Application of Zoning Provision: Chapter 4.21, Section 4.21.040 ° . ` No. 73 840 BOARD OF COUNTY COMMISSIONERS OF SPOKANE COUNTY, WASHINGTON FINDINGS AND ORDER REGARDING ZONING MAP PROPOSAL, ZE-81-73 - AGRICULTURAL SUBURBAN TO RESIDENTIAL OFFICE AND MULTIPLE FAMILY SUBURBAN: MC CALLUM WHEREAS, the Spokane County Planning Commission did, after public hearing on September 21, 1973 forward to the Board of County Commissioners a recommendation that the Zoning Map not be changed ( motxon for approval failed for lack of a quorem vote) from the exista.ng Agricultural Suburban classification to the Residential Office and Multiple Family Suburban classifications on property described as follows: Tracfi 38, Opportunity, except 350 f eet of the north 438 f eet of the East 150 feet, and except the South 35 feet thereof in Section 15 , Township 25 N., Range 44, E. W. M. Spokane County, Washington, and, WHEREAS, the agent for the applzcant before the Planning Commission, F.V. Seipp, did by Ietter dated September 25, 1973, request a hearing before the Board of County Commissioners to present evidence and testimony fn favor of their application, and WHEREAS, the Board of County Commissioners did hold a public hearing on November 1, 1973, to consider the recommendations of the Planning Commission and testimony and evidence of the applicanfi and other fnterested parties, and WHEREAS, at said hearing opportunity was afforded those favoring and those opposing the above-descnbed Zoning Map proposal, and the Board af County Commissioners of Spokane County having fully considered the testirriony given, the records and minutes of the Planning Commission and all other evidence pre- sented and heanng personally acquainted themselves with the site and vicinity in question does hereby find: 1) That the property in question is approximately 7.9 acres in size and is located south of the Spokane Valley General Hospital. . . 2) That the applicant proposes to construct a complex of offices on the northerly 2/3 of the site and a cluster of 36 two-story apart- ments and townhouses on fihe southerly 1/3 of the advertised property. 3) That surrounding land uses include a hospital to the north, apartments and scattered residences to the east, single famfly residences and duplexes to the soufih, and a funeral home, retail businesses, and scattered residences to the west. 4) That several office complexes and apartment projects have been established in the vicfnity of the Spokane Valley General Hospital wrth access to Mission Avenue and Pines Road without a detri- mental affect on the surrounding neighborhood. NOW, THEREFORE, the Board of County Commissioners does hereby conclude that the above described property should be reclassified to the Residential Office (N 2/3 of the site) and Multiple Family Suburban (S 1/3 of the site) classifi- cations and does hereby order that an appropriate resolution for that purpose be presenfied to the Board at such time as-the followin.g ri.gb_t of way- dedications and assurances of improvements have been -made and that the following additional condi- ,ions be incorporated into the resolution as conditions of the issuance of building permits: A. DEDICATIONS AND IMPROVEMENTS 1) Dedication and fmprovement to Spokane County standards of the south five (5) feet of the advertised property along Boone Avenue for righfi of way. Improvements shall include curbs, sfdewalks, drainage control and paving to existing oil, 2) Dedication and improvement to Spokane County standards of the east five (5) feet of the advertised property along Vercler Road for right of way. Improvements shall include curbs, sidewalks, drainage control, and paving to existing oil. -2- . 3) Dedication and improvement to Spokane County Standards of a 6 0' roadway for Houk Street between Sinto Avenue and Boone Avenue in an alignment acceptable to the Spokane County Engineer's office. Improvements shall include grading, drainage control, curbs, sidewalks, and paving. 4) Dedication and improvement to Spokane County standards of a 60' roadway for Sinto Avenue between Houk and Vercler Roads in an alignment acceptable to the Spokane County Engineer's office. Improvements sha11 include grading, drainage control, curbs, sidewalks and paving. 5) Dedications acceptable to the County Engineer's office shall be made for curb radii at road fntersections bounding the project. B. CONDITIONS APPLICABLE TO BUILDING PERMIT APPLICATIONS 1) The Multiple Family portion of the project shall be developed in substantial conformance with the approved sxte development plan; i, e., one and two story garden apartments, townhouses, and . recreation faciiitfes. Apartment structures along Boone Avenue shall not exceed 1 1/2 stones in height and shall back up to the street; i. e., no dnveways or parking areas abutting Boone Avenue. The total number of apartment units sha12 not exceed the number shown on the plan (36) 2) Off Street Parking - Multiple Family Project a) Any portion of the project which is to be occupied or traveled by automobiles shall be maintained in hard surface paving. b) Open parking areas shall be unlighted, except that driveways, walkways, and landscaped traffic xslands may be illum- inated by low intensity lightang on standards not exceeding eight (8) feet in height. -3- r A j c) The design, location, and arrangement of parking stalls , shall be in accordance with standard traffic engineering practices. Planting strips or landscaped traffic islands may be required by the Director of Planning for parking lots, which contain more than 20 parking stalls. 3) LANDSCAPING A11 areas not occupied by buildings, parking, and paved roadways shall be landscaped, planted and maintained in appropriate turf and shrubbery. The Director of Planning may require fencing and extensive landscaping along the perfineter of the proj ect to reduce the impact of the apartment and office projects on surround- ing residential properttes. 4) FIRE PROTECTION Provisions shall be made for fire hydrants in accordance with the requfrements of the Spokane Valley Fire Marshal.
