Planning Commission Recommendatfon: Approve, subiect to the followinq

1. The land use of the preliminary plat is comparable to the land uses
in the area.
2. The Spokane County Health Department has indicated that domestic
water is available on indivfdual sites.
A. C ONDITIONS:

record and/or attached sheets as noted.
2._~ That a statement be placed in the dedication to the effect that no
more than one dwelling struct ure be placed on any one lot, nor

approved by the water supplier and fire protection district. Said
water plan must also have been approved bythe appropriate
he alth authorities. The he alth autharitie s, water supplier (pur-
veyor), and fire protection district will certify, prior to the filing
of the final plat, on the face of said water plan that the plan is in
conformance with thelr requirements and will adequately satisfy
their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.

The water supplier (purveyor) will also certi.fy prior to the filing
of the final plat on a copy of said water plan that appropnate
contractual arrangements have been made with the plat sponsor
for construction of the water system, in accordance with the
approved plan, and in accordance with a time schedule. The
ame schedule will provide, in any case, for completion of the
water system and inspection by the appropriate health authorities
prior to application for building permits within the plat. The
contractual arrangements will include a provision holding Spokane
County and the water supplier (purveyor) harmless from claims
by any lot purchaser refused a building per mit due to the failure
of the plat sponsor to satisfactorily complete the approved water
system.
The plat dedication will contain a statement to the effect that the
public water system as approved by Gounty and State Health
authorities and the local fire district and water suaplier (purveyor)
will be installed within this plat, and the subdivider will provide
for individual service to each lot prior to sale of each lot.
,J8 That conditional approval be given subject to provisions in the plat
for a public sewer system for lots 4 throu-gh 13. Approval of the
design of said systems must be given by County and State Health
authorities and the County Utilities Department prior to filing of the
final plat. A suitable guarantee will be required to cover the cost
of providing said system in the amount as deter-mined by the Public
Work Department.
9. Spokane County Health District requirements before the final plat
is filed are as follows:

of the recorded easements in favor of a home-
owner association at least 12 feet wide for the
entire length of the public sewer line s and for

copy of the article s of incorporation and by-laws
of the Homeowners As sociation .
d. Furnish Spokane County Health District plans
and specifications for the effluent collection
and disposal system as prepared by a pro-
fe s sional engineer.
e. Spokane County Health District approval of the
operation and maintenance procedure s pertinent
to the efflue nt colle ctor line s and di spos a1
syste m.
f. Plat dedication must require lots 4 throLtr,,,y 13
owners to join, subscribe to and financially
support the Homeowners As sociation insofar
,as their indiviaual septic tanks and the public
effluent c ollector line s arid di sposal system
are concerned.
NOTE: The Spokane County Health District has determined that the
soil conditions in rhe plat for lost 1, 21 & 3, are suitable for
,:,n-site sewage disposal system on each of these lots.

plans, engineering costs, and placing of final center lire monuments.
14. That profile s of streets, cros s sections, proporsed grade s, and
drainage plan of the plat be submitted and approved by ghe County
Engineer and by the Planning Director before the final plat is drawn.
P-rior to acceptance of the improvements or release of bonds, a
certificate by a registered civil e ngine°r or licensed land surveyor
will be required iridicating that all improvements have been installed
on the approved coro-truction plans.
15 . Conditional approval of the plat is given subject to the dedication
of the right of way to the public and approval of the road system
in -che plat by the County Engineer.
16. That a name be indicated before the final plat is filed; such name
to be approved by the County Assessor and the Planning staff.
B. SiAFF ENVIRONMENTAL REVIEW AND RECOMMENDATIONS
As required in WAC 197-10-320, the staff of the County Planning
Commission reviewed the environmental checklist submitted by
Mr. Robert D. Rlegel for a preliminary plat called "Riegel Heights."
The proposal is located approximately in the SE 1/4 of the SW 1/4
of the SE 1/4 of Section 23, Township 25 N.,Range 43, E.W. M. ,
adjacent and north of 16th Avenue approximately 500 feet east of
C arnahan Road. The propone nt i s re que sting to subdivide 7.3 acre s
into 13 lots to be developed for single family dwi-alling units,
creating a gro ss density of 1. 8 units per acre. The site is located
on 10 to 20 percent sloping terrain with rock outcropping and sparse
coniferous timber. The staff review has identified three potential
are as of environme ntal impacts. First, and common to all sub-
divi sions i s the incre ase in motor veaic1E traffic and all the effects
associated therewith. These would include such impacts as increased
air pollution, specifically suspended particulates from unimproved
streets, increased noise, and increased public safety hazards
from traffic.
A second potential environmental impact area considered was the
increased demand on public services and utilities. This would
include such actors as increased requirements for police and fire
protection, provision of additional school, park, and recreational

facilities, and additional mantenance requirements on all county
faci].ities and roads. This would also include such impacts as
associated with extension of utility lines (power, natural gas,
telephone) and the provision of suitable long term sewerage, dome stic
water, storm water runoff, and solid waste disposal systems.
A third potential environmental impact revealed by the staff
evaluation involves the subsurface injection of sewage effluent
and storm water runoff. This waste water placed at a depth will
percolate downword toward the aquifer rather than evaporat,ing back
into the atmosphere as under natural conditions. A portion of the
contaminants will likely be filtered out of this waste water, but
the resulting quality has not been determined yet. A total of
approximately 2 acre-feet of sewage effluent will be disposed
of annually.
The conclusion of this environmental check list review is that no
significant environmental impacts will likely re sult from the
proposal if the specified mitlgating measures are adopted. There-
fore, it is recommended that a Declaration of Non-Significance
be issued and an environr-iental impact statement not be required.
C. ZONING RECOMMENDATION:
Planning Commission Recommendation: Approve RieQel Heiahts Addltion as
indicated on the preliminary plat of !-ecord to Single Family Residential (R-1)
Zonz Classification upon the filin;1 of the final p1at.
REASONS
1. The lots zn the plat have been designed to accommodate
single family resrdences; proposed 13 lots will create
a gross density of 1. 8 units per acre.
2. The Planning Commission has been routinely upgrading
similar residential plats in the area to the Single Family
Re sidential Zone.
3. The Commission is of the opinion th3t none af the lots within the
subdivision have disadvantaged relata.onships which would warrant
duplex zoning. _
4. The Single Family Re sidenti al Zone prohibits duplexe s,
animal keeping other than household pets, mobile home s,
and home occupations.

that plans, profiles, and cross sections showing proposed street ceaterline and curb
grades be submitted to the County Engineer for approval prior to construction and

that drainage plans and design calculations showfng the grades and aligrnaent of drafa-
age facilities be submitted to the County Engineer for approval prior to construction
and the filing of a final p3at;
construction within the propvsed public streets and easements shall be perfor•ned
under the direct supexvision of a Iicensed Iand surveyor, who shalZ be responsible
for perpetuating all evidence of the location of survey monuments which may be
disturbed during coastruction and who shall furnish the County Engineer with "As

the lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced;

b. The drainfield area must be fenced to prevent unauthorized uses.

The publ i c water purveyi ng enti ty, Washington Water Power, has declared its
intent and ability to provide the required water needs to subject plat.
On-site testhole investigations conducted over one year ago revealed that
the silt loam soil material within a northeast portion of the property (see
proposed drainfield area on plat map dated July 8, 1976) will be suitable
for the installation of a public drainfield system to serve 10 of the 13 lots.
(Lo ts l, 2, and 3 have confirmed on-site drainfield locations via previous
testhol e observati ons . )
A homeowners association will be responsible for the ultimate ownership and
maintenance of the public drainfield system.
