And, property pre sently zoned Multiple Family Suburban lying on the south side of East Fourth Avenue between the Nursing Home property and Felts Road be zoned Agricultural Suburban. Also, property lying on the south side of East Fourth Avenue between Felts and Farr Roads be zoned "Agricultural Suburban" to a lot depth of 137 feet more or le s s (rear lot line of Tract 244 to Opportunity) and all of johnston's Subdivision be zoned Agrlcultural Suburban. Reasons and Analysis: Existing Land Use: VVtthin the subject study area crosshatched on the agenda map are located the following land uses; eiqhty (80) single family residences fronting on Uni- versity, Felts Road, Herald Road, Farr Road, and East Fourth Avenue (47 of these sfngle fami,ly residences front on East Fourth Avenue between University and Farr Roads); one nursing hoine; one 12 unit apartment building; one non-conforming trucking terminal and repair shop; one nursery; and three trailers. One ownership located in Tract 227 of Opportunity (located nowrthwest of the apartment house) has an established barn and horse corral where several horses are presently mainr tained. There are approximately ten (10) parcels of land which have vacant lot frontage, or partial lot frontaqe with larqe vacant areas towards the rear of the parcel, on East Fourth Avenue. The Planning Commissfon's staff presented the followfng four zoning alter- natives for the study area: Alternative No. One: Maintain Fourtb Avenue as the boundary line for the Multfple Family Sub- urban zoning between University and Farr Roads, except leave the Nursing Home in the Multiple Family Suburban Zone. Then expand the existing Multiple Family Suburban Zone boundary to a rear lot line approximately 268.36 feet easterly of University Road between Fourth Avenue and the railroad tracks (Tract 173 of Opportunity). The south side of East 4th Avenue would be zoned Agricultural Suburban. - 14 - (contd. ) ZE-3 ].-68 -ZONING PLAN FOR FOURTH AVENUE BETWEEN UIVIVERSITY & FARR (contd Good Points; 1) Provides properties lying between the railroad and 4th Avenue with htgher residential density standards and certain other limited bu sfne s s uses and mobile home s. 2) Corrects the present Multiple Family Suburban zoning boundary lying approximately 75 feet south of the south line of 4th Avenue which cuts across the center of lots rather than at the rear property line s. 3) The expanded Multiple Family Suburban Zone boundary on University would allow a broader range of land use s fronting University near the railroad track s. Bad Points: 1) Singie family residences on the south side of 4th Avenue would front into the Multiple Family Suburban Zone receivinq the affects of higher residential density development such as apartment houses. 2) One trailer would be made non-conforming. 3) Would not protect the north side of 4th Avenue from high density residential development. Alternative No. Two: Maintafn Fourth Avenue as the Multiple Family Suburban Zone boundary between University and Felts Road except leave the Nursing Home in the Multiple Family Suburban Zone. Between Felts and Farr Roads the existinq Multiple Family Suburban Zone boundary would be extended to the rear lot lines 137 feet south of the south line of East Fourth Avenue. Also, the Multiple Family Suburban Zone boundary east of University would be extended to a rear lot line 268.36 feet east of the east line of University Road between the railroad tracks and Fourth Avenue. Good Points: 1) The existinq Multiple Family Suburban Zone boundary would be expanded southward from the south line of 4th. Avenue to the rear lot lines (except the frontage between Felts and the Nursing Home) which would provide a satisfactory Multiple Family Suburban boundary from tbe standpoint that both side s of 4th Avenue would have the same future development. 2) Same as No. One under Alternative One. 3) Same as No. Three under Alternative One. Bad Points: 1) This proposal does not solve the sinqle family apartment problerri. 2) The expansion of the Multiple Family Suburban Zone boundary allows the extension of Multiple Family Suburban permitted uses further southward into the single family residential area. - 15 - (contd. ) ZE-3 t-68 - ZOIVIIVG PLAN FOR FOURTH AVE f BETWEE N U1vIVERSITY & FARR (contd. ) Alternative No. Three; Relocate the existinq Multiple Family Suburban Zone boundary to a line one hundred fifty (150) feet north of the north Iine of Fourth Avenue and zone all the lot frontage on Fourth Avenue between University and Farr Roads to Agricultural Suburban except for the Nursing Home and lots froniing on South University Road which should retain the Multfple Family Suburban zoning classificatton. Also, a possible road right of way adjacent to the south line of the Chicago, Milwaukee, St. Paul & Pacific Raflroad right of way between Farr Road and University Road might be feasible depending upon the cooperation of individual property owners. Such a road, of course, would open up the rear portion of most of the lots with frontaqe on Fourth Avenue to hfgh density residential development. Good Pof nts: 1) Thi s proposal accompli shes the indicated wi s he s of single family resi.dential owners of not allowing any more apartinents next door to their Fesidence. 2) The rear portions of properties fronting on the north side of 4th Avenue can still be utjlized provided road acce s s is made availab le. 3) A Multfple Family Suburban Zone buffer is provided between the railroad track s and 4th Avenue residential frontage. Bad Points: 1) The possibility af qetting a road right of way adjacent to the south line of the railroad right of way between Farr and Universtty Roads is somewhat questionable. If no road were provided as indicated,, then separate Multiple Family 3uburban properties would be virtually impossible. 2) Three trailers and one apartment building would be made non-conforminq uses. Alternatfve No. Four; The fourth alternative suggested would be to rezone the entire area preaently zoned Multiple Family ,uburban (except the nursing home) to the Agncultural Suburban classification with one slight variation by moving the proFosed Agricultural Suburban boundary to the rear lot lines south of the south line of 4th Avenue between Farr and Felts Roads,, including the entire johnston's Subdivision. Good Points: 1) The area under study has been largely developed with moderate to substantial single family residences front- ing East Fourth Avenue and the Agricultural zoning would be in keeping with ex3sting residential development. 2) Mobile homes would be excluded from the area. - 16 - (contd. ) ► ZE-31-6e --ZONING PLAN FOR FOURTH AVE. BETVVEEN UNIVERSITY & FARR (contd.) Bad Points: 1) The properties running the full depth be#ween the rail- road tracks and 4th Avenue would be unable to develop with uses compatible to thsexisting residential neigh- borhood and at the same time able to develop next to the ratlroad tracks. 2) The neighborhood resfdential development would be forced by zoning to utilize the area adjacent to the railroad tracks which is highly unlikely. The Planning Commissfon recommends Zoning Plan "Altemative No. Four" otitllilecl above with the modification of ieavinq those properties presently zoned Multiple Family Suburban, and havtng frontaqe on South University Road, in the Muitiple Family Suburban Zone ctassification. Properties with frontage on the east side of University Road, which are now partially aoned Niultiple Family Suburban, are recommended to be zoned Multiple Family Suburban in their entirety. Property owners at the hearing and owners signinq a petition fn support of the Agricultural Suburban zoninq were opposed to the existing Multiple Family Suburban zoning along Fourth Avenue. However, several property om ers fronting on South University Road expressed their desire to keep the present Multiple Family Suburban zoning.
