This project lies in a relatively flat area (except the northern 370 feet) about 1/4 mile north of 190 Freeway and 1/4 mile east of Pines Road. Local drainage ways are insignificant. It is located over the Spokane Valley Aquifer. b. Surface soils are classed as Garrison gravelly loam with 0 to 15% slopes. They have a septic tank filter field limitation of slight with possible contamination of groundwater. c. Geologically the soils are glaciofluvial deposits; stream-laid sand and- gravel; contains some boulders in places; includes some undifferentiated glacial deposits. The lower terrace remnants have probably been reworked by streams. These geologic structures yield moderate to very large amounts of water. The data from 2 Consolidated Irrigation District wells in the area shows the wells are 73 to 147 feet deep and have static water levels varying from 47 to 61 feet below the surface. The total nitrogen level was 1.13 ppm. The Consolidated Irrigation District has indicated that it can supply domestic use water for the plat upon completion of agreements with the developer. 3. Impact discussion. a. The plat sponsor has proposed 13 lots on 9.37 acres. Each lot is to be served by a public water system and its individual on-site sewage dis- posal system. This raises the question of significance of the impact on the groundwater in the area and possible alternatives for sewage disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd conidered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he concluded that: ~ (1) In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. (2) All dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate por- tion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phos- phates, which are known to react with soil particles, or nitrates, which are taken up by plant roots" will be less than the total found in septic tank effluents. (3) "The calculated results at the downstream end of groundwater flow line indicate that the maximum range of (dissolved) sol- ids concentration expected at present (1975) is up to 93 mg/1 (milligrams per liter) above the natural groundwater back- ground of 155 mg/1. The forecast year 2020 maximum incremental concentration is 101 mg/1 above the natural background."---"The analytical results of the forecast impact of year 2020 when com- pared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality if already a substantial proportion of the ultimate level." c. Currently, results of chemical analysis show the total nitrogen content of the groundwater as in the range of 0.95 to 113 ppm. A projected incre- , mental increase using Dr. Todd's expected 8.6 percent would result in ranges 1.00 ppm, to 1.23 ppm. Current Federal and State drinking water standards permit up to 10 ppm. d. Alternative sewage disposal methods that would not recharge the ground- water have the following general characteristics: 0 I-- ~ Proposed preliminary plat - MEADOWS END Page 3 ~ January 19, 1978 i (1) Gollector and central treatment systems discharging to surface waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. These systems are not currently economically availablefor this project. (2) Sealed systems, whether individual or coimnunity, depend on evaporation for liquid removal. Some, such as la- goons, have safety hazards associated with them and relatively poor community acceptance. 4. Recommend that: a. A public water system including fire flows serve each lot prior to sale of the lot. b. Each lot be authorized the use of an individual on-site sewage ssstem. c. An on-site sewage management system be created and approved by this of- fice prior to 03) signing of the final plat if more than a total of thirty-three dwelling units are authorized within the plat. d. An existing well located in the southeast portion of the plat is to be abandoned and destroyed prior to filing the final plat pursuant to in- structions from the Spokane County Health District. e. Plans for grading and placement of fill in the site shall be approve3 by the Spckane Countv Health District prior to f iling the final plat. SPOKANE COU;qi y PLANNfNG DEPWRTmENT ~ BYLAIUS . OF MEADOWS END HOMEOWNERS ASSOCIATION ARTICLE 1 1. Purpose of the Association: The Association's primary function is the maintenance and oversight of the operation of each of the individual on-site septic tank and drainfield sewage disposal systems. The system is defined and composed of: A. The septic tank(s) and its drainfield(s) on its individual lot(s). ARTICLE 2 1. Individual On-Site SewaQe Disposal System Rules: The Association shall: A. Contract with a licensed agent rvho shall not less than once every three years, or if required more often, pump out, inspect and service the septic tank and drainfield system in accordance with accepted standards and procedures. B. Cause to be inspected and repaired components of the system when required by the Spokane Health District. The Spokane County Health District may from time to time inspect the system for satisfactory function and compliance. Users of the system shall introduce into it no materials such as paints, oils, solvents, and chemicals other than those and in quantities normally used in the home. ARTICLE 3 1. Limited Easement: A. Defined as the easement area, specifically drainfield and septic • tank area upon each lot. B. Limited Easement: The easement is for limited purposes only. The , respective lot owners of Meadows End shall enJoy full use and privacy from trespassers in every way except as required for the periodic or emergency inspection, maintenance, and repair of the system. ~ C. The respective lot orvners of Meadows End shall erect no structure or barrier that rvould prevent accessibility for maintenance and repair of the on-site sewage disposal system, or introduce plantings or engage in other activities within the easements that rvould prevent the proper functioning of the system drainfield. This paragraph does not preclude • the erection of fences such as chain like, wood or other materials that can be temporarily removed f or service or repair of the drainfield or system components. , ~ ARTICLE 4 1. Assessments and Liens: Each homeorvner shall be assessed by the Associa- tion for his pro-rata share of the full cost of maintenance and repair of the system. Such costs shall be defined and determined by the Association according to its rules and regulations so adopted. If any homeowner shall fail to pay the required assessment in the amount and time prescribed, the Association may declare the amount delinquent and place a lien against the respective homeowner's property. In the event that larvns and plantings placed upon the limited easements by the respective owners of Meadows End shall be disturbed for field replacement or repairs, the Association shall bear the full cost of restoring such lawns, gardens, and fences to their former state; the Association shall not be liable for loss of crops, flowers, or any planting inconvenience caused by such disturbance. ARTICLE 5 1. Dissolution of the Association: The Association may, by a majority vote of the homeowners be dissolved, provided that: A. All sewer lines of all lots in Meadows End are connected to a municipal sewer line servicing said plat when and if built by Spokane County or other Municipal Corporation. B. At such time as the treatment facility and disposal system and their components are abandoned, the limited easement providing for said system shall be vacated to or in part, such parts being retained for f uture pump station if required and each parcel af said easement or portions thereof shall revert with clear title and without charge to the respective owners of lot(s) Easements or parts thereof shall not revert to the owners of the lots until the Spokane County Health District shall have determined and agreed in writing that the easement or portions thereof are no longer required for the effective operation of said individual sewage systems. . ARTICLE 6 1. Annual Meeting: The annual meeting of the lot owners of the Meadows End Association for the election of officers to succeed those whose terms expire, and for the transaction of such other business as may properly come before the corporation, on the date and at the time hereinafter specified, if not a legal holiday and if a legal holiday, then on the next day at the same time of day. The day and time for said annual meeting shall be: the third Tuesday in January. 2. Special MeetinQ~.: Special meetings of the homeorvners for any purpose or purposes may be called at any time by the Association to be held at such time and place as the Associatfon may prescribe. -2- At any time, upon the request of any director, or of any homeowner or homeowners holding in the aggregate one-third (1/3) of voting power of all home- owners, it shall be the duty of the Secretary to call a special meeting of the homeowners to be held at such time as said Secretary may fix, not less than ten (10) nor more than thirty-five (35) days after the receipt of said request, and if said Secretary shall neglect or refuse to issue such call, the director or homeorvner or homeowners making the request may do so. 3. Notice of Meeting: No notice of the annual homeowner's meeting shall be required. Persons authorized to call special homeowner's meetings shall cause written notice of the time, place and purpose of the meetings to be given ten (10) days prior to the day named for the meeting. If such written notice is placed in the United States mail, postage prepaid, and addressed to a homeowner at his last known post office address, notice shall be deemed to have been given him,. Notice of any homeowner's meeting may be waived in writing by any homeowner at any time, either before or after the meeting, and attendance at the meeting in person or by proxy shall constitute a waiver of notice of the meeting. 4. Ad,7ourned hleetinq: An adjournment or adJournments of any homeowner's meeting may be taken to such time and place as those present may determine with- • out new notice being given, whether by reason of the f ailure of a quorum to attend or otherwise; but any meeting at which directors are to be elected shall be adJourned only from day to day until such directors are elected, and in the case of any meeting which is adjourned because of the failure of a quorum to attend the second of such adJourned meetings, although less than a quorum shall never- theless constitute a quorum for the purpose of electing directors and or contract- ing repairs and inspection of the sewage collection, treatment and or disposal system. ARTICLE 7 1. Off icers Enumerated Election: The off icers of the corporation shall be a President, a Vice President, a Secretary and a Treasurer, all of whom shall be elected by the maJority vote of all homeoavners at the annual meeting thereof, to hold office f or the term of bne (1) year, and until their successors are elected and qualified. 2. Qualifications: All of the officers of the association need to be home- owners. Excluding the office of President,'any two of the other corporate officers may be combined in one person. 3. The President: Shall exercise the usual executive powers pertaining - to the office of President. He shall preside at meetings of the officers and of the homeorvners and perform such other duties as the homeowners may from time to time designate. -3- 164. The Vice President: In the absence or disability of the President, the Vice President may act as President and shall perform such other duties as the homeowners may from time to time designate. 5. The Secretary: It shall be the duty of the Secretary to keep records of the proceedings of the homeowners and when requested by the President to do so, to sign and execute with the President all contracts and other obligations or instruments in the name of the association and to perform such other duties as the homeowners may from time to time designate. 6. The Treasurer: The treasurer shall have the care and custody, and be ~ responsible for, all funds of the association, and shall cause to be kept regular books of account. He shall cause in such depositories as may be designated by the homeowners. In general, he shall perform all of the duties incident to the office of Treasurer, and such other duties as from time to time may be assigned to him by the homeorvners. 7. Vacancies: Vacancies in any office arising from any cause may be filled by the maJority vote of all homeowners. 8. Other Officers and Aqents: The homeorvners may appoint such other officers and agents as it shall deem necessary or expedienV whohold their office for such terms and shall exercise such powers and perform such duties, as shall be determined f rom'time to time by the homeorvners. 9. Compensation: Officers shall serve without compensation. ARTICLE 8 BOOKS AND RECORDS 1. Records of Homeorvners Meetings and Share Register: The association shall keep at its office, complete reCords of the proceedings of the homeorvner. 2. Copies of Resolutions: Any person dealing with the association may rely upon a copy of any of the records of the proceedings, resolutions, or votes of the homeo►vners, when certified by the President or Secretary. 3. Books of Account: The association shall keep appropriate and complete books of account. ARTICLE 9 AMENUMENT OF BYLAINS 1. By the Lot Owners: These by-laws may be amended, altered or repealed at any regular or special meeting of the homeowners if notice of the proposed alteratxon or amendment is contained in the notice of the meeting by maJority vote, except Articles 2,3, & 5 may not be amended, altered or repealed without prior written approval from the Spokane County Health District. -4- w ~ , . Rules of Order: The rules contained in the most recent edition of Robert's Rules of Order, revised, shall govern all meetings of homeowners and officers rvhere these rules are not inconsistent with the Articles of Association, Bylarvs, or special rules of order of the Association.
