MEMORANDUM I
TO: Board of County Commissioners

SUBjECT: Environmental Assessment for ZE-4-74 - Residential Office to Local
Busines s .
The property is situated on the west side of Pines Road, a State highway,
between Cataldo and Broadway Avenues. Surrounding land uses include a multi- story office building to the north; a utility substation, utility offices and storage
area, and a retail store to the easC; a vacant lot and a residential lot to the south; I
and unoccupied tracts to the west.
The applicant proposed and has partially completed a garden store - nursery
facility on the site. Fencing has been installed around the holding and planting
areas. Plantings and fencing, along with paving of parking areas, will complete
the front part of the lot,

A house on the premisis has been remodeled for a sales office. Because the
remodeling and additions were not constructed with building permits with subsequent
inspections, portions may have to be redone to meet the uniform building code.
Although the structures appear quite rustic, modifications required by the building
code may significantly alter the facility.
Certain auxiliary free-standing signs on the property do not conform with the
Zoning Ordinance, and the Planning Commission staff has required their removal.
Variance hearings have been conducted to allow one free-standing sign to advertise
the premisis.

The site is situated within the urbanizing area. The zone change proposal
would not have any greater effect upon the topography, geology, biological and
botanical characteristics, atmospheric conditions and other natural development
than uses established in the immediate area. Although the present operation will
require some housekeeping measures in order to conform with the approved plot
plan, proper use of the facility would have no appreciable effect on continued
human development of the area.
Because of the scale of the project and its lack of impact on the natural
environment, I am of the opinion that an Environmental Impact Statement is not
required for the completion of the zone change action.

RESIDENTIAL OFFICE TO LOCAL BUSINESS: MAGLARAS
1 :
WHEREAS, The Spokane County Planning Commission did, after public
hearing on February 8, 1974, forward to the Board of County Commissioners a
recommendation that the Zoning Map not be changed from the existing Residential
Office classification to the Local Business classification on property described as
follows :
The North 107 feet of the East 196.08 feet of the S 1/2 of Block 76,
Opportunity in Section 16, Township 25 N. , Range 44 , E.W. M.`
Spokane County, Washington.
and,
WHEREAS, The applicant before the Planning Commission, Gus Maglaras,
did by letter dated February 13, 1974, request a hearing before the Board of County
Commissioners to present evidence and testimony in favor of their application, and
WHEREAS, The Board of County Commissioners did hold a public hearing on
March 14, 1974, to consider the recommendations of the Planning Commission and
fiestimony and evidence of the applicant and other interested parties, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described Zoning Map proposal, and the Board of
County Commissioners of Spokane County having fully considered the testimony
given, the records and minutes of the Planning Commission and all other evidence
presented and having personally acquainted themselves with the site and vicinity
in question, does hereby find:
1) That the site consists of a 21,000 sq, ft, parcel situated on the west
side of Pi nes Road between Cataldo and Broadway Avenues.
2) That the applicant proposed to construct a nursery, garden store on
the property utilizing portions of existing structures.
3) That the property is south of an office complex and southwest of a
neighborhood shopping area.
4) That the proposed use, namely, a garden store and nursery, is not out
of character with other uses established along Pines Road.
5) That appropriate provisions have been made to assure compatibility of
the project with adjoining properties through preparation of a specific
development plan.
6) That an environmental assessment of the project indicates that
sufficient mitigating measures have been incorporated into the approved
development plan,

MEMORANDUM
TO: Board of County Commissioners

SUBJECT: Environmental Assessment for ZE-4-74 - Residential Office to Local
Business.
The property is situated on the west side of Pines Road, a State highway,
between Cataldo and Broadway Avenues. Surrounding land uses include a multi-
story office building to the north; a utility substation, utility offices and storage
area, and a retail store to the east; a vacant lot and a residential lot to the south;
and unoccupied tracts to the west. ,
The applicant proposed and has partially completed a garden store - nursery
facility on the site. Fencing has been installed around the holding and planting
areas. Plantings and fencing, along with paving of parking areas, will complete
the front part of the lot.
A house on the premisis has been remodeled for a sales office. Because the
remodeling and additions were not constructed with building permits with subsequent
inspections, portions may have to be redone to meet the uniform building code.
Although the structures appear quite rustic, modifications required by the building
code may significantly alter the facility.
Certain auxiliary free-standing signs on the property do not conform with the
Zoning Ordinance, and the Planning Commission staff has required their removal.
Variance hearings have been conducted to allow one free-standing sign to advertise
the premisis.

botanical characteristics, atmospheric conditions and other natural development
than uses established in the immediate area. Although the present operation will
-equire some housekeeping measures in order to conform with the approved plot
:)lan, proper use of the facility would have no appreciable effect on continued.

Because of the scale of the project and its lack of impact on the natural
environment, I am of the opinion that an Environmental Impact Statement is not
required for the completion of the zone change action.
