U938 Sewer Assessment Protest
In response to the above-referenced memo from Mike Dempsey, I have researched the
applicable standards of the now expired Spokane County Zoning Ordinance and determined I
the following:
Zone Reclassification ZE-45-69, from Agricultural Suburban (AS) to Multiple Faznily
Suburban (IVIFS) was approved by the Board of County Commissioners Apri122, 1971 for
all of Block 23 of University Place in Section 20, Township 25 North, Range 44 EWM.
The subject property is approximately 123,250 square feet in size and according to Chapter
4.07 (WS) of the now expired Spokane County Zoning Ordinance, the maximum
densities permitCed for the site are calculated as follows:
Aparmnent houses required a ratio of 2,000 square feet of land per dwelling unit.
123,250 / 2,000 = 61.6 dwelling units
2,000 square feet per uait also equals 21.78 units per acre (43,560/2,000)
Court apartments required a ratio of 3,000 square feet of land per dwelling unit
123,250 / 3,000 = 41 dwelling units
3,000 square feet per unit also equals 14.52 units per acre (43,560/3,000)
These density calculations are based on Section 4.07.060 of the previous Multiple Family
Suburban (NTS) zone and said section also required that 65% of the total land area remain
in open space. Therefore, the allowable densides had to be located on a"buildable area" of
359'0. The original Agricultural Suburban (AS) zoning did not permit multiple family
dwellings and as per Chapter 4.05.050, duplexes were the most intensive residential
density permitted.
The cited sections and definitions of the old zoning code are also enclosed for your review.

The Board of County Commissioners would like to know the maximum
density of units allowable for apartment complexes under the
Agricultural Suburban Zone of the Spokane County Zoning Ordinance
at the time the application for the above rezone was submitted
(i.e. July 3, 1969), as well as the maximum density of units
allowable for apartment complexea u,rider the Multiple Family
Suburban Zone of the Spokane County Zoning Ordinance at the time
the above rezone to Multiple Family Suburban was granted by the
Board (i.e. April 22, 1971).
Please provide the Board with a written memo containing this
information at your earliest opportunity. Please attach a copy of
the relevant portions of the Zoning Ordinance indicating the
maximum densities allowable in these zones at the times indicated.

(Consideration of a change in condition of approval.)
Planning Commission Recommendation: Lpprove the rPalignment of the
rectufred road riqht of way dedication alonq both sides of Mansfield Avenue in
accordance with the Spokane County Engineer's proposal for the widening of
Mansfield Avenue,
A. Reasons:
The Planning Commission formerly approved the subject zone change
proposal, ZE-27-69, subject to the dedication of a fifteen foot strip
of land along the northern portion of the applicant's prvperty adjacent
to Mansfield Avenue at their May 29 , 19 69 , hearing.
The applicant has since submitted a letter stating his request to
provide additional road right of way along the north side of Mansfield
l,venue in lieu of the fifteen feet off of his property. He apparently
has the consent of the property owners along the north side of Mans-
field and wishes to make this arrangement in order to protect existing
buildings along the south side of Mansfield P►venue.
The Planning Commission concurs with the applicant`s requzst provided
that such road right of way realignment be approved by the Spokane
County Engineer's Office.

Washington as reqneated by your office subject to the additional con-
ditions as outlined in the Minutes of July 31, 1969, haa caused us to
modify our initial request.
We are in aecord with your plan to upgrade this area, this being
our intent in requeating the zona change of thia particular block.
There are no curba in the immediate area, and aidewalka completely
around tha block xere not taken into consideration in the initial plan-
ning of thia project, inauuch as it appeared that thia xould not be a
requireaaerrt at that time. It ia alao our underatanding aftar converaing
xith Mr. L. Ralph Smith that there could be a t''urther requirement, that
an on=eite sexage diaposal s3rstem be installed to aervi.ce this develop-
ment.
With these additional costs per unit to be prorated, we are accord-
ingly requesting an alloxance for an amended propoaed plat of thia block

#356, at its regular meeting on July 8, 1969, approved
the petition of the Alvin J. Wolff Company, Inc. for a
zone change fram agriculture-suburban to multiple-family

Spokane County, Washington.
Sixty percent of the property owners, exclusive of the school
district property, had already approved the petition, and
the Board was pleased to join this majority request to up-
