FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE RECLASSIFICATION
PE-1104-77 SOUTH EVERGREEN ADDITION ZE-82-77 AGRICULTURAL TO SINGLE FAMILY RESI '
DENTIAL. - WHEREAS, the Spokane County Planning Commission did, after public hearing
on May 13, 1977 forward to the Board of County Commissioners a recommendation that the preliminary plat to be known as South Evergreen Addition (File #PE-1104-77)
and zone reciassification to the Single Farniiy Residential zone (File #ZE-82-77) be approved, and
WHEREAS, Patrick H. Murphy did request a'special hearing before the Board
of County Commissioners to present evidence and testimony against the recommendations
of the Planning Commission to approve the above described preliminary plat and zone
reclassification, and
WHEREAS, the Board of County Commissioners did hold a public hea ring on
June 30, 1977 to consider the recommendations of the Planning Commission, the testi-
mony and requests of the applicant, objectors, and other interested parties, and
.
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary piat proposal and zone reclassification,
the Board of Caunty Commissioners of Spokane County having fully considered the
testimony given, the records and minutes of the Planning Commission, the environmental
assessment, and all other evidence presented, and having personally acquainted them-
selves with the site and vicinity in question hereby find that the conclusions of
the Planning Commission were generally valid and sufficient, although the plat should
be redesigned so as to incorporate a redesign that would not exceed six lots, all for
single family dwellings. Now, therfore, the Board of County Commissioners does
conclude that the preliminary plat be known as South Evergreen Addition (File #PE-1104-77)
and zone reclassification to the Single Family Residential zone (File #ZE-82-77)
should be, and hereby is, approved subject to the conditions as contained in the
Planning Commission minutes of May 13, 1977, except that in connection with condition
P-i it shall be modified to read as follows:
That the preliminary plat be redesigned as indicated on the revised
preliminary plat of record dated August 14, 1977 and shall contain no more than
six lots all for single family dwellings. The Chairman is hereby authorized to issue
a Final Declaration of Non- Significance.

Gentlemen:
I have been advised that the Board of County Commissioners
hag requested any information or knowledge pertaining to the
above proposed platt and the property on which it is located.
I feel I have knowledge going back to years 1926, 1937 and
moat particularly 1954 and I will make myself available to
acquaint you with this information and knowledge at your
convenience. I will give you some details at this writing.
In 1954 along with my brother, Conrad M. Westerman, and the
William Pearsons, (the Pearsons being the owners of the ad-
jacent property, which is now a controversial issue) we re-
uested the 4acating of Salteee Road. At that time my brother,
~Conrad M. Wegterman) and myself committed ourselves to the
Pearsons that we would platt our properties to the north of ~
them-eo as not to interfere with their buildings and property.
Mrs. William (Rena),Pearson personally accompanied us and
appeared with us before the County Commissioners of that time,
and agreed to the vacating of Saltese Road entirely upon the
firm committment of Conrad M. Westerman and myself, otherwise ~
it would have been extremely doubtful that Saltese Road would
hav-e been vacated. The Pearsons were the only property owners
i.nvolved to object to the vacating of that portion of Saltese
Road, and I might add they had acquired their property in 1923. .
I feel very strongly about living up to my personal committ- ~
ments and obligations even though I am no longer involved in
the matter per set I object to the platt as submitted for the

Clark has mainta.ined that part of the titi'esterman property has passed
into the ownership oF Clark through cont inued usE thereof over a
period of years. Litigation on this matter is now pending in
Spokane Superior Court under case #237747.
Because of the dispute referred to above, Clark has objected to
the approval of the plat and zone change. However, since the date
of the last hearing before the County Commissioners, we believe
the dispute between Clark and Westerman through compromise agree-

ment, has been resolved. A copy of the proposed "Stipulation fo-r,
Settlement" is enclosed. It has not been signed because we do not
know where the County will require the road to be placed which is

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
J. Brent McKinley, North 1014 Pines Road, Spokane, Washington 99206 for the
above captioned preliminary subdivision and zone classification upgrading;
and
The Board having received the recommendation of the Spokane County
Planning Commission to approve the preliminary plat, subject to findings
and conditions as contained in the Commission's minutes dated May 13, 1977;
and
The Board having conducted its own public hearing on June 30, 1977 at the
request of Attorney Patrick H. h1urphy on behalf of Mr. and Mrs. Lyle Clark,
South 2124 Evergreen, Veradale, Washington and after visiting the site
and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the recommendation of the Spokane County Planning
Commission to approve the preliminary plat, subject to findings and
conditions as contained in the Planning Commission minute's of May 13, 1977
EXCEPT that in connection with condition P-1 it shall be modified to read
as follows:
That the plat be designed as indicated on the revised
preliminary plat of record (dated ,4ugust 14, 1977) and
shall contain no more than six lots, all for single
family dwellings.
The Qoard also concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of NonSignificance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

MEMORANDUM
1. Zoning Problems
Section 4.02.030 of the Spokane County Code defines a single
family residential zone (R-1) as follows:
The "single family residential zone" is a land use
classification for a district suitable for resident-
ial uses which is or will become a single family
unit living area. Uses are limited to single family
dwellings, together with supplementary uses such as
schools, churches, parks, and playgrounds. Home
occupations, trailers, and animals, except for house-
° hold pets, are specifically prohibited.
Section 4.04A.040 of the Spokane County Code sets out
the uses permitted on a ten thousand square foot lot with
eighty foot of front8ge: On property of not less than ten thousand square
feet with not less than eighty feet of continuous
frontage on a public street, the following uses in
addition to the uses listed in Section 4.04A.030
above are permitted:
( a ) One single family dwelling with the uaual
accessory buildings and struc`tures commonly appur-
tenant to residential use;
(b) The keeping of not to exceed two boarders
' and/or lodgers in any one family dwelling unit.
The lots proposed in this instance are 86.4 feet by
115 feet. This gives them a total square footage of 9,936
feet which means that anyone purchasing these lots would be
in violation of the Spokane County Code if they were to
erect a single family dwelling on the lot purchased. Further-
more, one of the lots will have a radius taken out of it
which means ttiere will be at least an additional 100 square
feet lacking from the Code requirements.
2. Law Suit Problems
Mr. and Mrs. Clark have an adverse possession claim
pending in the Spokane County Superior Court for a portion
of the property which would be utilized for the access road.
The Clarks are almost certain to prevail in this matter as
did similar Plaintiffs in the case of Lewis v. Seattle,
174 Wash. 219, 24 P. 2d 427 (1933), reh. 174 Wash. 226, 27
P2d 1119 (1933). When the Clarks prevail in their law suit,

approximately 10 feet of the area which is to be dedicated
according to proposed plat will no longer be available for
dedication. This will mean that either the County has appro-
ved the meaningless plat or that access to the plat and lots
will be inadequate.
Furthermore, should the Clarks lose their lawsuit and
this plat be approved, the access road would lie within 5
feet of the side door to the Clark's residence. This would
mean that the Clarks were in violation of Section 4.04.150
of the Spokane County Code requiring a distance of 15 feet
between a residence and a flanking street.
3. Environmental Impact
The action which the County would be approving if it
were to approve this plat would be a" major action" within
the meaning of SETA. Consequently, an environmental impact
statement should be prepared in this case before the plat
is approved. Eastlake Community Counsel v. Roanoke Asso-
ciation, 82 Wash. 2d 475, 513 P.2d 36 (1973)

This letter is written to confirm that which I mentioned
in my telephone call to your of f ice earlier today.
We represent Lyle Clark and his wife who own and live upon
the property which is known as 2124 South Evergreen, Veradale.
We are informed that Mr. Conrad M. Westerman, who is the
owner of the property described as :
Section 27, Township 25 North, Range 44, E.W.M; The
South 2 of the North * of the NE4 of the SE~ of the
NE* of Section 27, Except County road right of way,
through the sponsorship of J. Brent McKinley, is requesting that
zoning be changed from Agricultural to single family residential
and that the area be divided into seven residential lots.
This is to advise you that our clients, Clark and wife,
claim ownership of at least the south 25 feet of the property
described above for which the zone change and plat are requested.
Clark§ North boundary fence and their garage are located on the
25 ft, strip. There is not pending in Spokane Superior Court,
case #237747, an action between Clark and Westerman which we
expect will resolve the ownership rights of the parties in this
regard.

Introduction: The State Environmentai Pvlicy Act of 1971, Chapter 43.21C, RC'•w,
requires all state and local governmental aqencies to considet environmental values
both for their own actions and when licensing privaCe propasals. The Act also requires
that an Envfronmencal Impact Statement be prepared for aIl major actions sfgnificantly
(and "edversely", as per WAC 197-10) affecting the quality of the environment. The
purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the infocmation
presently available to you. Please answer questions as "yes" or "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the dea,ree of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers sre required, or where you
believe an explanation would be helpful to qovernment decision-makers, include your

2. Topoqraphy, soils and water.
a. The plat is in generally flat area south of Opportunity.
b. Geologically the soils in the area are glaciofluvial deposits; stream-
laid sand and gravel containing some boulders in places and including
some vndifferentiated glacial deposits; lower terrace remnants proba-
b1y rewarked by streams; yield moderate to very large amounts of
water. We11 logs show most wells to be 200 to 250 feet deep yielding
1000 to 4000 gallons per minvte. We11s in this area penetrate gen-
era11 y gravel y soil s.
c. Structurally the soils are cZassed as Garrison graveZl y 1oam, 0-5
percent slopes, with slight Zimitations for septic tank filter
fields; possible contamination of groundwater. Field investigation
reveals no evidence of groundwater that would preclude subsurface
disposal of wastewater under current Health District regulations.
The District has no record of excessive failures of drainfields in
this immediate area.
d. The data from 8 Vera Water and Power Company we11s in the area
shows the wells are 140 to 175 feet deep and have static water
levels varying from 110 to 158 feet below the surface. The
highest total nitrogen 1eve1 was 3.42 ppm with the average being
1.73 ppm. The Vera Water and Power Company has indicated that it
can supply domestic use water for the plat upon completion of
agreements with the developer.

3. Impract discussion.
a. The plat sponsor has proposed 7 lots on 2.39 acres with a typical
1ot size of 86 by 115 fee. Each Iot is to be served by a
public water system and its individual on-site sewage disposaZ
system. This raises the question of significance of the imgact
on the groundwater in the area and possible alternatives for
sewage disposaZ.
b. In the course of the conduct of the Army Corps study*, Dr. Todd
considered typical soils, natural and sewage disposal recharge
to the groundwater, and the effect of continued urban development
in the Spokane River Va11ey upon the quality of the groundwater.
In svmmary, he concluded that:
,(3) In normal precipitation years subsurface disposal of
sewage treatment eff3uent does reach and recharge the
groundwater.
(Z) A11 the dissolved salts in sewage effluent wi11 be carried
to the groundwater. However, bacteria and detergents (phos-
phate portion) are mostly removed by the deep soil Zayer
above the groundwater and "minor dissolved constituents
svch as phosphates, which are known to react with soil
particles, or nitrates, wheich are taken up by plant roots"
will be less than the total found in septic tank effZuents.
(3) "The calculated results at the downstreasn end of groundwater

"The analytical rest33ts of the forecast impact of year 2020
when compared with the present impact, both measured in terms
of leachate volume and dissolved solids concentration, indi-
cate that the present impact on groundwater quality is
already a substantiaZ proportion of the ultimate level."
c. Current3y, resuZts of chemical analysis show the total nitrogen co»tent
of the groundwater as in the range of 1.22 to 3.42 ppm. A projected
incremental increase using Dr. Todd's expected 8.6 percent would re-
sult in ranges from 1.32 to 3.71 ppm. Current Federal and State
drinking water standards permit up to 10 ppm.
d. Alternative sewage disgosal methods that would not recharqe the
groundwater have the following generaZ characteristics:
(1) Collector and central treatment systen►s discharging to
surface waters would require at least tertiary treatment
and perhaps more to obtain a permit for the discharge
from the Department of Ecology. These systems are not
currently economically available for this project.

(2) Sealed systems, whether individua.l or community, depend
on evaporation for Iiquid removal. These systems re-
quire more land area than a conventional svbsurface
drainfield. Some, such as Zagoons, have safety
hazards associated with them and re3atively poor community
acceptance.
