It is the Piannrng Department's position that a self-storage or mini-warehouse is indeed a permitted use within the Commercial Zone In support o# this position is an interpretation rendered by the Spokane County Zoning Adjustor on October 20. 1980, and identified as Fite No I-9-80 (see attachment) In that case, the Spokane County Zoning Adjustor was asked to review the administrative decision of the Zornng Administrator that self-storage or mini- warehouses are not a permitted use in the Commercial Zone in overturning the Zoning Administrators interpretabon, the Zoning Adjustor found that - mini-warehouses are companbie to transfer storage warehouses which are a permitted use in the Commercial Zone according to Section 4 10 030(8)(45), - that mini-warehouses are a retail service which is consistent with the purpose and intent of the Commercial Zone, - and that historical files indicated that Spokane County had allowed several mini-warehouses to be located within the Commercial Zone The Spokane County Planning Department stands by this interpretation of the Zoning Adjustor provided that all standards of the Commercial Zone together ~ • ~ with all conditions of approval in a Commercial Zone are complied with in the development of the mini-warehouse use Although the above information is correct concerning a mini-warehouse use in the Commercial Zone, I have found some discrepancies in your letter of October 21, 1987 and rezone files related to the property descnbed by you It is imperative that I point these discrepancies out to you since they do in fact affect the situation described in your letter and modifies the interpretation you have asked me to make tn your letter, you describe the existing Shurguard Self-Siorage facility as being located on the Easterl_v twenty-five (25) feet of Tract 16, all of Tract 17, and a portion of Tract 18 of Assessors Piat No 6 In reviewing the legal descriptions, I find that the Westedy twenty-five (25) feet of Tract 16 is contiguous to Tract 17 and = the Easterly portion of Tract 16 Therefore, I assume that the correct legal description for the Shurguard Self-Storage facility should be the Westerly twenty-five (25) feet of Tract 16, all of Tract 17, and a portion of Tract 18 of Assessors Piat No 6 In your letter you also describe a brief zoning history of the area in question In review of the rezone files and associated legal descnptions. I find the following zoning history to be more correct In 1972 Tracts 15, 16, 17, 18, and 19 of Assessors Plat No 6 lying northeriy of Interstate 90 were rezoned from Agncuitural to Freeway Commercial by zoning file ZE-60-72 Subsequent to that rezoning, three (3) separate zone changes were proposed and approved to change most of the above-descnbed property from Freeway Commercial to Commercial or Resincted Industnal File ZE-3-73 changed the zornng on Tract 15 from Freeway Commercial to Restricted Industrial In 1975, the easteriy 250 feet of Tract 16 was proposed and approved for rezoning from Freeway Commercral to Commercial by File ZE-23-75 Tract 16 in reality is approximately 275 feet wide Therefore, since ZE-23-75 rezoned only the easteriy 250 feet of Tract 16, the westerty 25 feet was not affected by that zone change and remauned zoned Freeway Commercial Finally, in 1976, by File ZE- 43-76, Tracts 17, 18 and 19 lying north of interstate 90 were approved for Restncted Industnal zoning This application, ZE-43-76, did not include any portion of Tract 16 Therefore, it is the Pianning Department's position that the westerly 25 feet of Tract 16 continues to be zoned Freeway Commercial according to File ZE-60-72 Now, with the above in mind and knowing that the westerly 25 feet of Tract 16 is zoned Freeway Commercial, I believe that your intended question of interpretation would actually be as follows "Is a self-storage or mini-warehouse a permitted use in the Freeway- .C&mm r i I ZQg, Chapter 4 08A, of the Zoning Ordinance of Spokane County?"
