I am in possession of your August 29, 1979, letter to Mr Vince Seipp
I'd like to respond to your three items of concern in order
1 The Southerly portion of the site was approved for office
use under the RO zone, which also allows multifamily develop-
ments We thought got all the necessary agencies of government
approvals when we got our building permits, prior to when we
did any work on the site We are in possession of properly
approved plans from the County and the project was built in
accordance with those plans
2 We have landscaped the property in accordance with the plans
we submitted at the time we received our building permit The
landscaping is not in conformance with the office development
landscape plan submitted in 1972 at the time the property was
originally zoned Since then, the Southerly 40 feet of the
property (that was zoned residential office) was sold to Jim
Kuehnle, the owner of the office building on the corner of
Sprague and Skipworth He needs the extra land to meet his
parking and County requirements The land not sold to Kuehnle
has fully been landscaped and developed All parking areas
are paved and all landscaped areas are professionally done and
automatic sprinkler systems have been installed, and are
operating
3 I was under the distinct impression our builder had met all
the engineer's off site improvement requirements I enclose a
photocopy of a letter from the County Engineers which led me
to that impression
Please understand we do want to do all that is expected of us to satisfy
the various agencies of government Please understand also that there
are enough agencies to satisfy that it is difficult to keep track of who
is happy and who is yet demanding more money be spent and more work be
done

Subject Status of Landscapina and Off-site improvements.
In rnid-August, the Zoning section staff received a phone call requesting reiease
of the landscape bond for file, ZE-62-72. As part of the research of the file
prior to release of the landscape bond, the staff found that the site plan
approval was not consistent with the development as constructeci.
File ZE-62-72 was finalized by Board of County Commissioners' actiori iri
February of 1977. The zone change involved was from Agricultural Suburban tc,
Multiple Family and Residential Office. The Multiple Family Suburban portion of
the site was the northerly portion of the site. As per field investigation, thi(,
portion of the site was developed as per the site plan.
As per the Board of County Commissioners' resolution, the southern portion of the site was approved for residential office building. The approved site plan
indicates office use on this portion of the site. Our field investigation
indicated this portion of the site was developed as multiple family units.
Information in the file indicated that a change of conditions from the office
use to the multiple family use had not been processed.
Zoning Investigator, Ted McCoury, visited the site on August 22, 1979, as per-
the Memo in the file. He indicated that the Residential Office portion of thc
site was developed with 14 apartment units. In addition, Condition No. 1 of
the Board of County Commissio'ners' Resolution requiring curb, sidewalks, storri
drain, paving to existing pavement had not been complied with; and Condition
No. 3, the landscaping had not been planted.
Pursuant to the Zoning Investigator's field review, I contacted Jack Finney of
the Engineer's Office. He indicated that in fact the off-site improvements
had not been met as far as the County Engineer's Office was concerned. After
receiving the information from the Zoning Investigator and the County Engineer's
Office, a letter was prepared to the project applicant indicating problems that
we were aware of. This letter is dated August 29th directed to Mr. Vince Seipp
in the file. Response was received that Mr. Seipp no longer was associated with
the property, that all comments should be directed to Mr. Fritz Wolff.
On September 12th, we received a response to our letter from Mr. Fritz Wolff,
addressing each of the three of our concerns. Mr. Wolff introduced new
information; the staff did further research.
Building permits were signed off by the Planning Department's staff for
multiple family development on the RO portion of the site, even though change
of conditions had not been processed. Staff is unable to locate any landscaping
bond; therefore, the project has not been bonded to the best of our knowledge,
Mr. Wolff was able to produce a letter from the County Engineer'SOffice, indicating
that their bonds for off-site improvements had been released due to compliance
with the requirements.

It has recently come to my attention that property generally located on the east side
of Skipworth Road, nocth of SpraQu• Avenue, was not developed in conformance with
the approved site plan. (Reference, Board of County Commissioners' Resolution
No. 77-179 . )
Specifically, the followinq con#'licts have been identifieda
1) The southerly port#on of the site was approved for office use. The site is
presently used for residential purposes,
2) Landscaping as identified on the approved p1oC plan has not been accamplished.
3} County Engineer's :'ffice requirecnents for off-site improvements have not been

Planning Commission Recommendation: Deny. ~C
A. Reasons: 1. The Planning Commission is of the opinion that the proposed
apartment project would encroach into and disrupt the established
character of the surrounding residential neighborhood.
The Commission ccn.tends that multiple family projects should not
be approved if they do not provide an orderly transition between
busine s s propertie s and re side ntial neighborhood s.
2. The Planning Commission could not evaluaie the compatibility of
the Re sidential Office reque st with the re sidential neighborhood
because of the lack of a development plan.
3. The Commission notes that the neighborhood street pattern in the
Main and Skipworth area is not conducive to multiple family or
office development. The streets are narrow and provide very
, little circulation.
