Findings of Fact
GOVERNING LEGISLATION: Spokane Valley Comprehensive Plan
PREVIOUS COMMISSION ACTION TAKEN: Public hearing on October 25,2007
BACKGROUND: The City of Spokane Valley Comprehensive Plan provides for an annual
amendment process. The Community Development Department received seventeen amendment
proposalsby the November ls` submittal deadline,
On October 25, 2007, the Planning Commission reviewed CPA-01-07 thru CPA-09-07. Further
research was requested on GPA-10-07 to determine an appropriate boundary for the proposed
Regional Commercial designation. Using the Assessor's property use code and aerial photos,
parcels within this boundary were symbolized to determine partially used land,vacant land, and
commercial or residential use. This information is depicted in Exhibit 6: Existing LU Analysis.
Owner occupation was determined by cross referencing tax payer address with the site address in
Spokane County's parcel layer,
The analysis identified that a majority of the land in the proposed Regional Conirnercial
designation west of Barker Road consists of commercial or non-owner occupied property;
furthermore most of the residential property is partially used. For the purposes of this analysis
the regional Land Quantity Analysis methodology was used to indentify properties defined as
"partially used". Partially used land is land where the parcel is at least 5-times the required
minimum parcel size. In this analysis staff used 7,500 square feet as the most likely minimum
parcel size based on the City's R-3 zoning classification.
Property located east of Barker Road is split with residential and commercial land uses with most
of residential uses being partially used. Residential properties in the southeast corner are located
on smaller lots with little potential redevelopment. These properties could reasonably be
excluded from the Regional Commercial designation (see exhibit 7).
The conclusion from this analysis, in staff's opinion, supports the original recommendation of
Regional Commercial considering most of the residential properties have the potential ler
redevelopment and are not owner occupied. The area is suitable for Regional Commercial uses
and is consistent with the Comprehensive Plan goals and policies and has developed in.that

fashion thus far. It is recommended that the Planning Commission removed the properties
identified in Exhibit 7 from the proposed Regional Commercial designation in CPA-10-07.

The Spokane Valley Planning Commission conducted a public hearing on October 25, 2007,to
consider the proposed amendments. After hearing public testimony,the Commission made
recommendations on nine of the amendments. The Commission continued the public hearing for
CPA-10-07 thru CPA-17-07 to November 8, 2007.

Members of the Planning Commission:
This is a formal follow-up of my comments in your lust Planning Commission public
hearing concerning the issue of the annual amendment deadline and thank you for
allowing me to indulge on this. I know it seems somewhat odd that a different date is
needed when there is an entire year behind the deadline to prepare atnendment request,
but that only holds true if one has control over this work schedule_ Yet the reality is, no
one request these services until the last few weeks from the deadline and as 1 stated the
other evening,your deadline and the City of Spokane's are the same, thus exacerbating
the ability to get these applications filed on time.
It would be a great benefit to those of us who provide this service if you could adjust your
deadline even as little as 30 days to the end ofNoven ber so there is time to attend
adequately to each application. Since the applications seem to get deferred until the first
of the year for staff review and comment, an adjustment to the end of November would
seem inconsequential on the city side of things.
Please advise me of your intentions in response to this request.

Facts Basis
1. Inadequate Notification
A Change to Multi-Use published in Valley Herald
Publication circulated to 55,000 lx/weekly
rather than The Spokesman Review
Publication circulated to 355,000 Daily
B. No House to House notification of pending change
2 Misrepresentation by Mike Basinger
A Twenty-three (25) homes occupy the block bordered by the Freeway, Barker,
Alki and Greenacres Road{Mr. Basinger had stated there were seven.)
B. Picture shown was of a pasture for the horses owned by a resident of that block
C_ The one (1) business has been moved into the residentially zoned area slowly
over the period of 10 years -over continued objections of the neighborhood.
3. Monetary issues
A.Current homes will not be able to get financing for the upkeep and for
improvements of their properties
B. In a fluctuating stock market, will not be able to refinance to a lower interest rate - a
vital need for young families, as well as, older retired persons
C. Property values go DOWN when business begin to go in (i.e. Evergreen Road)
4. Quality of Life
A.This is a long standing neighborhood that is active and closely knit.
B.This is a thriving neighborhood (many new homes/remodels over the past few
years).
C.This is a neighborhood that knows,socializes and cares for each other.
D.The rezoning change just made, and the one proposed, will destroy the quality
life enjoyed by the residents of this neighborhood.
Proposal:
1.Options to consider
A. Reverse the current designation back to residential (or)
B. Restrict the mixed- use designation to the narrow corridor along Barker,
and restore the remainder of the block to Hesidential
1. Future businesses would be able, with a vote by the residents, to
apply for change of zoning, per individual case
C. In anticipation of future growth of businesses, widen and pave Broadway from
Long Road to Barker
