referred to as the "Platter" and SPOKANE COUNTY, a polita.cal
. sub-division of the State of Washington, having offices for
the transaction of business at West 1116 Broadway, Spokane,
Washington, 99201, hereinafter referred to as the "County",
jointly hereinafter referred to along c,rith the Platter as
the ,~Parties .
~ W I^1 N E S S E TH:
WHEREAS, the Board of County Commissioners of
Spokane County pursuant to Chapter 58.17. R.C.W. has the
legal obligation to approve sub-divisions and in so doing
shall determine if appropriate provisions are made for
public health, safety and general welfare including drainage .
ways, and .
WHEREAS, the Plattez is desirous of platting that
parcel of property commonly known as Wallace First Addition
and in conjunction therewith has designed a flood plain
drainage area through'a portion of said plat; and
WHEREAS, in conjunction caith the approval of said
plat, the Board of County Commissioners is desirous of

insuring that all owners of parcels within said plat are
made aware of the f act .that the f lood plain area wi 1,1 not
under any circumstances be maintained by Spokane County and
further that Spokane County will in no way be responsible
for ingress or egress- across or over the f lood plain area;
NOW, THEREFORE,.in consideration of the mutual
covenants contained herein, the parties do mutually agree as
follows:
l. That the Platter agrees that the County shall
have no obligation of any kind or nature whatsoever to con-
struct, maintain or repair that flood plain area shown on
the face of that parcel of property to be platted as Wallace First Addition, located within the County of Spokane, State
of Washington, a copy of said proposed plat, attached hereto .
as Attachment A, and incorporated herein by reference.

2. Platter further agree,s that Spokane County
will not be held liable for any claims, actions, damages or
injuries of any kind or nature whatsoever by or to any and
all persons.or property which damage or injury arises out of
or is in any way connected with the'construction, maintenance,
repair or obstruction of the flood plain area as referenced
in paragraph'l hereinabove.'
3.- Platter further agrees that Spokane County
will have no obligation of any kind or nature whatsoever to

construct, provide, or maintain any right of way or passage
way as a means of ingress or egzess over and across that
flood plain area as described in paragraph 1 hereinabove.
4. It is further agreed by the Platter that the
provisions of this agreement shall be binding on Platter,
their heirs and assigns,- and to any other person who shall here-
ina-fter acquire any title or interest to the property to be
platted as Wallace First Addition located in the State of
Washington, County of Spokane, as described in Attachment A. IN WITNESS WHEREOF, the parties her-eto have caused
this agreement to be executed on the day and year set forth
hereinabove.

Planning Commission Recomme ndation: Approve Wallace First Addition for the
followinQ reasons and subiect to the followinq conditions. (Vote was Unanimous.)
A. RFASONS: 1. ThE proposal is a logical extension of the existing development in the
neighborhoo d .
2. The Planning Commission has bEen routinely approving similar proposals.
B. CONDITIONS:
1. That the plat be designed as indicated on the preliminary plat of record
and/or attached sheets as noted o
2. That a statement be placed in the dedication to the effect that: no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of cre3ting additional lots or
bui';:~ng sites without filing a replafi.
3. That the plat provide for right of way width for..atreets as indicated on
the preliminary plat of record.
4. That appropriate provision be made that thE following descrfbed property
be held in trust until the continuation of the streets be dedicated or
deeded: A 1' strip at the ends or edges of all streets that terminate or
border the plat boundary. .(Temporary cul de sacs are required whEn
streets terminate at the plat boundaries.)
5. That appropriate street name be indicated.
6. That appropriate utility easements be indicated on copies of the approved
preliminary plat for di stribution to the Planning Department and the
utility companies. Written approval of the easements by the utility
company must be recefved prior to thE submittal of the fi.nal plat.
7. That a pla for water facilities adequate for fire protection be approved
by the water supplier and fire protection district. Said water plan must

also have been approved by the appropriate health authorities. The
heaIth authorities, water supplic:r (purveyor), and fire protection district
wi.11 certify, prior to the ffling of the final plat, on the face of said
wz.ier plan that tha plan is in conformance with their raquiremants and
wiiz adequately satisfy thc;ir respective needs. Said water plan and
certification will be drafted on a transparency suitable for reproduction.
The water supplier (purveyor) will also certify prior to the filing of the
final plat on a copy of said watar plan that appropriate contractual
arrangements have been made with the plat sponsor for construction of
the water system, in accordance with the approved plan, and in accord-
ance with a time sehcdule. The time sehedule will provide, in any case,
for completion of the waLer system and inspection by the appropriate
health authorities prfor to application for building permits within the
plat. The contractual arrangements will include a provision holding
Spokane County arid `he water supplier (purveyor) harmless from clafms
by any lot purchaser refused a building pc:rmit due to the failure of the
plat sponsor to satisiactorily complete the approved water system.
The plat dedication will contain a statement to the affect that the public
water system as approved by County and State Health authorities and the
local fire district and vaater supplfer (purveyor) W#11 be installed within
this plat, and the subdividar will provide for individual domestic water
as well as fire protection to each lot prior to sale of each lot.
Note: The Spokane County Health District has determined that the soil
conditions in the plat are suitable for on-site s~ewage disposal systems
on each lot.
8. Trlat a certificate of title ba furnished the Planning Department prior to
the ffling of the final plat.
9. That the preliminary plat be given conditianal approval to
December 1, 1977.
10. That streets be improved to standards established by Spokane County or
a bond to cover the cost of such improvements be furnished the County
Enginear. The bond Ynay also cover the cost of "as built" plans,
engineering costs, aiid placing of final centerline monuments.
11. That profiles of streats, cross sections, proposed grades, and drainage
plan of the plat be submifited and appravad by the County Engineer and
by the Planning Director before the final plat is drawn. Prior to accept-
ance of the improvements or release of bonds, a certificate by a
registered civil engineer or licensad land surveyor will be required

right of way to the public and approval of the road system in the plat by
teh Counfiy Engineer. That the temporary turnaround across from Lot 1
Block 1 be eliminated and that the developer open and improve Girard Road
Road between llth Avenue and 12th AvenuE; that the easterly five (5)
fE :J. of Lot 1 Block 1 be dedicated for the widening of Girard Road.
13. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Planning staff. f
C. STAFF ENVIRONMENTAL REVIEVI.%:
As required in WAC 19 7-10-32 0, the staff of the County Planning Lepartment
reveiwed the environmental checklist submitted by Kenneth G. Redlin for a
preliminary subdivision cal2ed Vlrallace First Addition. The proposal is located
approximately in the S 1/2 of Section 24, Township 25 N., Range 43, E. W. M. ,
south of llth Avenue, between Dollar Road and Cirard Road. The proponent is
requesting to subdivided 15 .0 acres into 3 6 lots for single family (31 lots) and
duplex (5 lots) use, thereby creating a gross density of 2.7 units/acre. The
terr3in is gently rolling with moderate to severe slopes on the southerly end.
The staff review has identified four potential areas of environmental impacts.
First, and common to all subdivisions, is the increase in motor vehicle traffic
and all the effects associated therewith. These would include such impacts
as increased air pollution, specifically suspended particulates from unimproved
streets, increased noise, and increased public safety hazards from traffic.
A second potential environmental impact area considered was the increased
demand on public services and utilities. This would include such factors as
increased requirements for police and fire protection, provision of additional
school, park, and recreational facilities and roads. This would also include
such imUcjcts as associated with extension of utility lines (power, natural gas,
telephorY:), and the provision of suitable long term sewerage, domestic water,
storm watEr runoff, and solid waste disposal systems.
A third potential environmental impact revealed by the staff evaluation involves
the sufsurface injection of sewage effluent and storm water runoof. This waste
water placed at a depth will percolate downward toward thE aquifer rather than
evaporating back into the atmosphere as under natural conditins, A portion of
the contaminants will likely be filtered out of this waste w3ter, but the resulting
qua lity ha s not been determined yet. About 14 acre feet of wa s te water w ill be
injected beneath the soil aurface, six acre feEt of which will be septic tank
effluent.
The final potentially significant impact.is the conversion of approximately 15
acres of presently vacant land into 216 lots for sinqle family and duplex use.

The conclusion of this environmental chECklist review is that no significant
environmental impacts will likely resu%t frozn the proposal if the specified
mitigating measures are adopted. Therefore, it is recommended that a
Declaration of Non-Significance be issued and an environmental impact state-
ment not be required. D. ZONING RECOiVIIVIENDATION:
Planning Commission Recommendation: Approve Lots 2 and 3, Block 2, and
Lots 20 & 21, Lot 24; Brock 3 of W611ace First Addition as indicated on the
f revised preliminary plat of record to the Two Family Residential (R-2) Zone and
Lots 1-7 , Block 11 Lots 1.4 & 51 Block 2,and Lots 1-19 & Lot 23, Biock 3 of
Wallace First Addition as indicated on the revised preliminary plat of record to
the Single Family Residential (R-1) Zone classification; all upon the filing of
the final plat.
REASON:.- :
1. The staff is of the opinion that Lots 2 and ? of BiocDc 2 and Lots 20, 21
and 2~ of Block 3 are sufficiently disadvantaged to warrant duplEx
zoning. Specifically these lots 1ie on the edge of a residential neighbor-
hood.
2. Lots 1-7 of Block 1, Lots 11 -a & S of Bl.ock 2, and Lots 1-19 and Lot 2 3
of Block 3, have been designed to accommodate single family dwellings.
