WHEREAS, The Spokane County Platting Hearing Examiner Committee did,

after public hearing on November 29, 1979, take action by motion that the pre-
liminary plat to be known as Sylvia Court Replat #1,(File No. PE-1348-79) be
denied; and,
• WHEREAS, F. V. Seipp, South 717 Pines Road, Spokane, WA, did request
a.special hearing before the Board of County Commissioners to present evidence
and testimony against the motion of the Hearing Examiner to deny the above-
described preliminary plat; and,
WHEREAS, The Board of County Comrnissioners did hold a public hearing
on February 11, 1980, to consider the Findings and Order of the Hearing Examiner
and testimony and request of the plat sponsor, objectors, and other interested
parties; and, .

WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the ab a e-described preliminary plat proposal, the Board of County
Commissioners of Spokane County, having fully considered the testimony given, the
- Findings and Order of the Hearing Examiner, the environmental checklist, and all
- other evidence presented, and further having personally acquainted themselves with
the site and vicinity in question, does hereby find that the conclusions of the
.Hearing Examiner were generally valid and sufficient.
NOW, THEREFORE, The Board of County Commissioners does conclude that
the preliminary plat to be known as Sylvia Court Replat #1 should be and hereby
is denied.

REPLAT #1 - SPONSOR: F. U. Seipp )
This being the time set by the Board of County Commissioners of Spokane
County, Washington to render its decision concerning the request of
F. V. Seipp, South 717 Pines Road, Spokane, I-JA for the above captioned
preliminary subdivision Replat; and
The Spokane County Ilearing Examiner Committee having heard the above
request on November 29, 1979, did deny said application; and
The Board having conducted its own public hearing on February 11, 1980,
at the request of the sponsor, Mr. Seipp, and after visiting the site
and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the denial of the Nearing Examiner Committee and
deny the appeal of Mr. Seipp.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

A. I NTRODUCT ION
This matter having come before the Examiner Committee on November 29, 1979,
and the members of the Committee present being Kenneth Kennedy, Chair-
person, Abby Byrne and John Culler.
B. PROPOSAL
The sponsor, F. V. Seipp, is requesting approval of a preliminary plat,
PE-1348-79, Sylvia Court Replat #1 for subdivision of 1.06 acres into 3 lots for
duplex and there being present, the following applicant or representative:

C. FINDINGS OF FACT
1. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.

have been fulfilled.
3. That the owners of adjacent lands expressed disapproval of the proposed

a) Finds that sponsor has not supplied facts warranting change of
density.
b) Finds that policy on frontage requirements for cul'de'sac lots are not
met by Lot #1 of the proposal and that the pol icy i. e., frontage on
cul'de'sac determined by paraflel line 25 feet1back from front lot line,
can not be changed by Hearing Examiner decision.
c) Finds that the proposal is contrary to the intent of the Board of
County Commissioners decision concerning Sylvia Court Addition.
D. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds

Enclosed are the forms necessary for the Subdivider of the above referenced
subdivision to complete the pubiic information requirements for subdividing
in Spokane County.
STEP 1: Take the titte company list of owners' form and the memo request
form ( EXH I B I T H) to any local title company you may select for a title
search of property owners and taxpayers within four hundred (400) feet of
the periphery of the proposed parcel. In those instances where any portion
of the abutting property is owned, controlled or under option by the Sub-
divider or his representative, then all property owners within 400 feet of the
applicant's total ownership shall be shown on the maps. The title company
search shall not be dated anymore than forty-five (45) days before the
Hearing.
STEP 2: Utiliiing the addresses obtained in STEP 1 and copies of the
Agenda Notification (enclosed), the Subdivider shall notify all property
owners abutting the subject site by certified mail at least ten (10) days
prior to the Hearing. The Subdivider shall notify all property owners not
abutting the subject site, yet within a 400 foot radius of the periphery of
the subject site by mail at least ten (10) days prior to the Hearing.
Property owners are those shown on the most current Treasurer's computer
records obtained by the applicant from a title company no more than forty-
five (45) days prior to the Hearing. NOTICE OF HEARING (Agenda
Notification) shall be mailed to the property owner. Whenever the names
and/or address of the owner is not available, the taxpayer shall be notified.
STEP 3: The Subdivider shall provide the Affidavit of Mailing, certified mail
cards and all returned mailings to the Planning Staff p►-ior to the public
hearing for inclusion to the file.
STEP 4: The Subdivider will provide a sign on site as herein described at
least ten (10) days prior to the Hearing.

PRELIMINARY SUBDIVISION
I. GENERAZ IiNFORMATION
A. Location
The proposal is situated north of Mansfield Court and east of Bessie Road
extended and south of the Burlington Northern Rail right-of-way.
B. History
The proposal is Lot 1 of the plat known as Sylvia Court Addition. Sylvia
Court Addition was heard by the Planning Commission on October 14, 1977. The
Planning Commission did forward the matter to the Board of County
Commissioners with no recommendation. The Board of County Comrnissioners did
approve the preliminary plat with the conditions as contained in the Planning
Staff's Findings dated October 14, 1977 except that the number of lots be
reduced from 8 to 6 lots so as to reduce the density and mitigate any possible
environmental hazards.
The sponsor accomplished this reduction in number of lots in Sylvia Court
Addition by leaving all lots their original size except for Lot 1 which was
made into an acre lot.
The sponsor is now requesting a replat of Lot 1 of Sylvia Court Addition into
three lots for duplexes.
C. Proposal
- 1.06 acres subdivided into 3 lots for duplexes
- Lot frontage = Varies from 32.29 feet to 90 feet
- Lot size = 14,400 sq. ft. to 16,700 sq. ft.
D. Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density designation.
E. Land Use Analysis:
1. Existing Land Uses
The proposal is currently vacant. Uses to the south of the proposal are
predominately duplexes with single family uses found to the east of the
proposal. To the west is vacant and single family uses. North of the
proposal is the Burlington Northern Railroad right-of-way and Trent Avenue.

2. Compatibility with Existing Land Uses
The proposed land use appears to be compatible with existing uses and lots in
the vicinity. But the proposal is inconsistent with past decisions of the
County Commissioners.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has examined the proposed preliminary plat of record
and recommended conditions for satisfactory development of the project.
B. Sewage Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means; including on-site septic tank disposal, treatment plant and
sewage lagoon. For economic reasons, and to provide the most realistic
alternative, the applicant's engineer feels on-site septic tanks should be
utilized.
The Spokane County Health District has authorized the use of individual
on-site sewage systems for each lot within the plat. The plat is situated
over the Spokane Valley Aquifer and the Health District in their examination
of the possible impact on groundwater quality f rom this proposal have the
following comments:
Impact Discussion
a. The plat sponsor has proposed 3 lots on 1.07 acres. Each lot is to be
served by a public water system and its individual on-site sewage
disposal system. This raises the question of sigaificance of the impact
on the groundwater in the area and possible alternatives for sewage i
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley '
upon the quality of the groundwater. In summary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. ~

2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.

3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1 {
(milligrams per liter) above the natural groundwater background ;
of 155 mg/1. The forecast year 2020 maximwn incremental
concentratioa is 101 mg/1 above the natural background.
- - - The analytical results of the forecast impact of year ~
2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater quality is
already a substantial proportioa of the ultimate level.
c. Currently, results of chemical analysis show the total nitrogen content r
of the groundwater as in the range of 1.3 to 1.5 ppm. A projected ~
incremental increase using Dr. Todd's expected 8.6 percent would result ~
in a range of 1.41 to 1.63 ppm. Current Federal and State drinking water
standards permit up to 10 ppm. !

d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics: ~p

1. Collector and central treatment systems discharging to surface y
waters would require at least tertiary treatment and perhaps more to
obtain a permit for the discharge from the Department of Ecology. ,
These systems are not currently ecoaomically available for this
project. f

2. Sealed systems, whether individual or community, depend oa evaporation for liquid removal. These systems require more land ^
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety hazards associated with them and relatively
poor community acceptance. Land, installatioa and operational cost
are generally more expensive thaa those for septic tanks and
drainfields.
C. Drainape
The County Engineer reports that the preliminary storm drainage plan submitted
by the applicant indicates that on-site storm drainage provisions will
adequately handle surface water runoff. However, final construction plans
~
should be reviewed aad approved by both the County Engineer and Health
District prior to the final plat filing.
D. 6Jater Supply
The proposal is located within the recorded service area of the Washington
Water Power Company.
The Company advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrigation uses.

E. Fire Protection

The proposal is situated within the recorded service area of Fire District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydraats of sufficient size for fire protection as a condition of
final plat approval. The District also requests that they be allowed to
review and approve final fire flows and water plans. 6
F. Schools

Proposal lies within the boundaries of West Valley School District #363. ~
G. Parks
The report "Planning for Parks" (revised 1976) indicates the aeed for a 6 acre
neighborhood park in the center of the neighborhood possibly in the area south
of Indiana, north of Nora, and west of Vista.
H. Unique Environmental Features
None have been indentified.
1. Cultural Resources
None have been indentified.
III. ZONING ANALYSIS The proposal does not require a zone change. However the creation of Lot 1 would
not meet minimum requirements of the Spokane County Zoning Ordinance, as the build
setback (25 feet from right-of-way of the road) would not provide the necessary
frontage of 90 feet.
IV. ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and has been reviewed by
the Planning staff. No significant adverse environmental impacts were judged to
exist.
Slight adverse environmental impacts were identified on the checklist in the
following categories: earth; air; water; flora; fauna; noise; light and glare;
land use; population; housing; transportation/circulation; public services;
utilities; and energy.
The Planning Director issued a proposed Declaration of Non-Significance, and it was

V. CONDITIONS:
If approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.

2. That a statement be placed in the dedication to the effect that no more than
one dwelling structure be placed on any one lot, nor shali any lot be further ~
subdivided for the purposes of creating additional lots or building sites
without filing a replat.
3. That appropriate provision be made that the following described property be
held in trust until the continuation of the streets he dedicated or deeded: A
1' strip at the ends or edges of all streets that terminate or border the plat
boundary. (Temporary cul de sacs are required when streets terminate at the
plat boundaries.) f

5. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.
6. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is ia conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time schedule
will provide, in aay case, for completion of the water system and inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provisioa holding Spokane County and the purveyor harmless from claims by aay
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
7. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
8. That the preliminary plat be gzven conditional approval to December 1, 1980.
9. That a declaration of Non-Significance be issued, in accordance with
Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11.15.340.

proposal and a staff review of their checklist as required by
WAC 197-10-320.

10. The drainage plans and design calculations showing the grades and alignment of ~

Special Conditions `

the project applicant within thirty (30) days of formal action by the Hearing
Examiner Committee, with regard to the preliminary plat approval; as
instructed by the Planning Departroent staff.
20. That the project sponsor is responsible for requesting an extension of time to
review any preliminary plat approval. All extensions applied for may subject
the project sponsor to new conditions required by Reviewing Agencies.
21. That the Hearing Examiner Committee sustain the issuance of a proposed '
Declaration of Non-Significance and recommends issuance of a final Declaration
of Non-Significance.

22. There will be ao phasing of the project, and the plat will be finalized in its
entirety.
23. That a public water system serviced by Washington Water Power Company, and
including fire flows, serve each lot prior to the sale of the lot.
24. That final coastruction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.

2. Topography, Soils, and Water:
a. This project lies in a rela.tively flat area 200' south of N.P. RR
right-of-way at the northWest corner of Bessie Road and bia.nsfield
Court. Local drainage ways are insignificant. It is located over
the Spokane Valley Aquifer.
b. Surface soils are classed as Garrison gravelly loa.m with 0 to 5% slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.
c. Geologically, the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferntiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic structures yield moderate to very large
amounts of water.

d. The data from Orchard Avenue #fl and Wti4`P 1-4 Water District wells
have a total nitrogen level of 1.5 ppm. The WWP Company has indicated
that it can supply domestic use water for the plat upon completion
of agreements with the developer.
3. Impact discussion :
a. The plat sponsor has proposed 3 lots on 1.07 acres. Each lot is to be
served by a public water system and its individual on-site sewage dis-
posal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternative for sewage
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
(1) In normal precipitation years, subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) Al1 dissolved salts i.n sewage effluent will be carried to the
groundwater. However, bacteria and detergents (phosphate por-
tion) are mostly removed by the deep soil layer above the
groundwater and "minor dissolved constituents such as phos-
phates, which are known to react with solid particles, or
nitrates, which are taken up by plant roots" will be less
than the tota.l found in septic tank effluents.
(3) "The calculated results at the downstxeam end of groundwater
flow line indicate that the anaximum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 ma.ximum increra►ental
concentration is 101 mg/1 above the natural background."---"The
analytical results of the foreca,st impact of year 2020 when com-
pared with the present impact, both measured in terms of leachate
volume and dissolved solids concentration, indicate that the
present impact on groundwater quality is alrea.dy a substantial
proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 1.3 to 1.5 ppm. A projected incre-
mental increase using Dr. Todd's expected 8.6 percent would result in
ranges 1.41 ppm. to 1.63 ppm. Current Federal and State drinking
water standards permit up to 10 ppm.

d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
(1) Collector and central treatment systems dischareing to
surface waters would require at least tertiary treatment
and perhaps more to obtain a permit for the discharge
from the Department of Ecology. These systems are not
currently economically available for this project.
(2) Sealed systems, whether individual or comnunity, depend
on evaporation for liquid removal. Some, such as la-
goons, have safety hazards associated with them and
relatively goor community acceptance.
.
4. Recommend that:
a. The final plat shall be designed as indicated on the preliminary plat of
record and/or attached sheets as noted.
b. The dedicatory language of the plat will state that each lot is authorized
the use of an individual on-site sewage disposal system.
c. Prior to filing of the final plat, the sponsor shall present evidence
that the plat lies within the recorded service area of the water system
proposed to serve the plat. The dedicatory language on the plat shall
state: "Use of private wells and water systems is prohibited."
d. A plan for water facilities adequate for domestic use, domestic irrigation
use and fire protection use shall be approved by the water supplier. Said
plan must have been approved by the fire protection district and the
appropriate health authorities. The health authorities, water supplier
(purveyor), and fire protection district will certify, prior to the filing
of the final plat, on the face of said water plan that the plan is in con-
formance with their requirements and will adequatelysatisfy their respective
needs. Said water plan and certification will be drafted on a transparency
suitable for reproduction.
e. The purveyor will also certify prior to the filing of the final plat on a
copy of said water plan that appropriate contractual arrangements have been
made with the plat sponsor for construction o#' the water system, in accordance

3 ALTERNATIVES FOR SEWAGE TREATMENT

1. Septic Tanks - This method is the most commonly accepted practice in
the Spokane Valley. The recent 1208' Study has indicated that
recharge of the aquifer is occuring and septic tank effluent is
reaching the ground water. According to the study, this recharge is
having adverse impacts'upon the aquifer water quality.
2. Treatment Plant - To effectively reduce the aanount of pollutants that
would enter the aquifer, a treatment plant would need to remove
nitrates, phosphates and other contaminants that septic tanks do not
remove. This advanced wastewater treatment is not economically
feasible for a sma11 plant such as this plat would require.
3. Lagoon - This plat doesn't have the additional land required for a
lagoon. Also, the odor which may occur would be objectionable to
this plat and the surrounding properties.
S ince the County doesn't have a comprehensive sewer plan for this area, the
advanced wastewater treatment option is not feasible at this time. Until
such time as advanced wastewater treatment is offered on a large scale to
this portion of the Spokane Valley, the most feasible method of sewage
disposal will be with individual septic tanks and drainfields with a
management system if required by your office.
