FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE RECLASSIFICATION,
PE-1337-79, MAMER ADDITION; ZE-196-79, AGRICULTURAL TO AGRICULTURAL SUBURBAN
OR R-2.
WHEREAS, The Spokane County Subdivision Hearing Examiner Committee did, after
public hearing on September 28, 1979, take action by motion that the preliminary
plat to be known as MAPIER ADDITION (File No. pE-1337-79) be DENIED; and,
WHEREAS, Arthur M. Noll, E 12721 Sprague, Spokane, Washington, representing
the sponsor, Mr. Teeter, did request a special hearing before the Board of County
Commissioners to present evidence and testimony against the motion of the Hearing
Examiner to the above described prelmininary plat and zone reclassification; and
WHEREAS, The Board of County Commissioners did hold a public hearing on
November 13, 1979, to consider the Findings and Order of the Hearing Examiner and
testimony and request of the plat sponsor, objectors and other interested parties;
and, WHEREAS, At said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County, having fully considered the
testimony given, the Findings and Order of the Hearing Examiner, the environmental
checklist, and all other evidence presented, and further having personally acquainted
themselves with the site and vicinity in question, does hereby find that the con-
clusions of the Hearing Examiner were generally valid and sufficient.
NOW, THEREFORE, The Board of County Commissioners does conclude that the
preliminary plat to be known as MAMER ADDITION and zone reclassification upgrading
to Agricultural Suburban or R-2 should be and hereby is DENIED.

This being the time set by the 6oard of County Commissioners of Spokane County, Washington to render its decision concerning the request of
Randy Teeter, East 11910 Broadway Avenue, Spokane, WA 99206 for the
above captioned preliminary subdivision and zone reclassification; and
The Spokane County Hearing Examiner Committee having heard the above
request on September 28, 1979 did deny said application; and
The Board having conducted its own public hearing on November 13, 1979,
at the request of the sponsor, Mr. Teeter, represented by Arthur M. Noll,
East 12721 Sprague, Spokane-, 14A. 99216 and after visiting the site and
reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the Hearing Examiner Committee's action to deny
said application.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

A. INTRODUCTION
This matter having come before the Examiner Committee on September 28, 1979,
and the members of the Committee present being Eldon Thomas, Chairperson,
Jane Myers, and Pau) Sceva, Jr.
B. PROPOSAL
The sponsor, Randy Teeter, is requesting approval of a preliminary plat and
zone change, PE-1337-79, Mamer Addition and ZE-196-79, Agricultural to
Agricultural Suburban or R-2 for subdivision of 1.7 acres into 4 lots for single
family dwellings and/or duplexes and there being present, the following
applicant or representative:

1. That the existing land use in the area is vacant.
2. That the Comprehensive Plan designates this area as residential usage.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.

STATEMENT or- OPPOSITION
The majority of people residing on Mamer Road between Broadway and Mission
purchased their property for specific reasons - the most important one
being the availability of acreage. The open space and quietness of the
area and small amount of local traffic were other contribu'ting factors.
Most of the residents have a minimum of two acres of land - some have four
or more and most of them use -this land for cattle and/or horses. The agri-
cultural zonirg is very important to us. It is a possibility that a change
in the zoning could eventually prohiba.t future land use for our animals
and alter our lifestyle.
We are concerened that the quality of the proposed structures -to be built
on the site in question would have a serious impact on the surxounding land
values. Tt is reasonable to assume -that the developement would not be in
keeping with the values of the existing homes. Multiple farnily units will
have transient type occupants - somEOne living there just long enough to
find a perrnanent home in a less crowded area. We believe this development
would lead to a low-income type of environrnent - a condition that no one
would like to ha.ve in their neighborhood.
In rEViewing the lei~gth of residence of the present home owners, we found
that the neighborhood has a very s-table population - many people have lived
here for over 20 years.
Another problem that would surface with eight additional families is the
increased traffic. Most families have more than one car, many also have
boats, trailers and motorcycles. We ar.e anxious to prevent a situation like
the one that has been allowed to develope an East Mission between Best and
Sullivan.
We would like -to }anow the exact description Of thE land to be used for this

project. According to our measureinents there are 1.72 acres. The proposal
mentions 2.5 acres; we question this.

It is the feeling of the neighborhood that one single farctily dwelling
per acre is all that shoulcl be allowed an this area. This would be in
balance with the lifestyle on Mamer Road and be an asset to cuxxent
property values - not a devaluation.
If this opposition statement sounds familar it should. On April
25, 1978 we faced the exact situation on the same piece of property - the
only difference being a proposal for eight single family homes. The pre-
sent proposal ca11s for four duplexes - still eight fami.lies - the end
result being the same'.t
In conclusion it is still the feeling of all persons signing this petition
against the re-zoning that the changes would sharply lower our land values
and restrict our right to a quiet and peaceful neighborhood such as now
exists. We believe -that this project wou.]_d have adverse environmental
impact on the area.

PRELIMINARY SUBDIVISION AND ZONE RECLASSIFICATION
I. GENERAL INFORMATION
A. History This proposal was heard in April, 1978 as Poochies Addition. The proposal
consisted of eight (8) lots and was denied by the Planniag Commission. It was
subsequently appealed to the County Commissioners, but final action never
occurred and the plat was dropped by the sponsor. The property has been sold
and this sponsor is now proposing 4 lots for the same area.
B. Location
Mamer's Addition is situated in the Spokane Valley, south of Mission Avenue
and directly east of Mamer Road.
C. Proposal
- 2.54 acres subdivided into 4 lots for single family or duplex use
- Lot frontage = 166 feet
- Lot size = 15,106 sq. ft. .
D. Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density designation.
D. Land Use Analysis:
1. Existin~g Land Uses
The site is vacant with no significant topographical problems. The general
area has been developing into residential subdivisions such as Gutherie's
Valley View Additioas to the southwest. The immediate area between Evergreen
and Blake Road south of Mission consist of segregations of 10,000 sq. ft. lots up to 5 acres.
2. Compatibility with Existin$ Land Uses
The proposal appears to be compatib).e with the lot sizes in the area
particularly regarding the existing subdivisions in the area and the smaller
segregations along Mission Avenue directly to the north.

II. SPECIAL INFORMATION
A. Circulation

B. Sewage Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means; including on-site septic tank disposal, treatment plant and
sewage lagoon. For economic reasons, and to provide the most realistic
alternative, the applicant's engi.neer feels on-site septic tanks should be utilized.
The Spokane County Health District has authorized the use of individual
on-site sewage systems for each lot within the plat. The District states that
an on-site sewage management system should be created and approved by their
office prior to the signing of the final plat if more than a total of 8
dwelling units are authorized within the plat. The plat is situated over the
Spokane Valley Aquifer and the Health District in their examination of the
possible impact on groundwater quality from this proposal have the following
comments: Impact Discussion
a. The plat sponsor has proposed 4 lots on 2.54 acres. Each lot is to be
served by a public water system and its individual on-site sewage
disposal system. This raises the question of significance of the impact
, on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd coasidered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
nitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background.

- - - The analytical results of the forecast impact of year
2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater quality is
already a substantial proportion of the ultimate level.
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 9.6 to 1.7 ppm. A projected
' incremental increase using Dr. Todd's expected 8.6 percent would result
in a range of 1.04 to 1.8 ppm. Current Federal and State drinking water
standards permit up to 10 ppm.
d. Alternative sewage ZiispQSal methods that would not recharge the ground-
water have the following general characteristics:
1. Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps moreto
obtain a permit for the discharge from the Department of Ecology.
These systems are not currently economically available for this
project.
2. Sealed systems, whether individual or community, depend on
evaporation for liquid removal. These systems require more land
area than a conventioaal subsurface drainfield. Some, such as
lagoons, have safety hazards associated with them and relatively poor cammunity acceptance. Land, installation and operational cost
are generally more expensive thaa those for septic tanks and drainfields.
C. DrainaRe
_ The County Engineer reports that the preliminary storrn drainage plan submitted
by the applicant indicates that on-site storm drainage provisions will
adequately handle surface water runoff. However, final construction plans
should be reviewed and approved by both the County Engineer and Health
District prior to the final plat filing.
D. Water Supply The proposal is located within the recorded service area of Vera Water and
Power District.
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and •
irrigation uses.
E. Fire Protection
The proposal is situated within the recorded service area of Fire District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient size for fire protection as a condition of
final plat approval. The District also requests that they be allowed to
review and approve final fire flows and water plans.

F. Schools
Proposal lies within the boundaries of Central Valley School District.
G. Parks
The report "Planning for Parks" (revised 1976) indicates no plans for a county
park in the immediate vicinity.
H. Unique Environmental Features
None have been indentified.
I. Cultural Resources
Idone have been indentified.
III. ZONING ANALYSIS
This property and the surrounding area are currently zoned Agricultural. The
sponsor is requesting duplexes on all lots and to accomplish this has proposed
either R-2 or Agricultural Suburban zoning. There are several duplexes along
Mission approximately 200 feet to the north and if the proposal is approved, the
staff would recommend R-2 zoning.
IV. ENVIRONMENTAI, REVIEW
An Environmental Checklist was submitted by the sponsor and has been reviewed by
the Planning staff. No significant adverse environmental impacts were judged to
exist.
Slight adverse environmental impacts were identified on the checklist in the
following categories: earth; air; water; flora; fauna; noise; light and glare;
land use; population; housing; transportation/circulation; public services;
utilities; and energy.
The Planning Director issued a proposed Declaration of Non-Significance, and it was
circulated to other agencies of jurisdiction.
V. CONDITIONS:
If approval is granted, the following conditions are recommended.
1. That the plat be designated as indicated on the preliminary plat of record and/or attached sheets as noted.
2. That a statement be placed in the dedication to the effect that no more than
one dwelling structure be placed on any oae lot, nor shall any lot be further
subdivided for the purposes of creating additional lots or building sites
without filing a replat.
3. That appropriate provision be made that the following described property be
held in trust until the Continuation of the streets be dedicated or deeded: A
1' strip at the ends or edges of all streets that terminate or border the plat
boundary. (Temporary cul de sacs are required when streets terminate at the
plat boundaries.)

4. That appropriate street names be indicated.
5. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.
6. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the water system and inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purvepor harmless from claims by any
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
7. That a certificate of titie be furnished the Planning Department prior to the
filing of the final plat.
8. That the preliminary plat be given conditional approval to October 1, 1980.
9. That a declaration of Non-Significance be issued, in accordance with
Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
WAC 197-10-320. 10. That conditional approval of the plat is given subject to the dedication of
right of way to the public and approval of the road system in the plat by the
County Engineer.
11. That plans, profiles, and cross sections showing proposed street centerline
and curb grades be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.

12. The drainage plans and design calculations showing the grades and alignment of
drainage facilities be submitted to the County Engineer and Spokane County
Health District for approval prior to construction and the filing of a final
plat.
13. Coastruction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, wha shall
- be responsible for perpetuating all evidence of the location of survey
monuments which may be distrubed during construction and who shall furnish the
Couaty Engineer with "As Built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.
14. No construction work is to be performed with the Public Right of Way until a
permit has been issued by the County Engineer. All work is subject to
inspection and approval by the Countp Engineer.
15. All construction within the Public Right of Way is to be completed prior to
filing the final plat or a bond in the amount estimated by the County Engineer
to cover the cost or construction of improvements, construction certification,
"As Built" plans, and monumenting the street centerlines, shall be filed with
the County Engineer.
16. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planning staff.
17. That each lot be authorized for the use of individual on-site sewage disposal
systems.
18. Prior to filing of the final plat, the sponsor shall present evidence that the
plat lies within the recorded service area of the proposed water district.
Special Conditions
19. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080 RCW and
the Board of Countq Commissioner's Resolution No. 77-1392 be accomplished by
the project applicant within thirtp (30) days of formal action by the Hearing
Examiner Committee, with regard to the preliminary plat approval; as
instructed by the Planning Department staff. 20. That upon filing of the final plat, the zoning be reclassified to R-2, Two
Family Residential.
21. That the project sponsor is responsible for requesting an extension of time to
review any preliminary plat approval. All extensions applied for may subject the project sponsor to new conditions required by Reviewing Agencies.
22. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recomsnends issuance of a final Declaration
of Non-Significance.
23. That a public water system serviced by Vera Water and Power, and including
fire flows, serve each lot prior to the sale of the lot.

a. This project lies in a relatidely f lat area between Opportunity and "
Vera. Local drainageways are insignificant. It is located over
the Spokane Valley Aquifer.
b. Surface soils are classed as Garrison gravelly loam c-yith 0 to 5% slopes.
They have a septic tank filter f ield limitation of slight with possible -
contamination of groundwatex.
c. Geologically the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The locaer terrace remnants have probably been reworked
by streams. These geologic structures yield moderate to very large
amounts of water.

d. The ciata from three 208 study wells in the area shocas the highest
total nitrogen level was 1.7 ppm. The Vera jJater District has
indicated that it can supply domestic use caater for the plat upon
completion of agreements with the developer.
3. Impact Discussion:
a. The plat sponsor has proposed 4 lots on 2.54 acres. Each lot is to be
served by a public water system and its individual on-site sewage dis-
posal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for secJage
disPosal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and setaage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
(1) In normal precipitation years, subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All dissolved salts in sewage effluent will be carried to the
groundcaater. However, bacteria and detergents• (phosphate por-
tion) are mostly removed by the deep soil layer above the
groundwater and "minor dissolved constituents such as phos-
phates, which are known to react with soil particles, or
nitrates, which are taken up by plant roots" will be less
than the total found in septic tank effluents.
(3) "The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background."--- " The
analytical results of the forecasC impact of year 2020 when com-
pared with the present impact, both measured in terms of leachate
volume and dissolved solids concentration, indicate that the
present impact on groundcvater quality is already a substantial
proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of .96 to 1.7 ppm. A projected incre-
mental increase using Dr. Todd's expected 8.6 percent would result in
ranges 1.04 ppm to 1.8 ppm. Current federal and state drinking cJater
standards permit up to 10 ppm.
d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:

(1) Collector and central treatment systems discharging to
surface waters would require at least tertiary treatment and
perhaps more to obtain a permit fox the discharge from the
Department of Ecology. These systems are not currently
economically available for this project. -
(2) Sealed systems, whether individual or community, depend
on evaporation for liquid removal. Some, such as lagoons,
have sa£ety hazards associated with them and relatively
poor community acceptance.
4. ltecommend that:
~ a. A public water system including fire flows serve each lot prior to
sale of the lot.
~b. Each lot be authorized the use of an individual on-site secaage system.
c. An on-site sewage management system be created and approved by this
IN° office prior to the signing of the final plat if more than a total
of eight (8) dwelling units are authorized t-jithin the plat.
X d. The final plat shall be designed as indicated on the preliminary plat
of record and/or attached sheets as noted.
e. Appropriate utility easements shall be indicated on copies of the

preliminary plat of record for distribution by the Planning Department
to the utility companies, County Fngineer and Spokane County Health
District. CJritten approval of the easements by the utility company must
be received prior to the submittal of the final plat.
f. Drainage plans and design calculations showing the grades and alignment
of drainage f acilities shall be submitted to the County Engineer and
Spokane County Health District for approval prior to construction and
the filing of the final plat.
~ g. The dedicatory language of the plat will state that each lot is authorized
the use of an individual on-site seviage disposal system.
h. Prior to filing of the final plat, the sponsor shall present evidence
that the plat lies within the recorded service area of the water system
proposed to serve the plat. The dedicatory language on the plat shall
state: "Use of private E-iells and water systems is prohibited."
~ i. A plan for water facilities adequate for domestic use, domestic irrigation
use, and fire protection use shall be approved by the water supplier.
Said water plan must have been approved by the f ire protection district
and the appropriate health authorities. The health authorities, water
supplier (purveyor), and fire protection district will certify, prior
to the f iling of the final Plat, on the face of said water plan that
the plan is in confornnance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification cai11
be drafted on a transparency suitable for repXoduction.

j. The purveyor will also certify prior to the filing of the final plat
~ on a copy of said water plan that appropriate contractual arrangements
"x have been made with the plat sponsor for construction of the water
system, in accordance with the approved plan, and in accordance with a
time schedule. The time schedule will provide, in any case, for completion
of the water system and inspection by the appropriate health authorities ~
prior to application for building permits within the plat. The con-
tractual arrangements will include a provision holding Spokane County,
Spokane County Health District and the purveyor harmless from claims
by any lot purchaser refused a building permit due to the failure of
the plat sponsor to satisfactorily complete the approved water system.
k. The plat dedication will contain a statement to the effect that: "The
public water system as approved by County and State health authorities
x and the local fire district and purveyor will be installed within
this plat, and the subdivider will provide for individual domestic
caater service as well as f ire protection to each lot prior to sale of
each lot,"
