A. I NTRODUC7'ION
This matter having come before the Examiner Committee on October 8, 1981, and
the members of the Committee present being John R. Culler, Chairman, Kathteen
Carstens and Jerry Wiltiams.
B. PROPOSAL
The sponsor, Jack Brace Co., Inc. , is requesting approval of a change of
conditions, Fi1e No. ZE-61-73, Restricted lndustrial Zone, for the purpose of
developing an additionai structure on the site which is shown on a revised
development plan.
C. FINDINGS OF FACT
1. That the existing land use in the area is industrial, railroad tracks, I-94,
residential, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for Major
Commercial development.
3. That the existing zoning of the property described in the application is
Restricted I ndustrial .
4. That the provjsions of RCW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration of
Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfiUed.
6. "i'hat the land in this area is suitable for the proposed use, or uses within
the proposed Zone Ciassification.
7. That the applicant has demonstrated that condittons have substantially
changed since the original ioning of this area and accordingly, the pro-
posed rezone is justified.
8. That tfie proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approvat nor dis-
approval of the proposed use.
10. The Hearing Examiner Corrimittee finds the proposed use to be in harmony
with the generai purpose and will not be otherwise detrimental to the publtc
health, safety, and welfare.

a) C4UNTY PLANN1 NG DEPARTMENT
1, A specific landscape plan, planting schedute and pravisions for main-
tenance acceptable to the Spokane Caunty Zoning Administrator shall
be submitted with a performance bond fvr the project prior to release
of building permits.
2, `fihe applieant shall dev+elop subject property generally in accardance
within the cancept presented to the Hearing Examiner Cammifitee.
Variations when approved by the Zvning Administrator wjll be per-
mitted, inciuding, but nat litvtiited to the fc+l#owing changes: Building
location, Landscape plans, and general allowable uses of the permitted
Zone. All variatians must conform ta regulations set foryth in the
Spokane County Zoning Ordinance. The original intent of the derrelop-
mertt plans shall be maintained,
3. Direct iight from any exterior area lighting fixture shall not extend
over the praperty boundary.
4. All current standards of the Rsstricted lndustrial Zane, as amended,
shall be complied with in the development of this site.
5. Applicant shall comply with 1208' recflmmendations concerning storm-
water runoff and provide nece5sary fandscap'rng for runaff.
6. The applicant shall comply with RCW 58-17 and the Spokane County
Platting C}rdinances priflr to issuance of building permits.
7. That the provisions of SEPA's NO'rt'1CE OF AC"1"!t]N pursuant to
Chapter 43.21C.084 RCW and the Board of Spakane County Comrnis-
sioners Resotution #77-1392 be initiated by the pruject applicant within
thirty (30) days af final disposftion of this application, and prior to
any on-site improvements.
8. Pursuant to the prav'rsions of Chapter 43.21C RCW, the SEPA
GWidelines (WAC 197-10) and the Spokane Caunty Environmental
Ordinance (SCE0), a prvposed deelaration of rton-signrficance
has been issued at fQast fifteen (15) days priar to this date; trie
official file, written comments andjor public testimony contain in-
formation regarding assessment af the proposal's adverse impacts
to the physical envira►nment; a finding €s hereby made that
no patentFally significant adverse impacts upon the physical
environment are anticipated as a result of the presject; and a
finaf declaration of non-significance is herehy to be issued.

1. The applicant shall submit for appraval by the Spokane County
Engineer and the Spokane County Health District a detailed combined
an-site sewage system plarn and surface water disposal plan for the
entire project priar t4 the issuance of any building permit on #he
property.
2. A parkiMg plan and traffic circutation plan shall be submitted and
apRroved by the Spakane County Engineer prior to the Issuance of a
bu'rlding permit on the property. The design, lvcation, anc1 arrange-
rnerat of parking stallg shali be in accardance with standard traffic
engineering practices. Paving or surfacing as appraved by the
County Engineer, will be required far any portion of the project which
is to be occupied or travete+d by vehicles.
3. The word "applicant" shall Include the owner or awn,ers of the
property, his heirs, assigns, and successors.
c) COUNTV UTILITI ES DEPARTMEN"i"'
1. Pursuant to Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. ThiS
authorization is conditioned an compliance with alf rules and regulations
of the Spokane County Heaith District and is further cvnditioned and
subject ta specific application approval and issuance of permits by the
Health Qistrict.
2. The a►wner, his hEirs or successors shall join and participate in any
petiti4n or resaiution wh3ch Rurpose is the fvrmatiort of a utility local
impra►vement district (UL1D) pursuant tv RC1Rl', Chapter 36.94~ as
amended. 7he owner, his heirs and successQrs shall further agree not
tfl oppose or protest any legal assessments for any utility focal tm-
provement district (ULID) established pursuant tv RCW Chapter 36.94,
as amended.

3. Any water service for this praject shall be pravided in accordance with
the Coordinated Water System Plan for Spokane Caunty.
d} Ct?UNTY HEALTH DlSTRIC7
1. A cambined surface rnrater and sewage disposai detailed plan shall be
approved by the County Engineer and t,he Health District privr to the
issuance of any building permit for this praject.
2. Sewage disposal method shall be as authorized by the Director of
Utilities f Spokane County.
3. Subject to specific application approval and issuance of permits by the
Health OffiCeri the use of an individuai ort-site sewage system may be
authorized.
4. 1Nater serv3ce must be coordinatec9 through t~e Directar of
Utilities, Spo#cane Caunty.

g) AIR POLLUTION COIdTROL AUTWORITY
1. That Air Pollution Control regulations be folloared, and that they
require measures be taken to controi dust emissions during all phases
of the project which include excavation, construction, paving, etC.

I I i . gACKGROUND/ANALYSIS
This property vves originally approved for a rezone from Agricuttural to
Restricted industrial on June 27, 1974, to allow construction of two struc-
tures with approximately 15,000 sq.ft. Currently, there are two struc-
tures on the site which exceed 15,000 sq.ft. The sponsor is requestpng
approval of the addition of a third structure of approximately 10,000 sq.ft.
Conditions on fihe originat Zone change require that the property be devel-
oped in accordance with the approved deveiopment plan and, thus, neces-
sitates the approvai of a revised devetopment plan before the additional
development can take piace.
Additionaliy, the applicant should be aware that two more conditions
originally placed on the approval of this zone change have not been com-
plied with. These conditions are:
1) All advertising structures on the property shal I be placed flat
agajnst the building.
2) Open storage and display of machinery, automobiles, recreation
vehicles, moblle homes, etc. normally displayed for sales purposes
shall be prohibited.
Staff recommends approval of this proposai, subject to the following
conditions.
IV. AGENCIES RECOMMENDED CONDITIONS
a) COUNTY PLANNi1dG DEPARTMENT
1. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Adminis-
trator shall be submitted with a performance band for the project
prior to release of building permits.

2. The applicant shall develop subject property generally in accord-
ance within the concept presented to the Hearing Examiner
. Committee. Variations when approved by the Zoning Adminis-
trator will be permitted, including, but not limited to the follow-
ing changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must con-
form to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall be
maintained.
3. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.
4. All current standards of the Restricted I ndustrial Zone, as
amended, shall be compiied with in the development of this site.
5. Applicant shall comply with 1208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
6. The applicant shall comply with RCW 58-17 and the Spokane
County Platting Ordinances prior to issuance of building permits.
7. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the Qroject
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
8. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance
has been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain in-
formation regarding assessment of the proposal's adverse impacts
to the physical environment; a finding is hereby made that
no potentially significant adverse impacts upon the physical
environment are anticipated as a result of the project; and a
final declaration of non-significance is hereby to be issued.
9. All original conditions of approval shall be complied with.
b) COUNTY ENGINEERING DEPARTMENT
1. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Heatth District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any building
permit on the property.

2. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
. issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in accord-
ance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required
for any portion of the project which is to be occupied or
trave! ed by veh i cl es .
3. The word "applicant" shail include the owner or owners of the
property, his heirs, assigns, and successors.
c) COUNTY UTI LITI ES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance with
all rules and regulations of the Spokane County Health District
and is further conditioned and subject to specific application
approval and issuance of permits by the Health District.
2. The owner, his heirs or successors shall join and participate in
any petition or resolution which purpose is the formation of a
utility local improvement district (ULID) pursuant to RCW,
Chapter 36.94, as amended. The owner, his heirs and suc-
cessors shall further agree not to oppose or protest any legal
assessments for any utility local improvement district (U LI D)
established pursuant to ftCW Chapter 36.94, as amended.
3. Any water service for this project shall be provided in accord-
ance with the Coordinated Water System Plan for Spokane
County.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District
prior to the issuance of any building permit for this project.
2. Sewage disposal method shall be as authoriZed by the Director of
Uti I ities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authorized.
4. Water service must be coordinated through the Director of
Utilities, Spokane County. _

2. Findings:
a. This project lies over the Spokane Aquifer.
b. It is within Critical Water Supply Service Area No. 3, and within the
service area of Consolidated Irrigation District. Groundwater resources
appear adequate to support development at the proposed density.
c. The project is inside the '201' Sewer Study Area; and inside the Priority
Sewer Service Area recommended in the '201' Study. The method of sewage
disposal is subject to approval of the Director of Utilities pursuant to
County Resolution 80.0418 adopted March 24, 1980. The topography and
soils in the area are generally suitable for use of individual on-site
sewage systems. The lot is of the proper dimensions to permit use of
both an individual well and sewage system.
d. The project lies in a relatively flat area east of Pines Road and south
of Indiana Avenue. Local drainageways are insignificant.
e. Surface soils are classed as Garrison gravelly loam with 0 to 5% slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.

f. Geologically, the soils are glaeiofluvial deposits. These geologic struc-
tures yield maderate ta very large amaunts vf water. Data fram wells in
the area shows they are from 50' ta 176' deep and have static water levels
varying from 40' to 157' belaw the surface.

and we feel that there are no valid reasons why this

P 1 a n n i n g Commission Recommendation: Approve to Restricted
Industrial Zone, subiect to the followinq conditions:
1. The dedication of the North 30' of the advertised property along
Indiana Avenue for right of way.
2. All advertising structures on the property shall be placed flat
against the building.
3. Approval by the Board of County Commissioners of a final development
plan for the advertised property including lighting, sign detail, etc.
/1. Installation of fire hydrants in accordance with the requirements
of the Spokane Valley Fire Marshal.
5. Open storage and df splay of machinery, automobiles, recreation
vehicles, mobile homes, etc., normally displayed for sales
purpose s shall be prohibited.
Note: Section 4. 11.120 of the Spokane County Zoning Ordinance requires
a 6' high sight - obscuring fence for storaye areas.
A. Reasons:
1. The Comprehensive Plan indicates that the general area
between the Spokane Valley Freeway and the Spokar_`
International Railway tracks is appropriate for Iight
industrial use s .
2. The Planning Commission notes that two properties to ~h,:
west of the proposal have been approved for Res-tricted
Industrial zoning.
3. The Planning Commi s sion note s that the propo sed use
would be a relatively low traffic generator and would not
significantly contribute to traffic congestion at the Pines
Interchange.
14 . The Planning Commission has recommended conditions
of approval which will enhance the industrial corridor by
limiting lighting and signing and prohibiting outside
