MONTH TEMPORARY USE PERMIT. (SPE -2A-85); ) FINDINGS, CONCLUSIONS
DAVID AND GLORIA DIEHL ) AND DECISION
SUMMARY OF APPLICATION:
The applicant previously received a temporary use permit to allow a non -family
employee to participate in their home occupation. That permit expires on
September 9, 1985. The applicants intend to move into a new dental office
complex, but the construction work has been delayed and is not estimated to be
completed for occupancy at least until the end of December, 1985. The
applicants are requesting an extension of the temporary use permit until March
6, 1986 so as to allow them time to occupy their new quarters and still
maintain the home occupation non -family employee in the interim.
LOCATION:
West of and adjacent to Laura Road, approximately 78 feet north of Indiana
Avenue in Section 7, Township 25, Range 44. The Spokane County Assessors
Parcel number is 07544-0323.
DECISION OF THE ZONING ADJUSTOR:
Based upon the evidence presented, the Zoning Adjustor APPROVES the renewal
and extension of this temporary permit until February 6, 1986.
PUBLIC HEARING:
After examining all available information on file with the application and
visiting the subject property and surrounding area, the Zoning Adjustor
conducted a public hearing on August 28, 1985, rendered a verbal decision on
August 28, 1985, and a written decision on September 5 , 1985.
FINDINGS OF FACT
1. The proposal is generally located west of and adjacent to Laura Road,
approximately 78 feet north of Indiana Avenue in Section 7, Township 25, Range
44 and is further described as Assessors Parcel #07544-0323, being more
accurately and specifically described in Zoning Adjustor files SPE -2-85 and
SPE -2A-85.
2. The proposal consists of extending a permit to allow a non -family
employee to participate in a dental laboratory home occupation. The original
6 month permit was issued with an expiration date of September 9, 1985. The
present proposal contemplates extending that to March 6, 1986 in order to
allow additional time for the construction of permanent dental laboratory
quarters, which are now under construction.
3. The adopted Spokane County Future Land Use Plan designates the area of
the proposal as URBAN and the proposal is consistent with the
County's entire Comprehensive Plan, including the Future Land Use Plan.
4. The site is zoned Agricultural which would allow the proposed use
upon approval of this application.

5. The existing land uses in the area of the proposal are residential
and are compatible with the proposal.
6. The applicant presented information concerning the construction of
their new quarters, including a letter from Robert G. Wendel, DMD, P.S.,
indicating that the building has been delayed in construction. The building
is currently having its footings and foundation poured and they expect it to
be ready for occupancy by late December. The delays have been caused by the
time -taking approval of permits and financing arrangements.
7. There was no testimony indicating that there were adverse affects to
the neighborhood as a result of a non -family employee. The non -family
employee parks his or her automobile off the street adjacent to the
applicants' driveway. The non -family employee maintains regular work hours of
approximately 8 to 5 o'clock.
8. A letter was received from Excel Dental Laboratory. The substance of
this letter concerned itself with the advisability of conducting a dental
laboratory in a residential situation. The letter did not address
specifically the extension of the six month permit to allow a non -family
employee to participate in the home occupation. The letter from Excel is not
germain from the standpoint that it questioned whether or not a home
occupation of this nature should be carried on. An administrative decision
has been made that this home occupation is consistent with the provisions of
the Zoning Ordinance. Therefore, the issues raised in Excel's letter are not
pertinent to the renewal of the temporary use permit. That is not to say,
however, that the issues raised in Excel's letter are not germain, only that
they are not the issue before the Zoning Adjustor.
9. The proposal is exempt from the provisions of Chapter 43.21C RCW
pursuant to WAC 197-11-800 (1) (c) and Spokane Environmental Ordinance
11.10.070 (c).
10. There were no legal requirements from the departments or agencies
which would effect the project as proposed by the applicants.
11. There were no written or verbal oppositions to the extension of the
permit, except the communication from Excel Laboratories.
12. The proper legal requirements for advertising of the hearing before
the Zoning Adjustor of Spokane County have been met.
13. The use is of a temporary nature.
14. An extension of the permit does not involve the erection of a
substantial structure.
15. The objective of establishing the temporary use can be achieved in a
six month period of time.
16. Any conclusion hereinafter stated which may be deemed a finding
herein is hereby adopted as such.
From the Findings, the Zoning Adjustor comes to these:
CONCLUSIONS
1. The proposal is not detrimental to and is compatible with the public
health, safety and welfare.
2. The proposal as set forth by the applicant is the extension of a
temporary use, the conclusion of which appears quite certainly to be in early
1986.
3. Any finding hereinbefore stated which may be deemed a conclusion
herein is adopted as such.

DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES
the proposal. The following CONDITIONS OF APPROVAL ARE STIPULATED.

is extended to and shall expire on Feburary 6, 1986.
2. Any extension of this permit cannot be done administratively and must be
subject to another public hearing.
3. The hours of business for the non -family member employee shall continue
to be approximately the hours of 8 a.m. to 5 p.m.
4. The employees automobile shall continue to be parked off the street and
on a location adjacent to the driveway of the residential structure.
5. The applicant shall proceed to resolve any conflict or any unissued
permit situation which may exist with the Spokane County Department of
Buildin and Safety.

THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, in
hearing application SPE -2-85, hereinafter referred to as the "Proposal", and the Zoning
Adjustor of Spokane County having held a public hearing on February 27, 1985 and having
fully considered all testimony presented thereat and having rendered a verbal decision
on the 27th day of February, 1985, APPROVING the proposal, makes the following:
FINDINGS OF FACT
1. That the proposal is.generally located west and adjacent to Laura Road,
approximately 78 feet north of Indiana Avenue and is further described as Assessors
Parcel #07544-0323, being more specifically described as -West Valley 2nd, Lot 9, Block
2.
2. That the proposal consists of allowing one employee, not living on the pemise
of the home occupation (dental laboratory), to assist in processing an excess workload
until such time as the applicants are able to locate a new office; and further that
this request is consistent with language allowing such application in Section 4.25.030
e. of the Spokane County Zoning Ordinance.
3. That the adopted Spokane County Future Land Use Plan designates the area of
the proposal as URBAN and the proposal is consistent with the County's entire
Comprehensive Plan, including the Future Land Use Plan.
4. That the site is zoned Agricultural which would allow the proposed use upon
approval of this application.
5. That the existing land uses in the area of the proposal are residential and
compatible with the proposal.

4) Approval is given for the employee's automobile to be parked on the
street, except that upon complaint and investigation by the Zoning
Adjustor of congestion caused by said vehicle, the Zoning Adjustor may
direct that the automobile must be parked on the premise.
5) A change in use permit, from the Spokane County Department of Building and
Safety is required for that portion being used fo a dental laboratory in
accordance with Section 502 of the Uniform Building Code, and said permit
shall be filed with the Planning -Department within 5 days of its issuance.
