The proposed action is the annexation to Consolidated Irrigation
District No. 19 of a body of land pursuant to a petition for
annexation which has been filed by the landolvners thereof with
the Board of Directors of the district. `

The lands covered hy said petition for annexation and by this '
noti ce of i ntenti on i s descri bed as fol 1 aws :
Sunnyvale 1lddition, accordinq to plat thereof recorded
in Volume 13 of Plats, page 50; Peplinski's First /lddition
according to plat thereof recorded in Volume 13 of Plats,
page 48; and Govt. Lots 1 and 2 in Section l, Township 25
illorth, Range 44 E.W.M. lying north of the canal right of
tvay except the platted portions knovfn as Peplinski's First
Addition and Sunnyvale Addition, and Except Vlellesley Avenue.
The aoplicable statute qoverning the annexation of lands to an
i rri qation di stri ct and pursuant to whi ch sai d petition has been
f7 1 ed wi th the di stri ct, and rihi ch sai d statutes wi 1 1 be fol 1 owed
, b,y the district in further proceedings pertaining to said petition
and said proposed annexation, is RCtJ 87.03.560 et seq.
A declaration of non-significance Iias been entered by the responsible
official oF Consolidated Irrigation District "•lo. 19 nertaining to the
annexation of said lands to the district. This declaration is based
on decl arati on of non-si gni fi cance entered by Spokane County i n
connecti on ivi th the approval of pl ats for SunnJlvale llddi ti on and
Peplinski's First /1ddition, and upon an environmental check list
filed with the district relatinq to that portion of said lands
proposed to be annexed which is owned by T. D. C. Inc. and which
as yet is not platted.
Tlie reasons for the proposed annexation are that the 58-acre body
of lands is adjacent to lands already in tlie district and are
loc7ically within the district's service area. Said lands are
ad,iacent both to the Boundaries of Consolidated Irrigation District
and to those of Trentvrood Irrigation District, but Trenttiood Irrigation
District has iridicated that it has no desire or intention to annex
sai d 1 ands i nto that di stri ct. Annexati on of tlli s tract of 1 aiid

The 1 ands i n clues ti on were not made apart of the di stri ct at the
time of the di stri ct' s ori gi nal organzati on because these 1 ands ,
1 i e north of the ol d canal ri glit of way ar1hi ch consti tuted thE northerly
1 i ne of the 1 ands be i ng served by the ol d gravi ty di stri buti on systern
and these lands were not adaptable to Qravity irriqation. These lands
are in need of water service in order to permit their development.
Qy tlie construction of additional facilities needed to provide the
additional puinoing capacity requirecl at that location they may be
served basically as part of the district's existing distributiori system.

A. REASONS.
1. The proposal as submitted is a logical extension of the existing develop-

B. CONDITIONS:
1. That the p1.at be designed as indicated on the preliminary plat of record
and/or attached sheets as noted.

water plan must also have been approved by the appropriate health
authorities. The health authorities, water supplier (purveyor)
and fire protection distract will certify, prior to the filing of the
final plat, on the face of said water plan that the plan is in con-
formance with their requirements and will adequately satisfy
their respective needs. Said water plan and certification will be
drafted on a transparence suitable for reproduction.
The water supplier (purveyor) will also certify prior to the filing of
the final plat on a copy of safd water plan that appropriate con-
tractual arrangements have been made with the plat sponsor for
construction of the water system, in accordance with the approved
plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the watEr system and
inspection by the appropriate health authorities prior to application
for building permits within the plat. The contractual arrangements
will include a provision holding Spokane County and the water
supplier (purveyor) harmless from claims by any lot purchaser
refused a buildfng perrnit due to the failure of the plat sponsor t~
satisfactorily complete the approvEd water system . -
The plat dedication will contain a statement to the effect that the
public water system as approved by County and State Health
authorities and the local fire district and water supplier (purveyor)
will be installed within this plat, and the subdivider will provide
for individual domestic water service, as well as fire protection,
to each lot prior to sale of each Iot.
Note: The Spokane County Health District has determined that the
soil conditions in the plat are suitable for on-site sewage disposal
systems on each lot.
No subsurface drainfield shall be installed within 150 feet in any
direction from a linE extending from a beginning point located on
the common boundary of Lots 16 and 17, Block 1 and 50 feet east
of the west end of said boundary; the line extending northerly from
beginning point a distance of 15 feet and parallel to the west
boundary of Lot 17, Block 1. (Note that this will provide for two
well holes 15 feEt apart and have minimum impact on lots within
the proposed plat as well as similarly sized lots whfch may be
proposed in the unplatted area to the east of the well site).

10. That streets bE irnproved to standards established by Spokane
County or a bond to cover the cost of such improvements be
furnished the County Engineer. The bond may also cover the cost
of "as built" plans, engineering co sts , and placing of final center

11. That profiles of streets, cross ections, proposed grades, and
drainage plan of the plat be submitted and approved by the County
EnginEer and by the Planning Director before the final plat is drawn .
Prior to acceptance of the improvements or release of bonds, a
certificate by a registered civil engineer or licensed land surveyor
will be rEquired indicating that all improvements have been installed
to the lines and grades shown on the approved construction plans.
12. Conditional approval of the plat is given subject to the dedication
of the right of vvay to the public and approval of the road system
in the plat by the County Engineer. •
13. That a statement be placed in the dedication prohibiting individual
lot access to Wellesley Avenue.
14. That a name be indicated before the final plat is filed; such name
to be approved by the County Assessor and the Planning staff.
C . STAFF ENVIRONIVIENTAL REVIEW:
As required in VIIAC 197-10-320, thc staff of the County Planning Depart-
ment reviewed the environmental checkiist submittQd by Dani e1 B. Clark
on behalf of Lawrence Peplinski for a preiiminary subdivision called
Peplinski's First Addition. The proposal is located approximately in the
Northeast 1/4 of Section 11 Township 25 N., Range 44, E.W. M. and
lies directly south of and adjacent to Wellesley Avenue. The proponent
is rG-questing to subdivide approximately 14.5 acres into 37 lots for single
f-ami-ly dweliings, thereby creating a gross density of about 2.5 units
per acre . The terrain is relatively flat and the land is in active
cropland.
The staff review has identified four potential areas of environmental
impacts. First, and common to all subdivisions is the increase in motor
vehicle traffic and all the effects asscciated therewith. These would

include such impacts as increased air po.llution specifically suspended parti-
culates from unimproved streets, increased noise, and increased public safety
hazards `.-om traffic.
A second potential environmental impact area considered was the , -increased
demand on public services and utilities. This would include such factors as
increased requirements for police and ffre protection, provision of additional "
school, park, and recreational facilities and roads. This would also include
such impacts as as socfated with extension of utility lines (power, natural gas,
telephone) and the provision of suitable Iong term sewerage, domestic water,
storm water runoff, and solid waste disposal systems.
A third potential environmental impact revealed by the staff evaluation involves
the subsurface injection of sewage effluent and storm water runoff. This waste
water placed at a depth will percolate downward toward the aquifer rather than
evaporating back into the atmosphere as under natural conditions. A portion of
the contaminants will likely be filtered out of this waste water, but the resulting
quality has not been determined as yet. About 12 acre feet of waste water will
be injected beneath the soil surface, S. 5 acre feet of which will be septic tank
effluent.
The final potentially significant impact is the conversion of approximately
14.5 acres of active cropland into single family use.
The conclusion of this environmental checklist review is that no significant
environmental impacts will likely result from the proposal if the specified miti-
gating mcasure are adopted. Therefore, it is recommended that aDeclaration of
Non-Sig. 1ficance be issued and an environmental impact statement not be
required e
D. ZONING RECOMMENDATION:
Planning Commission Recommendation: Approve Peplinski's First Addition as
indicated on the preliminarv plat of record to thE Sinale Familv Residegtial (R-1)
Zone classificatinn upon the filinq of the final plat.
REASONS:
1. The lots in the proposed plat have been designed to accommodate single
family dwellings with a proposed density of 2.5 units per acre.
2. The Plannfng Commission has been routinely upgrading similar residentfal
. plat proposals in the Spokane Va11ey to the Single Family Residential
(R-1) Zone.
3. The staff is of the opinion that none of the lots within the proposed plat
have disadvantaged relationships which would warrant duplex zoning.
