A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
Nfarch 7, 1985, and the members of the Committee present being Jane Myers,
Chairperson, F. Ly nn Tennican and Richard L. Skalstad.
B. PROPOSNL
The sponsor, Gary W. Nelson, is requesting approval of a site plan review
as per condition of approval for File No. ZE-43A-73, for the purpose of
developing a 46-Unit Apartment Complex on a site size of a 2.65-Acre
parcel zoned Multiple Family Suburban.
C. F IND IPIGS OF FACT
1. That the existing land use in the area is single family residential,
apartments, Elks Lodge and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Urban type development.
3. That the exi sti ng zoni ng of the property descri bed i n the appl i cati on
is Multiple Family Suburban.
4. That the Board of County Commissioners and Planning Commission
requi red a revi ew of the si te pl an by the Pl anni ng Commi ssi on whi ch
i s to i ncorporate an i nteri or courtyard desi gn.
5. That in 1978, the County adopted a Hearing Examiner Committee
Ordinance, which delegates all zoning actions to the Zoning Hearing
Examiner Committee.
6. That legal counsel for the Hearing Examiner Committee advises that
thi s i tem be consi dered as ol d busi ness for an admi m strati ve revi ew
of a si te pl an by the Zoni ng Heari ng Exami ner Commi ttee.
7. That detailed drainage plans indicate a low spot at the northeast
corner of the site which would restrict building at that location.
8. That the site plan as submitted appears to comply with the vague
direction received from the Planning Commission in 1973.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) DEPARTiNENT OF BUILDING AND SAFETY
The Department of Building and Safety is hereby informing the
applicant that:
1. Because of the size and specific location of the structure
located on the south property line, a one-hour rated wall wili
be requi red. In addi ti on, i f the roofs are constructed of
combustible construction, a 30-inch parapet above the roof will
be requi red.
2. In reviewing the site topography, there appears to be a
substantial slope to this property. Due to the number of units,
accessible units which meet the Washington State Regulations for
Barri er-Free Faci 1 i ti es wi 11 be required. Dependi ng on the
1 ocati on of these uni ts, the si te pl an may requi re some revi si on
to accommodate the required site access.
b) COUNTY UTILITIES DEPARTMENT
l. Pursuant to Board of County Commissione rs Resolution No.
80-0418, the use of on-site sewer disposal sy stems is hereby
authorized. Thi s authori zation is condi ti oned on compl i ance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
appl i cati on approval and i ssuance of permits by the Heal th
District.
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
peti ti on i ncl udes the Owner(s) property and further not to
object by the si gm ng of a protest peti tion agai nst the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
obj ection to any assessment(s) on the property as a result of
improvements cal l ed for i n conj uncti on wi th the formati on of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. The dwelling u m ts shall be double-plumbed for connection to
future areawide collection systems.

c) COUNTY ENGINEERING DEPARTMENT
1. In addi ti on to the ori gi nal Condi ti ons set forth i n the Board of
County Commissioners' Resolution No. 79-0340, dated
March 12, 1979, the following shall apply.
2. Si dewal ks are requi red al ong Mari etta Avenue.
3. Prior to issuance of building permits, sidewalks shall be
constructed along Robie Street. This requirement is pursuant to
the provisions of Spokane County Road Standards 1981.
Prior To The Issuance Of A Building Permit:
4. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
5. Other specific improvements:
Applicant shall construct Portland Cement concrete sidewalks
along the west side of kobie Street for the length of the
proposal.
6. Applicant shall submit for approval by the Spokane County
Engi neer si dewal k pl ans pri or to the issuance of a bui1 di ng
permi t on the property.
7. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combi ned on-si te sewage system pl an and surface water di sposal
pl an for the entire project pri or to the issuance of any
building permit on the property.
8. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfaci ng as approved by the County Engi neer, wi 11 be
requi red for any porti on of the proj ect whi ch is to be occupi ed
or traveled by vehicles.
9. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
10. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
11. Roadway standards, typical roadway sections and drainage plan
requi rements are found i n Spokane Board of County Commi ssi oners'
Resolution No. 80-1592 as amended and are applicable to this
development proposal.

The above referenced case involves propertv we control at the intersection
of Marietta Ave and Robie St. in the Ualley. The property was approved for
multi-family residential on July 20, 1983 and amended to increase density
on May 20, 1971. The Resolution wasn't actually signed until March 12, 1979
for some unkown reason.
One of the conditions is that a revised development plan be approved by
the Spokane County Planning Commission, Since the Planning Commission doesn't
hear those matters any more you have suggested having our development
plan brought up as old business before the Board of County Commissioners,

The above referenced case involves propertv we control at the intersection
of Marietta Ave and Robie St. in the Valley. The property was approved for
multi-family residential on July 20, 1983 and amended to increase density
on May 20, 1977. The Resolution wasn't actually signed until March 12, 1479
for some unkown reason.
One of the conditions is that a revised development plan be approved by
the Spokane Count,y Planning Commission. Since the Planning Commission doesn't
hear those matters any more you have suggested having our development
plan brought up as old business before the Board of County Commissioners.
We hereby submit our development plan which comp1ies with all of the
conditions. We request that ,you have the project reviewed by the County
Commissioners for compliance at your earliest opportunity. 4Je intend to
proceed with the project this spring.

automobiles shall be maintained in hard surface paving.
d) Open parking areas shall be unlighted except that driveways, walkways,
and landscaped traffic islands may be illuminated by low intensity lighting
on standards not exceeding eight (8) feet in height.
e) The design, location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices, planting strips or
landscaped traffic islands may be required by the Director of Planning for
parking lots which contain more than 20 parking stalls.
6) All areas not occupied by buildings, parking, and paved roadways shall be
landscaped, planted and maintained in appropriate turf and shrubbery. An
automatic sprinkler system shall 'be installed in all landscaped areas. If the
project is developed in stages, this requirement shall apply as each succeeding
area is developed.
7) Provisions shall be made for fire hydrants in accordance with the requirements

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RC W,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions signifir,antly

purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.

Suburban Zone, subiect to the following conditions: (Unanimous vote)
A. CONDITIONS
1. Dedica tions and Improvements
a. Dedication and improvement to Spokane County standards of
the East 20 feet of the advertised property alonq Robfe Street
for right of way. Improvements shall include curb, side`rvalk,
and drainage control.
b. Improvement to Spokane County standards of Marietta Avenue
along the north boundary of the advertised property. Improve-
ments shall include curb, sidewalk, drainage control and
paving.
c. Paving to Spokane County standards of Marietta Avenue from
the project to Pines Ftoad (approximately 480 feet).
d. Dedication of a 201 radius at the southwe st corner of
Marietta Avenue and Robie Street.

c. Any portion of the project which is to be occupied or traveled
by automobiles shail be maintained in hard surface paving.
d. Open parking areas shall be uniighted except that driveways,
walkways, and landscaped traffic islands may be iiluminated
by low intensity lighting on standards not exceeding eight
(8) feet in height.
e. The design, iocation, and arrangement of parking stalls shall
be fn accordance with standard traffic engineering practices,
planting strips or landscaped traffic islands may be requzred by
the Director of Planning for parkfng lots which contain more
than 20 parking stall s.
5. Landscaping
All areas not occupied by buildtngs, parking, and paved roadways
shall be landscaped, planted and maintained in appropriate turf and
shmubbery. An automatic sprinkler system shall be installed in all
landscaped areas. If the project is developed in stage s, this re -
quirement shall apply as each succeeding area is developed.
6. Fire Protection.
Provisions shall be made for fire hydrants in accordance with the
requirements of the Spokane Valley Marshall e

1. The site adjoins an apartment project to the east and the Elk's
Lodge property to the south. The Planning Commission notes that
