This bein; the date duly advertised to hear this particular appeal from the recommendation of the Spokane County Plannirg Commission, Commissioner W. 0. Commissioner Allen stated that he wanted everyone to ~,n o;~~~o-^i,:~~d- to be heard. He called on Spokane County Plannirg Di.rector, Charles Huogins, to r~ the recanmendations of the Planning Commission. Mr. Huggins stated that th? matter t:ias first heard on October 30. It is the proposal to zone to Com.. property just west of the intersection at Argonne. The proposal ;•ras for neighborhood shopping center containin,g a supermarket, drug store, and a.. ciated businesses. The Planning Commission's recommendation was for approval Ub3 ect to conditions which I4r. Hu,ggins read fro~:n the minutes of the October J, 1969 meetirag. (See attached). He stated that since the appeal has been iled, the County Planning Department and the County En,gineer have made ~ddi~iona~. _o:zs ;rith control of access on Argonne Road. Commissio]aer Allen as?:ed hoyi far this property YJ2S from the railroad track and 11r. Huggi.ns answered that it was approximately 150 feet. CA-nmissioner Geraghty pointed to the map and asked if the zone chan,;e goes all the way to the narrocc triangle at the irest end of the property in question. Mr. Huggins explained that it was not felt that this extremely narraw triangle could be used for ar~-y- good use. Mr. Huggins shot-,ed various dra?•dn,7s shorrin~ the p-roposea shopping center site. He stated that the additional traffic causes peopl.e to send their children doin to their neighborhood to play because of the addi-- tional traffic that the light on Argonne brin.os. Cor,znissianer Allen asked Mr. Role if he was aware tha~ there was a portion of the property already zoned Commercial and 14r. Role i.ndicated that he n~3 no idea that they V;otild consider puttina in another shopping center. Mr. Delbert Trad: of 8515 E. Mansfield said that he lives across the street z rc::z 1-ir. Role and that his bi;gest camplaint of the shopping center iras the addi- tional traffic and the c3ecrease in property values. He said that he didntt believe that one more shopping center could make it because of the cornpetiti_on of the Argo~ne Shoppiiig Center. rir. Allen said that the hearing ~•;as not to decide whether or no~ they could make it but rather %bether this was a su~_t~:~,lc; area to be rezoned for a shoppin.g center. Mr. Role said that it was his opinion that houses could be put along the railroad tracks if the ZO;IC'-i Cv,'i.'i:Ci,~.~ . . R03ISCN Pave 2 Commissioner Geraghty asked rlr. Trad if Aroonne Village i-ras there when he moved in and t-ir. Trad said that it was but didn't concern hi.m as it was close enou;h to be convenient for shoppi.ng but yet far enou;h away to not be of a nui- sance. Mr. John Odette of 8603 E. riansfield said that he would like to bring up the need for this shopping development by saying some of the things that have gone through people's minds. He said that no one is going to benefit from shopping centers on every block. He said that there is too much business out there no-vr. He said that banking facilities would be vrelco:ne in Argonne Village. He said that there was other space available Vrithout disrupting this area. He said that they didn't want the additional traffic. He said that all of the people con- tacted by the petitioners were against the zoning change, and that at the other meeting only one party was for the change Vrho'kas in the imrnediate area. He said that there were other considerations such as what the development would do to property values. He said that they didn't t,;ant their property values chan,;ed. He said that the streets Sargent and Bessie noc•, are gravel and most . of the traffic would have to use Sargent . He said that if the streets were paved, they would have to pay for the paving. He s aid that &t the present time the gravel streets are adequate. He said that they didn't want to pay an assess- ment for paving, a street that V.ould be of no benefit to them. He stated that if the shopping development went in the streets would have to be paved. He ~ said that all of the residents like the peacefulness of the neighborhood and that they didn't want a lot of additional noise. He said that most supermarkets are now open up to 11:00 o'clock at night and people are there long after that getting ready for the next day's business. He thought that this would disrupt the neighborhood. Commissioner Al1en asked if ar~yone else who lives in the neighborhood would li.ke an opportunity to speak. - Everest SVZOpe of $521 E. Mansfield said that what he had to sa}r was about the same as already had been said. He stated that he moved into the neighborhood because it was close to a shopping center but it was away from the traffic and the congestion and they didn't have to Vrorry too much about their children. He sai3 that anyone living out of the city moves out there usual.ly because they want to move away from the noise and congestion of city life. He said that he moved into his home about 1~ years aoo because he lived on the other side of Ar- gonne. He said that 14r. Sam Postell o►ti-ned praperty all around him and that Postell tried to put in everjrthing conceivable and so he sold and moved wherE he felt that it would be better. He didn't feel that he i•:anted to sell again and move because thinds are goi.ng to be congested and he wants to live where there isn't so much conoestion. He stated that he has already move3 two times because of this same type of __situation and doesn't want to move again. He said that there was ample shopping area an3 that they didn't feel they needed any more. Mr. Geraghty asked Mr. Swope if he had seen the vacant property. Mr. Si-rope said that he had seen the vacant property but understoa3 that it vrould be used for houses or a golf range. He said that he feels that if people wantzd to build houses,-~hey would be no closer to the railx oad tracks t;han he is. klrs. Jeffery of 8709 E. Knox said that she has lived in the area for about 13 years and that she feels the shopping center will be detrimental because of neighborhood children trho play in that area. The shopping area would malte additional traffic, she felt. She said there is so much traffic now that it is da.erous and as far as housin~, one of her neighbors lives close to the railroad tracks and he does not feel that it is a nuisance. She didn't feel that the area in question was unsuitable for residential. She thoudht that they (Rosauers) should develop onto Argonric Villa-e. - ~ ROBISCH Pa.ge 3 Mrs. Earl R. Bibelheimer of 2218 Marguerite said that she lives south of the proposed area. She said that they moved into the area before the Argonne Shop- ping Center went in. She stated that they moved out there to get away fram the traffic. She thought that the area was more suitable for a duplex than a shopping center and felt that Argonne Village was sufficient. William Lcnkc of 14'. 22'11 Hu~chinson said that hc was o,-)po~ed 'uo this becaus-- of the traffic problem. He s aid that the traffic comes down his street and that it creates a traffic hazard for their children and animals. He said that thc proposed shopping center would double their present traffic. He said that the shopping center wouldn't bother him but it is an unnecessary thing becau:~e there is so much area to the East of Argonne Villa?e. He didn't feel that trie rai1-- road tracks would be that detrimental for housing. Mrs. John Odette of 8$06 E. Mansfield brought out the fact that 48 falqilies signed the petition against the shopping center and that there was only one person in favor of the shopping center. She asked Mr. Allen if the majorit.-,- shouldn't rule and N1r. Al1en answered that this wasn't necessarily so in zonira,, matters which limit property useage. rirs. Odette Ysent on to say that the area doesn't need another shopping center. She said that they are adequately serve:~ by the shopping center that is there now. She mentioned also that there is plenty of room to expand East of Argonne Village. She menti.oned that it would create additional traffic and that they didn't need another shopping center. ' She suggested that houses could be built there. Commissioner Allen said that he rememberc-3 the proposal but that was not bein; planned now. Commissioner Allen asked to hear from the applicants for th:; zone chan;:,,e. Tir. Vic Robisch of 830 N. Divisiont represented himself. He said that he j10L11.d like to establish one fact which, he thought, a lot of people were not aware of. He said that in addition to the 300 feet that is now officially Co:nmercial, the balance of the land t•ras zoned with a conditional cornmercial zoning. He said that people seem to be quite concerned with the amount of the traffic. He said that an apartment building would cause just as much traffic. He said it wouldn't make any difference traffic :•Tise, whether a shopping center went in Qr an apart- ment building,. He said that residential dwellings are c ampletely out of the pic'uure; that it could be a mobile park or either industrial or commercial. didn't feel the residents would want industrial and that at one time they ga~~~,--: serious thought to a mobile park. So, he said, it boils down to either trial or commercial. He said that as far as the other shopping center ti,a:) concernedi they are doing very ttiell. He said that the Rosauers people ar.- atready in this area and they are just moving because they have outgro.:m `.1 = area that they are presently occupyino. He said that the Rosauers people feel that it is an ideal location. He brought out i•,tat he considered important factor. He said that it was brought out that only one person was for the proposed ping center but that therO .:ere five people who didn't Uet a chance to speat. ROBISCH Page 4 Comrnissioner Al1en then brought up the subject of the letter that was con-- tingent on P4r. Robisch's granting the county 10 feet. Mr. Allen then said that he didn't grant this 10 feet to the county at that time. Mr. Robisch said that that was a matter of opinion and t-ir. Allen retorted that not only did Mr. Robisch not grant the 10 feet to tlie County but that he sold it for $8,000 and that this was a matter of record - not a matter of opinion. Commissioner Geraghty said that Mr. Robisch has a piece of property and someone has come alorg with a proposal. Mr. Robisch answered that he had several chances to sell the property at the time the 10 feet was needed by the County and he didn't. Mr. Geraghty brought up th~ fact that there is a real need for lo;r-p; icea hausing in this area. l,ir. Robisch replied that contractors don't want to build apartment houses by a railroad track. He said that sone of the people seem to have the idea that if this goes commercial then this other property can go commercial. It would have to be rezoned from residential to cammercial. Mr. Glen McNews of 2329 N. Sargent Road s aid that he owns lots 1-6 and he is supposed to be the one person that was in favor of the proposed shopping center. He said that a portion of this property is already comrnercial and the rest of it should be. Living next to a business is not always pleasurable, he said. Low income houses are being built and low income housing is a lot more detrtmental than a shopping center which in most cases is kept up in pretty good shape. He said that he lives close and he is in favor if it. He said that if there is a chance of the property beirg devalued he is all for it because he is being taxed out of it right noi•r, he stated. He said that he lives along the Northern Pacific Railroad tracks. He said that he bought the other lots to keep people from buildi.ng. I4s. McNews stated that Mr. Robisch pointe3 out that he had talked to several of these neighbors and they were under the impression that if this Commercial zoning were allowed, they did not realize that it did not effect this area in here. (He pointed out the area on the map). He said that there is bound to be traffic. He said that lojr-.inco:ne people livin.; in lo~,.--incorne housing v.,Ith cars of various ages and no garages would be more detrimental to the neighborhood than a shopping center. He said that most of the people object to it primarily because of the traffic and property develuation. He said that there is bound to be an increase in traffic. He stated that there are people whose names are on the petition who are not noYr against it. He said that the majority of the property o:•mers on the South side of Montgomery are not against it. He said that he actually feels that this shoppino center ::~.11 be a benefit to the area rather than lo~•.-cost housin, with transient tenants. He didn't feel that the property vras suitable for resi- dential property. He stated that he had a lot of trouble gettin.; p°rmission to build his house where he did and that he wasn't permitted to face the railroad tracks as he originally wanted. He said that the property in question, as far as he was concerned, was either commercial, iridustrial, or mobile home park. He said that as far as the roadway was concerned, he personally vrill resist it as far as he can and that he wants to get the County to vacate this roadway. Mr. Art Bittrick fro:n Roszuers stated that they don't have a large enouGh store where they are and that the develop:nent they have in mind s..zll be better suited to their needs. Commissioner Allen asked if there was an,yone else Vrho ::ished to speak before they closed the hearing. He stated that the Board -vro•ald like a chance to review all of the test:Umony that was given and also an opportunity to go out and look at the neighborhood an3 -vrithin aweek or 10 days he hoped that there would be an ans vrer. Commissioner Geraghty sugges'ued that they make a decision within two weeks. The County Engineer's office will be using Montgomery as part of the detour plan when we work on the Argonne - railroad crossing. This work will involve widening Montgomery temporarily. This widening will come within 1' of his property line. once our project is completed on Argonne the County will remove the extra pavement and construct sidewalk along his frontage. Ron Green is concerned that we will destroy his landscaping and it would have to be replaced at our expense. He would like to hold off on installing the permanent landscaping until after this work on Montgomery is completed. The completion of this project fs,expected in 2 to 3 years. He is willing to plant grass in the interim. I have told Ron Green that landscaping is not a concern of the Engineer's Department and any questions regarding landscaping should be brought to the attention of the Planning Department. Mr. John Odette of 8503 E. Mansfield said that he would like to brinU up the need for this shopping developnent by saying some of the things that have gone through people's minds. He said that no one is going to henefit fran shopping centers on every block. He said that there is too much business out there now. He said that banking facilities would be welcome in Argonne Village. He said that there was other space available without disruptino this area. He said that they didn't want the additional traffic. He s aid that all of the people con- tacted by the petitioners were against the zonin.g change, an3 that at the other meeting only one party t•ias for the cha.nge Vrho was in the immediate area. He said that there were other considerations such as what the development would do to property values. He said that they didn't want their property values changed. He said that the streets Sargent and Bessie now are gravel and most ~ of the traffic i:ould have to use Sargent . He said that if the streets were paved, they would have to pay for the pavirg. He said that ;~t the present time the gravel streets are adequate. He said that they didn't want to pa,y an assess- ment for pavinv a street that would be of no benefit to them. He said that most supermarkets are now open up to 11:00 o'clock at night and people are there long after that gettirg ready for the next day's busi.ness. He stated that he has already moved two times because of this sarie type of __situation and doesn't V.ant to move again. He said that there was ample shopping area an3 that they didn't feel they needed any more. Mr. Geraghty asked P•ir. S:aope if he had seen the vacant property. Mr. S:rope said tha'u he had seen the vacant property but understoal that it would be used for hauses or a golf range. Knox said that she has lived in the area for about 13 years and that she feel.s the shopping center will be detrimental because of neiohborhood children i•rho play in that area. The shopping area would make additional traffic, she felt. She said there is so much traffic now that it is dange-rous and as far as housing, one of her neighbors lives close to the - railroad tracks and he does not feel that it is a nuisance. Mrs. John Odette of 880b E. l~iansfield brought out tr~e i act tr:at ~,~s f'~:ailies signed the petition against the shopping center and that there was only one person in favor of the shopping center. She asked hir. Allen if the majority shouldn't rule and I+~r. Allen answered that this wasn't necessari.ly so in zonir~ matters which limit property useage. Mrs. Odette Vrent on to say that the area doesn't nee3 another shopping center. She said that they are adequately served by the shopping center that is there not~r. She mentioned also that there is plenty of room to expand East of Argonne Village. She mentioned that it would create additional traffic and that they didn't need another shopping center. She suggested that houses could be built there. She said that they have resided in one home for quite a number of years and that they moved out in the valley to get a~~ray from the traffic and the noise. She thought that the people in the area should be given a little choice. Mrs. Ella Shumaker of I~l. 232~ Vista said that several years a~o she i~~as approached to put a road from Argonne to Vista alon~ the railroad right of ~•,ay. She won- dered if this propos~l would go into effect iaith the proposed shoppir~g center. Commissioner Al1en said that he remembered the proposal but that was not being planned now. Commissioner Allen asked to hear from the applicants for the zone change. Mr. Vic Robisch of S30 N. Division~ represented himself. He said that he Vrould like to establish one fact which~ he thought, a lot of people were not a~~are of. He said that in addition to the 300 feet that is noVT officially Canmercial, the balance of the land t,ras zoned with a conditional commercial zoning. He said that people seem to be quite concerned with the amount of the traffic. He saici that an apartment buildir~ would cause just as much traffic. He said it wouldn'-~ make any difference traffic-•.~ise, whether a shoppin; center Y.ent in or an apart- ment building. He said that residential dwellings are :.ornpletely out of the picture; that it could be a mobile park or either industrial or co~.mercial. didn't feel the residents would want industrial and that at one time they gav:: serious thought to a mobile park. Robisch's granting the county 10 feet. Mr. Allen then said that he didn't grant this 10 feet to the county at that time. lir. Robisch said that that was a matter of opinion and Mr. Allen retorted that not only did r•ir. Robisch not grant the 10 feet to the County but that he sold it for $8,000 and that this was a matter of record not a matter of opinion. Commissioner Geraghty said that 14r. Robisch has a piece of property and someone has eome along with a proposal. Mr. Robisch answered that he had several chances to sell the property at the time the 10 feet was needed by the County and he didn't. Mr. Geraghty brought up the fact that there is a real need for lo;;-priced housing in this area. Mr. Robisch replied that contractors don't want to build apartment houses by a railroad track. He s aid that some of the people seem to have the idea that if this goes ca-nmercial then this other property can go commercial. It would have to be rezoned from residential to commercial. Mr. Glen hicrdews of 2329 N. Sargent Road said that he owns lots 1--6 and he is supposed to be the one person that was i.n favor of the proposed shopping center. He said that a portion of this property is already c anmercial and the rest of it should be. Living next to a business is not always pleasurable, he said. Low i.ncome houses are bei.ng built and lovr incorae housirg is a lot more detrinental than a shopping center 'Ohich in most cases is kept up in pretty good shape. He said that he lives close and he is in favor if it. He said that if there is a chance of the property being devalued he is all for it because he is being taxed out of it right now, he stated. He said that-he lives along the Northern Pacific Railroad tracks. He said that he bought the other lots to keep people from buildirg,. I4s. McNews stated that Ni.r. Robisch pointed out that he had talked to several of these neighbors and they were under the impression that if this Commercial zonirg were allowed, they did not realize that it did not effect this area in here. (He pointed out the area on the map). He said that there is bound to be traffic. He said that loir-income people livi.ng in loti•;-income housing with cars of various ages and no gara.ges would be more detrimental to the neighborhood than a shopptng center. He said that most of the people object to it primarily because of the traffic and property develuation. He said that there is bound to be an increas e in traffic. He stated that there are people whose names are on the petition vrho are not now against it. He said that the majority of the property ov:ners on the South side of Montgomery are not 2.gainst it. He said that he actua]1y feels that this shopping center uzll be a benefit to the area rather than lot•,-cost housirg with transient tenants. He didn't feel that the property was suitable for resi- dential property. He stated that he had a lot of trouble gettin; permission to .build his house Ylhere he did and that he wasn't permitted to face the railroad tracks as he originally wanted. He said that the property in question, as far as he was concerned, was zither canmercial, industrial, or mobile home park. Turner: Re: Minutes of Plar.ning Com.mission October 30, 1969 (1) We have delivered to Spokane County Commissioners the Right-of-Way Deed for 30 feet of property for future road widening. (2) Covered later in letter. (3) Landscaping, shrubs and sDrinklers will be installed substantially as shown on development plan of site. (4) Before work commences on site, a finalized lighting plan and sign plan will be submitted to the Planning Director for approval. Now regarding (2), we are desirous of entering into a Participation Agreement with the County of. Spokane to curb, sidewalk and pave a portion of Montgomery between Argonne and Sargent Roads. It is under- I stood that the Spokane County Engineering Department will prepare plans and call for bids. After bids have been opened but prior to entering into contract, we will deposit with the County an amount equal to our percentage share of the contract plus 10 per cent and agree with the County to pay our specified share of the cost when billed on the completion of the project. At some time, likely before September, 1972, when our building plans finalize, the County Engineer would then order construction, inspect work and make payments to the contractor. When the project was completed, the County Engineer would present to us a stater:lent of f inal total co st of the proj ect and showing our agreed share. Our participation would be calculated on the final total cost wr.ich would include construction, engineering, inspection and overhead. We understand that under the nresent Road Improvement Program, Spokane County participates up to 25 per cent and that this annual reduction in particination decreases 10 per cent each year during 1971 and 1972. Our development of the area may be delayed until we determine what we may do with another store in the close proximity. This is our problem and our reason for the uncertainty as to project start.
