This being the time set by the Board of County Comissioners of Spokane
County, Washington, to render its decision concerning the request of
Howard C. Lemley, East 11323 26th Avenue, Spokane, Washington 99206 for
the above captioned preliminary subdivision and zone classification
upgrading; and
The Board having received the recommendation of the Spokane County
P1 anni ng Comi ssion to approve the prel imi nary p'i at, subject to f i ndi ngs
and conditions as contained in the Cammission's minutes dated April 15,
1977, and
The Board having conducted its own public hearing on May 26, 1977 at
the request of 6everly F. Kunz, etal, and after visiting the site and
reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the pwbllc hearing and other evidence avail-
able to the Board to uphold the recQmmndation of the Spokane County
Planning Comission to approve the preliminary plat, subject to findings
and conditions as contained in the Planning Commission minutes of April
15' 1977.
The Board also concurred in the Planning Staff's recormtendation that no
significant adverse lmpacts will result and a Declaration of non-significance
bQ issued.
The 8oard instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definltively the Board's action in this matter.

A. FINDINGS:
1, The proposed subdivisfon is located within the Spokane Metropolitan
Area. Specifically, the proposal is located in the Spokane Valley north
of Mission Avenue between Felts Road and Woodruff Road.
2. Mission Hills lst Addition is situated within an area designated as suit-
able for residential development by the approved map of the Park and Rec-
reation Element of the Spokane County Comprehensive Plan and its ac=
companying text. The Comprehensive Plan for the Spokane Ntetropolitan
Area, as approved by the Spokane Regional Planning Conference, also
designates the area as a residential neighborhood. The neighborhood
in question is bounded by Sprague to the south, University to the east,
Argonne to the west and Interstate 90 to the north.
The applicant requests preliminary approval for the subdivision of appro-
ximately 4.7 acres into twelve (12) lots for single family dwellings;
creating a gross density of less than three (3) units per acre.
- 4. The lots in the proposed subdivision have been designed to accommodate
single family dwellings with atypical lot size of 10, 875 square feet and
a typical frontage of eight-seven (87) feet.
5. The proposed subdivision appears to be a compatible extension of exist-
ing development in the area. Plats in the area include Mission Hills
Subdivision which is located directly north of the proposed subdivision.
fi. The site in question is currently vacant and the USIl~A has classified
its cropland potential as fair.
7. Public facilfties and utilities are available within the area to serve the
propo sed subdivf s ion to the following extent:
A. Water and Povyer: Modern Electric Vi'ater Company states that
"upon completion of satisfactory arrangement with the
Modern Electric Water Company, the utility is capable
of providing water for domestic use and fire protection,
and electricity for residential consumption."
B. Sewage Disposal: The site in question is located over the aquifer
that serves both the City of Spokane and Spokane Valley.
The Spokane County Health District has approved the pro-

rict states "the topography and soils in the plat are suitable

the devE lopment at somc tim.e in the future
C. Schools: ThE proposEd subdivision lies within the bounderies of the
East Valley School District. The District's facilities are
currently at capacity lcvels and any increase in student
Enrollment will havE to bE absorbed by presEnt facilfties un-
til their current building program is completed in two or three
years .
D. Parks: The Spokane County Valley h4ission Par'c is Iocated approxi-
mately one half milE to the east of the proposcd subdivision.
Thc County Par'~s DEpartmcnt has no presEnt plans for future
site acquisition in the area.
E. Polic ProtECtion: The Spokane County Sheriff's Department has been
contacted an:'A no commcnt has been received regarding this
proposal.
F. Fire ProtECtion: Spo::anE County FirE Protection District 41 has been
contacted and the District states hydrants need to be fnstalled
to provide for adequate fire protection.
G. Roads: AdequatE County roads appear to bE availablE at the site to
handle the increased traffic if the proposal is approved. The
Spokane Regional Planninr ConfErences' adopted transpor-
tation plan has designatEd 1,11i5sion Avenue as a principal
arterial. '
8. The staff of the Planning Department has reviewed the environmental check-
list as submitted by thE, applicaut, and the staff recorr►mends that a declar-
ation of non-significance be issued.
If the Planning Commission feels approval of this proposal would be appropiatE,
the department staff rECOmmends the following conditions:
1. That the plat bE dESigned as indicated on the reviscd preliminary plat of
record and/or attachEd sheets as noted.

2. That a statement be placed in the dec?ication to the effECt that no mors than
one dwelling structure be placed on any onE loe, nor shall any lot be further
subdivided for the purposes of creating additional lots or building sites
without filing a replat.

3. That the plat providE for right of way width for streets as indicated on the
preliminary plat of record.

boundary. (Tesr►porary cul de sacs are required when streets terminate at
the plat boundariES. )

preliminary plat for distribution to the Flanning Department and the utility
companies. Vejritten approval of the easements by the utility compan y
must be received prior to the submittal of the final plat.
7. That a plan for water facilitiES adequate for fire protection be approved by
the water supplier anu fire protection district. Said water plan must also
have bEen approved by the appropriate health authorities. The health auth-
orities, watEr supplier (purveyor), and fire protection aistrict will certify,
prior to the filing of the final plat, on the face of saia water plan that the
plan is in conforrnance with their requireinc-nts ana will adEauatEly satisfy
their rESpECtivE needs. Said w3ter plan an4 ccrtification will be drafted
on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangemEnts have been made
with the plat sponsor for construction of the water system, in accordance with
the approved plan, and in accordancE with a time schedule. The time
schedule will providE , in any casE , for cornplE tion of the water system and
inspection by the appropriate hEalth authorities prior to application for
'.buiiding pormits withfri the plat. The contractual arrangement& will include
a provision holding Spo'Kane County and the purveyor harmless from claims
by any lot purchaser refused a buiiding permit due to the failure of the plat
sponsor to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authoritics and the
local fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as
firE protection to each Iot prior to salc of each lot.
8. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
9. That the preliminary plat bE givEn con-Alirional approval to IVIay 1, 1978.

10. That a declaration of Non-Significance be issued, in accordance with Section
11. 15.340 of the Spokane County Environmental Ordinance (SCEO) prior to
approval of this recommEndation by the Board be conditioned upon issuance
of Final Declaration of Non-Significance in accordance with SCEO 11. 15.340.
11. That a name be indfcated before the final plat is filed; such name to be approv-
ed by the County Assessor and the Planning staff.
12. The Spokane County Health District has determined that the soil conditions in
the plat are suitable for on-site sewage disposal systems on each lot.
13. That conditional approval of the plat is given subject to dedicatfon of right
of way to the public and approval of the road system in the plat by the Gounty
Engineer.
14. That plans, profiles, and cross sections showing proposed street centerline
and curb grades be submitted to the County EngineEr for approval prior to
construction and thE filing of a final plat e
15. That drainage plans and design calculations showing the grades and alignment
of drainaqe facilities be submftted to the County Engineer for approval prior
to construction and the filing of a final plat.
16. Construction within the proposed public streets and easements shall be per-
formed under the direct supervision of a licensed land surveyor, who shall
be responsible for perpetuating all Evidence of thE location of survey monu-
ments which may be disturbed during construction and who shall furnish the
County Engfneer with "As Built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction pians and that all disturbed monuments have been replaced.
17. No construction work is to be performed within the public right of way until a
permit has been issued by the County Engineer. All work is subject to inspec-
tion and approval by the County Engineer.
18. All construction within the public right of way is to be completed prior to filing
the final plat or a bond in the amount estimated by the County Engineer to cover
the cost of construction of improvements, construction certification, "As Built" plans, and monumenting the street centerlines shall be filed with the
County Engineer.
~ Prior to filing the final plat, the developer shall be required to work with the
adjacent property owner to obtain sufficient right of way in order that access
to the proposed development will be provided from Felts Road.
20. Upon the filing of the final plat, upgrade Mission Hills First Addition to
Single Family Residential (R-1) zone classification.

Introduction: The Sta[e Environmental Policy Act of 1971, Chapter 43.21C, RCW,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions siqr.ificantly
(and "adverse2y", as per WAC I 97-10) affecting the quality of the environment. Thc
purpose of this checklist is to he2p the agencies involved determine whether or not a
proposal is such a major action.

II. Topography, soils and water.
a. The plats are in a generally f lat area north and east of Dishman.
b. Geologically the soils in the area are glaciofluvial'deposits: streamlaid
sand and gravel containing some boulders in places and incl.uding some
undifferentiated glacial deposits; lower terrace remnants probably reworked
by streams; yield moderate to very large amounts of water. Well logs show
most wells to be 90 to 250 feet deep with large yields. Wells in this
area penetrate generally gravely soils.

c. Structurally the soils are classed as Garrison gravelly loam, 0-5
percent slopes, with slight limitations for septic tank filter fields;
possible contamination of groundwater. Field investigation reveals
no evidence of groundwater that would preclude subsurface disposal
of wastewater under current Health District regulations. The District
has no record of excessive failures of drainfields in this immediate
area.
d. Individual subsurface disposal sewage systems have been proposed for
treatment and disposal of sewage generated within the project. This
raises the question of significance of the impact on the groundwater
in the area and possible alternatives for sewage disposal.
e. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the eff ect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage treatment
effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage eff luent will be carried to the
groundwater. However, bacteria and detergents (phosphate portion)
are mostly removed by the deep soil layer, above the groundwater
and "minor dissolved constituents such as phosphates, which are known
to react with soil particles, or nitrates, which are taken up by plant
roots" will be less than the total found in septic tank effluents.
3. "The calculated results at the downstream end of a groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at present (1975) is up to 93 mg/1 (milli-
grams per liter) above the natural groundwater background of
155 mg/1. The forecast year 2020 maximum incremental concentra-
tion is 101 mg/1 above the natural background." -__"The analytical
results of the forecast impact at year 2020 when compared with
the present impact, both measured in terms of leachate volume
and dissolved solids concentration, indicate that the present
impact on groundwater quality is already a substantial propor-
tion of the ultimate level."
f. August, 1975, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 0.8 to 0.9 ppm. A projected in-
cremental increase using Dr. Todd's expected 8.6 percent would result
in ranges from 0.87 to 0.98 ppm. Current Federal and State drinking
water standards permit up to 10 ppm.
g. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
i. Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps
more to obtain a permit for the discharge from the Department
of Ecology. These systems are not currently economically availa-
ble f or this proj ect .
2. Sealed systems, whether individual or community, depend on
evaporation tor liquid removal. These systems require more

land area than a conventional subsurface drainfield. Some,
such as lagoons, have safety hazards associated with them and
relatively poor community acceptance. Land, installation, and
operational costs are generally more expensive than those for
septic tanks and drainfields.
3. Special disposal systems using various methods of irrigation
or using evapotranspiration have had insufficient use in this
area to validate design criteria. Irrigation requires effluent
disinfection in most cases. These systems also require rela-
tively large areas for year around operation. Land and some
operational costs are more than for septic tanks and drainfields.
Again, without a specif ic additional treatment to remove dissolved
solids or completely sealing the disposal area from percolation,
some dissolved salts will be carried with effluent recharge to
the groundwater.
h. Historically, urban density development has resulted in polluted ground-
water beneath the development and increased values of land to the extent
space for individual sewage disposal drainf ields is too expensive for
that use.
III. Conclusion:
a. The use of subsurface sewage disposal systems for these projects will have
a negligible impact on the water quality.
b. The development of these projects in conjunction with other surrounding
urbanizing projects can be expected ultimately to have at least a
moderate impact on the water quality.
c. The plat sponsors have proposed a public water supply for the plats as
an extension of Modern Electric tdater Company. Extension of this system
to serve the plats would'provide an excellent means of ineeting the re-
quirements of D.S.H.S. for public water supplies.
d. The topography and soils in the plats are suitable for installation of
individual on-site sewage disposal systems. Such systems will have
negligible immediate impact on the=environment in the area but con-
tinued urbanization in the area at this density historically pollutes
groundwater under the development at some time in the £uture.
e. The plat should be served by the eKisting public water system in the area.
f. Proposed density greater than 3.5 dwelling units per acre, will require
an on-sfte sewage disposal management system.
IV. Recotmnendations. Prior to signing the final plat:
a. Contractual agreements shall be concluded between the plat sponsor and
the existing public water purveyor.
b. No more than two dwelling units per lot shall be permitted; an on-site
management system shall be approved by the Health District if the system
is required.

c. Sponsors shall present evidence that the plats lie within the
recorded service area of the water purveyor.
d. Individual on-site sewage disposal systems will be accepted for
sewage disposal in the plat.
