MINUTES OF THE SPOKANE COtNTY PLANNING COi,MISSION HEARING OF MARCH 30, 1978.
W1iEREAS, the Spokane County Planning Commission did hold a public meeting on
March 30, 197$ to consider the testimony and requests of several applicants,
objectors and other interested partles concerning the below referenced subdl visions,
- zone classzfication upgradings, extensions of time, a.nd other items of business and,
t,tHEREAS, at said hearing opportunity was afforded those favoring and those
opposing all items of business, and'
WHEREAS, NIr. McCoury, Mr. Thomas, Mr. Quigley and Mr. Kennedy were in atten-
dance and constituted a quorum, and,
IqHEREAS, the Spokane County Planning Commisslon fully considered the testimony
;iven the environmental review, and all other evidence presented, recommends to the
Board of County Comrazssioners the following:

Bob Bethards of the staff presentecl a report to the Commission
members regarding the number of preliminary plats which had
been reviewed by the Planning Commission during the past year
and the number of appeals which were heard by the Board of County
Commissioners. Of the total 121 preliminary plats reviewed, 37
were appealed. About 70% received the same cecommend'ation from
the Board of County Commissionecs. The Board only reversed less
restrictive action on five diffecent plats.

b) Shart Plak OrdinanrP,
Mr, Be[hards reported that the Short Plat Ordinance became
effective on M,arch 13, 1978. The appeal prucedure in the Short
Plat administration is heard before the Planning Commission and
then forwarded to the Board of County Commissioners. There h?v_e
also been some other minor changes in the adopted ocdinznce,

Mr. Bethards said a copy of Road Standards which have been
adopted by the Board of County Commissioners will be sent to the
Planning Commission. It is planned rhat these will be discussed
at the April hearing.

Tom Davis of the staff inforined tlie, Commission that Mr. Paul
Rayburn wished to request that the use of a Vital Records Center
be made a Conclitional Use in the Agricultural Zone, and that •`_he
staff be directed to advectise for this amendment to the Spokane
County Zoning Ordinance for consideration at the April 21st
• hearing,
In explaining the desire for this use further, Mr, Paul Rayburn,
South 3518 Lincoln Drive, Spokane, commented that there is not
a vital re:.ord center presently located in the Northwest. The
intended location is to be one mile north of Daep Creek at Sprague ~
and Ritchie Roads.
Mr, Thomas moved, Mi•. Quigley seconcied, that the propo5ed amendment
to [he Spokane County Zoning Ordinance be advertised for public hearing
on the April agenda. Motion carried unanimously,

Mr. Eugene Prather of the Spokane County Health District requested
tha t the Commis sion be made aware and review the engineering cos ts
involved in platting. At the present time the only consfderation being
given is at the initial costs and not the long-range costs which car. '_-e

d Gary Fergen of the staff presented a report on the current status of
citizen participation. The "Operation Insight" flyer was updated in
March and sent to the regular mailing list and also to the granges and
to the County libraries . Mr. Fergen also cited a list of c~roups and
organizations at which presenLations have been made by the staff and
those which are scheduled for the immediate futuce.

History:.,. Midilome Addition, originally known as Chester Addition,
was approved in April 1976 as a 7-phase proposal. The first phase,
Midilome Addition, was finalized in April 1977; the second phase,
Midilome lst Addition, was finalized in July 1979; and a portion of
phase three is currently being reviewed for finalization (the June
1983 HOME SHOW will be held on this portion of Midilome) as Midilome
'2nd Addition. The preliminary plat has received 6 one-year Extension
of Time approvals, in which the March 1981 extension included a
change-of-condition for the addition of 3 lots to phase-seven.
The sponsor indicates that progress has been made as: two phases
have been filed and built; the sewer treatment plant and drains-
field, designed for the entire preliminary plat, is built and oper- -
ating under an 0& M Agreement with Spokane County; and a portion of
of phase-three is currently being finalized through the various
County departments. The sponsor stresses that the preliminary plat
approval was required for his entire 160 acres and was subsequently
approved as a 10-year phased development with at least seven phases.

Due to the poor economic conditions of the housing market the
• scheduled 10-year development program has "slipped", therefore, the
sponsor is requesting this change be a consideration of his request.
Proposal: The sponsor is requesting an "extension of time" of the
preliminary plat approval to divide the remaining 112 acres into 307
lots for single-family dwellings and to change the zoning on the 112
acres from Agricultural to R-1. .

H. SPECIAL INFORMATION
The Planning Department is recommending that all preliminary plat approvals be
brought into conformance with RCW. 58.17 regarding the amount of time allowed
before a preliminary plat must be finalized. State law currently allows a
preliminary plat three (3) years (without any new conditions) and allows one
extension of time for one year, if the sponsor requests the additional year;
however, this 4th year may have new conditions added. Staff is recommending
three (3) years for the extension of time rather than only one (1) year due to
the preliminary plat beinga approved for long-term "phased" development.
Staff finds that this preliminary plat constitutes "fill-in" development for
the Urban Category, for the Valley Sewer since the proposal is within the
Priority Sewer Service Area (PSSA), and for the existing public services and
facilities of the near vicinity.
Since the sponsor has, in good faith, complied with the agreement of the '
conditioned approval by making progress toward finalizing this preliminary
plat and since the proposal was approved as a long-term "phased" project, ~
staff recommends the three (3) year extension be granted with the opportunity
to request another three (3) year time extension if substantial progress
continues to be made.

No other additional conditions of approval are being recommended by the re-
maining departments.

I. GENERAI, INFORMATION
A. History
Midilome Addition, originally known as Chester Addition, was approved
April 1976 as a 7-phase proposal. The first phase, Midilome Addition,
was finalized April 1977, and the second phase, Midilome,lst Addition,
was filed July 1979.-
This proposal, Midilome 2nd Addition, has received 5 oae-year Exten-
. sion of Time approvals, with the March, 1981 approval including a
change of conditions to expand the proposal by 3 lots.
The sponsor indicates that progress is being made as the sewer plant
and drainfield are being operated by Spokane County under aa Opera-
tion and Maintenance Agreement. The sponsor requests that his
160-acre, 10-year development with 7 phases, be granted a one-year
Extension of Time to April 1, 1983, so they can proceed as originally

In the South Central Spokane Valley, east of Dishman-Mica Road and

attachment "C".
HEALTH CONDITIONS -
1. We offer no new recommended conditions; only those conditions already
attached to the preliminary plat of record and those conditions imposed by
the Spokane Board of County Commissioners on December 1, 1977 (Resolu-
tion #77-1394).
UTILITY CONDITIONS
1. The owner, his heirs and successors shall join and participate in any
petition or resolution which purpose is the formation of a utility local
improvement district (ULID) pursuant to RCW Chapfier 36.94, as amended.
The owner, his heirs and successors shall further agree not to oppose or
protest any legal assessments for any utility local improvement district
(ULID) established pursuant to RCW Chapter 36.94, as amended.
2. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County.
3. That provisions for public sewers be made. NOTE: Planned treatment
plant expansion is adequately sized to accommodated the three (3) addi-
tional lots but the area set aside for the drainfield area may not be shown
large enough to accommodate full development of the Midilime Subdivision
and these three (3) lots. Phase S, or an equivalent thereof, should not
be approved unitl appropriate departments have decided if additional
drainfields are needed.
BUILDING AND SAFETY DEPARTMENT
1. Recommend approval with condition that prior to development of this prop-
erty that an engineered water distribution systiem plan shall be submitted
to the Spokane County Department of Building and Safety. This disCribu-
tion plan shall include waler main siZe, Flows, locations, fire hydrant type
and locations, water storage tanks size, and location and design criteria.

I. GENERAL INFORMATION
A. Location
In the South Central Spokane Valley, east of Dishman-Mica Road and south of
Opportunity, more specifically bounded by Pines on the east. Bowdish to the
west, 32nd Avenue on the north and 40th Avenue on the south.
B.. Proposal
- Project size is 112 acres subdivided into 307 lots for single family use.

- Lot size = 12,500 sq. ft.
NOTE: The original project encompassed 160 acres to be divided into 437 lots;
to date, two phases have been finalized with 133 lots on 48 acres.
C. Relationship to the Comprehensive Plan
The proposal is located in the "Urban" Category of the Generalized Compre-
hensive Plan for Spokane County. The project is a"fill-in", development and
appears to be consistent with the general purpose, detailed definition and
general intent of the Comprehensive Plan Text. The project site lies within
the boundaries of the Aquifer Sensitive Area and the General Sewer Service
Area. The proposal is to be served by the existing sewage treatment plant.
In considering the above, the Planning staff would therefore recoanmend approval
of this project.
D. Chaage of Conditions:
The sponsor is requesting the addition of three (3) lots to the project as a
result of negotiations with the Central Valley School District and the County
Engineers Department. The site, containing the three additional lots, is
presently vacant, Pines Road is improved to the south boundary of the school
site.

2. Compatibility with Existing Land Uses
The proposed change of conditions resulting in three (3) additional lots would
appear to be consistent and compatible with the developing Midilome lots.
II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has examined the proposed change of conditions and
finds that the "conditions of approval" which have been attached to the pre-
liminary plat of record are adequate and should be required for this change of
condition. The plat of Midilome shall be subject to the provisions of the
Board of County Commissioners Resolution #80-1592 as amended, attachment "C".

' B. Sewage Disposal

The Health District indicates that the three (3) additional lots are intended
' to be included in the existing sewage treatment facility and that adequate
area exists to accommodate the additional lots.
C. Water Supply ~
:•The proposal is iocated wi.thin the recorded service area of Model Irrigation
District #18.
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrzgation uses.
D. Drainaj~e '
Final construction plans should be reviewed and approved by both the County
Engiaeer and Health District priar to the finai plat filing.
E. Fire Protection
The proposal is situated within the recorded service area of Fire Protection
District #1. .
, The Fire District staff requests that the Hearing Examiner Committee require

PRELIMINARY SUBDIVISION AND ZO(VE RECLASSIFICATION
.
I. GENERAL INFORMATION
-This preliminary plat proposal has had an Environmental Impact Statement prepared
for it. The final Environmental Impact Statement, including review comments, has
been published as of September 13, 1978. The purpose of the Environmental Impact
Statement is to provide a maximum amount of information to the decision makers,
including the Planning Commission. Any unmitigated, adverse impact identified in
the Statement, including review commentary in response to the draft impact state-
ment, can be considered grounds for the Commission to conditipn or deny the pro-
posal, pursuant to R.C.W. 43.21C,060.
A. Location
-Midilome subdivision is situated in the south central Spokane Valley, Zt is
east of the Dishman Mica Road and south of Opportunity, more specifically,
it is bounded by Pines, Bowdish Road, 32nd and 40th Avenue. (Reference page 9
of the D.E.I.S.)
B. Proposal
-As the Planning Commission may remember, the proposal entails 25 acres, and
72 lots that have already been approved. The E,I,S, addresses the entire
plat, which with the lots approved, is for 160 acres, and a total of 425
lots, all for single family residences.
-The plat as presented today is for the remaining 353 lots at a gross density
of about 2.6 per acre, and a lot size of 10,500 to 11,500 square feet.
C. Relationship to the Comprehensive Plan
-The approved map of the Comprehensive Plan indicates res,idential usage of
the proposed plat area with no specific densities designated,
D. Existing Land Uses
-The iand is vacant with approximately 60 acres in cultivation. (Reference
page 108 of the D.E.I.S.)
-Land to the north is residential in character with subdivisions such as
Kokomo townsite and Skyview acres at approximately the same density as the
proposed plat.
-To the west is the approved portion of Midilome and other subdivisions,
Aloha Addition and Castle Addition, extending to the Dishman Mica Road. -South and east of the proposed plat, the land is in larger parcels of vacant
and agricultural uses. Directly east across Pines Road, is the Chester
Elementary School. '
E. Compatibility with Existing Land Uses
-The proposed plat appears compatible with other residential use and complies
with recent and past Planning Commission decisions in the area.

H. SPECIAL INFORMATION
-Those items that are normally covered by the Planning Staff within this
section of the Findings have not been addressed, as the staff feels they are

retained in the plat file as an official part of these Staff Findings.
III. ZONING
-Pending approval of the final plat, it would be appropriate to reclassify the
zoning to Single Family Residential.

concentration of nitrates in the wells in the area; statistics on automo-
; bile and train traffic; soil and water runoff; erosion that comes with

B. SHORT PLAT SUBDIVISION APPEAL
1. SP-78-059, Short Plat by J. Bevan. Appeal by Gaubinger. That the short
plat be DENIED. Because of a statement in the dedication of Myron Estates
that no more than one structure be placed on any one lot without filing a
replat, and also stated lots in this plat would remain one acre in size,
the question was raised as to whether or not a short plat is considered
a replat. The issue remained that the area was intended for one-acre
lots, which was a decision made with consideration of the neighboring
Ponderosa plat.
(Motion to deny the short plat by Cu11er, seconded by Byrne. Voting was
five.in favor of the denial, with two opposed.)
C. PRELiMiNARY SUBDivISiONS AND ZONE RECLASSIFiCATiONS
2. PE-1168-78, MIDILOME FIRST ADOITION by «idilome, Inc. ZE- 13-78, AGRiCULTURAL to SINGLE FAMILY RESIDENTIAL: That the preliminary
plat request be CONTINUED to September 28, 1978, at 10:00 A.M. Because ,
earlier items on the agenda had consumed a good portion of the day, the
motion was made by 6yrne, seconded by Quigley, that the Commission hear
Midilome until 6:00 P.M., and to continue to another day if not concluded
by that hour. Vote was six in favor of that motion, with one opposed.
, W. 0. Hubbard presented Findings of the Staff with additional conditions ,
-of the Engineering Department. Mr. Willard Sharp, representing the sponsor,
presented history of and request of approval for Mililome. The sponsor also
, testified. Mr. William Powe11, representing Mrs.Honnican, presented opposing
testimony. Testimony was still in progress at 6:00 P.M.
(Motion to continue until September 28 at 10:00 aM by Thomas, seconded by
Quigley. Uote in favor of motion was unanimous.)

WNEREAS, t•trs. Frank Gerimonte, did by letters dated March 30, 1978 and
April 7, 197E3, request a special public liearing bef'ore t,he Board of County
Commiesionere for the purpose of presenting evidence arid testimony against the
Board'e ieeuanoe of a proposed declaration of non-significance with regard to
the change of condition for Malloy's Additicn to fill an area for approximately
62 homes, creating an 11 acre barrow sump and permitting septic ta.nks rather
t}lan a sewage collecta.on system; and,
WHEREAS, the Planning Director did Pdvise the Board of County Commieeioners
by memorandum dated April 17, 1978 to schedule a hearing for the reconeider-
ing of the proposed declaration of non-aignificance, atid con9equently the plat
proposal itself; and,
WHEREAS, the Board of County Comnieeioner did hold a publie hsaring on
the reconsideration of the proposed declaration of non-eignificance and to take
testimony of the pIat eponsor, objectore, and other intereeted parties; and,
WHEItEAS, at eaid hearing opportunity wae afforded those favoring and
those opposipg t.he above described propoaed declaration of non-significanee
and change of coruiition to the preliminary plat and zone change, the Board of
County Commissionera of 3pokane County havina fully congidered the teetimony
given, the records and minutes of the Planning Cormnission, the Planning Depart-
ment staff's recominended aonditions to which tlie change of conditions for
Ma1•loy's Addition would be sub,ject, the environmental review, and all other
evidence presented, and further having pxeviously personally acquainted them-
selves wi.th the site and vicinity in queation, does hereby find that sufficent
data was presented to raiee serious queetions with regard to the project'a
= mpact on the physical envirorunent particutexly in light of the recent Aopel 1 ate
and Supreme Court environmental decisions. NOW, THMREFORE, t.he Board of County Courniesioners does conolude that a
declaration of oignificance should be and hereby ie iesued by the Chtiirrnan for
the prelicninary plat known ae Malloy'e Addition, PE-lo86-77 and zone reelass-
ification to Single Faraily Residential; and any and all previouely iseued pro-
posed or final negative threshold determinations are hereby rescinded.

FURTHERhiORE, the subject plat is to be reriianded to the Planning Conunission
for,a public heariiig wi th a final Erivironinental Impact S#.atement, at such time as
one becomes available, and after legal rrotification of the hearing as per standard
Pl anning Departnient pracedures for a proposed prelimi nary plat.
