This matter having come before the Examiner Committee on December 18, 1980,
and the members of the Committee present being Eldon Thomas, Chairperson,
Jane Myers and John Culler.

by the water supplier and fire protection district. Said water plan must
also have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor),- and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said wa-ter plan and certification will be
drafted on a transparency suitable for reproduction.
l' The water purveyor will also certify prior to the filing of the final plat on
a copy of said water plan that appropriate contractual arrangements have
been made with the plat sponsor for construction of the water system, in
accordance with the approved plan, and in accordance with a time schedule.
The time schedule will provide, in any case, for completion of the water
system and inspection by the appropriate health authorities prior to appli-
cation for building permits within the plat. The contractual arrangements

will include a provision holding Spokane County and the purveyor harmless
from claims by any lot purchaser refused a building permit due to the
failure of the plat sponsor to satisfactorily complete the approved water
system.
The plat dedication will contain a statement to the effect that the public
~water system as approved by County and State Health authorities and the
local fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each -lot prior to sale of each lot.
9. That conditional approval be given subject to provisions in the plat for a
public sewer system. Approval of the design of said systems must be
given by County and State Health authorities and the County Utilities
o~ Department prior to filing of the final plat. A suitable guarantee will be
required to cover the cost of providing said system in the amount as
J~ ~I~~~ Jf determined by the Public Works Department.

NOTE: The topography and soils in Block 1, Lots 4 through 13, Block
V2, Lots 5~t~ugh 11, and Block 3, Lots 7 t rough 14 of the preliminary
plat are not suitable for installation of individuat on-sifie sewage disposal
drainfields. Each of these lots shall provide its individual sewage treat-
ment facility (i.e., septic tank) which shall be connected to a community
(public) effluent collector and drainfield disposal system locafied on Block
2, Lots 14 and 15 and Block 3, Lots 1 and 2 of said preliminary. plat of
record.
Also NOTE: Thafi the remaining lots have been determined to be suitable for
on-site sewage disposal systems by the Spokane County Health District.
Prior to finalization of the plat, the sponsor shall provide covenants for
LIX review by the Spokane County Health District indicating that a Home
Owners Association will be incorporated requiring membership and financial
support of owners of all lots served by the public sewage disposal system.
The Association shall be responsible for inspections, operation and. main-
tenance of the public effluent collector and disposal system and shall
control the lots on which the disposal system is located.

11. That the preliminary plat be given conditional approval to January, 1978.
That streets be improved to standards esfiablished by Spokane County or a
bond to cover the cost of such improvements be furnished the County
Engineer. The bond may also cover the cost of "as built" plans, engineer-
ing costs, and placing of final center line monuments.
~3. That profiles of streets, cross sections, proposed grades and drainage
plan of the plat be submitted and approved by the County Engineer and
by the Planning Director before the final plat is drawn. Prior to accept-
ance of the improvements or release of bonds, a certificate by a registered
civil engineer or licensed land surveyor will be required indicating that all
improvements have been installed to the lines and grades shown on the approved construction plans. 3

I. GENERAL INFORMATION
A. History
The preliminary plat was approved by the Planning Commission in December,
1976. Two previous time extensions have been approved based on the sponsors
statement that the plat was very close to finalization. The sponsor still
indicates that virtually all of the requirements have been completed and are
waiting for final County inspection and is therefore requesting an Extension
of Time until January 1, 1982.
B. Location
Between 16th and 21st Avenue on the south side of 16th, approximately ~ mile
east of Carnahan Road.
C. Proposal
- 20 acres subdivided into 42 lots for single family residential
- Lot frontage = 50' to 235'
- Lot sizes = Approximately 12,600 sq. ft.
II. SPECIAL INFORMATION
• A. Circulation
The County Road Engineer has not recommended any new conditions. Oaly those
conditions already attached to the preliminary plat of record.

The County Engineer reports that the final construction plans must be reviewed

D. Fire Protection

5. That appropriate provisioa be made that the following described property be
held in trust until the coatinuation of the streets be dedicated or deeded: A
1' strip at the ends or edges of all streets that terminate or border the plat
boundary. (Temporary cul de sacs are required when streets terminate at the
plat boundaries.)
6. That appropriate street names be indicated.
7. 2hat appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the fiaal plat.
8. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The water purveyor will also certify prior to the filing of the final plat on
a copy of said water plan that appropriate contractual arrangements have been
made with the plat sponsor for construction of the water system, in accordance
with the approved plan, and in accordance with a time schedule. The time
schedule will provide, in any case, for completion of the water system and
inspection by the appropriate health authorities prior to application for
building permits within the plat. The contractual arrangements will include a
provision holding Spokane County and the purveyor harmless from claims by any
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will coatain a statement to the effect that the public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the sub-
divider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
9. That conditional approval be given subject to provisions in the plat for a
public sewer system. Approval of the design of said systems must be given by
County and State Health authorities and the County Utilities Department prior
to filing of the final plat. A suitable guarantee will be required to cover
the cost of providing said system in the amount as determined by the Public
Works Department.
NOTE: The topography and soils in Block 1, Lots 4 through 13, Block 2,
Lots 5 through 11, and Block 3, I.ots 7 through 14 of the preliminary plat are
not suitable for installation of individual on-site sewage disposal drain-
fields. Each of these lots shall provide its individual sewage treatment
facility (i.e., septic tank) which shall be connected to a community (public)
effluent collector and drainfield disposal system located on Block 2, Lots 14
and 15 and Block 3, Lots 1 and 2 of said preliminary plat of record.

Also NOTE: That the remaining lots have been determined to be suitable for
on-site sewage disposal systems by the Spokane County Health District.
Prior to finalization of the plat, the sponsor shall provide covenants for
review by the Spokane County Health District indicating that a Home Owners
Association will be incorporated requiring membership and financial support of
owners of all lots served by the public sewage disposal system. The Associa-
tion shall be responsible for inspections, operation and maintenance of the
public effluent collector and disposal system and shall control the lots on
which the disposal system is located.
10. That a statement be placed in the dedication to the effect that a public sewer
system will be made available for the plat and individual service will be
provided to each lot prior to sale.
11. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
12. That the preliminary plat be given conditional approval to January, 1978.
13. That streets be improved to standards established by Spokane County or a bond
to cover the cost of such improvements be furnished the County Engineer. The
bond may also cover the cost of "as built" plans, engineering costs, and
placing of final center line monwnents.
14. That profiles of streets, cross sections, proposed grades and drainage plan of
the plat be submitted and approved by the County Engineer and by the Planning
Director before the final plat is;,drawn. Prior to acceptance of the improve-
ments or release of bonds, a certificate by a registered civil engineer or
licensed land surveyor will be required indicating that all improvements have
been installed to the lines and grades shown on the approved construction
plans.
15. Conditional approval of the plat is given subject to the dedication of the
right-of-way to the public and approval of the road system in the plat by the
County Engineer.
16. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planning staff.

(1) Pursuant to the Board of County Commissioners Resolution No. 80-0418, the
use of on-site sewer disposal systems is hereby authorized. This authoriza-
tion is conditioned on compliance with all rules and regulations of the
Spokane County Health District and is further conditioned and subject to
specific application approval and issuance of permits by the Health District.
Q The owner, his heirs or successors shall join and participate in any peti-
t/ tion or resolution which purpose is the formation of a utility local im-
provement district (ULID) pursuant to RCW Chapter 36.94, as amended. The
owner, his heirs and successors shall further agree not to oppose or pro-
test any legal assessments for any utility local improvement district (ULID)
established pursuant to RCW Chapter 36.94, as amended.
Any water service for this project shall be provided in accordance with the
/ Coordinated Water System Plan for Spokane County.

(4) There are no recommendations concerning the method of sewage disposal as the
project is outside of the 201 sewer study area.
(5) Water service as approved by the Spokane County Health District and/or the
Washington State Department of Social and Health Services.
(6) Each dwelling unit shall be double plumbed for connection to future area-
wide collection systems.
(7) A dry sewer connection to the future North Spokane Sewerage System is to be
constructed. Plans and specifications for the dry sewer connection are to
be reviewed and approved by the Utilities Department prior to construction.
(8) Located within the Critical Water Supply Service Area but not within any
purveyor's district. May be serviced by an individual well owned and oper-
ated by lot owner.

A reviev of the community septic tank and drainfield plan for subject
developmient ie completed and vill be approved upon incorporating the follow-
ing detaile into the final varking draw3.ngs :
1. Drainfield sizing specifications based on two gallons per square foot . of bottom trench area; thus six gallons per lineal foot utilizing a three-foot xide drainfield trench.
2. Distribution box shall be designed to include both a center baPPle
plate and inlet pipe vhich diverts doXnward Pour inches below the liquid
level. The outlet pipesshould extend interior of the distribution
box a sutficient distance (three inches) to allov the instsllation
of a flox ad,Justment elbox. It is suggested that a metal type lid
be epecified for the distribution box rather than the aood type.
3. The compartm,ent partition wa11 within the septic tank shall.be extended
to one inch of the top oP the tank. Upon receipt and approval of the drainfield plans, which incorporate the
above changes, our department kill be able to issue a permit Por the install-
ation of such.

Since a management entity (i.e. Spokane County Utilities or Homeowner;s
Association) is necessary for assuring the maintenance and operation of the
lift station and drainPield system, it vill be essential that we have a
copy of the maintenance and operatioa agreement on file prior to signing
the final plat.
For individual lot home construction, land use/building permits may be
obtained after the licensed engineer hes approved and certified the com-
pletion of the sewer collection piping system and Spoksne County Health
District has approved the community drainfield installation.

I. GENERAL INFORMATION
A. Histor.y
The plat was originally heard and approved by the Planning Commission in
December of 1976. The preliminary plat received conditional approval to January l, 1977. In December 1977, the applicant applied for and received
an Extension of Time to January l, 1979. The applicant again asked for
an Extension to January l, 1980. The staff at this time last year reported
that the plat was relative close to finalizing the proposal. The plat
at this time, appears to be very close to finalizing, although little
progress appears to have occurred over the last year. The Sponsor is
considering selling the proposal to a knowledgeable developer to bring
the issue to a conclusion. Since the cost of the Bond is considerable,
the sponsor is reluctant to make this expenditure at this time in view of
their selling plan. The sponsor is therefore asking for an Extension of
the approval until January l, 1981.
B. Location
Between 16th and 21st avenue on the south side of 16th, 1/2 mile east of
Carnahan Road.
C. Proposal
- 20 acres subdivided into 42 lots for single family residences
- Lot frontage = from 50' to 235'
- Lot sizes = approximately 12,600 sq.ft.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has not recommended any new conditions. Only those

This proposal has been conditioned for a public sewer system.

The County Utilities Engineer reports that final construction pians must be

of the final plat for the Heather Park, First Addition development.
Our Enginee r, Mr. Chuck Simp so n, has cAmple ted al l o f the ne ce s-
sary work and we believe that in order to finalize the plat the
remaining need is the performance bonds.
tiJe have learned during the past year, that certain legal restric-
tions applying to Profit Sharing Plans, specifically the sale of debt
financed property, will cause us considerable difficulty in acting
. as developers. We therefore are now considering selling the entire
twenty acres. to a knowledgeable developer who will bring the issue to
a conclusion.
Since the cost of the Bond is considerable, we are reluctant to
make this expenditure at this time in view of our selling plan.
We ask for this time extension in order to review our ro le in
this project.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on December 20, 1978,
and the members of the Committee present being Kenneth Kennedy, Chairman,
Abby Byrne and Glenn Quigley.
B. PROPOSAL
The sponsor, Spokane Colonial Realty, Inc., is requesting approval of a
preliminary plat and zone change; Extension of time on PE-1061-76 Heather Park
First Addition and ZE-146-76, Agricultural Suburban to Single Family
Residential for subdivision of ?10 acres into 42 lots and there being present, the

C. FINDINGS OF FACT
1. That the existing land use in the area is residential.
2. That the Comprehensive Plan designa-tes this area as residential.
3. That the existing zoning of the property described in the application is
Agricultural Suburban. 4. Thafi the provisions of RCW 43.21C (The State Environmental Policy Act)
have been compl ied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.

l. Heather Park First Addition is located at the southern edge of the Spokane
Valley south of and ad,jacent to 16th Avenue and approximately 1/4 mile east
of Carnahan Road. Ttie Aroposed plat calls for 42 single family dwellings
on 20 acres.
2. The plat was originally heard and approved by the Planning Commission in
December of 1976. The preliminary plat received conditional approval to
January l, 1978. In December 1977, the applicant applied for and received
an Extension of Time to January 1, 1979. The sponsor is now requesting an •
additional Extension or Time to January 1, 1980.
3. The staff has receiveci a copy of the final plat of Heather Park First
.Addition for checking. It appears that the sponsor is relatively close
to filing and finalizing this proposal. An Extension of Ti-me should allow
him the time to receive final approval,

Planning Commission Recommendation: AAprove for the followinv reasons and subiECt

1. This proposed plat is within the Metropolitan area.
2. This proposed plat is a continuation of similar suburban density plats
listed: HeathEr Park Addition, Valley View Hi lls Addition, Sloan's
Addition and the recently approved Riegel Heights.
The lower density ownerships to the south and west arE moderately buf-
fered by topographic relief and some timber.
4. The proposed plat will have ample dedicated roads, power, water,
fire protection, and two-thirds of this plat will have a public sewer
system.
5. There is no agricultural value for this land that is presently vacant
with sparse timber and some rock outcroppings.
B. CONDITIONS:

1. Reference: Map of subject, scale 1" = 100' by Simpson, dated November
10, 1976 and revised December 2, 1976.
2. Washington Water Power Company has indicated it will serve domestic use
water to the proposed plat upon cornpletion of contractual agreements
with the sponsor. We recommend that:
a. Water service also provide for fire protection flows. '
b. Evidence that all contractual agreements are concluded
prior to signing the final plat.
3. Sewage disposal is proposed by two methods.
a. The topography and soils are suitable in Block 1 Lots 1,2,3 and
Block 2 I.ots 1,2,3,4,12 through 15, and Block 3 Lots 1 through 6
for iastallation of individual on-site sewage disposal systems.
However, Block 2 Lots 14,15 and Block 3 Lots 1,2 are to be re-
served for a community drainfield so long as the Health Officer
shall determine that such facility is required.
b. The topography aad soils in Block 1 Lots 4 through 13, Block 2
Lots 5 through 11, and Block 3 Lots 7 through 14 are not suitable
for installation of individual on-site sewage disposal drain-
fields. Each of these lots shall provide its individual sewage
treatment facility (ie;septic tank) which shall be connected to
a commwnity (public) effluent collector and drainfield disposal
system located on Block 2 Lots 14,15 and Block 3 Lots 1,2.
The plans specifications for the effluent collector piping system
and drainfield shall be prepared by a licensed engineer under
the advisement of Spokane County Health District.
c. A Home Owners Association shall be incorporated requiring membership
and financial support of owners of all lots served by the public
sewage disposal system. The Association shall be responsible
for inspections, operations and maintenance of the public effluent
collector and disposal system and shall control the lots on which
the disposad system is located.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW,
requires all state and local governmental agencies to consider environmental values
both for their own actfons and when licensing private proposals, The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. ThE
purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Please answer questions as "yes" or "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the dearee of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers are required, or where you
believe an explanation would be helpful to government decision-makers, include your
explanation in the space provided, or use additional pages, if necessary. You should
include references to any reports or studies of which you are aware and which are
relevant to the answers you provide. Complete answers to these questions now will
help all agencies involved with your proposal to undertake the required environmental
review without unnecessary delay.
