APPROVAL OF AMENDED AGENDA Chairman Crosby indicated that the hearing planned for tonight had been withdrawn by the applicants and is reflected on the amended agenda. Commissioner Beaulac moved that the February 10, 2005 amended agenda be approved as presented. Commissioner Carroll seconded the motion as amended. Motion passed unanimously. V. APPROVAL OF MINUTES Commissioner Kogle indicated that her name was spelled wrong on pages 1 and 4. It was moved by Commissioner Carroll and seconded by Commissioner Kogle that the minutes of the January 27, 2005 Planning Commission meeting be approved as amended. Motion passed unanimously. VI. PUBLIC COMMENT There was no public comment. VII. COMMISSION REPORTS Commissioner Blum attended the February 8, 2005 council meeting. The Pines/Mansfield agreement was moved forward. ADMINISTRATIVE REPORTS Ms. Sukup reminded the Commission of the Parks & Recreation survey focus group meeting next Thursday, February 17, 2005, at 6:00 pm. The meeting will be held in the second floor conference room. Commissioner Kogle will not be in attendance. Michael Freedman, Freedman, Tung & Bottomley, Urban Design, a member of the ECONorthwest consultant team will be here on March 1, 2005, 2:00 pm in Council Chambers. Please RSVP because seating will be limited. Ms. Sukup thanked Commissioner Gothmann for all his hard work on the matrix and definitions. Commissioner Robertson arrived;at$26-prrr.' Mr. McCormick thanked Commissioners Beaulac and Gothmann for stepping up to be part of the combined working planning commission for Spokane County, City of Spokane, and City of Spokane Valley. This working group will be arranging meetings for all three planning commissions. Any other commissioners interested in the working group are welcome. VII. COMMISSION REPORTS cont Commissioner Robertson stated he went to the Greenacres Neighborhood meeting. It was well attended and the organization was pleased that the City Council and City Planning Commission had representatives at the meeting. There were good questions and suggestions. 2 Chairman Crosby stated that the Planning Commission is interested in watching how this neighborhood group is formed to see if it will fit in the comprehensive plan. IX. COMMISSION BUSINESS A. OLD BUSINESS: A. Uniform Development Code & Matrix and Schedule of Permitted Uses Commissioner Crosby stated that this is a first touch of the uniformed development code and matrix for the Commission to review and amend. A decision was made to go through definitions page by page. Page 1 There were no suggestions for this page. Page 2 There was discussion again on the meaning of "airstrip," "airpark," and "airport." There was discussion to include the Federal Aviation Administration (FAA) definitions. Then there was discussion about the meaning of"ultra lights" and "gliders." It will need research. Commissioner Gothmann will bring definitions for review by the Commission. What about "airport zoning"? It was discussed and decided it was needed. Ms. Sukup stated that "heliports" and "helipads" need to be added to the list. Does "agricultural land" and "agricultural zones" need to be defined? It was decided that it is not a zone and should be striked. Page 3 There was discussion on how to define a small or large animal, specifically about "pot-bellied pigs." It was decided they were part of the swine definition. Why is "antique store" defined when other businesses are not? It was discussed that this definition is to determine the difference between a junk store and an antique store as this seems to be an issue with Spokane Valley residents. Should there be a definition for "aquifer"? There was discussion. "Assembly" was the next definition to discuss. It was decided that pounds of weight might be a better way to define light versus heavy assembly. Commissioner Kogle suggested asking the local 3 industry for their help. Commissioner Carroll stated he would like to use the Washington State Department of Revenue NAISC codes for defining businesses. He will look up the definitions and bring those back to the commission for review. X. FOR THE GOOD OF THE ORDER There is nothing to bring before the Commission. Xl. PREVIOUS COUNCIL ACTION TAKEN: City Council adoption of Ordinance No. 04-002 (Street Vacations) in January 2004. The ordinance was codified in Title 10 Article III of the Spokane Valley Code of Ordinances. Planning Commission was briefed on January 27, 2005 and City Council received an administrative report on the proposed amendments on February 15, 2005. BACKGROUND: The City has processed four street vacation requests since Ordinance 04-002 was adopted. As a result of questions which arose during these actions, several amendments should be considered: 1. City signatures on survey documents are unnecessary on documents prepared by a licensed Washington Surveyor; 2. Survey of properties outside the area of the actual vacation add additional cost to the survey without commensurate benefit to the petitioner; 3. Monuments provide control points for property owners, as well as establishing monuments in areas where monuments have been destroyed as a result of past street construction activities; 4. Providing the governing body with necessary findings by the hearing body who receive public testimony establishes the basis for legislative findings; 5. Requiring documentation of the transfer of title by means of a quit claim deed formalizes the transfer to abutting owners; and 6. The repeal of the existing code references and the establishment of a new section renumbered as part of the Spokane Valley Uniform Development Code. (Title 10 of the Spokane Municipal Code) A Determination of Non-Significance (DNS) was issued on January 20, 2005, and the proposed ordinance distributed to CTED and adjacent jurisdictions. The appeal period expires on February 18, 2005. No final action of the proposal will be scheduled prior to March 22, 2005. A public hearing before the Planning Commission is scheduled for February 24, 2005. OPTIONS: Approve, amend or disapprove. The Public Works Department shall be responsible for conducting a needs analysis of the street or alley proposed for vacation in consideration of existing and future transportation system needs and requirements. The report shall address the criteria,to be considered by the City Council in determining whether Deleted:(see Section 11) to vacate the street or alley, and such other information as deemed appropriate by the Director including but not limited to drainage requirements, street closure requirements such as the removal and replacement of concrete, asphalt, and placement of barriers limiting vehicle movements. In preparing the report, the Director shall solicit comments from the Police Department, the Fire Department and may solicit comments from other governmental agencies and utility companies having jurisdiction or utilities within the boundaries of the City. The report shall be submitted to the Planning Commission and to the petitioner and his or her representative, not less than seven(7)calendar days before the hearing. SECTION 10.09.04.10.08 Notice of Hearing. Upon the passage of the resolution fixing the Deleted:10.05.290 time for hearing the petition or proposal for vacation,the City Clerk,or the Director,acting under direction and supervision of the City Clerk, shall give not less than 20 days' notice of the time, place and purpose of the hearing by(1)posting of a written notice in three(3)conspicuous places in the City; (2) publishing written notice once in the City's official newspaper, (2) posting a minimum twenty-four(24)inch by thirty-six(36)inch notice sign in a conspicuous place at each end of the street or alley sought to be vacated describing the proposed vacation and the date,time and location of the public heaimg;and(3)mailing written notice to all petitioners at the addresses on the petition and all owners of property abutting the street or alley proposed to be vacated, as shown on the records of the Spokane County Assessor, not to exceed ninety(90) calendar days from the date of the public hearing. The Director shall send the same written notice to the representative of the petitioners at the address on the petition. SECTION 10.09.04.10.09 Protest. If fifty (50) percent or more of the abutting property (Deleted:10.05.300 owners file written objections to a City Council-initiated vacation with the City Clerk,prior to the time of the hearing,the city shall be prohibited from proceeding with the vacation. For the purpose of this Code certain words and terms are herein defined. The word "shall" is always mandatory. Agricultural Direct Marketing Activities: Those accessory activities associated with the retail sale of agricultural products produced on and off the premises. This includes the sale of non- agricultural products (e.g. crafts, antiques, kitchen goods, etc.), educational classes and tours, commercial farms rides on premises, and limited restaurant services as defined. Agricultural land: Defined in WAC 365-190-030(1) as now or hereafter amended. DO \nNE NEED THIS? Airport means an area of land or water that is used or intended to be used for the landing and takeoff of aircraft, and includes its buildings and facilities, if any. Airport Hazard: Any structure or tree or use of land which obstructs the airspace required for the flights of aircraft in landing or taking off at an airport or which is otherwise hazardous to such landing or taking off of aircraft, and any use of land which is hazardous to persons or property because of its proximity to an airport. OR Airport Hazard - any structure or object of natural growth located in the vicinity of the air ort which obstructs the airspace required for the flight of aircraft or airport operations. Airport Obstruction - any structure or object of natural growth or use of land which would exceed the federal obstruction standards established in 14 CFR sections 77.21, 77.23, 77.25 and 77.28, or which obstructs the airspace required for flight of aircraft in landing or take-off, or is otherwise hazardous to airport operations. Airstrip, Personal: A landing area for only one (1) aircraft for personal use by only the owner. Airstrip, Private: A landing area for more than one (1) aircraft. 2 Ailey: A public right-of-way which provides access only to the rear and/or side of properties abuttir:g and having access to a public road. Animal, Large: Animals, including, but not limited to, horses, donkeys, burros, llamas, bovines, goats, sheep, swine, bison, camels and other animals or livestock of similar size and type, except inherently dangerous mammals and inherently dangerous reptiles. Young of horses, mules, donkeys, burros, llamas, alpaca, bison, and camels under one (1) year in age, bovines, under ten (10) months in age, and sheep, goats and swine under three (3) months in age shall not be included when computing intensity of large animals. Dairy: Any premises where three (3) or more cows, three (3) or more goats, or any combination thereof are maintained and milked for a period exceeding sixty (60) days. Day Care Facility, C�-1: 1:: A facility furnishing care, supervision and guidance of a child or group of children up to twelve (12) years of age or under for a period of more than four(4) hours, but less than twenty-four(24) hours, per day which facility meets all state and local licensing requirements. Day care facility is further defined as follows: 1. "Day Care Center": A facility for the care of thirteen (13) or more children with resident or nonresident license(s). Mobile Home: A factory-built dwelling constructed prior to June 15, 1976 to standards other than the Manufactured Home Construction and Safety Standards Act, having a minimum size of eight (8)feet wide and thirty-two (32) feet long, being completely selfcontained, designed for use as a dwelling for a single family, and otherwise acceptable under state and local codes which were in effect at the time of manufacture, introduction into Spokane County or relocation of the mobile home within Spokane County which acceptability is evidenced by certification by the Washington State Department of Labor and Industries that said mobile home has passed their"Alteration Inspection" or its equivalent. Such a unit includes the connection to electric power, water supply and sewage disposal facilities. WHY THE DISTINCTION? Motel: One or more attached or detached buildings providing separate sleeping or living quarters primarily to temporarily accommodate transient individuals or families traveling by motor vehicle, with attached garages or parking spaces conveniently located to each unit and may include kitchen facilities. Also commonly referred to as a tourist court, tourist home, motor lodge, motor inn, and similar designation. DEFINITION A LITTLE DATED! Multiple Building Complex: A group of structures, or a single structure, with dividing walls and separate entrances for each business, housing at least two (2) retail businesses, offices, commercial ventures or independent or separate parts of a business which share the same lot, access and/or parking facilities. Neighborhood: A geographic area bounded by distinct physical boundaries, such major or minor arterials, geologic formations, broad open spaces and similar features, centered around common interests or facilities and distinguished from a "community"which could be composed of more than one (1) neighborhood as herein defined. Why is this definition useful? Nonconforming: A lot, use, building, or structure, which was legal when commenced or built, but which does not conform to subsequently enacted or amended regulations. Nonprecision Instrument Runway: A runway having existing or planned "straight-in" instrument approach procedures, as defined by the Federal Aviation Administration, utilizing air navigation facilities with only horizontal guidance, and for which no precision instrument runways are planned or indicated on a document approved by the Department. Nursery: An area, structure, or building and all accessory areas, structures, or buildings which are used exclusively for the purpose of nurturing trees, shrubs, flowers, and/or other plants for the purpose of transplant and/or sale. SAME AS GREENHOUSE.? 17 Nursery School: A private agency, school, or institution engaged in educational work with preschool children and in which no child is enrolled on a regular basis for four (4) or more hours per day. Enrollment for four(4) or more hours per day shall classify the facility as a "Day Care Facility" or "Kindergarten." WHY IS THE DISTINCTION IMPORTANT? MONTESSORI SCHOOLS? Nursing Home: A place licensed by the State Department of Social and Health Services as a "nursing home" or institution which operates or maintains facilities providing convalescence and/or chronic care for a period in excess of twenty-four (24) consecutive hours for three (3) or more patients who are not related to the operator by blood or marriage and who by reason of illness or infirmity are unable to properly care for themselves. Public Utility Local Distribution Facility: Any building, structure, or device which transfers directly to the public the service or supply provided by a public utility, including telephone, electric(less than sixty (60) feet in height), gas, cable television, water and sewer, and all other 20 facilities. equipment and structures necessary for conducting a local distribution service by a government or public utility. Sanitarium: A health station or retreat, or any place where resident patients are housed, which specializes in giving temporary or emergency clinical services of a medical or surgical nature including surgical and postsurgical treatment of persons with mental disorders, but excluding the psychiatric treatment of such mental and nervous disorders. Schools; Kindergarten, Elementary, Middle, Junior High and High: Public and private institutions of learning offering instruction from kindergarten to grade 12 required by the Education Code of the State of Washington. Seasonal Harvest Festivities: Those temporary and incidental accessory activities associated with the sale of annual harvest crops. Solar Collector: The south face of a structure higher than two (2)feet above the ground level at the south wall which has solar sky space and can use solar energy to reduce consumption of energy for space heating, lighting, water heating, and/or to generate electrical energy used by that structure. Solar Lot: A platted tract or parcel of land within a solar development which has solar sky space to the solar shell or solar structure as defined. Solar Shell: The three dimensional area shown on a site plan or subdivision map which designates each lot's future limits of building and growth of vegetation which is or can be over six (6) feet in height and by which shadow patterns shall be determined. The purpose of the shells to protect solar access of the lot to the north and to designate access area to be protected on the lot. Solar Sky Space: The space between the sun and the south face of a solar structure or solar shell which is unobstructed by topography, by any structure(s), or by vegetation not defined as Deciduous vegetation within this Code. The sky space is defined as the area between when: 1. the sun, at approximately 10 a.m. and 2 p.m. in January and November, is at an altitude of seventeen (17) degrees and is at a direction between thirty (30) degrees east or west of true south; and 2. the sun, at approximately 10 a.m. and 2 p.m. in April and August, is at an altitude of forty-five (45) degrees and is at a direction between forty-five (45) degrees east or west or true south. Solar Structure: Any dwelling unit which is designated to maximize available solar energy for heating, cooling, or lighting needs and which is located on a solar lot as defined. Solid Waste: All putrescible and non-putrescible solid and semisolid material, including, but not limited to, garbage, refuse, bulky wastes, inert waste, agricultural solid waste, sewage sludge and demolition and construction wastes. 25 Solid Waste Recycling/Transfer Site: A municipally owned and/or operated area with a structure or vehicle, the main purpose of which is to hold solid waste or recyclable materials, prior to transport to a central disposal or collection location. The SIC covers the entire field of economic activities by defining industries in accordance with the composition and structure of the economy. Over the years, it was revised periodically to reflect the economy's changing industry composition and organization. The Office of Management and Budget(OMB) last updated the SIC in 1987. In recent years,rapid changes in both the U.S. and world economies brought th SIC under increasing criticism. The 1991 International Conference on the Classification of Economic Activities provided a forum for exploring the issue: and for considering new approaches to classifying economic activity. In July 1992,the OMB established the Economic Classification Policy Committee chaired by the Bureau of Economic Analysis, U.S. Department of Commerce, with representatives from the Bureau of the Census,U.S. Department of Commerce, and the Bureau of Labor Statistics,U.S. Department of Labor. The OMB charged the ECPC with conducting a"fresh slate" examination of economic classifications for statistical purposes and determining the desirabilit of developing a new industry classification system for the United States based on a single economic concept. A March 31, 1993,Federal Register notice(pp. 16990-17004)announced OMB's intention to revise the SIC for 1997, the establishment of the Economic Classification Policy Committee, and the process for revising the SIC. The ECPC and Statistics Canada reviewed the existing structure of detailed "4- digit" industries in the 1987 U.S. SIC and the 1980 Canadian SIC for conformance to economic concepts. Page 2 of 13 1. NAICS will be erected on a production-oriented, or supply-based, conceptus framework. This means that producing units that use identical or similar production processes will be grouped together in NAICS. 2. The system will give special attention to developing production-oriented classifications for(a)new and emerging industries, (b) service industries in general, and(c)industries engaged in the production of advanced technologies. 3. Time series continuity will be maintained to the extent possible. However, changes in the economy and proposals from data users must be considered. In addition, adjustments will be required for sectors where Canada, Mexico, and the United States presently have incompatible industry classification definition, in order to produce a common industry system for all three North American countries. 4. The system will strive for compatibility with the 2-digit level of the International Standard Industrial Classification of All Economic Activities (ISIC,Rev. 3) of the United Nations. NAICS Structure NAICS industries are identified by a 6-digit code, in contrast to the 4-digit SIC code. The longer code accommodates the larger number of sectors and allows more flexibility in designating subsectors. It also provides for additional detail not necessarily appropriate for all three NAICS countries. The international NAICS agreement fixes only the first five digits of the code. The sixth digit, where used, identifies subdivisions of NAICS industries that accommodate use needs in individual countries. Similarly,the SIC division for Service Industries has been subdivided to form several new sectors, as shown ii the chart below. Other sectors represent combinations of pieces from more than one SIC division. The new Information sector includes major components from Transportation, Communications, and Utilities (broadcasting and telecommunications),Manufacturing(publishing), and Services Industries (software publishing, data processing, information services, motion picture and sound recording). The Accommodation and Foodservices sector puts together hotels and other lodging places from Service Industries and eating and drinkin€ places from Retail Trade. Seventy-nine new industries are recognized and another 186 are revised. In all, there are 474 NAICS industries in manufacturing as compared with 459 in the 1987 SIC. The most significant change to manufacturing is the creation of the Computer and Electronic Produc Manufacturing subsector. This new subsector brings together those establishments engaged in the production of computers, computer peripherals, communications equipment, similar electronic products, and the components ft such products. Page 5 of 13 of the North American countries, and because the production processes of the establishments in these industries are fundamentally different from the production processes for other machinery and equipment. A number of important activities have been moved out of manufacturing while other activities have moved in. Publishing has moved to the new Information sector and logging to Agriculture,Forestry, and Fishing. Coming into manufacturing are bakeries that bake on the premise and custom manufacturin€ Retail and Wholesale Trade NAICS redefines the boundaries between Retail and Wholesale Trade. The nev NAICS definition emphasizes what the establishment does,rather than to whor it sells. Retailers are defined as those establishments that sell merchandise, generally without transformation, and attract customers using methods such as advertising, point-of-sale location, and display of merchandise. A store retailer has a selling place open to the public; merchandise on display or available through sales clerks; facilities for making cash or credit card transactions; and services provided to retail customers. Wholesale establishments, on the other hand, are primarily engaged in selling c arranging the purchase or sale of: (a)goods for resale, (b)capital or durable non-consumer goods, and (c)raw and intermediate materials and supplies used in production. Wholesalers normally operate from a warehouse or office and ar characterized by having little or no display of merchandise. In addition, neither the design nor the location of the premises is intended to solicit walk-in traffic. Wholesalers also do not normally use advertising directed to the general public The 1987 SIC defined retailers as those establishments that sold primarily to consumers while wholesalers were those establishments that sold primarily to business customers. The distinction between the boundaries of the two SIC divisions was based on class of customer rather than the selling characteristics of the establishment. It is estimated that seven percent of computer wholesaler 22 percent of office supply wholesalers; 35 percent of farm supply wholesalers and 57 percent of petroleum bulk stations will move to retail. Another major change to the retail trade sector is the removal of restaurants from retail trade. Restaurants are combined with accommodations to form a ne' sector in NAICS, Accommodation and Foodservices. Restaurants accounted fo about 10 percent of retail trade as defined by the 1987 SIC. Information Perhaps the most important change in NAICS is the recognition of a new Information sector. This new sector includes those establishments that create, disseminate, or provide the means to distribute information. It also includes establishments that provide data processing services. Page 6 of 13 in services; broadcasting and telecommunications producers and distributors, previously included with utilities and transportation; and motion picture and sound recording industries, information services, and data processing services, previously included in services. There are 34 industries included in this new subsector, 20 of which are new. Some of the new industries include paging, cellular and other wireless telecommunications, and satellite telecommunications. Finance and Insurance This new sector recognizes the important and dynamic changes occurring in the U.S. financial sector. Real estate--part of this grouping in the SIC--was moves to a new sector called Real Estate and Rental and Leasing. Deregulation and thi constantly changing structure of financial industries made it difficult to construct a system among the three countries. Therefore, agreement with Mexico for this sector reaches only to the 3-digit level (subsector)for finance and 4-digit level (industry group)for insurance. However, Canada and the United States reached agreement down to the 5-digit level. Real Estate and Rental and Leasing This sector includes industries from Services; Finance, Insurance, and Real Estate; and Transportation, Communications, and Public Utilities Professional,Scientific,and Technical Services Those businesses whose major input is human capital are grouped together in this new sector. The industries within this sector are each defined by the expertise and training of the service provider. The sector includes such industries as offices of lawyers, engineering services, architectural services, advertising services, veterinary services, advertising services, and interior design services. Forty-seven industries are grouped in this sector, 28 of which are new. Administrative and Support; Waste Management and Remediation Services This sector includes industries from Services; Transportation, Communications and Utilities; Construction; and Agriculture,Forestry, and Fishing Educational Services Health and Social Assistance This new sector recognizes that it is sometimes difficult to distinguish between the boundaries of health care and social assistance; therefore, NAICS groups these industries together in a new Health and Social Assistance sector. Some of the new industries include HMO Medical Centers,Family Planning Centers,Blooc and Organ Banks,Diagnostic Imaging Centers, Continuing Care Retirement Communities, and Community Food Services. The sector also includes ambulance services transferred from Transportation, Communications, and Public Utilities. Accommodation and Food Services This sector includes lodging from Services and food services from Retail Trade Arts,Entertainment,and Recreation Those businesses engaged in meeting the cultural, entertainment, and recreational interests of their patrons are grouped together in this new sector. Casinos and other gambling businesses are recognized for the first time in NAICS, as are historical sites and sports teams and clubs. In all,there are 25 industries in the sector, most of which are new-- 19 in all. While most of the industries in the sector come from the SIC Services division, others come from Retail Trade and Finance, Insurance, and Real Estate. Other Services This sector includes industries from Services; Agriculture,Forestry, and Fishing;Manufacturing; and Finance, Insurance, and Real Estate Auxiliary Establishments Auxiliary establishments are those establishments that primarily produce support services for other establishments of the enterprise. Generally, these support services are not intended for use outside of the enterprise. In NAICS, these establishments are classified according to the establishment's primary activity. For example, an establishment providing data processing services for an enterprise is classified in NAICS 51421,Data Processing Services. An establishment that is the head office of an enterprise is classified in the new NAICS industry 551113, Corporate, Subsidiary, and Regional Managing Offices. In the 1987 SIC, each of these establishments was classified according to the primary activity of the establishment for which the support activity was performed. In the above examples,if those support units primarily served an automobile making plant,the support establishment was classified in automobile manufacturing. The SIC, however,treated the production of goods for other establishments of the same enterprise differently. If a manufacturing establishment produced goods for use within the enterprise,the manufacturing establishment was classified according to its primary activity, not the primary activity of the establishment it served. Page 8 of 13 this inconsistency.NAICS classifies auxiliary establishments based on what they do,not on whom they serve. The production oriented concept of NAICS mandated this change. This change will result in significant shifts in employment data. In 1992, Censl data showed over 1,000,000 auxiliary employees assigned to manufacturing an over 840,000 auxiliary employees assigned to retail trade. These employees are most likely to move to either the Management of Companies and Enterprises sector;the Warehousing and Storage subsector;the Computer Systems Design and Related Services subsector; the Accounting, Tax Preparation,Bookkeepin€ and Payroll Services subsector; or some other services-related subsector. For th 1997 Economic Census, these auxiliary establishments will be dual coded by primary activity and by whom they serve. The data will be shown separately to provide data users with the necessary links to prior information. With some important exceptions,it provides a set of standard 5-digit industries that describe the industrial structure and composition of the Canadian, United States and Mexican economies at selected levels of aggregation where agreement occurred among the three countries on a compatible classification. Below the agreed-upon level of compatibility each country has added additional detailed six-digit industries, as necessary to meet national needs, provided that this additional detail aggregates to the NAICS level. As a rule, the 6-digit classes of the three countries carry the same code when they refer to similar industries and different codes when they refer to different industries. However, in rare instances,when the combined number of Canadian and US 6-digit classes exceeded 10, this resulted in an identical code for classes with a different content.
