I. GENERAL IATFORMATION
A. History
The applicant is requesting a third Extension of Time. The proposal was heard
and recommended for approval on June 11, 1976 by the Planning Commission.
Since that time, two Extensions of Time have been granted. The sponsor
indicates that changes in engineering requirements and paper work have created
delays. The plat is currently close to being finalized and is requesting an
Extension of Time to September 1, 1980.
B. Location
The proposal is located in the Spokane Valley south of Forker Road and about
500 feet east of Bannen Road.
C. Proposal
- 4.55 acres subdivided into 8 lots for single family dwellings
- Lot frontage = 105 feet
- Lot sizes = 17,640 sq. ft.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has not recommended any new conditions. Only those
conditions already attached to the preliminary plat of record.
B. Sewage Disposal
The sponsor has proposed individual on-site sewage disposal systems which have
been authorized by the Health District.
C. Drainage
The County Utilities Engineer reports that the final construction plans plans
must be reviewed and approved prior to the filing of the final plat.
D. Water Supply
The proposal is located within the recorded service area of Trentwood
Irrigation District.
E. Fire Protection
The proposal is situated within the recorded service area of Fire District #l.

There was some discussaon and objection from a developer representative with regard to the,$240 zoning reclas,sification f,ee'being charged with plat applica-
tions. Mr. McCoury made the announcement that each of the Planning Commissi'on members
had received a letter from the Board of County Commissioner.s which stated that
the Commission Hearin-gs in September, with the exception of the September 21st
Special Hearing, tivould be heard by the Hearing Examiner Committees.
The Chairman closed the business, discussion and announced the remainder of the
hearing would address itself to Preliminary Subdivision applications and zone
reclassifications, along-with related items, presented by W. D.-Hubbard, Plat .
Administrator, and each plat sponsor or his representative; followed by favorable
. and/or opposing testimony from the audience, with rebuttal allcwed the sponsor.
. Chairman McCoury announced the Agenda items in order. B. PRELIMINARY SUBDIVIS'IONS - EXTENSIONS OF TIME ' The Planning Commission membe,rs discussed at length the question of extensions
of time and present policy,in that connection. It was decided the.Policy Com-
mittee would meet and set a stricter policy as to necessary proof by the sponsor
what he had accomplished, how many extensions of time should be granted,'etc.
Mr. Prather of the Health District expressed a desire to meet with the Policy
Committee in regard to extensions of time, as this has been a problem in his
departmentalso. . . l. PE-1011-76, SWAN ACRES FIRST ADDITION for an EXTENSION OF TIME by Swan, and
ZE- 59-76, AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL: That the Extension of
Time be granted to September l, 1979. It was noted by the Commission members

5. PE-1141-77, MOUNTAIN VIEW MEADOWS for a CHANGE OF CONDITION, by Swanson, and
ZE- 161-77, AGRICIJLTURAL TO SINGLE.FAMILY RESIDENTIAL. The plat sponsor's
representative presented at the Hearing a different proposal thari that which
had been presented to the Plat Administrator for advertising and appeared on
the Agenda. The Health Department and the Plat Administrator, as well as the
Commission members, did not have available previous to the hearing, what the
sponsor's representative asked for at the-hearing. The original Change of Con-
dition had proposed a change from 59 lot.s to 24 lots. At the hearing, a request
was.made for approval of 26 1 ots . After consi derabl e-testimony i~t was. proposed :
That the Change of Condition be APPROVED for 24 lots only. ,

request be-DENIED. Principle reason given was improper zoning. There was con-
siderable discussion concerning schoo-l overcrowding, and park allowance in new
subdivision applications. There was discussion concerning the higher density
allowance in Agricultural Suburban zoning than there is in Sing.le Family.Resi-
dential.
(Motion to approve by Main, seconded by Kennedy. Vote was one "yes" and five

ZE- 114-78, AGRICULTURAL & AGRICULTURAL'SUBURBAN to SINGLE FAMILY RESIDENTIAL:
That the preliminary plat request be DENIED. Presentation was made by Hubbard, and
the plat's sponsor, vrith added conditions presented by the Pacific Gas Transmission
Company, across whose right-of-way part of the proposed plat is located. (Prior
to opposing testimony, the Commission recessed for lunch.) There were petitions
and one letter presented in protest of the proposed plat, along with opposing
testimony. Reason for denial was that the proposed plat, as designed and with the
proposed zoning, is incompatible with the surrounding area, which is principally '
used for farm land and animal raising.
(Motion to approve by Byrne, seconded by lCennedy. Vote was unanimously opposed.)

will include a provision holding Spokane County and the water
supplier (purveyor) harmless from claims by any lot purchaser

B. STAFF ENVIRONMENTAL REVIMfw
A s required in WAC 197-10- 320, the staff of the County Planning Commissiori
reviewed the environmental checklist submitted by Mr. Lawrence V. Dunsmui
in behalf of Mr. George Swan for the Swan Acres First Addition Preliminary
Subdivision. The proposal is located approximately in the NE 1/4 of the
SW 1/4 of Section 35, Townshfp 26N0 , Range 44 E.VV .IVt., south of and
tangent to Folker Road, and about 150 feet east of Bannen Road, The Sponso
requests to subdlvlde about 4. S acres into 8 lots creatfng a density of
nearly 1/8 lots per gross acre. The site Is located on relattvely flat terrain
which is currently being used as active agricultural land.
The staff revtew has identified four potenttal areas of environmental impacts
First, and common to all subdivlsions is the increase in motor vehfcle
traffic and all the effects associated therewith. These would include such
Impacts as fncreased afr pollutfon, specifically suspended particulates from
unimproved streets, fncreased noise, and increased public safety hazards
from traffic. In this case, these are not considered sugnificant.
A second potential environmental Lmpact area consldered was the increased
demand on public services and utilfttes. ThLs would include such factors
as increased requirements for police an3 fire protection, provision of
additional school, par k, and recreational facilities, and additional mafnten-
ance requirements on a.ll county facilities and roads. Thls would also
include such impacts as assocfated with extension of Utility lines (power,
natural gas, telephone) and the provision of suitable long term sewerage,
domestfc water, storm water runoff, and solid waste disposal systems.
Again, these impacts are not considered significant.
A third potentfal Impact area identified by, the staff review Involves the
transition of acttve agricultural land into r~sfdential. Existing productive
alfalfa fields will be converted to single fa,mily residential use at a density
of lESS than two unfts per gross acre. Due to the relatively small size of
this subdlvtsfon and the fairly tow develo~ment density, this fs not consfde°
a significant tmpact.

A final problem area involves the use of septic tank/drainfield sewerage
systems in close proximity to an existing domestic avater well. The Count,.
Health Df strict has proposed to mitiggte any possfble contamtnation from
sewage effluent by recommending that all septic tank drainfields be set
back a minimum of 100 feet from the well. If this measure is employed,
no significant tmpact should result.
The conclusfon of thfs environmental checklist review is that no sfgntfical
environmenta l impacts will likely result from the proposal tf the specffied
mltigating measures are adopted. Therefore, it is recommended that a
Declaratlon of Non-Significance be issued and an envlronmental lmpact
statement not be required.
C. ZONING RECQIV:NENDATION:
Planning Commission Recommendation: Approve Swan P.cres First Addition as
fndicated on the pretimtnary plat of record to Sinqle Famtly Residential (R-1)
Zone Classtfication upon the filinq of the final plat.
REASONS:
1. The efght (8) [ots in the subdivision have been designed to
accommocate single family residences; proposed densfty of 1.8
lots per gross acre.
2. The Planning Commission has been routinely upgrading simllar
residential plats in the Trentwood Community to the Single Family
Residential and Two-Family Residential Gones.
3. The Staff is of the opinion that nonV of the lots within the subdivi-
slon have disadvantaged relationships which would warrant duplex
zoning.

Dear Mrs. Jeske:
I am enclosing a copy of a preliminary plat of Swan Acres First Addition
dated May 8, 1976 and f iled with Spokane County. According to the above
f iled plat, a proposed road would cover a triangle of about 60 feet by
20 f eet or would equal between 1/16th to 1/8th acre of non-crop land on
the above trust property together with that owned by you. The parcel
would be the point on your plat map marked "Part D" where Forker Road
intersects with Plat No. 4 West Farms irrigated tracts. This point has
never been farmed and has been used in the past as an existing road. In
fact, it has been used as a roadway for a suff icient time as access to
the Anderson and the Swan land and it could be held open as such.
Nevertheless, the above-referred to preliminary plat has been filed
whereby this point would become a roadway. There would be nothing we
could do to prevent it and the said area is not farmable and is used for
an entry to the Anderson lands at present. I see of no objection to our
agreeing to the area being used as a proposed road, as we are using it
for this purpose already. The area involved is marked in ink on the

SUBJECT: Proposed Preliminary Plat - SWAN ACRES FIRST ADOITION (George Swan)
Reference: Map of proposal, scale 1"=100' by Dunsmore dated
May 8, 1976.
2. Trentwood Irrigation District has indicated the proposed plat is
within its service area and that the District has the capability
to provide domestic use water to each lot. We recommend that water
service be provided at each lot prior to signing of the final
pl at. We al so recomnend the water servi ce i ncl ude fi re protecti on .
3. The topography and soils in each lot are suitable for installation
of individual on-site sewage disposal systems. These systems must
be separated by at least 100 feet from the well in the fourth lot
from the north end on the east side.
4. The remarks in paragraphs 2 and 3 above apply also to the re-plat
of Lots 1 and 3 B1ock 1 of the final plat of SWAN ACRES SUBDIVISION.
