IN THE MATTER CONCERNING
ZONE CHANGE - ZE-119-732 COMMISSIONERS' DECISION
AGRICULTURAL TO CONNERCIAL -
DOUGLASS
This being the time set by the Board of County Commissioners
to render its decision concerning the request of Harlan Douglass,
East 13516 Sprague;Avenue, Spokane, Washington, for the above
zone change, and
The Boaxd having received the recommendations of the Planning
Commission contained in the Commissionts minutes of July 20, 1973,
and
The Board having conducted its own hearing on August 20, 1973,
at the request of Harlan Douglass and after visiting the site
and reviewing the testimony9 and
The Board being fully advised in the premises did determine to
disagree with the recommendation of the S?okane County Planning
Commission as set forth in the Commission s minutes of July 20,
1973, which denied the subject zone change, and instead approved
the application for zone change, Agricultural to Commercial.
The Board directed the Planning Directar to piepare Findings
and Order setting forth this action taken by the Board for
signature at a later date.

FINDINGS AND ORDER REGARDING ZONING MAP PROPOSAL, ZE-119-73 - DOUGLASS
WHEREAS, The Spokane County Planning Commission did, after public
hearing on july 20, 1973, forward to the Board of County Commis sioners a
recommendation that the Zoning Map not be changbd from the existing Agricultural
classification to the Commercfal classification on property described as follows:
The West 143 feet of the East 1, 221 feet of the NE 1/4 of the NE 1/4
lying north of the C. M.&St. P. Ry right of way in Section 22 , Townahip
25 N. , Range 44, E.W.M., Spokane County, Washington.
and,
WHEREAS, The applicant before the PlanninqCommission, Harlan D. Douglass,
did by letter dated July 24, 1973, request a hearfng before the Board of County
Commissioners to present evidence and testimony in favor of their application, and
0 WHEREAS, The Board of County Commissioners did hold a public hearing on
AugusC 20, 1973, to consider the recommendations of the Planning Commission and
testimony and evidence of the applicant and other interested parties, and
WHEREAS. At said hearing opportunity was afforded those favoring and those
opposing the above-described Zoning Map proposal, and the Board of County Com-
missioners of Spokane County having fully considered the testimony given, the
records and minutes of the Planning Commfssion and all other evidence presented
and having personally acquainted themselves with the site and vicinity in question,
does hereby find:
1) That the present Comprehensive Plan indicates property in this
vicinity between Sprague Avenue and the railroad tracks to the south
to be appropriate for commercial use.
2) That properties in the vicinity have generally been approved for
Commercial zoning, including adioining propertfes to the east and
west.
3) That it would be improper use of zoning authority to allow the
Commercial Zone only for selected uses within the classification or
to reiect it particularly because of a particular proposed use which is
one of the regularly permitted uses within the classification. If
taverns are not generally suitable at locations where the Commercial
Zone is suitable, then the OrdinBnce itself should be changed.
NOW, THEREFORE, The Board of County Commissioners does conclude that the
above-described property should be reclassified to the Commercial classification and
does hereby order that an appropriate resolution for that purpose be prepared; such
resolution to specify that development of the property be in substantial conformance
to the site plan dated june 18, 1973 , and subiect further to the following conditfons:

1) Dedication and improvement to Spokane County standards of the
South 60 feet of the advertfsed property for right of way. ('The
applfcant would be obligated to improve Second Avenue from the
advertised property to Blake Road prior to the issuance of a building
permit for cons truction fronting on Second Avenue.)
2) Access to Che project shall be approved by the Spokane County
Engineer's Office.
3) Landscaping along Sprague Avenue shall be installed in accordance
wi,th the sfte plan dated June 18, 1973, on file with the application.
Shrub plantings within the landscape strip shall be of a species
which will not attafn a height of more than three feet. An automatic
sprinkler system shall be installed to serve the landscape strip.
4) Advertising sighs for the advertised property shall conform to
Sections 4.09.125-1, 3, 4, 5, and 6 of the Spokane County Zoning
Ordinance and shall not exceed twenty (20) feet above the average
elevation of the finished grade alonq the front of the buildfngs (Local
Business Zone standards). Parking lot lighting shall be of low
intensity and shall be designed to confine illumination to the site.
5) Installation of fire hydrants in accordance wirh the requfrements of
the Spokane Valley Fire Marshal.
