After reviewing the conditions set forth in the Mitigation Agreement and the actions taken by Developer, the City has determined that the Developer has complied with the following conditions, and all such conditions are deemed to be satisfied by the City: Section 3 —Mitigation Fee: Paid in full Section 4—Payment: Paid in full Section 6 — Compliance with RCW 82.02.020: City has expended the mitigation fee on design, right-of-way acquisition, and construction of the Project and did so within 5 years of receipt of funds. All other conditions, requirements and provisions of the Mitigation Agreement remain in full force and effect as provided by the Mitigation Agreement and as intended by the Parties.
