Dear Mr. Haney:
With regard to your questions about the Spokane Valley Municipal Code's language
concerning the rebuilding of conforming uses, there is no code section that deals with the
rebuilding of a conforming use. If a use, in this case residential, is allowed or
"conforming" and it is destroyed to any extent, it could be rebuilt because it is an allowed
use. The only time the 80% rule is an issue is if a "non -conforming" use is destroyed.
Again, in the case of the above referenced address, the residential use in a Mixed Use
zone is a conforming use and therefore can be rebuilt in the event that it is partially or
completely destroyed.
