WHEREAS, the Boerd of County Commissioners of Spokane County, pursuant to the
provisions of the Revised Code of Washington, Section 36.70.620, shall upon
recei.pt of any recomtnended official control or amendment thereto, at its next
regular public meeting set the date for a public meeting "re it may, by ordinance, '
adopt or reject the official control or amendment; and
W►HEREAS, the Board of County Commissioners of Spokane County, did by Resolution
No. 78 433 acknowledge receipt of the recommendations from the Spokane County
Planning Commission concerning its Agenda, dated March 30, 1978, and,
WFiEREAS, the Board of County Commissioners of Spokane County, did by said '
resolution set this 13th day of April to consider the recommendations oY the I
Planning Commiasion concerning its March 30, 1978 agenda, a copy of said
recommendations are attached hereto a.nd incorporated herein by reference.

March 30, 1975 to consider the testimony and requests of several applicants,
+objectors and other interested parties concerning the below referenced subdivisians,

WHEREAS, the Spokane County Planning Commission fully considered the testimony
given the exivironmental review, and a1.1 other evideace presented, recammends to the
Haard of County Commissioners the foTlowing:

Bob Bethards of the staff presented areport to the Commission
members regarding the nunnber of preliminary plats which had
been revfewed by the Planning Commission during the past year
and the nurnber af appeals which were heard bgr the Board of County
Commissianers.Of the tvtal 121 preliminary plats reviewed,37
were appealed. Abottt 70% recQived the same recommendation from
khe Baard of County Commissioners. The Board anly rever~~d less
restrictive action an five different plaks.

Mr. Bethards reported that the Short Plat Ordinance became
' effective on M,arch 13, 1 978 , The appeal prucedure in the Shor"'.
Plat admin~~tration is heard before the Planning Commission and
then forwarded to the Board of Caunty Comrrrissfoners. There ?:-ve
also been sorne other minor changes in the adopted ordinance,

Mr. Bethards said a copy of Road Standards whieh have been .
adopked by the Board af County Cammissioners will be sent ko the
PXanning Cornmission, It is planned that these will be discussed
ak the April hearing.

Tom D3vis of the staff inforrned tlie, Commission that Mr. Paul
Rayburn wished to request that the use of a Vital Records Center
be made a ConLiitional Use in the Agricultural Zone; and that `he
staff be directed to advertise for this amendment to the Spokane
County Zoning Ordinance for consideration at the April 21st
hearing.
In explaining the desire for this use further, Mr, Paul Rayburn,
South 3 518 Lincoln Drive, Spokane, commented tha t there is not
a vital re:,ord center presently located in the Northwegt, The _
intended location is to be one mile north of D--ep Creek at Sprague
and Ritchie Roads.
Mr, Thomas moved, Mr. Quigley seconded, that the propo5ed amendment
to the Spokane County Zoning OrciinancE be advertised for public hearing
on the April agenda. Motion carried unanimously.
b) Plattina Engineerinq .osts.
Mr. Eugene Prather of the Spokane County Health District requested
tha t the Commis sion be made aware and review the engineering cos ts
involved in platting. At the present time the only consideration beina
given is at the initial costs and not the long-range costs which car.
involved. "
c) Citizen Partfcigatiop tTodate Report
Gary Fergen of the staff presented a report on the current status of
citizen participation. The "Operation Insight" flyer was updated in
March and sent to the regular mailing list and also to the granges and
to the County libraries. Mr. Fergen also cited a list of groups and
organizations at which presenLations have been made by rhe staff and
those which are scheduled for the immediate future.
3. Fiue Mile 2j-nQres s Report:
Mr. Quigley, Commission member, asked whdt plan was voted on at the last
meeting at Five Mile. ML-. FergEn ceplied that the citfzens had voted on
Plan "D". The Five Mile Goais and Policies report fs to be sent back to r'^e
Planning Commission front the Board of County Commissioners after they ha:•e
recommended their changes.

. Mr. Dayhacsh, Planning Director, asked the Commission for direction to
proceed on consideration of the Five Mile issue. Mr. Quigley moved,
Mr. Kennedy seconded, that the Planning staff be directed to prepare a final
plan for Five Mile based upon the maps and the goals and poiicies pretty much
as developed as per the Citizens Committee from Five Mile and as per Lhe f_nal

Mr. D3yharsh said that the staff is in the process of drafting up the sugges*,ions
f or the Hearings Examiner Committee Ordinance, and asked if the Planning
Commission would like to have this for their consideration at the second cub'4c

directed to complete the wording of the Hearings Examiner Commitree Ordin?nce
and present it to the members of the Commis sion on their agenda for rhe

agenda page so that the Commission would be able to teil where duplexes ,
single family residences and multiple units were to be located.

Staff findings regarding PE-1087-77, Swan Acres Replat #1:
I. This preliminary plat has received conditional approval by the Board of County
Commissioners to March 1, 1978. It would appear that reasonable progress has
been made by the plat sponsor towards meeting the conditions of approval that
were imposed by the Board of County Commissioners. The applica.nt is attempting
to resolve the drainage problems with this proposal and he expects to file the
final plat i-rithin the next several months.
II. The applica.nt has notified the Planning Department Staff that he is desirous of
obtaining an extension of time to April 1, 1979, so that he might have addition-
al time to meet all conditions of approval that ha.ve been imposed by the Board
of County Commissioners.

WHEREAS, the Spokane County Plannfng Commfsston did, after publfc
hearing on March 11, 1977, forward to the Board of County Commissioners a
recommendation that the prelimfnary plat to be known as Swan Acres Replat #I
(File Number PE-1087-77) and zone classificatfon upgradfng (File Number ZE-47-77)
be approved, and
WHEREAS, George Swan, et al, did by letter dated March 16, 1977,
request a spectal hearing before the Board of County Commissioners to present
evidence and testimony against the recommendatton of the Planning Commission
to approve the above described preliminary plat and zone change upgradtng, and
WHEREAS, the Board of County Commissioners dfd hold a public hearfng
on April 14, 1977, to consider the recommendations of the Planning . Commfssf on
and testimony and request of the applf cant, obj ectors, an3 other interested

WHEREAS, at said hearing opportuntty was afforded those favoring and
those opposing the above descrfbed preliminary plat proposal and zone change
upgrading, the Board -of County Commissioners of Spokane County 'having fully
considered the testimony given, the reco!-ds and minutes of the Planning
Commisslon, the envtronmental assessment, and all other evidence presented and
having personally acquainted themselves wtth the sfte and vtcinity in questfon,
~ does hereby find that the conclusfons of the Planning Commission were generally
valid and sufficient, spzciftcally:
I) The proposal as submitte3 is located within the Spokane Metropolitan
Area. Specifically the proposal is located at the southeast corner
of Bannen and Forker Roads in the north central area of the
Spokane Valley.

of Block 1(located at the northern most edge of the proposed plat).
' 7) Publtc facillties an3 utiltties appear to be readily available

8) The proposal as submftted appears to be a compatible extension
of existtng development ln the area. This development has occured
through both segregatton and platting.
9) Adequate County Roads appear to be available at the site to handle

10) Upon revtew of the envtro nmental checklist as submitted by the
applicant, the Planntng Staff concludes that no slgntffa;ant adverse
impacts will result and a Declaration of Non-Significance should
be lssue3.
NOW, THEREFORE, the Board of County Commissfoners does herebyconclude
that the prellminary plat of Swan Acres Replat #1 and zone classtfication upgradfng
should be and hereby is approved, subject to the conditions as contained fn the
Planning Commfsston minutes of March 11„ 1977, except that condition Number 10

This being the time set by the Board of County Commissioners of Spokane County,
Washington, to render its decision concerning the request of George R. Swan,
North 5416 Bannen Road, Spokane, Washington, for the above captioned preliminary
subdivision and zone classification upgrading; and
The Board having received the recommendation of the Planning Commission to approve
said preliminary plat subject to the findings and conditions as contained in the
Planning Commission minutes of its March 11, 1977 meeting; and
The Board having conducted its own public hearing on-April 14, 1977, at the request
of the plat sponsor, Mr. Swan, and after visiting the site and reviewing the
testimony;- and
The Board being fully advised in the premises did determine, based upon the
testimony submitted at the public hearing and other evidence available to the
Board, to uphold the appeal of Mr. Swan which concerned Lot 1, Block 1 of subject
plat; and
The Board did determine to approve said plat and zone change subject to those
findings and conditions of the Planning Commission contained in its minutes of
Ma rch 11 with the exception of certain restrictions concerning Lot 1, 61ock 1 of
said plat, and subject to submission by the plat sponsor of an adequate drainage
pl an to the County Engi neers ;
The Board instructed the Planning Staff to prepare Findings and Order, for
execution by the Board of County Commissioners, at a subsequent meeting, setting
forth more definitively the Board's action in the matter.

quality. This District further believes that the developments
of this pro ject in conjunction with other surrounding urbaniz-
ing projects can be expected to have at least a moderate
impact on the water quality.
D. 8c.hools:' The proposed subdivision is located within the East Valley
School District. The district facilities are prese$tly at
capacfty levels, although they expect this problem to be
mitigated somEwhat when their current building program is
completed in two to three years.
E. Parks: No improved county parks are located within the area and
the County Parks Department has no present p13n for site
acquf s ition or ma jor park improvement.
F. Police Protection: The Spokane County Sheriff`s Department has been
contacted and no comment ha s been received regardinq

that appropriate contractual arrangements have been made with the plat sponsor for con-
strUCtion of the water system, in accordance with the approved plan, and in accordance
vriUa a time schedule. The time schedule will provide, in any case, for completion of
the water system and inspectton by the appropriate health authorities prior to applica-
tion for buiIding permits wfthin the plat. The contractual acrangements wi21 lnclude a
provision hoiding Spokane County and the purveyor harmless from claims by any lot
purchaser refused a building permtt due to the failure of the plat sponsor to satisfactar-
ily complete the approved water system.
The plat dedication will contafn a statement to the effect that the public water system
_ as approved by County and State Health authorities and the local flre district and pur-
veyor will tie lnstalled within this plat, and the subdivider wdll provide for tndividual
domestic water service as well as fire protectfon to each lot prior to sale of each lot.

Introciuction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCN,
requires all s[ate and local governmental agencies to consider environmental values
both for their awn actions and when licensing prlvate proposals. The Act also requires
that an Environmental Impact Statement be prepared for ali major actions significantly
(and "adversely", as per WAC 197-10) affecting the qualfty of the environment. The
purpose of this checklist is to help the agencies invalved determine whether or not a
proposal is such a ma jor action.
Please answer the followinq questions as comPletely es you can with the infacmation
presently available to you. Please answer questions as "yes" or "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware af and concern themselves with the deQree of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers are requfred, or where you
believe an explanation would be helpful to qovernment decision-makers, include your

II. Topography, soils and water.
a. The plat is 3n a generally f 1at area known as Trentwood. The plat
and the immediate area slope gently €rom north to south, about 11~
mi1es ta the southwest, the 1and slvpes sharply intv the Spakane
RYVer.
b. GealQgically the s+oils in the area are glaciofluvial deposits;
stream=1aid sand and gravel containiag some bouldera in place;
' and ineluding some undi€ferentiated g1acia1 degvsits; l❑wer terrace •
rernnants grobably reworked by streams ; yieZa moderate to very large
amaunts of water. We11 logs show most weZ1s to be 150-250 feet deep,
yielding 500 + gallons per minute. Wells to the sauth permeate
general1y gravelly soils while we11s to the north permeate generalIy
granite rock to depths of up to 600 feet.
c. Structurally the soils are cliassed as Garrisan gravelly laam, 0-5
percent s2opes, with slight 11mitations for septic tank filter
f ields; possible cnatamination of groundwater. Field in-ueatig$tinn
reveal.s nv evidence of grvunrdwater that wnuld preclude subsurface
disgosal of wastewater under current Health District regulations.
The District has no record of excessive fai1ures of drainfields in
this immediate area.

d. Individual subsurface disposal sewage systems have been pro-
posed for treatment and disposal of sewage generated within
the project. This raises the question of significance of the
i.mpact on the groundwater in the area and possible alternatives
for sewage disposal.
e. In the course of the conduct of the Army Corps• study , Dr. Todd
considered typical soils, natural and sewage disposal recharge
to the groundwater, and the effect of continued urban develop-
ment in the Spokane River Valleq upon the qualitq of the groundwater.
In summary, he concluded that:
1. In normal precipitation years subsurface disposal of
sewage treatment effluent does reach and recharge the
groundwater.
2. All the dissolved salts fn sewage effluent will be
carried to the groundwater. However, bacteria and
detergents (phosphate portion) are mostly removed by
the deep soil layer above the groundwater and "minor
dissolved constituents such as phosphates, which are
knoram to react with soil particles, or nitrates, which
are taken up by plant roots" will be less than the
total found in septic tank effluents.
3. "The calculated results at the downstream end of a
groundwater flow line indicate that the maximum range
of (dissolved) solids concentration expected at present
(1975) is up to 93 mg/1 (milligrams per liter) above
the natural ground water background of 155 mg/1. The
forecast year 2020 maximwn incremental concentration is
101 mg/1 above the natural background." "The analyti-
cal results of the forecast impact at year 2020 when
compared with the present impact, both measured in terms
of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater quality
is already a substantial proportion of the ultimate
level."
f. Currently, results of chemical analysis show the total nitrogen
content of the groundwater as in the range of 0.3 to 1.0 ppm. A
proj ected incremental increase using Dr. Todd's expected 8.6
percent would result in ranges from 0.31 to 1.09 ppm. Current
Federal and State drinking water standards permit up to 10 ppm.
g. Alternative sewage disposal methods that would not recharge the
groundwater have the following general characteristics:
1. Collector and central treatment systems discharging to
surface waters would require at least tertiary treatment
and perhaps more to obtain a permit for the dfscharge
from the Department of Ecology. These systems are not
currently economically available for this project.
2. Sealed systems, whether individual or community, depend
on evaporation for liquid removal of sludges. These sqs-
tems require more land area than a conventional subsurface
drainfield. Some such as lagoons, have safety haaards

associated with them and relatively poor community
acceptance. Land, installation and operational
costs are generally more expensive than those for
septic tanks and drainfields.
3. Special disposal systems using various methods of
irrigation or using evapotranspiration have had in-
sufficient use in this area to validate design criteria.
Irrigation requires effluent disinfection in most cases.
These systems also require relatively large areas for
year around operation. Land and some operational costs
are more than those for septic tanks and drainfields.
Again, without a specific additional treatment to re-
move dissolved solids or completely sealing the disposal
area from percolation, some dissolved salts will be
carried with effluent recharge to the groundwater.
h. Historically, urban density development has resulted in polluted
groundwater beneath the development and increased values of land
to the extent space for individual sewage disposal drainfields is
too expensive for that use.
III. Conclusion:
a. The use of subsurface sewage disposal systems for this project will
have a negligible impact on the water qualitq.
b. The development of this project in conjunction with other surrounding
urbanizing project can be expected ultimately to have at least a
moderate impact on the water quality.
c. The plat sponsor has proposed a public water supply for the plat as
an extension of Trentwood Irrigation system. An extension of this
system to serve the plat would provide an excellent means of ineeting
the requirements of D.S.H.S. for public water supplies.
d. The topography and soils in the plat are suitable for installation
of individual on-site sewage disposal systems. Such systems will
have negligible immediate impact on the environment in the area but
continued urbgnization in the area at this density historically
pollutes groundwater under the development at some time in the future.
e. The plat should be served by the existing public water system in the
area.
IV. Recommendations: Prior to signing the final plat:
a. Contractual agFeements shall be concluded between the plat sponsor
and the existing public water purveyor to serve each lot with domes-
tic use and f ire protection water f Zows.
b. No more than one dwelling unit per lot shall be permitted.
c. Sponsor shall present evidence that the plat lies within the recorded
service area of the water purveyor.
d. Individual on-site sewage disposal systems will be accepted for sewage
disposal in the plat.

ZE- 47--77 AGRICULTURAL SUBURBAN TO SINGLE FAMILY RESIDENTIAL
Planning Commissfon Recommendation: Approve the nreliminarv nlat, subiect to
the findinqs and conditions; (Vote was unanimous.)
A. FINDINGS regarding Swan Acres REplat No. I:
1. The proposal as submitted is located within the Spokane Metropolitan Area.
Specifically the proposal is located at the southeast corner of Bannen and
Forker Roads in the north central area of the Spokane V-31ley.
2. Swan Acres Replat #1 is located within an area designated as suitable for
residentiai development by the approved map of the Park and RECreation
element of the Spokane County Comprehensive Plan and its accompanying text.
3. The applicant requests preliminary approval for the subdivision of approxi-
mately 4.2 acres for seven single family dwellings (a gross density of less
than two units/acre).
4. The lots in the proposed subdivision have been designed to accommodate
single family dwellings with a typical lot size of about 20,400 square feet.
5. The site h.as a minimum potential for cropland because of its site size (4.2
acres oil which approximately two acres are currently occupied by single
family avveliings) .
6. There appears to be a potential flooding problem with Lot 1 of Block 1(located
at the northern most edge of the proposed plat).
7. Public facilitfes and utilities are available within the area to serve the pro-
posed subdivision to the following extent:
A. Water: Trentwood Irrigation District has st3ted that it has the abilfty
. to serve the proposed subdivision with both domestic water
and fire flow.
B. Fire Protection; The Spokane County Fire District No. 1 has reviewed
the proposal and states that mains and hydrants need to be
installed.
C. Sewaqe Disposal: The Spokane County Health District has approved
the site for on-site sewage disposal and the District believes
that the use of subsurface sewage disposal systems for

~ this pro ject will have a negligible fmpact on the water
quality. This District further believes that. the developments
of this projecfi in conjunction with other s-Lrrounding urbaniz-
ing projects can be expected to have at lez•st a moderate
impact on the water quality.
D. Bchools:' The proposed subdivision is located within :he East Valley
School Distrfct. The district facflities are .)resebtlp at
capacity levels, although they expect this p:-oblem to be
mitigated somewhat when their current building program is
completed in two to three years.
E. Parks: No improved county parks are located within the area and
the County ParDcs repartment has no preseni plan for site
acquisitfon or major park improvement.
F. Police Protection: The Spokane County Sheriff` s Department has been
contacted and no commenL ha s been received regarding
this propo sal ,
8. The proposal as submitted appears to be a compatible extensfon of existing
development in the area. This development has occured through both segre-
gation and platting.
9. Adequal[e ~ounty roads appear to bE available at the site to handle the increase
in autaz;:obile traffic.
10. Upon review of the environmental checklist as submitted by the applicant,
the staff concludes that no significant adverse impacts will result and a
Declaration of Non-Significance should be issued.
B. CONDITIONS:
Specific conditions applicable to this plat are referenced below and found
in the attached supplement entitled "St3ndard Conc?itions for Approval of
Preliminary Plats - February, 19 77" .
