditions as contained in the Planning Staff's Findings dated October 14, 1977 except that the number of lots be reduced from 8 to 6 lots so as to reduce the density and mitigate any possible environmental hazards. The sponsor accomplished this reduction in number of lots in Sylvia Court Addition by leaving all lots their original size except for Lot 1 which was made into an acre lot. The sponsor is now requesting a replat of Lot 1 of Sylvia Court Addition into three lots for duplexes. C. Proposal - 1.06 acres subdivided into 3 lots for duplexes - Lot frontage = Varies from 32.29 feet to 90 feet - Lot size = 14,400 sq. ft. to 16,700 sq. ft. D. Relationship to the Comprehensive Plan The approved map of the Comprehensive Plan indicates residential usage of this area, as well as all nearby surrounding lands, with no density designation. E. Land Use Analysis: 1. Existing Land Uses The proposal is currently vacant. Uses to the south of the proposal are predominately duplexes with single family uses found to the east of the proposal. To the west is vacant and single family uses. Compatibility with Existing Land Uses The proposed land use appears to be compatible with existing uses and lots in the vicinity. But the proposal is inconsistent with past decisions of the County Commissioners. II. SPECIAL INFORMATION A. Circulation The County Road Engineer has examined the proposed preliminary plat of record and recommended conditions for satisfactory development of the project. B. Sewage Disposal The applicant's engineer has prepared an analysis of alternative sewage dis- posal means; including on-site septic tank disposal, treatment plant and sewage lagoon. For economic reasons, and to provide the most realistic alternative, the applicant's engineer feels on-site septic tanks should be utilized. The Spokane County Health District has authorized the use of individual on-site sewage systems for each lot within the plat. The plat is situated over the Spokane Valley Aquifer and the Health District in their examination of the possible impact on groundwater quality f rom this proposal have the following comments: Impact Discussion a. The plat sponsor has proposed 3 lots on 1.07 acres. Each lot is to be served by a public water system and its individual on-site sewage disposal system. This raises the question of sigaificance of the impact on the groundwater in the area and possible alternatives for sewage i disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley ' upon the quality of the groundwater. In summary, he concluded that: 1. In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. ~ E 2. All the dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate portion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phosphates, which are known to react with soil particles, or nitrates, which are taken up by the plant roots," will be less than the total found in septic tank effluents. -4C- STAFF ANALYSIS - Novemb%_,.. 29 , 1979 SI A COURT REPLAT #1 - continued 3. The calculated results at the downstream end of groundwater flow line indicate that the maximum range of (dissolved) solids concentration expected at present (1975) is up to 93 mg/1 { (milligrams per liter) above the natural groundwater background ; of 155 mg/1. The forecast year 2020 maximwn incremental concentratioa is 101 mg/1 above the natural background. - - - The analytical results of the forecast impact of year ~ 2020 when compared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality is already a substantial proportioa of the ultimate level. c. Currently, results of chemical analysis show the total nitrogen content r of the groundwater as in the range of 1.3 to 1.5 ppm. A projected ~ incremental increase using Dr. Todd's expected 8.6 percent would result ~ in a range of 1.41 to 1.63 ppm. Current Federal and State drinking water standards permit up to 10 ppm. ! ~ d. Alternative sewage disposal methods that would not recharge the ground- water have the following general characteristics: ~p . P 1. Collector and central treatment systems discharging to surface y waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. , These systems are not currently ecoaomically available for this project. f e r 2. Sealed systems, whether individual or community, depend oa evaporation for liquid removal. These systems require more land ^ area than a conventional subsurface drainfield. Some, such as lagoons, have safety hazards associated with them and relatively poor community acceptance. Land, installatioa and operational cost are generally more expensive thaa those for septic tanks and drainfields. C. Drainape The County Engineer reports that the preliminary storm drainage plan submitted by the applicant indicates that on-site storm drainage provisions will adequately handle surface water runoff. However, final construction plans ~ should be reviewed aad approved by both the County Engineer and Health District prior to the final plat filing. D. 6Jater Supply The proposal is located within the recorded service area of the Washington Water Power Company. The Company advises the staff that adequate system capacity, and a desire on their part to serve, exists for the provision of water for domestic, fire and irrigation uses. -4D- ; . The Fire District staff requests that the Hearing Examiner Committee require mains and hydraats of sufficient size for fire protection as a condition of final plat approval. The District also requests that they be allowed to review and approve final fire flows and water plans. 6 F. Schools , Proposal lies within the boundaries of West Valley School District #363. ~ G. Parks The report "Planning for Parks" (revised 1976) indicates the aeed for a 6 acre neighborhood park in the center of the neighborhood possibly in the area south of Indiana, north of Nora, and west of Vista. H. Unique Environmental Features None have been indentified. 1. Cultural Resources None have been indentified. III. ZONING ANALYSIS The proposal does not require a zone change. However the creation of Lot 1 would not meet minimum requirements of the Spokane County Zoning Ordinance, as the build setback (25 feet from right-of-way of the road) would not provide the necessary frontage of 90 feet. IV. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and has been reviewed by the Planning staff. No significant adverse environmental impacts were judged to exist. The data from Orchard Avenue #fl and Wti4`P 1-4 Water District wells have a total nitrogen level of 1.5 ppm. The WWP Company has indicated that it can supply domestic use water for the plat upon completion of agreements with the developer. 3. Impact discussion : a. The plat sponsor has proposed 3 lots on 1.07 acres. Each lot is to be served by a public water system and its individual on-site sewage dis- posal system. This raises the question of significance of the impact on the groundwater in the area and possible alternative for sewage disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he concluded that: (1) In normal precipitation years, subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. (2) Al1 dissolved salts i.n sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate por- tion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phos- phates, which are known to react with solid particles, or nitrates, which are taken up by plant roots" will be less than the tota.l found in septic tank effluents. (3) "The calculated results at the downstxeam end of groundwater flow line indicate that the anaximum range of (dissolved) sol- ids concentration expected at present (1975) is up to 93 mg/1 (milligrams per liter) above the natural groundwater back- ground of 155 mg/1. The forecast year 2020 ma.ximum increra►ental concentration is 101 mg/1 above the natural background."---"The analytical results of the foreca,st impact of year 2020 when com- pared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality is alrea.dy a substantial proportion of the ultimate level." c. Currently, results of chemical analysis show the total nitrogen content of the groundwater as in the range of 1.3 to 1.5 ppm. A projected incre- mental increase using Dr. Todd's expected 8.6 percent would result in ranges 1.41 ppm. to 1.63 ppm. Alternative sewage disposal methods that would not recharge the ground- water have the following general characteristics: (1) Collector and central treatment systems dischareing to surface waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. These systems are not currently economically available for this project. (2) Sealed systems, whether individual or comnunity, depend on evaporation for liquid removal. Some, such as la- goons, have safety hazards associated with them and relatively goor community acceptance. . 4. Recommend that: a. The final plat shall be designed as indicated on the preliminary plat of record and/or attached sheets as noted. b. The dedicatory language of the plat will state that each lot is authorized the use of an individual on-site sewage disposal system. c. Prior to filing of the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." d. A plan for water facilities adequate for domestic use, domestic irrigation use and fire protection use shall be approved by the water supplier. Septic Tanks - This method is the most commonly accepted practice in the Spokane Valley. The recent 1208' Study has indicated that recharge of the aquifer is occuring and septic tank effluent is reaching the ground water. According to the study, this recharge is having adverse impacts'upon the aquifer water quality. 2. Treatment Plant - To effectively reduce the aanount of pollutants that would enter the aquifer, a treatment plant would need to remove nitrates, phosphates and other contaminants that septic tanks do not remove. This advanced wastewater treatment is not economically feasible for a sma11 plant such as this plat would require. 3. Lagoon - This plat doesn't have the additional land required for a lagoon. Also, the odor which may occur would be objectionable to this plat and the surrounding properties. S ince the County doesn't have a comprehensive sewer plan for this area, the advanced wastewater treatment option is not feasible at this time. Until such time as advanced wastewater treatment is offered on a large scale to this portion of the Spokane Valley, the most feasible method of sewage disposal will be with individual septic tanks and drainfields with a management system if required by your office. .~S E.
