1. Prior to filing the final plat, the sponsor or his engineer shall
work with the Ptanning Commissfon staff to rearrange lotlines
within the central block (Block 2) of the preliminary plat of record
to meet cul de sac standards of 80' of lot width at the minimum
setback lines; and to consider the revision of lot wldth of Lots
1-13 of the same block. The purpose is to improve lot width of
Lots 2-6, 12 and 13, and the possible shifting of the southerly

The water supplier (purveyor) will also certify prior to the filing of the
final plat on a copy of said watvr plan th::t appropriatE contracrual
arrangements have bcen madc with the plat sponsor for construction of
the water system, in 3ccordance with the approved plan, and in
accordance with a time schedule. The time schedule will provide, in
any case, for completion of the water system -3nd inspection by the
appropriate health authorities prior to application for building permits
within the plat. The contractual arrangements will include a provision
holding Snokane County and the water supplier (purveyor) harmless from
claims by any lot purchaser refused -a buflding permit due to the failure
of the plat sponsor to satisf3ctorily complete the approved water system.
The plat dedication will contain a s[atement to the effect that the public
water system as approved by County and State Health authorities and
the 1oc31 fire district and water supplier (purveyor) will be installed
within this plat, and the subdivider will provide for individual service
to each lot prior to sale of each lot.
7. That a certificate of tftle be furnfshed the Planning Commission prior to
f iling of the f inal pla t.
8. That the preliminary plat be given conditional approval to May 1, 1977.
9. That streets be improved to standards established by Spokane County or
a bond to cover the cost of such improvemEnrs be furnished the County
Engineer. The bond may also cover the cost of "as built" plans,
engineering costs, and placing of final centerline monuments. In
addition, the plat's developer shall open and improve Sands Road from
the northcrly linc of the railroad right of way to the northerly plat
boundary.
10. That profiles of streets, cross sections, proposed grades, and drainage
plan of the plat be submitted and approvc:d by the County Engfneer and
by the Planning Director before the final plat is drawn. Prior to
acceptance of the improvements or re1e~-~se of bonds, a certificate by a
registered civil engineer or .licensed land surveyor will be required
indicating that all improvEments have becn installed to the lines and
grades shown on th2 approved cons truction plans.
11. Conditional approval of the plat is given subject to the dedication of the
right of way to the publfc 3nd approval of the road system in the plat by
the County Engineer.
12. That a name be indicated before the finai plat is filed; such name to be
approved by the County Assessor ana the Plannfng staff.

13. The Spokane County Health District has determined that the soil condi-
' tfons in the plat are suitc-iblc: for an-site: sewage disposal systems on
each lot , provided thut fill, of an amount and type satisfactory to local
health officials must be placed upon Lots 4, S, and 6, Block 2 of the
preliminary p13 t of rzcord, prior to filing of the fina 1 pla t. And, the
final plat shall contain a statemEnt to the effect that no building permits
can be issued to the 3bove-referenced lots for a period of one year from
the date of filling and accept-3nce of the fill by County Health officials.
B. BACKGROUND:
The proposed plat adjoins the existing Myron Est3tes p13ts to the west and
is bounded by Central Va11ey's Junior High site on the north and east and the
Union Pacific R ailroad branch line on the south.
C. ANALYSIS INCLUDINC ENVIRONMENTAL ASSESSMENT:
Thc proposed plat consists of 36 single-family lots upon 14 acres of tree-
covered ground which slopes to the east with a change in Iocal relief of
55 feet.
Preparation of the site for single-family lots does not require any alterations
and improvements beyond those normally associated with single famiiy plat
development. Furthermore, the land usc is consistent with adjoining land
uses and its demand for public services are adequately met by existing
public services for this immediate areca.
Therefore, the s taf f is of the opinion tha t if the prelimf nary pla t is approved .
and developed to the above-stated conditions, the proposed plat will not
have any significant or grEater impact on natur3l and physical (cultural)
conditions than simiiar residential uses cst3blished in the area. The staff
, concludes that an environmental impact st3tement is not required in conjunc-
tion with the approval of this prEliminary pl~t,

that plans, profiles, and cross sections showing proposed street centerline and curb
grades be submitted to the County Enaineer for approval prior to construction and
the fiZing of a final plat;
that drainage plans and design calculations showing the grades and alignment of drain-
age facilities be submitted to the County Engineer for approval prior to canstruction
and the filing of a final plat; _
cozstruction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed Iand surveyor, who shall be responsible
for perpetuating all evidence of the Iocation of survey monuments c,rhich may be
disturbed during construction and who shall furnish the County Engineer with "As

The soil material throughout the area consists Clayton sandy loam and
marble sandy loams which are acceptable for sub-surface disposal drain-
fields; the terrain slopes and surface drainage characteristics presently
evident on lots 1 and 2, of the North Block and lots 4, 5, 69 79 16 and 17
of the Center Block of lots may prohibit the proper workability of sub-
surface disposal systems. The aforementioned lots are therefore not
acceptable at this time for disposal systems.
A completed surface drainage plan acceptable to both Spokane County Engineers
and Spokane County Health District shall be evaluated prior to any further
action on this plat.
The water purveying entity has satisfactorily committed its ability to provide
an adequate water source to all the proposed lots.

In accordance with a request from the Planning Commission at its last hearing
and also in order to deal with problems much in evidence in recent months,
tne staff suggests action at this time by the Commission on the following
procedures:
Prior to submittal of a preliminary plat to the Planning Commission, the sponsor
must demonstrate to the satisfaction of the Spokane County Health District that
his proposed method of sewage disposal and water supply is adequate and
feasible to be utilized for his proposal.
, For sewage disposal systems, results of soil testing may be submitted to the
Health District for their review. (The Health officer may require additional
testing or less testing at his discretion.) 111 some cases testing may be re-
quired from an independent outside source to determine feasibility of a given
prcnosi?],
For water systems, the sponsor must demonstrate the adequacy and feasibility
of his proposed system for domestic use and fire protection including a report
from the proposed supplier that the suppiier considers service to the plat to be feasible, or, in the case of individual wells, sponsors must demonstrate
that indzvidual systems are feasible and that such systems will produce a suffi-
clenfi quantity of water for domestic use. The latter may require actual installa-
tzon of a well to demonstrate to the satisfaction of County and State Health
authorities that such systems are workable. If a community sewer system is
proposed, the sponsor must indicate the location and general type of treatment
proposed including a report from the proposed operator that the operator considers
such a system to be feasibl.e.
At the time a preliminary plat is submitted, the Planning Commission must receive
«s a part of its preliminary plat application (Exhibit E) a statement from the
Spokarle County Health District to the effect that the Distrfct has reviewed the
proposed method of sewage disposal and the water supply system and that aII
district requirements necessary to assure compliance have been completed to
the s ati sf action of the di strict .
Prior to the Planninq Commission hearinq , submit the above referenced feasibility
reports from water suppliers and/or sewerage system operators.

In regard to your letter dated December 28, 19741,
on the Myron Estates water proposal, I have drawn and
executed a contract between Mr. Ral ph Guthri e and West
Valley Excavators for your review. Upon your acceptance
West Val l ey Excavators tivi 1 i authori ze thei r i nsurance
company to post the peri'omance bond required.
In reference to paragrapn four i n your letter, I
feel that it is not necessary due to the iact that at
this time Mr. Huggins and myself were discussing how to
accompiish our objectives. Thz railroad had not official'iy
given us a signed contract from their Glest Coast office.
However, they had approved it and told us to go ahead and
they ivoul d provi de us avi th an i nspector to approve the
` installation witnout a signed contract. Since that time,
we have received the signed contract from the railroad
and would have the actual installation of the pipes under
the tracks covered in the overall contract with West Valley
Excavators.
I have discussed these items with Mr. Huggins and I
am 4vri ti ng you thi s 1 etter ai, hi s reques -L and suggesti on.
There are many builders that are being held up on 'Lhis
matter due to their not being able to obtain building per-
mits. I am sure that you and your office would be doing
the community a great serviee to expzdite this ayreenent
as quickly as possi b1 e.

3. The Contractor, at his sole expense, shall provide, install,
and construct, in accordancE with the Company's design as p-rovided by
the ~ompany and in accordance witiz the Company' s specif ications ,
attaclied hereto as ExiiiUit "C", the water distribution and trar_smission
facilities deEmed requixed 'oy the Company to be located in the final
p1ats of the area describeci in SECtion 1 herein and in the area
shotvn on the sketch (Exhibit "B") attachecl hereto. Said WatEr
facilities shal-1 consist of xaater dis-Lribution and transmission mair_s
and appurtenances thexeof, including fire hydrants but to exclude
sEn,Tices and service connections, The above-mentioned water facilities
shall be installEd only after the fina1 road grades have been established
and completed and the County of Spokane, Washington, has given final
approval to the Contractor's plot and dedicatian. A11 fire ilydrants
located in thE aforesaid plats shall be owned and maintained in accor-
dance ZJ'lth the Cam.pany's Rules and Reaulatyons on f-ile -%aith t'tze
V°ushington Ut7lities and `rrunsporta-.ion CcatumisSion.
4. The Contractor shall cantract ivith an agent approved by the
Company for the perfarmance of the worlc of const-ructing and installing
the afarementioned jaater facilities. The Company shall desicrnate a

Company representative to inspect tl-ic construction, installation, and
test oF the xJatEr facilities installEd by the Contractor's Agent.
Shoiild the Company's representative find that the materials,
ii1sta11ation, ancl/or construction are not in compliance with, thE
Cotiipany's aforementioned design and specifications, the Company
shal1 have the.right to stop the worlc until sueh time as the
Contractor`s Agent has made the corrections requirEd by the Company.
The Company shall have the right to test and approve the water
facil-Lties before the Company accepts t'ne facilities a The Company's
acceptance sha11 be in writing. True and accurate invoices
spe;;if icaliy describing the size of pipe and footages installed and
a1"1 material and labor used in the installation of the water facilities,
c'lescribed in Scction 3 hereof, shall be fucnished to the Company
pr-Lor to the Company's acceptance of such facilities in order that
the Company may establish the installed cost of said facilities
provided by the Contractor.

of Ecology, a new well is to be drilled, developed, and the nECessary
pur-tlping equipment installed by the Comp3ny or its agent on a well

the Stid 4 of Section 34, Toi-mship 25 North, Range 44 E.W.if., Snokane
County, WashingLOn.
ThE Company's actual cost associated with the drilling,
development, tESting, screening, and casing of said ne« well (2stimated
to b e approxim.ately $16,000) will be paid to the Company by the
Contractor,
4ne-half of this cost, as estimated by the Comgany, will be
naicl Lo the Company by the Contractor iaithin iifteen days a.fter tne
Company has been xssued a permit from thE State nf Washington

interest in the area described in Section 1 nerein withouL first

tnot be unreasonably withheld. This Agreement will inure to the
benAfi-L of ancl be binding upon trle suecessors ancl assigns of t'nP
respective parties hereto.

Qver the past several days we have had several discussions related
to the above plat that is to be presented to the Planning Comnission
in the near future. These discussions have becn directed toward ,
our approval of the water sysLEm that Eaill be required to service
ttie plat prior to its acceptance.
At this time we have not received any plans for the water system
and have not given any iaritten approval for the jae11 site. We
have, during the past year or so, looried at t~ao possible taell
sites and have i.ndi.cat-Ed we would approve the sitES when we re-
ceived a specific request for approval, accornpanied by the exact
Iegal description or the site chosen. We understand that this
pla-L is located within the service area of the tdashi.ngton Water
Pacqer Company and that tney have agreed to furnish water for the
nlat. If t'nis is true, then tae see no problems on our part ia
approving water system pXans when we receive these, providing
they have met the requirements es-Lablished by the Washington llater
Pcwer Company and are in agreement with the comprehensive plan
ior the area.
