BACKGROUND: Staff has received a request for consideration of"Plastic Injection Molding" as a permitted use in business zones. Using current technology, the process involves heating plastic pellets within a mold. No solvents or Volatile Organic compounds are used in the molding process. Machinery is hydraulic, generating less noise than a small forklift. The process is less intensive than a print shop which is a permitted use in both B-2 and B-3 business zoning districts. Currently the use is permitted only in 1-2 Light Industrial and 1-3 Heavy Industrial zoning districts. The proposed amendment was sent to CTED on December 8, 2005, and a Determination of Non-Significance (DNS) was made on the same day, with comments due on December 30, 2005. Spokane Valley Airport Hazard Zone CITY OF SPOKANE VALLEY SPOKANE COUNTY, WASHINGTON ORDINANCE NO. 06- AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, WASHINGTON, AMENDING SVMC 10,309.060 BY AMENDING CHAPTER 14.702 AIRPORT OVERLAY (AO) ZONE IN THE VICINITY OF FELTS FIELD, PROVIDING FOR SEVERABILITY; AND ESTABLISHING EFFECTIVE DATE. WHEREAS, the Interim Comprehensive Plan adopted by the City of Spokane Valley pursuant to Ordinance 52 (2003) , codified in SVMC 10.30.010; and WHEREAS, Interim Plan Goal T.3g provides for the protection of airports from encroachment by incompatible land uses and the prohibition of uses which would conflict or obstruct airport operations and airport safety; and WHEREAS, Felts Field is located both within and adjacent to the city of Spokane Valley; and WHEREAS, Airport hazards endanger the lives and property of users of landing fields and persons in the vicinity of Felts Field; and WHEREAS, Airspace obstructions and incompatible land uses impair the utility of an airport and diminish the value of the public investment therein; and WHEREAS, Preventing the creation or establishment of airport hazards and incompatible land uses protects the public health, safety, and general welfare, and promotes the most appropriate use of land; and WHEREAS, the protection of airspace and prevention of airport hazards is regulated pursuant to CFR Part 77 and RCW 14.12.020; and WHEREAS, Ordinance No. 53 (2003) adopted the Spokane County Zoning Code, as codified in SVMC 10.30.060; and WHEREAS, this ordinance amends Section 14.702 of the adopted Spokane County Zoning Code; NOW, THEREFORE, the City Council of the City of Spokane Valley, Washington, does ordain as follows: Section 1. SVMC 10.30.060 is hereby amended to amend Chapter 14.702 to read as follows: "Chapter 14.702 Airport Hazard Overlay (AO) Zone 14.702.000 Purpose and Intent The purpose and intent of the Airport Hazard Overlay Zone is to reduce the potential for airport hazards, because, it is found that:: 1. An airport hazards endangers the lives and property of users of landing fields and property or occupant: and persons in the vicinity of landing fields within Spokane CountyFelts Field-: and 2. All uses and activities are at all times subject to the underlying zoning district. Conical Arca (CA): The conical arca is all that land which lies directly under an imaginary three dimensional surface (the conical surface) extending outward from the Spokane Valley Airport Hazard Zone 30,000 feet as measured radially outward from the edge of the primary surface except extend upward and outward from the primary surface at a slope of one vertical foot for every one hundred horizontal feet for a horizontal distance of thirty thousand (30,000) Air Hazard Height Restrictions Except as otherwise provided herein, no building or structure shall be erected, altered. or maintained so as to proiect or otherwise penetrate the FAR Part 77 airspace surfaces shown on the Airport Hazard Map attached hereto and made a part hereof for all purposes. Such applicable height limitations are hereby established for each of the zones as follows: 1. Primary Surface—A surface longitudinally centered on a runway. The primary surface extends 200 feet beyond each end of the runway and is 1.000 feet wide. The elevation of any point on the primary surface is the same as the elevation of the nearest point on the runway centerline. 2. Precision Instrument Runway Approach Zone - Slopes fifty (50) feet outward for each foot upward beainninq at the end of and at the same elevation as the primary surface and extending to a horizontal distance of 10,000 feet along the extended runway centerline: thence slopes upward forty (40) feet horizontally for each foot vertically to an additional horizontal distance of 40.000 feet along the extended runway centerline. 3. Transitional Zones - Slope seven (7) feet outward for each foot upward beginning at the sides of and at the same elevation as the primary surface and the approach surface, and extending to a height of 150 feet above the airport elevation which is 1.952 feet above mean sea level. In addition to the foregoing. there are established height limits sloping seven (7) feet outward for each foot upward beginning at the sides of and at the same elevation as the .approach surface, and extending to where they' intersect the conical surface. Where the precision instrument runway approach zone projects beyond the conical zone, there are established height limits sloping seven (7) feet outward for each foot upward beginning at the sides of and at the same elevation as the approach surface, and extending a horizontal distance of 5.000 feet measured at 90 degree angles to the extended runway centerline. 4. Horizontal Zone - Established at 150 feet above the airport elevation or at a height of feet above mean sea level. 5. Conical Zone - Slopes twenty (20) feet outward for each foot upward beginning at the periphery of the horizontal zone and at 150 feet above the airport elevation and extending to a height of 350 feet above the airport elevation. The following items are exempt from this provision. except as follows: 1. Any structure or object that would be shielded by existing structures of a permanent and substantial character or by natural terrain or topographic features of equal or greater height,and would be located in an area of established shielded will not adversely affect safety in air navigation.. 2. Any air navigation facility, airport visual approach or landing aid, aircraft arresting device, or meteorological device, of a type approved by the Federal Aviation Administration, or an appropriate military service at military airports, with a fixed location and height. 3. Incinerator(s) and/or associated structure(s) owned and/or operated by a municipal corporation or political subdivision, either individ.lally or jointly. 43. Prohibited uses in all Airport Land Use Compatibility Zones: a. -Any use that creates or causes interference with the operations of radio or electronic facilities at the airport or with radio or electronic communications between airport and aircraft,_ b. Any use or lighting that impairs makes it difficult fora pilot's ability to distinguish between airport lights and other lights., or that creates-glare in the eyes of pilots using the airports.affecting pilot-vision: or otherwise impairs visibility in the vicinity of the airport. All lighting shall be "cut-down" and fully shielded. c. Any use that endangers the landing, taking off, or maneuvering of aircraft: or d. Such uses include: 1. amusement parks, fairgrounds 2. box retail 3. convention/exhibit halls, major auditoriums, theaters 4. stadiums and arenas 5. temporary events attracting dense concentrations of people—fairs, circuses, carnivals, revival meetings. sports tournaments, conventions, but not including events for which exposure to aviation safety hazard is a well-know expectation (air shows, airport open houses, pilot meetings, etc.) 2. Nothing in this chapter shall diminish the responsibility of project proponents to submit a Notice of Construction or Alteration to the Federal Aviation Administration if required in accordance with Federal Aviation Regulations Part 77, "Objects Affecting Navigable Airspace". 14.702.100 Non-Conforming Uses 1. Regulations Not Retroactive- 'The regulations prescribed herein shall not be construed to require the change of use, nor the removal or alteration of any structure or tree not conforming to the regulations as of the effective date of this ordinance, provided however that the owner of any existing non-conforming structure or tree is required to permit the installation, operation, and maintenance of such markers and lights as shall be deemed necessary by the Director of Airport Operations. 2. Nonconforming Uses Abandoned or Destroyed -Whenever the Director of Community Development determines that a legal non-conforming tree or structure has been abandoned . destroyed or damaged .bv more than more than 80% percent, no permit shall be issued granted that would allow such use, structure or tree to exceed the applicable height limit or otherwise deviate from the zoning regulations. 14.702.120 Permits & Variances a. No building permit shall be issued for any prohibited use, or for any structure or obstruction which exceeds the air hazard height restrictions adopted herein. b. An application for a permit for the construction of a building, structure, use, subdivision, short subdivision, binding site plan or other development located within the Airport Hazard Overlay Zone shall submit a site plan which includes the elevation of the site above mean sea level. and the height of any proposed structure. b. Additional notice: any building permit or land use action including plats, short plats, subdivisions and binding site plans within the airport hazard overlay zone shall contain the following notice: 'Notice is herein provided that this property is located within the Airport Hazard Overlay Zone of the City of Spokane Valley. Washington. and is subject to restriction on height and use pursuant to Chapter 14.702 Airport Hazard Overlay Zone as it may be amended from time to time." c. Variances-Any person desiring to erect or increase the height of any structure, or permit the growth of any tree, or use of property, not in accordance with the regulations prescribed herein may apply to the Spokane Valley Community Development Department for a variance, provided however that the application shall be accompanied by a determination from the Federal Aviation Administration as to the effect of the proposal on the operation of air navigation facilities and the safe, efficient use of navigable airspace. A copy of the application shall be furnished to the Director of Airport Operations for review and comment. Final determination on the variance shall be made by the Hearing Examiner following notice and hearing. Spokane Valley Airport Hazard Zone Section 2. Severability. If any section, sentence, clause or phrase of this ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This Ordinance shall be in full force and effect five days after publication of this Ordinance or a summary thereof occurs in the official newspaper of the City as provided by law. This definition shall also include human male genitals in a discernibly turgid state, even if completely and opaquely covered. Specified Sexual Activities: Human genitals in a state of sexual stimulation or arousal; acts of human masturbation, sexual intercourse or sodomy; fondling or other erotic touching of human genitals, pubic region, buttock or female breast. Stealth: Any Wireless Communications Antenna Array or Wireless Communication Support Tower which is designed to blend into the surrounding environment. Examples of stealth may include architecturally screened roof-mounted antennas, building-mounted antennas painted to match the existing structure, antennas integrated into architectural elements, and wireless communication support towers designed to look like trees, clock towers, bell steepeles, light poles or flag poles. Storage, general indoor: The storage of equipment, merchandise and supplies within an enclosed structure. Storage, general outdoor: The storage of any equipment, machinery, commodities, raw, semi- finished materials, and building materials, not accessory to a residential use, which is visible from any point on the building lot line when viewed from ground level to six feet above ground level. Storage, Self-service Facility: A facility including buildings and/or structures containing spaces of varying sizes leased, rented or sold on an individual basis and used exclusively for the storage of excess property and outdoor storage of vehicles and boats. Stormwater Drainage Facility: Constructed and natural features which function together as a system to collect, convey, channel, hold, inhibit, retain, detain, infiltrate evaporate, divert, treat or filter stormwater. Stormwater facilities include but are not limited to, pipes, ditches, culverts, street gutters, detention ponds, retention ponds, evaporation ponds, constructed wetlands, infiltration devices, catch basins, oil/water separators and swales. Telecommunications +The transmission, between or among points specified by the user, of audio and/or visual information and data of the user's choosing. without change in the form or content of the information as sent and received. 37 • Alternative Mounting Structure - a water tower, man made tree, clock tower, church steeple, bell tower, utility pole, light standard, free standing sign, flagpole, or similar structure, designed to support and camouflage or conceal the presence of telecommunications antennas. • Antenna - a structure or device used to collect or radiate radio, television, or microwave electromagnetic waves, including directional antennas, such as panels, wireless cable and satellite dishes, and omni-directional antennas, such as whips, but not including satellite earth stations or noncommercial antennae installations for home use of radio or television. • Array - an arrangement of antennas and their supporting structure. • Dish - a parabolic or bowl shaped device that receives and/or transmits signals in a specific directional pattern. • Panel - an antenna which receives and/or transmits signals in a directional pattern. • Stealth - a telecommunications antenna that is effectively camouflaged or concealed from view. • Telecommunications antenna - an antenna used to provide a telecommunications service. This excludes lightning rods, private mobile radio systems, amateur radio antennas less than 35 feet in height in residential districts and 50 feet in height in non- residential districts, and whip antennas less than 4 inches (10 cm) in diameter and less than 10 feet in height. • Whip - an omni-directional dipole antenna of cylindrical shape which is no more than 6 inches in diameter. • Collocation - a single telecommunications tower and/or site used by more than one telecommunications service provider. • EIA-222 - Electronics Industries Association Standard 222, "Structural Standards for Steel Antenna Towers and Antennas Support Structures." • Service - the offering of telecommunications for a fee directly to the public, or to such classes of users as to be effectively available directly to the public, regardless of the facilities used. • Tower- a self-supporting or guyed structure more than twenty feet in height, built primarily to support one or more telecommunications antennas. • Electric Transmission - a self-supporting structure in excess of 50 feet in height designed to support high voltage electric lines. This does not include local utility or distribution poles (with or without transformers) designed to provide electric service to individual customers. • Guyed - any telecommunications tower supported in whole or in part by cables anchored to the ground. • Height- the distance measured from grade to the highest point of any and all components of the structure, including antennas, hazard lighting, and other appurtenances, if any. • Monopole - a self-supporting telecommunications tower, which consists of a single vertical pole, fixed into the ground and/or attached to a foundation. • Self-supporting Lattice - a telecommunications tower that consists of an open network of metal braces, usually triangular or square in cross-section. 38 _ - _ .- days i-n cen}unction with a single event.
