This is true of zoning ordinances, which are laws intended to protect and govern the many different uses of land in Spokane County. It is my responsibility, as the Code Coordinator, when the situation arises, to help resolve conflicts involving the Spokane County Zoning Ordinance. This office has received reports regarding an electric fence on your property, located E. 10909 Mallon Spokane County, parcel number 16542-1045. This property is zoned Agricultural -Suburban. A recent visual inspection by our field inspector indicated, we believe, that these reports are accurate. A wire connecting from a box on the house and extending to a pole near a hedge on the east property line was confirmed. Section 4.17.045 of the Spokane County Zoning Ordinance prohibits electric fencing of any type within residential zone classifications. It is theintent of this letter to advise you of an apparent zoning violation and to request compliance within a suitable time frame. Accordingly, we are of the opinion that since you have now been informed of the requirements of the Spokane County Zoning Ordinance, a period of 10 days, beginning with the date of this letter, should be sufficient time in which to bring your property into compliance by removing the wire from its power source. Do not hesitate to act upon this important matter, since a violation of the Spokane County Zoning Ordinance is a misdemeanor and does carry a penalty. The fence in question was put in place to protect the Sadowskis' hedge from the neighbor's dog and is designed to be electrified. However, the fence is not electrified, a fact which your field inspector could have determined during his inspection. Also, the box on the house to which you refer is a part of the burglar alarm system, and a closer inspection will show that the wire in question does not enter that box. The position of this office in matters dealing with electrified fences and devices is to encourage the non-use of such systems where prohibited by county and state laws regulating their use. To that end, if a system is designed and is capable of carrying an electric current, whether or not electrified, would constitute a violation of Section 4.17.045 of the Spokane County Zoning Ordinance (copy enclosed). The statement that the wire in question "is designed to be electrified" would in itself be a violation and, therefore, we would ask that it either be removed, or be broken or apart from its entry into the house.
