Commisaioner Allen called the meeting to order. Comtnissi.oners Allen aud
Christensen were present. Commissioner Parsons waa ill. Chairnan Allen asked
Mr. Huggins to brief the Board.
Mr, Kuggins informed the Board that the location is on Broadway and Sullivan
Road. The existing zoning is two-family residential which was established on
February 23, 1954• The proposed zoning was for local business with the proposed
zoning for a grocery store.
Mr, Howard Anderson} attorney for Kevin Kummer, came before t,he Boa,rd. He
explained that at the autset of thia whan they went before the Board in December
they indicated that they had found out that the property immediately to the west
was not zoned multi-faurily. When the hearing was before the Board that involved
the property to the north the developer took out a piece of property to the
north and the west is still agriculture. At the hearing before the Planning
Commission the PlaYUUng Commission cU.d find this property would be properly 2oned
Residential Office. As the attorney for Mr. Kumaner and in view of the fact that
the property to the North is not zoned freeway camneresal he ie asking the Board
to zone Mr. Kummer's property Reaidential Office.
Cammissioner Allen asked Mr...Neal, the Chief Civil Deputy from the Prosecutors
office, if there was any legal questions about this Board granting the zone
cnange.
Mr. Neal replied that this was within the Board'e authority.
Commissioner Allen asked if there was anyone present that wa.s against the
propased zone change.
Nlr. Richard Becker, North 924 Ravelli Drive, came before the Board. He was
opposed to local business zone but he ia not against residential office zoning
bn,it he would like to knaw what kind of offices will be constructed.
Corrmrissioner Allen stated tnat there are no plans as of yet but that ar~ythin,g
that ia built must be first appraved by the Planning Comcnission.
Mr, Hugons spoke to Mr. Becker explaining in more detail the residential
office zone.
- Mr. Kuggins then spoke in regard to an environlaental impact statement for
the area. The proposed residential office zoning would be compa.tible with the
residences. The landscaping that is required in residential office zoning wauld
make any project campatible with the residencee that are now in the area.
The ded,ication of rzght of way on Sullivan Road was discussed by the Board.,
• Mr, Anderson and Mr, Huggins.
Comi.ssioner Christensen maved that the residential office zoning then be
apprOved.
Comni.ssioner Allen said that the motion had been made and seconded that the
matter ZE-145-73 relative to zoning be zoned residential office, the motion carried
a.nd was approved with the condition noted subject to the right of way dedi.cation
and also no Ersd.ronmental Imrpact Statement will be aecessazy.
Commissioner Allen ad3rnumed the meeting.

ANAI.YSIS
The advertised property is loaated on the northwest corner of Broadway
and L;ullivan. The applicant propo se s to construct a convenience
grocery store on the site.
The staff is of the opinion that the advertised property is inappropriate
for Local Business Zoning because:
1. The Generalized Comprehensive Plan does not indicate that the
advertised area is appropriate for nefghborhood shopping
facilities. The Comprehensive Plan contemplates that neighborhood
shopping facilfties will be accommodated at Sprague and Sullivan.
2. The staff is oi the opinion that O'ullivan Road frontage properties
between the Freeway Commercial faeilfties oriented to Interstate
90 and Commercial properties on aprague Avenue are appropri.ate for
Residential Office and Multiple Family Suburban uses. The staff
is concerned that approval of this request would establish a
precedent for business Zoning on Sullivan Road.
3. The staff is of the opinfon that adequate neighborhood shoppitig
facilitie s are zoned and provided at Sprague and Sullivan approxi -
mately one -half mile south of the adverti sed property.
