Approve. Backc~round: In 1967, the Planning Commission and Board of County Commissioners approved a zone change to Multiple Family Suburban, as requested by Dr. Bemis, for the purpose of establishing a Veterinary Clinic as permitted through a"Conditional Use" permit in the Multiple Family Suburban Zone. However, on Septembar 5, 1968, veterinary clinics were deleted from the Multiple Family Juburban Zone as a"Conditional Use" and added to the "Residential Office" Gone as a"Conditional Use". The applicant did not apply for a Conditional Use Permit and Building Permit until November, 19 69 , and the Conditional Use Permit was approved by the Zoning Adjustor on November 17, 1969, after a ffnding that Dr. Bemis had made investments in reliance on the pravious zomng. A bullding perma.t was subsequently issued on December 5, 1969, for the establishment of a veterinary clinic on the subject property. Consequently, at the Commission's direction of October 30, 19 69, the applicant has submitted a zonc; change application to bring the use of his properfiy in compliance with the presenfi Zoning Ordinancz. A. Reasons. 1. The Pines Road property frontaga has been considered by the Planning Commissfon as an appropriate location for high density residential and professional office land use. Several zone change applications have been approved by the Planning Commission and Board of County Commissioners for either Multiple Family Suburban or Residential Office zonfng on RTorth Pines Road frontage between Sprague Avenue and Trent Road. South Pines Road property frontage has also been considered favorably in several instances (Weldon Subdivision apartments and Valley Green apartments) for Multiple Family Suburban zoning. The proposed zone changa is the first Residential Office zone change south of Spragua Avenue to be considered by the Planning Commission. The Commission notes the following two points in consideration of the proposed Residential Office zoning - 7 - (contd. ) ► ~ ZE-73-69 - MULTIPLE FAMILY SUBURBAN TO RESIDENTIAL OFFICE (contd. ) 1) The Multiple Family Suburban zoning permits certain profe s sf onal offices as an outright permitted use, and 2) the present non-residential land use along South Pines Road immediately north consists of three businesses, namely, a lodge, and a grocery store and office complex. The Planning Commission, in view of the foreqoing, is of tho opinion that the proposed Residenttal Office zoninq would be compatible with both the existing land use along Pines Road and tha Planning Commis sion's zoninq policy for Pine s Road in qeneral.
