~ on February 9 and March 9, 1973, forward to the Board of County Commissioners a
' recommendation that the Zoning Map be changed from the existing Multiple Family

Suburban classification to the Local Business classification on property described

LOCAL BUSINESS - HAMER
IN THE MATTER CONCERNING the Spokane County Planning Commission's
recommendation to approve, subject to conditions contained in
the Planning Commission's minutes of March 9, 1973, the request
of David T. Hamer for the above mentioned zone change on property
located in Section 17, Township 25 N., Range 44, E.W.M.:
The Board of County Commissioners of SVokane County, Washington,
concurred with the Planning Commission s recommendation to zone '
the property Local Business and found the reasons expressed by
the commission to be sufficient and controlling. The Board expressed concern that an appropriate guarantee be
furnished by the applicant to insure the right of way and site
improvements as stipulated by the Planning Commission are installed.
The Board requested the Spokane County Prosecuting Attorney prepare
Findings and Order incorporating those conditions contained in
the commission's minutes and setting forth provisions for a
performance bond to insure installation of the required right
of way and on-site improvements.

We object to the decision of the Planriing Board on thie matter for msny reasons.
1• If thie parcel of l,and is allowed to chsnge zones it opene the door for other
areae in the valley to be overrun with comanericel sonea.
29 This deaiefon isn't aonsistent with past decisions of the board and ie, if
alloxed to stand., SPOT ZONNING., which the courts have ruled ageinet in the pest.
3• This matter was first heard on February 9., 1973o at Which time we presented
petitiona and testimor~y cngainst the change. It was continued to,, March 9. 1973.
6n March 9th at 9AM we presented more evidence and letters of objections ngPinst
the proposed change. After all this, the board listened to mArq other matters,
most of them long and detailed., for the remainder of the dey. Finally at 5:15PM
the P1.anning Board took a vote on this matter. After all day; one manth for Ynany
of the iterrus presented; the board had forgotten most of the things said atxi
presented. We feel after a very long and hectic day the boPrd Was confu8ed.
Thie xas in evidence bp their queetions durp6ng the voting. They hAd come to
the poi,nt of having many of the issues, presented thet dey, conflused in their
minds.
4. We have many other objections to the decision and many mistPkes noted in the
way the desieiaa iraB reached. These are too numeroue to put in trhia letter.
We therefors ask you to grant ue a special hearing on this mRtter, i.n order thet we msy appeel the cleaieion ren,dered by the County Planning Board.

Planning Commission Recommendation; Approve to Local Business Zone,
subiect to the following conditions: ' e!
A. Conditions:
1. Dedication and improvement to Spokane County standards of the
East 10' of the ownership along Farr Road for right of way.
(Improvements shall include curb, sidewalk, drainage control,
and paving to existing oil.)
2. Dedication of a 20' curb radius at the northwest corner o'
Sprague Avenue and Farr Road.
3. Approval of access by the Spokane County Engineer's Office.
4. The subject property shall be daveloped in substantial con-
formance with the "approved" plot plan on file with the
application. An automatic sprinkler system shall be installed
to serve the landscaping on the premises.
5. The Director of Planning shall approve a specific exterior
lighting and signing plan for the restaurant project prior to such
installations.(Such plan shall attempt to confine illumination
to the business area with full consideration to adjacent
residential properties.Advertising structures shall be oriented
to Sprague Avenue.
6. All areas used for access, egress, parking, and circulation
shall be maintained in hard surface paving. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices.
7. Installation of fire hydrants in accordance with the require-
ments of the Spokane Valley Fire Marshal.
B. Reasons:
1. The advertised parcel lies north and east of areas which have
been 2oned Local Busine~s since 1962. The Planning
Commissfon is of the opiElion that the restaurant proposal would
allow a logical and appro )riate extension of the Local Business
area.

proposed restaurant site; thus further encroaching on quiet residential
areas. I
E. In the proposed reconstruction and xi.denin`; o~, Sprague Ave., present
plans call f or an island and left turn lauae at Sprague and Farr, that
X will not allow eastbound traffic to enter the restaurant tirithout travel-

A tra ffic generated North of Sprggwe dve, and west o~.' Farr iid. as well
as North o.f Sprague ave, an3 east of Farr Rd. will be funneled North on
Fzrr Road to reach the restaurant. We feel that the additional traffic
peaks will occur at the same time tnariy school children are walkin~7 along
Farr Road. St. John Vianney as well as public school pupils will face
extrzordinary traffic hazar3s as they walk to arid from the schools and
bus stops. At the present time these pupils use the street as a walkway
since no sideWalks are in place along Farr Road.
We are also concerned with the long range use of the proposed site.
Recent past history o- buffet or smorgasbord type restaurants shows a
hi"h degree of failure in this type establishment in the Valley. We
~ believe a fzilure of t.he proposed restaurant could open the door to
a totally und,esireable bu9iness e;3tablishment.
G. We, as local residents must re],y on you for the safety of our children
as well as to protect indfvidual property values, and peaceful non-
hazardous living. If tflis protection is not provided by organi.zaLions
such as the Planning Commi.ssion ana Cowaty Comim.ssioners, what other
