WHEREAS, this being the time set by the Board of County
Commissioners of Spokane County to conduct a public hearing
concerning the above entitled matter; and
tdHEREAS, the Board of County Commissioners of Spokane County
having received the recommendation of the Spokane County
Planning Comrnission concerning subject matter, said re-
commendation set forth in the Planning Commission's minutes
' dated November 16, 1977; and
WHEREAS, the Board of County Commissioners did, at the
request of Mrs. Shirley A. Grumbly, North 1226 University Road,
Spokane, Washington, by Resolution No. 77-1423 adopted by
the Boarcl on December 8, 1977, give Notice of Public Hearing
concerning the reactivation of subject preliminary plat
application; and
WHEREAS, the Board being fully advised in the premises did
determine, based upon evidence introduced at this hearing
that the original plat applicatian had been withdrawn by the
sponsor, as set forth in that certain letter to the Spokane
~ County Planning Commission, dated November 9, 1976, attached
hereto and incorporated herein by reference; said letter being
a part of the Commissioner's Proceedings of November 18, 1976,
as document #14740.
BE IT THEREFORE RESOLVED by the Board of County Commissioners
of Spokane County, Washington, that the Board does hereby
conclude to decline jurisdiction and does request the sponsor
to again initiate plat application through the Spokane County
~ Planning Department for subsequent hearing by the Spokane
' County Planning Commission and recommendation to this Board
. of County Commissioners.
BE IT FURTHER RESOLVED that r1rs. Grumbly's check in the
amount of $25.00, representing the appeal fee, be returned.

PRELIMINARY SUBDIVISION ATJD ZGNE CLASSIFICATION UPGRADING
PE-1046-76 WYATT ADEITIOIV NO. 1: WYATT
ZE- 118-76 AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL AND,/OR TWO
FAMILY RESIDENTIAL
Planning Commission Recommendation: Approve PE-1046-76, Wyatt Addition No. 1,
subject to the foilowing conditians: (Vote was unanimous.)
A. REASONS:
1. That the proposed density of the plat in question would be appropriate
for ~he area.
2. 'I'he area has developed in single family and two family uses.
B . CONDITIUNS:
1. That the plat be designed as indicated on the preliminary plat of record
and/or attached sheets as noted, and that the 20 foot strip of land as
shown on the preliminary piat of record be excluded.
2. That a statement bE placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdividEd for the purposes of creating additional lots or
building sites without filing a replat.
3. That the plat provide for right of way width for streets as indicated on
the preliminary plat of record.
4. That appropriate provision be made that the following described property
be held in trust until the continuation of the streets be dedicated
or deeded: A 1' strip at the ends or edges of all streets that terminate
or border the plat boundary. .(Temporary cul de sacs are requires when .
streets terminatc at the plat boundaries.)
5. Tha t appropriatE street names be indicated.
6. Th~ L appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planninq Department and the utility
companies. Written approval of the easements by the utility company
must be received prior to the submittal of the final plat.

7. That a plan for water facilzties adEquate for firE protection be approved
by the water supplier and ffre protection district. Said water plan must
also have beEn approved by the appropriate health authorities. The
health authorities, water supplicr (purveyor), and firc protection district
will certify, prior to the filfng of the finai plat, an the face of said water
plan that the plan is in conformance with their requirements and will
adequately satisfy their respective needs. Said water plan and certifi-
cation will be drafted on a transparency suitable for reproduction.
The water supplier (purveyor) will 31so certify prior to the filing of the
final plat on a copy of said water plan that appropriate contractual
arrangements have been made with the plat sponsor for construction of
the water system, in accardance with the approved plan, and in accord-
ance with a time schedule. The time schedule will provide, in any case,
for completion of the water systEm and inspection by the appropriate
health authorities prior to application for building permits within the plat.
The contractual arrangements will include a provision holdfng Spokane
County and the water supplier (purveyor) harmiess from ciaims by any
lot purchaser refused a buildfng permit due to the failure of the plat
sponsor to satisfactorily cocnplete the approved water system.
. The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities and
the local firE district and water supplier (purveyor) will be installed
within this plat, and the subdivider will provide for individual domestic
w-iter service as well as fire protect.fon to each lot prior to sale of each

NOTE: The Spokane County Health Distrfct has determined that the soil

C . STAFF ENVIRON'MENTAL REVIEW:
Aa required in VltAC I97-10-320, the staff of the County Planning Department
reviEwed the environmental checklist submitted by David E. Vllyatt for a
preliminary subdivision of Wyatt's Addition No. 1. The proposal is located
approximately in the NW 1/4 of the NVIT I/4 of Section 161 Township 25 N. ,
Range 44, E.W W. M, just north of and fronting on BoonE Avenue about 400 feet
west of Pierce Road. The proponent requests to subdivide approximately 7.4
acres of land into 15 Iots for sfngle family (7 lots) and duplex (8 lots) use,
thereby creating a gross density of about three (3) units per acre. The site
is located on relatively f.lat to gently sloping terrain currently covered by
productive pasture vegetation.
The staff review has identified four poteniial areas of environmental impacts.
First, and common to all subdivisions, is the increase in motor vehicle traffic
and all the effects associated therewith . These would include such impacts
as increased air pollution, specifically suspended particulates from unim-
proved streets, fncreased noise, and increased public safety hazards from
traffic. ~
A second potential environmental impact area considered was the increased
deman~ on public services and utilities.This would include such factors
as increased requirements for police and zire protection, provision of addi-
tional school, park, and recreatfonal facilitiES, and additional maintenance
requirements on all county facilities and roads. This would also include
such impacts as associated with extension of utflity lfnes (power, natural
gas, telephone) and the provision of suitable long term sewerage, domestic
water, storm water runoff, and solid waste disposal systems.
The third potcntia2 environmental impact revealed by the staff evaluation
' involves the subsurface injection of sewage effluent and storm water runoff.
This waste water placed at a depth will percolate downward toward the
aquffer rather than evaporating back fnto the atmosphere as under natural
conditions. A portion of the contaminants will .tikely be filtered out of this
waste water, but the resulting quality has not been determined yet. A total
of about si.x (6) acre-feet per year of waste water will be genErated by this
proposal, three and one half (3.5) acrE-feet of which will likely be sewage
effluent.

The final potential area of environ:nental impact is the trans'tion of land from
an active agricultural use to suburban residential. The 7.4 -3cre site is
currently used as pasture gr: zing land but the proposal will :hange this to
single family and two family residential use at a gross densLy of three (3)
units per acre.
The conclusion of this environmental checklist review is 1-hat »o significant
environmental impacts will likely result from the proposal. Th erefore, it
is recommended that a Declaration of Non-Significance be issued and an
Environmental impact statement not be required.

A check ind.icates scme other property owmers adjacent to and i.n
the near vicinity of PE-1046-76 failed to receive any notification.
We are the owners and residents of approx:ilna.te]~y five acres on the
corner of Pierce Road and Loone Avenue. This property is in the
name of Mrs. L~lenzel (nee Ellen Rodell).
At this time, we think the plans PE-10146-76, Wyatt Addition #1 and.
ZE-118-76, Agricultural to Single Famil,y Re sidential anci/or Twro-
Familjn Re sidential pre sent s the possibility of a population dens ity
too great to adequate],y be served by only one dead-end street.
In addition to egress and ingress problems, the 23 proposed living
11Tl1 ts coul.d create serious polution problems by the addition of the
necessary concentration of septic tanks.
We urge the Spokane County Planning Corrrmission to derq the request
for Subd.ivision and Zone Reclassification as presented.
It wrould seem a plan more coi-apatible with the area, both ecological%y
and traffic-wise, would be to lirni.t the Subdivision to somethixig like
seven s ingle f ami],y dwellings.

I hereby withdraw my application for the above mentianed zone change.
Ttxe plats and plans which were suggested by the county planning office
were followed by us as closelq as possible.
The final decision passed down by the Planning Commission, however,
so widely disagreed with our original piat, that we have chosen to
abandon the entire project.
The appelate hearing before the Board of County Comnissioners which
was scheduled for November 12, 1976, has also been cancelled.

16. Tom Mosher of the Planntng Department's Staff reported on:
I. The recently completed contract with National Heritage, Inc., Pullrrian,
Washington, which pulled together extsting lnfocmation on the historlcal and
archaeologlcal resources of the County.
2. The Hlstorical Preservation Committee of the junlor League where CLty
and county progress were discussed. An addittonal toplc of discussion was an
upcoming proposal to the CLty and County qovernments to work toward
establtshment of a Ctty-County Landinarks Commission.
3. A currently developlag proposal to seek, wlth a cooperative agreement
wlth the CLty of Spokane, A 50-50 matchtnq gcant from the State's Offlce of
Archaeology and Historlc Pressrvation to Hire a Preservation Planner and
subsequently expand the preservatlon actlvtties within the County.
17. Mr. Fred Dayharsh, Dlrector of Planning., brought to the Planning Commtssion
ttention a need to set ahead the ftilnq date for prellminary plats and zone changes. An
amendrnent to the Zoninq Qrdlnance and a resotutton by the County Commtsslore
will be needed tomake thts chanqe [n poltcy. A motion was made to direct the
staff to recommend amendments as to the cut-off date for zone changes and
plats, also all fteld work ls to be done prlor to the fiitnq of the prellminary
zone changes and plats ln the Planning Lepartment Offtce. (Motton by Af:rs.
Rawlings, seconded by Mr. Thomas. Vote was unanlmous.)
18. The members of the Plann(ng Commtssion dlscussed the revlew pertod of the
Five-Mile Draft EIS. A motion was made by 1Vfrs. Rawltnqs and seconded by
Mrs. Byrne that an extenston af tlme of the comment perlod of the Draft EIS
for Flve-Mlle be extended to December 1, 1977. The Staff was dtrected to
write a letter to the Clty to that effect. It was requested that a CLty Staff
member be present at further discussion. Nrs. Rawtlnqs was concerned about
not gettinq recommendations up fcom the Coordtnating Commtttee. It was sugges
ted that on Frtday's Planning Commtsston hearing that Staff and Plann[ng
Commtsston member couid have some observation on that [tem. Mr. McCoury
agreed that it could be done.
Mr. Main excused himself from dlscusston and votlnq on Items No. 6 and 11, due
to a posslhle con#lict of interest.
