Authority to consider such a request exists pursuant to Section 4.25 of the Spokane County Zoning Ordinance. PROJECT LOCATION: Generally located approximately 1/4 mile east of Pines Road and at the SW corner of Lenora Drive and Vercler Street in the SW 1/4 of Section 27,Township 25 N., Range 44 EWM. PARTIES OF RECORD: None PUBLIC HEARING: After examining all available information on file with the application and visiting the subject property and surrounding area, the Zoning Adjustor conducted a public hearing on June 21, 1989 and rendered a written decision on July 7, 1989 FINDINGS OF FACT AND CONCLUSIONS 1. The proposal is described above. 2. The adopted Spokane County Future Land Use Plan designates the area of the proposal as Urban. The proposal uses are generally consistent with this category. 3. The site is zoned R-1,which allows the proposed use upon approval of this application. 4. The existing land uses in the area of the proposal are predominantly single-family residences and vacant land, both of which are compatible with the proposal. 5. The proposal is exempt from the provisions of Chapter 43.21C RCW pursuant to WAC 197-11-800(6)(b). CASE NO. VE-25-89 SPOKANE COUNTY ZONING ADJUSTOR PAGE 2 6. The applicant has been made aware of the recommendations of various county/state agencies reviewing this project and has indicated he can comply with those recommendations. 7. No one appeared to oppose the proposal. No written comments adverse to the proposal have been received. 8. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. 9. The applicant presented numerous examples of other homes and garages which have less than the forty-five (45)-foot setback in this same area and zone. 10. The applicant indicated the proposed construction will not intrude into the clear view triangle area which has been established for traffic safety. 11. The applicant agreed that no other visual obstructions, e.g., fencing or landscaping, would be placed in the front yard along the flanking street. DECISION AND ORDER From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal, subject to compliance with the following: CONDITIONS OF APPROVAL I. GENERAL The following conditions shall apply to the applicant,owner and successors in interest and shall run with the land. II. PLANNING DEPARTMENT 1. The applicant develop the property in conformance with the site plan submitted to the file. 2. Only see-through fencing be established along the front yard of the flanking street, Vercler Road. III. DEPARTMENT OF BUILDING & SAFETY The issuance of a building permit by the Department of Building and Safety is required. VI. ENGINEERING DEPARTMENT It is required that,prior to the release of a building permit, the site plan be reviewed to assure that the clear view sight distance triangle will not be obstructed by the proposed structure.
