POSSIBLE ZONING AND BUILDING VIOLATIONS
Laws and regulations in our society are, at times, difficult to
understand and fully comprehend. This is true of zoning ordinances,
which are laws intended to protect and govern the many different uses
of land in Spokane County. It is my responsibility, as the Zoning
investigator, when the situation arises, to help resolve contlicts
involving the Spokane County Zoniny ordinance.
This oftice has received reports regarding possible zoning and
buildiny violations on your property, located at East 10601 MaIIon,
Spokane County, parcel number 16542-1020. This property is zoned
Agricultural Suburban.
A recent visual inspection by our field inspector indicated, are
believe, that these reports are possibly accurate. It was noted
that the relocated residence and the addition may be in violation of
the rear yard setback requirement. Further, our records indicated
that no nuildiny permit was applied for the addition and that no
inspections were requested for the relocated residence.
Section 4.U5.11U(a) of the Spokane County Zoning Ordinance provides
that residential structures i)e setback at least 25 feet from the rear
property Iine. Further, Section 301 of the Uniform Building Code
requires a buildiny permit for any alterations or additions.
It is the intent of this letter to advise you of an apparent zoning
and buildiny code violations and to request compliance within a
suitable time trame. Accordingly, we are of the opinion that since
you have now been informed of the requirements of the Spokane County
Code, a period of 3U days, beyinniny withyour receipt of this letter,
should be s u t f i c i e n t tine in which to briny your property into
compliance by contactiny the Spokane County PIanniny Uepartment in
regard to possible alternatives available to you such as fiIiny for a
variance. In addition, within ten (10) days, the requirea
inspections for the relocated structure shall be requested pursuant
to building permit 83A-9370.

There was a question as to the rear property setback for the structure located
on Parcel #16542-1020.
Due to the "T" intersection of Mallon and Van Marter in the middle of this
property, the rear property line would be considered the western most property
line. The distance shown by Kenneth Pegg is approximately 56 feet, which clearly
exceeds the minimum rear yard setback of 25 feet.
Consultation with the County Engineer's indicates dedication of 25 feet along
the East 25 feet and North 90 feet of the property in question has occurred,
providing the necessary road frontage on Van Marter.
