SUBJECT : Swan Acres Third Addition
The Spokane County Planning Department has reviewed the final plat and approval of Swan
Acres Third Addition. The Planning Department would sign off on any building permit so
long as the County Planning Department's conditions of approval were met. This does not
appear to be the luniting factor in regard to issuance of a building pernut in this case.
Per Dennis Kroll's memo to you dated June 20, 1991, it appears that the County Health
District would not be able to sign off on a building permit until "a public sewer becomes
available or FEMA adjusts the flood hazard boundary following the construction of a retention
pond or sump or FEMA reevaluates the area and adjusts the boundary that would no longer
include Swan Acres Third Addition."
In addition, in conversation with the County Engineer's office (Gary Nelson), I have been
informed that, to have that department sign off on a building permit, the lowest finished floor
and/or any opening(s) would have to be two feet above the highest elevation of the adjacent
ground elevation. A grading and drainage plan is needed to determine what the adjacent
grounci elevation would be. That would mean no basements allowed.
I would suggest that you contact Dennis Kroll and Gary Nelson to get further details. It seems
there would be a possibility for issuance of a building permit if: (1) public sewer were
provided to the sites and (2) construction of the dwellings were two feet above the highest
elevation of the adjacent ground elevation.

Zn June, 1990, representatives from FEHA observed the Forker Road drainage
basin. According to the 'Spokane County Engineers office, FEMA designated a
specif ic area that includes all of Swan Acres Third Addition in an alluvial
f an f lood hazard.
In the District•s regulations for sewage systems, section 1.04.180, paragraph
(9), a subsurf ace soil absorption system (SSAS - septic tank and drainfield)
shall not be located in areas subject to f looding.
All remaining unimproved vacant lots in Swan Acres Third Addition would be
affected by this determination, until a public sewer becomes available or FEMA
adjusts the flood hazard boundary following the construction of a retention
pond, sump, or FEMA re-evaluates the area and adjusts the boundary that would
no longer include Swan Acres Third Addition.

of County Commissioners of Spokane County has the care of County property and the
management of County funds and business; and
WHEREAS, pursuant to the provisions of RCW Chapter 58.17, the Board of
County Commissioners of Spokane County approved the subdivision known as Swan Acres
Third Addition, recorded in the Spokane County Auditor's Office at Volume , Page
, which plat, as a condition of approval, required that all buildings therein
conform to the pravisions of the National Flood Insurance Program which program was
adopted by Spokane County and codified in Spokane County Code Chapter 3.20; and
WHEREAS, the Spokane County Flood Control Ordinance, codified in Spokane
County Code Chapter 3.20 does not discuss Shallow Flood Zone areas, however, such
code chapter does require a development permit to be obtained before any construction
or deYelopment may occur within properties located within the flood hazard boundary
map; and
WHEREAS, Spokane County is willing to issue a building permit for certain
properties loca[ed within Swan Acres Third Addition governed by the National Flood
Insurance Program under the conditions that the owner of such properties agrees to
comply with certain conditions in conjunction with building any structure on such
parcel as well as indemnify Spokane County for any flood damage which the property
upon which the structure or the structure itself may sustain;
NOW, THEREFORE, BE IT RESOLVEll by the Board of County Commissioners of
Spokane County pursuant to the provisions of RCW Section 36.32.120(6) and RCW Chapter
Chapter 58.17, that the Board of County Commissioners of Spokane County hereby auth-
orizes the Chairman of the Board or a majority of the Board to execute that document
entitled "Indemnity Agreement," pursuant to which under certain terms and conditions
Spokane County, through the Spokane County Building and Safety Codes Department, will
issue a building permit on all lots located in the Swan Acres Third Addition recorded
in Volume , Page in the Spokane County Auditor's Office, in consideration of
the owner of such property agreeing to comply with certain conditions necessary to
carry out the intent of the National Flood Insurance Program adopted by Spokane
County under Spokane County Code Chapter 3.20 as well as agreeing to indemnify
Spokane County against any and all liability which may occur as the result of the
issuance of such building permit on such lot and damages which may occur as a result
of building within the flood hazard boundary area.

Indemnitor's successors and assigns to indemnify and hold harmless the Indemnitee,
its successors and assigns and all its officers and employees against any and all

actions, causes of action, claims,•demands•, damages, costs, expenses (including
attorneys' fees), suits and compensation on account oF or in any way growing out of
•damages which may be claimed by any person including the owners or any party having a
property interest in that parcel of property described hereinabove to themselves or
to that parcel of property described hereinabove, to include al2 personal property on
the same, by reason of Spokane County through the Spokane County Building and Safety
Codes Department issuing a building permit on that parcel of property described here-
inaboveo
It is understood that a21 other provisions of federal, state and local laws,
ordinances and regulations must be complied with by the Indemnitor in conjunction
with the issuance of the building permit on that parcel of property described herein-
above, as well as those conditions set forth in Attachment "A".
This Indemnity Agreement contains the entire agreement between the parties
hereto. The terms of this release are contractual and not merely recitals.

The Indemnitor states that he has caref ully read the foregoing Indemnity
Agreement, knows the contents thereof, and that he has signed the same as his o wn
free act and deed.
The Indemn3.tor further states that he has been advised to contact legal
counsel prior to executing this doc wnent.
This agreement is one which shall run c,ith that parcel of property described
hereinabove.

Lot 10, Block 2; is a 1 foot strip and is hereby
dedicated to Spokane County as general county property to
be dedicated for roadway purposes at such time as the road
is extended as a full width public right-of-way and/or
adjacent lands are platted.
An individual driveway access permit, for the driveway
approach to the County road system, is required prior to
the issuance of a building permit for each lot.
A 10 foot wide drainage easement, as platted and shown
hereon, lying adjacent to all front lot lines for the
purpose of installing, operating and maintaining drainage
swales and drainage facilities to dispose of runoff, is
hereby granted. The County of Spokane is hereby granted
the right of ingress and egress to all drainage easements
adjacent to the public rights-of-way. The property owner
shall maintain the drainage swale with a permanent live
cover of lawn turf, with optional shrubbery and/or trees,
which do not obstruct the flow and perculation of storm
drainage water in the drainage swale as indicated by the
grade of acljacent streets. .

placed on permanent foundations and be low in profile not
to exceed twelve (12) inches above ground level.
No more than one dwelling unit may be placed on any
one lot, nor shall any lot be further subdivided for the
purpose of creating additional lots or building sites
without filing a replat. No duplexes shall be allowed on
any lot shown hereon.
Su bject to specific application approval and issuance
of permits by the Health Officer, each Lot is authorized
the use of an individual on-site sewage disposal system.
The Owner(s), or Successor(s) in interest agree to
authorize the County to place thier name(s) on a petition
for the formation of a ULID by petition method pursuant to
RCW 36.94 when the petition includes the Owner(s) property
and further not to object by the signing of a protest
petition against the formation of a ULID by resolution
method pursuant to RCW 36.94 which includes the Owner(s)
property. PROVIDED, this condition shall not prohibit the

constructed below one foot above the maximum curb elevation
in front of each lot without special construction standards
as required by the "National Flood Insurance Program" Title

The use of private wells and water systems is
prohibited. The public water system as approved by County
and State Health authorities and the local fire district
and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water

A. I NTR4DUCTION
This matter having come before the Spokane County Subdivision Hearing Exam-
iner Committee on October 21, 1982 and the members of the Committee present
being Kathy Carstens, Chairperson, Richard Skalstad and Jerry Williams.
B. PROPOSAL
The sponsor, George Swan, is requesting approval of an Extension of Time for
PE-1341-79, SWAN ACRES 2ND ADDITION, and Zone Change ZE-221-79, Agri-
cultural to Agricultural Suburban for subdivision of 10 acres into 23 lots for
single-family dwellings, and there being present, the following applicant or

feet southeast of the intersection of Bannen Road and Forker Road;

D. History The preliminary plat was approved by the Hearing Examiner Com-
mittee October 1979, and has received 2 one year time extensions,
October 1980 and October 1981. At the October 1981 Hearing a change
of condition was granted for a preliminary plat redesign (road) and
to allow double-wide manufactured homes by approving Agricultural
Suburban zoning, but prohibiting duplexes. The Board of County
Commissioners upheld the Hearing Examiner Committee with an December
1981 appeal decision.
The Sponsor indicates that progress has been made toward finalizing
this preliminary plat, as all Surveying, Engineering and drafting of
all Plans and.Final Plat Map have been completed. The Water Plan
has been approved and water lines have been sized and installed to
the site boundary. The delay of finaliZing this plat is due to
current economic condition of the housing market and high interest
rates. '
E. Protaosal The sponsor is requesting an "extension of time" of the prelimi-
nary plat approval to divide 10 acres into 23 lots for single-family
dwellings and to change the zoning oa the 10 acres from Agricultural
to Agricultural Suburban.
II. SPECIAL INFORMATION
This proposal lies outside the Priority Sewer Service Area (PSSA) in an area
calling for 5 acre density as part of the adopted Wastewater Management Plan
and the Water Quality Section of the County Comprehensive Plan (for the purpose
of causing "fill-in" to support the valley sewer system and protect the aquifer
with S acre density until the PSSA boundary is expanded.) The County Utilities
Department recommends that if substantial progress has not been made toward
finalizing this prelimrnary plat that the 5 acre minimum lot size be imposed
until the PSSA boundary is expanded to include this site. However, after
reviewing the sponsor's application, it is the staffs opinion that substantial
progress has been made toward finalizing and that this proposal located in the
. URBAN category constitutes "fill-in" of existing similar type development for
(other than the valley sewer) public services and facilities that exist, and
therefore, staff recommends the time extension be granted.

The Planning Department is recommending that all preliminary plat approvals be
brought into conformance with RCW. 58.17 regarding the amount of time allowed .
before a preliminary plat must be finalized. State law currently allows a
preliminary plat three (3) years (without any new conditions) and allows one
extensioa of time for one year, if the sponsor requests the additional year;
however, this 4th year may have new conditions added.
No other additional conditions of approval are being recommended by the re-
maining departments.
III. CONDITIONS
If approval is granted, the following conditions are recommmended.

1. Those conditions already attached to the preliminary plat of record.
2. That the preliminary plat be given conditional approval for three (3)
years to November 1, 1985. The applicant may request a one (1) year
extension of time by submitting a written request forty-five (45) days
prior to the above expiration date. Such applications should demonstrate
the progress made toward finalizing this preliminary plat. If a time
extension is not requested in a timely manner or a time extension is not
granted, then the preliminary plat approval is NULI, & VOID.

THIS 1`LATTER, Ueing the consideration by the Board of County
Commissioners of Spokane County, hereinafter referred to as the "Board", of an
appeal of the Spokane County Subdivision Hearing Examiner Committee decision
of October 29, 1981, where the Subdivision Hearing Exami.ners Committee did
approve the extension of time and change of condition for the zone reclassifi-
cation to be AGRICULTURAL SUBURBAN wzth the condition that duplexes are not
allowed; hereinafter referred to 3s the "Proposal."
The Board received an appeal From George Swan requesting to remove
the Hearing Examiners Committee`s condition that duple:ces not be allowed.
The Board did hold a de novo public hearing on December 8, 1981, and
having fu].ly considered all testimony presented thereat, and having individually
acquainted themselves with the site and vicinity in question and having reached
a decision on the 22nd day of December, 1981, to deny the appeal., does hereby
make the following:
FINDINGS OF FACT
1. That the proposal is located approximately 450 feet East of BANiNEN ROAD
and South of FORI<ER ROAD.
2. That the proposal consists of 10 acres to be subdivided into 23 lots for
single family homes.
3. That the sponsor has demonstrated good faith toward finalizing this
preliminary Plat.
4. That the County Comprehensive Plan indicates that the area of the proposal
is planned for URBAN level of services and URBAN ty►pes of uses, but
calling for compatiUility beti,reen existing and planned uses.
5. That the existing single family homes in the vicinity are similar to the
resiclential uses condit]_oned for approval for this proposal.
b. That other preliminary plats in the vicinity a].so do not altow duplexes.
7. That the proposal lies within the recorded: fire service District #1;
school boundaries o£ East Valley #361; and water service of Trentwood
Irrigation District #3.
8. That the proposal, as conditioned to exclude duplexes, is not detrimental
or otherwise harmful to the public healtli, safety and welfare.
9. That the County Comprehensive 1'lan's URBAN category, in which t.he proposal
is located, establishes maximum level of public services including public
sewers.
10. That the County has adopted a Comprehensive laastewater Management Plan
(C.tJ.M.P.) to complement and add further detail to the Countiy Comprehen-
sive Plan and that this wastewater Plan is to be amended by direction of
the Board to better correlate with the location of the various categories
of the Comprehensive Plan as well as the existing physical features of
areas to be served Uy a public sewerage collection system.
11. That current Board-initiated amendment to the C.W.M.P. service boundaries
include thxs pxoposal withYn the Pri.ority Sewer Servxce Area (P.S.S.A.).
12. That this proposal has an approval for an aciditional year to Novembez 1,
1982, and that the C.W.M.P. amendmeuts are to be accomplished prior to
the expirztion of this approval.

Non-Signxficance.
17. That the proper legal reqiiiremenLs for advertising of the hearing before
the Board of County Commissioners of Spokane County have been met.
18. That on the 22nd Day of December, 1981, the Board, at a regular meeting,
dzd deny the appeal based upon the testimony submitted at the public

Existing subdivisions in the area were, in the past, approved for R-1 Zone
Classification and some have developed with conventional single family
houses. Recently, those subdivisions with preliminary plat approval have
been requesting'"change of conditions" to change the zoning to Agricultural
suburban, so as to a11ow double-wide manufactured homes (i.e., Sanson East
Addition, Pace Addition and, on this month's H.E.C.'s agenda, Lucy's
Addition and Swan Acres 2nd Addition). Recent Board of County Commissioners'
appeal decisions have approved the change of condition request with
conditions that address compatibility betvieen the existing conventional
single family hous^s and the proposed double-wide manufactured homes. T'he
Comprehensive Plan Category Urban Decision Guideline 1.1.5 calls for
aesthetic compatibility and with the recorranended conditions within this
Staff Analys i s the change of condi tion approval woul d be compatibl e ti•ii th
the Comprehensive Plan and compatible with the existing land uses. A
mixture of iones do currently exist in the area which provide for a variety
of housing types.
III. CONDITIONS
If approval is granted, the following conditions are recommended.
PLAPINIPIG DEPARTMENT ,
1. Those conditions already attached to the preliminary plat of record.
2. That the project sponsor is responsible for requesting a time extension to
review any preliminary plat approval. Al1 extensions applied for may
subject the project sponsor to new conditions required by Reviewing Agencies.
3. That a time extension be granted to November l, 1982.
4. That no duplexes are allowed.
5. That only domestic pets are allowed.
6. That the zoning be changed to Agricultural Suburban upon filing of the
Final Pla t, and that Condition n13 of the Findings and Order dated

PRELIMINARY SUBDIVISION AND ZONE RECLASSIFICATION
I. GENERAI. INFORMATION
A. Location
The proposal is located in the Spokane Dalley approximately 450 feet south
east of the intersection of Bannen Road and Forker Road.
B. Proposal
- 10 acres subdivided into 23 lots for single family use
- Lot frontage = varies from 80 feet to 125 feet
- Lot size = approximately 15,000 square feet
C. Relationship to the Cocnprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding Iands, with no density designation.
D. Land Use Analysis:
1. Existing Land Uses
The site is level land at the base of the North Spokane Valley wall in an area
that is cultivated with crops that include wheat, barley, hay and some truck
farming to the south of the proposal. The the east of the proposal is the
Prelicnentary Plat of Summerfield East with approximatelq 266 single faraily
lots on 91 acres on 10,000 square foot lots. West of Bannen aad North of
Wellesley south of The Proposal are the recently approved Lucy's Addition
(14,500 square foot lots) and Pace Addition (14,500 square foot lots) both
preliminary plats. Also South of the proposal Curry One subdivision has been
approved and constructed. Directly to the West is the Swan Acres lst
Addition, a preliminary plat approved with lots of approximately 18,000 square
feet. Also there is Swan Acres a final plat abutting Swan Acres lst with lots
varing in size from one acre to 25,000 square feet.
2. Compatibility with Existing Land Uses
The sponsor has requested the subdivision of 23 lots on 10 acres with
approximately 15,000 square feet per lot. Given the existing residential
developments in this area the Planning Staff feels that the proposul would be
compatible and consistent with the present development trend in the area.

II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has examined the proposed preliminary plat of record
and made specific conditions for the satisfactory development of roads and
circulation pattern for the proposal.
B. Sewage Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means; including on-site septic tank disposal, treatment plant and
sewage lagoon. For economic reasons, and to provide the most realistic
alternative, the applicant's engineer feels on-site septic tanks should be
utilized.
The Spokane County Health District has authorized the use of individual
on-site sewage systerns for each lot within the plat. The District states that
an on-site sewage management system should be created and approved by their
office prior to the signing of the final plat if more than a total of 35
dwelling units are authorized within the plat. The plat is situated over the
Spokane Valley Aquifer and the Health District in their examination of the
possible impact on groundwater quality from this proposal have the following
comments:

Impact Discussion
a. The plat sponsor has proposed 23 lots on 10 acres. Each lot is to be
served by a public water system and its individual on-site sewage
disposal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
1. Ia normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the aatural groundwater background
of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background.

- - - The analytical results of the forecast impact of year
2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater quality is
already a substantial proportion of the ultimate level.
c. Currently, results of chemical analysis show the total nztrogen content
of the groundwater as in the range of 2.7 to 6.7 ppm. A projected
incremental increase using Dr. Todd's expected 8.6 percent would result
in a range of 2.9 to 7.3 ppin. Current Federal and State drinking water
standards permit up to 10 ppm.
d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
1. Collector and central treatment systems discharging to surface
waters would require at least tertia ry treatment and perhaps more to
obtain a permit for the discharge from the Department of Ecology.
These systems are not currently economically available for this
project.
2. Sealed systems, whether individual or community, depend on
evaporation for liquid removal. These systems require more land
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety ha2ards associated with them and relatively
poor community acceptance. I,and, installation and operational cost
are generally more expensive than those for septic tanks and
drainfields.
C. Draina&e
The County Engineer reports that the preliminary storm drainage plan submitted
by the applicant indicates that on-site storm drainage provisions will
adequately handle surface water runoff. However, final construction plans
should be reviewed and approved by both the County Engineer and Health
District prior to the final plat filing.
D. Water Supply
The proposal is located within the recorded service area of Trentwood
Irrigation District #3.
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrigation uses.
E. Fire Protection
The proposal is situated within the recorded service area of Fire District #1
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient size for fire protection as a condition of
final plat approval. The District also requests that they be allowed to
review and approve final fire flows and water plans.

G. Parks
" The report "Planning for Parks" (revised 1976) indicates That the proposal is
located in the Velox neighborhood as the area develops a community park
proposed at 15.0 acres should be located in the vicinity of the East Valley
Junior High.
H. Unique Environmental Features
None have been indentified.
I. Cultural Resources
None have been indentified.
III. ZQNING ANALYSIS
The property is currently zoned Agricultural. The area has recieved several
preliminary plat approvals-in the recent past. Summerfield East to the East of the
proposal with single family residential zoning. Pace Addition and Lucy's Addition
South of the proposal with single family residential zoning. Given current zoning
trends for similar uses and lot sizes in the area, the site would be most
appropriately zoned R-1 Single Family Residential.
IV. ENVIRONMENTAZ REVTEW
An Environmental Checklist was submitted bq the sponsor and has been reviewed by
the Planning staff. No significant adverse envirorunental impacts were judged to
exist.
Slight adverse environmental impacts were identified on the checklist in the
following categories: earth; air; water; flora; fauna; noise; light and glare;
land use; populat3-on; housing; transportation/circulation; public services;
utilities; and energy.
The Planning Director issued a proposed Declaration of Non-Significance, and it was
circulated to other agencies of jurisdiction.
V. CONDITIONS:
If approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record
aad/or attached sheets as noted.
2. That a statement be placed in the dedication to the effect that no more than
one dwelling structure be placed on any one lot, nor shall any lot be further
subdivided for the purposes of creating additional lots or building sites
without filing a replat.

3. That appropriate street names be indicated.
4. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.
5. That the plan for water facilities adequate for fire protection be approved
by the water supplier and fire protection distrlct. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the poan is in comformance with their requirements and will adequateZy
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction. The purveyor will also
certify prior to the filing of the final plat on a copy of said water plan
that appropriate contractual arrangements have been with the plat sponsor for
construction of the water sustem, in accordance with the approved plan, and in
accordance with a time schedule. The time schedule will provide, in any case,
for campletion of the water system and inspection by the appropriate health
authorities prior to application for building permits within the plat. The
contractual arrangement will include a provision holding Spokane County and
the purveyor harmless from clairos by any lot purchaser refused a building
permit due to the fialure of the plat sponsor to satisfactorily complete the
approved water system. The plat dedication will contain a stateroent to the
effect that the public water system as approved by County and State Health
authorzties and the local fire district and purveyor will be installed within
this plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lot prior to sale of each.lot.
6. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
7. That the preliminary plat be given conditional approval to November 1, 1980.
8. That a declaration of Non-Significance be issued, in accordance with
Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmentai checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320.
9. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planniag staff. 10. That each lot be authorized for the use of individual on-site sewage disposal
systems.
11. Prior to filing of the final plat, the sponsor shall present evxdence that the
plat lies within the recorded service area of the proposed water dxstrict.

Special Conditions
12. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080 RCW and
the Board of County Commissioner's Resolution No. 77-1392 be accomplished by
the project applicant within thirty (30) days of formal action by the Hearing
Examiner Committee, with regard to the preliminary plat approval; as
instructed by the Planning Department staff.
13. That upon filing of the final plat, the zoning be reclassified to Single
Family Residential.
14. That the project sponsor is responsible for requesting aa extension of time to
review any preliminary plat approval. All extensions applied for may subject
the project sponsor to new conditions required by Reviewing Agencies.
15. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declaration
of Noa-Significance.
16. That a public water system serviced by Trentwood Irrigation District #3, and
including fire flows, serve each lot prior to the sale of the lot.
17. That an on-site sewage management system be created and approved by the Health
Office prior to the signing of the final plat, if more than a total of 35
dwelling units are authorized within the plat.
18. That final coastruction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
19. That the plat dedication contain the statement: "Use of private w~'lls and
water systems is prohibited.
20. Sewage disposal drainfield surfaces located in any flood hazard zone must be
at the same elevatioa as the water entry elevation for dwelling structures as
established by the County Engineer. '
21. There shall be no sewage system effluent disposal with 31 feet of the west
boundary of Lot 2, Block 1, until the well in Lot 4, Block 1, Swan Acres First
Addition has been abandoned pursuant to WAC 173-160.
22. That conditional approval of the plat by the County Engineer is given subject
to dedication of right-of-way and approval of the road system as indicated in
the preliminary plat of record.
23. That plans, profiles, and cross-sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the County
Engineer for approval prior to construction and/or the filing of a final plat.
Road plans to be prepared under the directioa of a licensed Professioaal Civil
Engineer.
24. That drainage plans and design calculations showing the alignment of drainage
facilities be submitted to the County Engineer for approval prior to
construction and/or the filing of the final plat. Drainage plans to be
prepared under the direction of a licensed Professional Civil Engineer.

25. That the regulations of the National Flood Insurance Program be observed since
the proposed plat is affected by a Flood Hazard 2one.
26. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed engineer/surveyor, who
shall furnish the County Engineer with "As Built" plans and a certificate in
writing that all improvements were installed to the lines and grades shown on
the approved construction pians and that all disturbed monuments have been
replaced.
27. No construction work is to be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
is subject to inspection and approval by the County Engineer.
28. All construction within the existing or proposed public right-of-way is`to be
completed prior to filing plat or a bond in the amount estimated by the County
Engineer to cover the cost of constructioa of improvements, construction
certification, "As Built" plans, and monumenting the street centerlines shall
be filed with the County Engineer.
29. No direct access from lots to half right-of-ways until such roads are
constructed to County Standards and established as County Roads.
30. No direct access from lots to stub road connections until such roads are
constructed to County standards and established as County roads.
31. Road design, construction, and drainage coatrol for half right-of-ways and
stub road connections are the responsibility of the Developer.
32. That appropriate provision be made that the following described property be
held in trust until the continuation of the streets be dedicated or deeded. A
1 foot strip at the ends or edges of all streets that terminate or border the
plat boundary. (Temporary cul de 'sacs are required when streets terminate at
the plat bouadaries.)
33. That all public roads within the plat be curbed aad paved to the
specifications of the County Engineer.
34. That sidewalks are required along the arterial(s) on Crown Avenue.

38. That no building permits be issued for Lots 7, 8, 9, and 10, Block 3 as shown
on the preliminary plat of record; until full width right-of-way is obtained
and the roadway improved and established as a county road.
