to Multiple Family Suburban
You have asked for an opinion whether the proposed zone
change from agricultural to multiple family suburban would con-
stitute "spot zoning."
Tize proponent, Wolfland, Inc. (F. V. Seipp) proposes
to construct 32 multi-family dwelling units on 3.2 acres or a
gross density of about 10 dwelling units per acre.
The land iscurrently zoned agriculture which permits
a gross maximum density of about five single family dwelling
units per acre. (See Zoning Ordinance, Section 4.04.040 where-
in a lot minimum of 7,000 square feet and 65 feet of frontage
is established)
The land is located near the corner of Knox and Bessie
in the 5pokane Valley. Single family dwellings surround the
property to the north and west. An older home with associated
agricultural pursuits adjoins the land to the west. The
railroad right of way adjoins the property to the north.
Single family residential homes constitute a broader perimeter
of the property to the west, south and east. There are no
multiple family dwelling units within five or six blocks of
the subject property. I would estimate that the average
density of the single family residences in the broader area
surrounding the subject property is three per acre. There
does not appear to be any other vacant land south of the
railroad tracts in the near vicinity of the subject property.
The nearest multiple family dwelling units I noticed were
four cluplexes located about 10 blocks away on Sargent and
the multiple family units located at the Argonne and Freeway
interchange.
For your information I have attached a section map
colored schemed to show the zoning surrounding the property
in question. As you can see for several blocks to the east,
west and south of the subject property, the land is zoned
either agriculture, two family and single family residential.
While all zones permit duplexes on a minimum of
15,000 square feet of land and 90 feet of frontage, none
allow multi-family structu.res.

Spot zoning has been defined by our Supreme Court
as:
'Spot zoning has come to x€tean arbitrary and un-
reasonable zoning action by which a smaJ.l area is singled
out af a larger area or district and specially zoned for
a use classification totally dif ferent fram and inconsis-
tent with the classification of surrounding land, and not
in accordance with the comprehensive plan. Spot zoning
is azoning for private gain designed to favor or benefit
a particular individual or group and nat the welfare of
the carrununity as awhole., See C. Rhyrne,' Municipal Law
5 32-3, at 825 (1957). The vice of a spat zone is itsin-
evitabl.e ef ~~ct of granting a discriminatory benefit
to one or a group of owners and to the detriment of their
neighbors or the cQmmunity without adequate public advant-
age or justificatian. Thomas v. Tawn of Bedford, 11 N.Y.
2d 428, 184 N.E.2d 285 (1962). Zoning merely for the bene-
fit of one or a few, or for ' the disadvantage of some and
with no substanti.al relationship to the public health,
safety, general welfare o~r morals, in conflict with
eitheac the comprehensive zoning plan or ordinance is
arbitrary and capricious and urilawful. Eckes v. Board

or haphazard zoning is -void, and so-called 'spat zoning,'

'spat zoning' may not necessarily be confined to
small areas or lots, the cases in which the courts •
have struct down rezoning ordinances as spot zoning
have involved single lots or small areas. Thus, singling
out of one lot or a small area for different treatment
from that accorded to similar surrounding land .

Accordingly, in my view to change the zoning of the
sub3ect property from agriculture to multiple family suburban
would be:
" . singling out of one lot or a small area for
different treatment from that accorded to similar surround-
ing land indistinguishable from it in character, for the
economic benefit of the owner of that lot.
and would be "spot zoning."
To allow multiple family uses would permit a much
higher density of the subject property than permitted by any
surrounding property.
It is further noted that the plan commission invited
the proponent to resubmit a proposal for duplexes which of course
would not necessitate a zone change.

A. History
Sylvla Court was originally heard by the Planning Commission, June 24,
1977. The proposal at that time calied for the subdlvlston of approxlmately
3.2 acres lnto seven (7) lots, all for multt-family dwelltngs. The proposal
was denled by both the Planning Commissinn and the Board of County
Commtssioners. The appllcant was also instructed to resubmlt the propo-
sal to the Commisslon for cp nsideration of the possibiltty of duplexes on
the slte.
B. Locatlon
Sylvla Court is located in the west central area of the Spokane Vatley,
north of Knox Avenue and east of Vtsta Road.
C. Proposal
The. appltcant proposes to subdlvide approximately 3.2 acres into elght
(8) lots, all for duplexes o The lots are of suffLctEnt size and frontage to
meet the minimums required by the zoning ordlnance for duplexes. The
proposal would create a gross denslty of about five (5) unlts per acre
wtth a minimum lot stze of 12, 600 square feet.
D. Relatlonship to the Comprehenstve Plan
The proposal is sltuated withtn an area designated as suitable for
residential development by the Comprehensive Plan. The property may
be sufflclently disadvantaged to warrant duplexes ln that to the north ls
located severa.l rallroad tracks and Trent Avenue, whlle to the Muth the
street that would serve the property carries enough traffic to consider lt as
an arterlal.

as well as lying north of a street that carries arterial trafffc.

from eight (8) so as to mitigate any possible environmental hazards.
NOW, THEREFORE, the Board of County Commissioners does conclude that the

This being the time set by the Board of County Commissioners of Spokane County,
Washington, to render its decision concerning the request of,Wolfland, Inc.
(F. V. Seipp), South 717 Pines Road, Spokane, Washington, for the above
captioned preliminary subdivision and zone classification upgrading; and
The Board having received no recommendation from the Spokane County Planning
Commission as stated in the minutes of the Commission, dated October, 1977;
and
The Board having conducted its own public hearing on December 8, 1977, at the
request of the sponsor, Wolfland, Inc. and after visiting the site and reviewing
the testimony; and
The Board being fully advised in the premises did determine, based upon the
testimony submitted at the public hearing and other evidence available to the
Board to approve the preliminary plat; PROUIDED, that the plat be limited to
six (6) iots rather than the eight (8) requested and; PROVIDED, further that
the sponsor submit a site development plan to the Planning Staff for approval.
The Board also concurred in the Planning Staff's recommendation that no significant
adverse impacts will result and a Declaration of Non Significance be issued.
The Board instructed the Planning Staff to prepare Findings and Order, for
. execution by the Board at a subsequent meeting, setting forth more definitively
the Board's action in this matter,and setting forth specific conditions of approval.

This being the time set by the Board of County Commissioners of Spokane County,
UJashington, to render its decision concerning the request of !Jolfland, Inc.
(F. V. Seipp), South 717 Pines Road, Spokane, Washington 99206, for the
above captioned preliminary subdivision and zone classification upgrading; and
The Board having received the recommendation of the Spokane County Planning
Commission to deny subject preliminary subdivision and zone classification
upgradning, said denial set forth in the June 24, 1977 minutes of the
Planning Commission.
The Board having conducted its own public hearing on August 11, 1977, at the
request of the applicant, Mr. Seipp, and after visiting the site and reviewing
the testimony; and
The Board having requested and received a legal opinion of the Spokane County
Chief Civil Deputy as to whether the proposed zone change f rom Agricultural
to Multiple Family Suburban would constitute "spot zoning", said opinion
is attached hereto and incorporated herein by reference.
The Board being fully advised in the premises did determine, based upon the
testimony submitted at the public hearing and other evidence available to the
Board to uphold the recommendation of the Spokane County Planning Commission
to deny the preliminary subdivision and zone classification upgrading.
The Board instructed the Planning Staff to prepare Findings and Order, for
execution by the Board at a subsequent meeting, setting forth more definitively
the Board's action in this matter.

You have asked for an opinion whether the proposed zone
change from agricultural to multiple family suburban would con-
stitute "spot zoning."
Tize proponent, Wolfland, Inc. (F. V. Seipp) proposes
to construct 32 multi-family dwelling units on 3.2 acres or a
gross density of about 10 dwelling units per acre.
The land is currently zoned agriculture which permits
a gross maximum density of about five single family dwelling
units per acre. (See Zoning Ordinance, Section 4.04.040 where-
in a lot minimum of 7,000 square feet and 65 feet of frontage
is established)
mhe land is located near the corner of Knox and Bessie
in the 5pokane Valley. Single family dwellings surround the
property to the north and wESt. An older home with associated
agricultural pursuits adjoins the land to the west. The
railroad right of way adjoins the property to the north.
Single family residential homes constitute a broader perimeter
of the property to the west, south and east. There are no
multiple family dwelling units within five or six blocks of
the subject property. I would estimate that the average
density of the single family residences in the broader area
surrounding the subject property is three per acre. There
does not appear to be any other vacant land south of the
railroad tracts in the near vicinity of the subject property.
The nearest multiple family dEaelling units I noticed were
four duplexes located about 10 blocks away on Sargent and
the multiple family units located at the Argonne and Freeway
interchange.
For your information I have attached a section map
colored schemed to show the zoning surrounding the property
in question. As you can see for several blocks to the east,
west and south of the subject property, the land is zoned
either agriculture, two family and single family residential.
While all zones permit duplexes on a minimum of
15,000 square feet of land and 90 feet of frontage, none
allow multi-family structures.

Spot zoning has been defined by our Supreme Court
as:
"Spot zoning has come to mean arbitrary and un-
reasonable zoning action by which a small area is singled
out of a larger area or district and specially zoned for
a use classification totally different from and inconsis-
tent with the classification of surrounding land, and not
in accordance with the comprehensive plan. Spot zoning
is a zoning for private gain designed to favor or benefit
a particular individual or group and not the welfare of
the community as a whole. See C. Rhyme, Municipal Law
§ 32-3, at 825 (1957). The vice of a spot zone is its in-
evitable effect of granting a discriminatory benefit
to one or a group of owners and to the detriment of thEir
neighbors or the community without adequate public advant-
age or justification. Thomas v. Town of Bedford, 11 N.Y.
2d 428, 184 N.E.2d 285 (1962). Zoning merely for the bene-
fit of one or a few, or for the disadvantage of some and
with no substantial relationship to the public health,
safety, general welfare or morals, in conflict with
either the comprehensive zoning plan or ordinance is
arbitrary and capricious and unlawful. Eckes v. Board
of Zoning Appeals of Baltimore Cy., 209 Md. 432, 121
A.2d 249 (1956." Lutz v. Longview, 83 Wn.2d 566, 520
P.2d 1374 (1974).

"Although not denounced by any hard and f ast rule,
zoning in a haphazard manner is not favored and, on the
contrary, zoning should proceed in accordance with a
definite and reasonable policy. Thus, a zoning ordinance
or an amendmEnt of a zoning ordinance to permit piecemeal
or haphazard zoning is void, and so-called 'spot zoning,'
where it is without a reasonable basis, is invalid. The
legislative intention in authorizing comprehensive zoning '
is reasonable uniformity within districts having in fact
' the same general characteristics and not the marking off,
for peculiar uses or restrictions of small districts
essentially similar to the general area in which they are
situated. Accordingly, an ordinance cannot create an
'island' of more or less restricted use within a district
zoned for a different use or uses, where there are no
differentiating relevant factors between the 'island' and
the district. Ordinarily, the term 'spot zoning' is used
to denote an amendment to the municipal zoning law
. reclassifying one or more lots or parcels of land for a use out of harmony with the classification of the surrounding
areas and without regard to public welfare. While the term

'spot zoning' may not necessarily be confined to
small areas or lots, the cases in which the courts
have struct down rezoning ordinances as spot zoning
have involved single lots or small areas. Thus, singling
out of one lot or a small area for different treatment
from that accorded to similar surrounding land
indistinguishable from it in character, for the economic
benefit of the owner of that lot or to his economic •
detriment, is invalid 'spot' zoning." (Emphasis Added)
Accordingly, in my view to change the zoning of the
subject property from agriculture to multiple family suburban
would be :
" . singling out of one lot or a small area for
different treatment from that accorded to similar surround-
ing land indistinguishable from it in character, for the
economic benefit of the owner of that lot.
and would be "spot zoning."
To allow multiple family uses would permit a much
higher density of the subject property than permitted by any
surrounding property.
It is further noted that the plan commission invited
the proponent to resubmit a proposal for duplexes which of course
would not necessitate a zone change.

We f eel with only four menbers present at the hearing we did not
receive a fair hearing. We further f eel with the railroad tracks
bordering one side and the arterial Knox Avenue on the other side
the platting into 4-Plex lots was proper.

2. Topography, soils and water.
a. This proj ect lies in a relatively flat area in northwest Dishman. Local
drainage ways are insignificant. It is located over the $pokane Valley
Aquifer.
b. Surface soils are classed as Garrison gravellq loast with 0 to SX slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.
c. Geologically the soils are glaciofluvial deposits; stream-laid sand and
gravel; coatains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic structures yfeld moderate to very large amounts
of water.

d. The data f.rom wells in the area shows the wells are 90 to 120 feet
deep and have static water levels varying from 56 to 74 feet below
the surface. The total nitrogen level was 1.2 ppm. The Washington
Water Power Company has indicated that it can supply domestic use
and fire protection water for the plat upon completion of agree-
ments with the developer.
3. Impact discussion.
a. The plat sponsor has proposed 7 lots on 3.2 acres. Each lot is to be
served bq a public water system and its individual on-site sewage dis-
posal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course of the conduct of the Army Corps study , Dr. Todd con-
sidered typical soils, natural and sewage disposal recharge to the
groundwater, and the effect of continued urban development in the
Spokane River Valley upon the quality of the groundwater. In summary,
he concluded that:
1. In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried
to the groundwater. However, bacteria and detergents (phos-
phate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents such
as phosphates, which are known to react with soil particles,
or nitrates, which are taken up by plant roots" will be less
than the total found in septic tank eff luents.
3. "The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background."--"The
analytical results of the forecast impact of year 2020 when
compared with the present i.mpact, both measured in terms of
leachate volume and dissolved solids concentratioa, indicate
that the present impact on groundwater quality is already, a
substantial proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater in the range of 1.20 ppm. A projected incremental
increase using Dr. Todd's expected 8.6 percent would result in ranges
from 1.30 ppm. Current Federal and State drinking water standards per-
mit up to 10 ppm.

d. Alternative sewage disposal methods that would not recharge the
groundwater have the follouring general characteristics:
1. Collector and central treatment systems discharging to
surface waters would require at least tertiary treatment
and perhaps more to obtain a permit for the discharge
from the Department of Ecology. These systems are not
currently economicallp available for this project.
2. Sealed systems, whether individual or community, depend
on evaporation for liquid removal from sludges. These
systems require more land area than a conventional sub-
surface drainfield. Some, such as lagoons,have safety
h(azards associated with them and relatively poor community
acceptance. Land, installation and operational cost are
generally more expensive than those for septic tanks and
drainfields.
4. Recommead that:
a. A public water system including fire flows serve each lot prior to sale
of the lot.
b. Each,lot be authorized the use of an individual on-site sewage system
until a public system becomes available.
