FINDINGS AND ORDER REGARUING NkELIMINARY PLAT PROPOSAL AND ZONE RECLASSIFICATION
PE-1151-77 CASTLE COURT ZE-181-77 AGRICULTURAL TO SINGLE FAMILY RESIDENTIAl. AND/OR
TWO FAMILY RESIDENTIAL: INGALLS
WHEREAS, the Spokane County Planning Conunission did, after public hearing on
Noveniber 16, 1977, forward to the Board of County Cortunissioners a recommendation that
the preliminary plat be known as Castle Court (File #PE-1151-77) and zone reclass-
ification to the Single Family Residential zone (File #ZE-181-77) be approved, and
WHEREAS, Edwin Joe Engalls did by letter request a special hearing before the
Board of County Commissioners to present evidence and testimony against the recom-
mendation of the Planning Commission to approve the above described preliminary plat
and zone reclassification, and
WHEREAS, the Board of County Commissioners did hold a public hearing on January 5,
1978 to consider the recommendations of the Planning Commission testimony and request
of the applicant, objectors, and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County, having fully considered the
testimony given, the records and niinutes of the Planning Canxnission, the environ-
mental assessment, and all other evidence presented, and having personally acquainted
themselves with Lhe site and vicinity in question does hereby that the eonclusions of

the Planning Commission were generally valid and sufficient. Now, therefore, the
Board of County Commissioners does conciude that the preliminary plat to be known as
Cast]e Court (File #PE-1151-77) and zone reclassification to the Single Family
Residential tone (File #ZE-181-77) should be, and hereby is, approved subject to the
conditions as contained in the Planning Commission minutes dated November 16, 1977
with the additional condition that a security fence be erected along the east, or
Sullivan Road, side of the preliminary plat. The Chairman is hereby authorized to
issue a Finai Oeclaration of Non-Significance.

action was taken and is recommended to the Board of County Cammissloners.

i. The recently completed cont`ract with National Heritage, Inc., Pullman,
VtTashington, which pulled together existing information on the historlcal and
archaeoloqical resources of the County.
2. The Htstorical Preservation Commlttee of the Juntor League where Ctty
and county progress were discussed. An addttional toptc of dtscussfon was an
upcoming proposal to the Cfty and County governments to work toward
establishment of a City-County Landmarks Commission.
3. A currently developing proposal to seek, with a cooperative agreement
with the City of Spokane, A 50-50 matchtnq grant from the State's Offtce of
Archaevlogy and Historlc Freservation to Hfre a Presecvation Planner and
subsequently expand the preservatlon activtttes within the County,
17. 1Vtr. Fred Dayharsh, Z?lrector of Planning., brought to the Planning Commission':
ttention a need to set ahead the fiting date for prelimtnary piats and zone changes. An
amendment to the Zoning Ordlnance and a resolution by the County Commtsstore
wlll be needed tomake thts change tn pollcy. A motion was made to direct the
staff to recommend amendments as to the cut-off date for zone changes and
plats, also all fteld work ls to be done prlor to the flling of the preliminary
zone changes and plats in the Planntng r-epartment Offlce.(Motlon by IVirs.
Rawlings, seconded by IVlra Thomas. Vote was unanimous.)
18. The members af the Planning Commission discussed the review period of the
Flve- MLIe Draft EIS.A motion was made by 1VIrs. Racriltngs and seconded by
Nrs, Byrne that an extenston of tlme of the comment perlod of the Draft EIS
for Flve-1Vltle be extended to December 1, 1977. The Staff was directed to
wrtte a letter to the Ctty to that effect. It was requested that a Ctty Staff
member be present at further discusston. Mrs. Rawlings was concerned about
not getting recommendations up from the Coordinating Committee. It was sugges
ted that on Friday's Planning Commisslon hearfng that Staff and Planning
Commission member could have some observation on that Item. Mr. McCoury
agreed that ft could be done. .
Nir. 1VIain excused himself from discussion and voting on Items No. 6 and 11, due
to a posstble conflict of interest.
Mrsa Byrne excused herself from discussion and voting on Item No. 13, due to the
fact that she has not heard any of the previous discussion on the Item.

at the northwest corner of 12th Avanue and Sullivan Road.

The appllcant proposes to subdivide approximately 3.3 acres into 10
lots, nine (9) of which would be for duplexes, thereby creating a gross
density of about si.x (6) units per acres wlth a typfcal lot size of

C. Relationshlp to the Comprehensive Plan
Castle Court is located within an area that has been designated as suit-
able for residenttal development by the Spokane County Comprehensive
Plan o
D. D. Existing Land Uses
The site Is presentiy vacant with no signiflcant topographic features.
The properties to the east, south, and west have developed recently
into several residenttal subdilvislons including, Rotchford Acres,
S1's Subdivislon, Sulltvan Way, Cherry Blossom and Cralg Subdlvision,
The properties that are generally to the north are prtmarily of the larger
lot rural category.
E. Compatibllity with the Surrounding Land Uses
The proposal appears to be compatlble wlth the recent subdivision acti-
vity in the area and appears to be compatible with the future Intended
land use for the area - higher density residentlal uses.
II . SPECIAL INFORTVi'ATIOIIT:
A. C irculation
Adequate county roads appear to be avallable to serve the proposed

B. Sewage Disnosal
The Spokane County Health Distrtct has approved the site for on-site
sewage disposal. However, the proposed subdtvision lies over the
Spokane Valley Aquifer. The Dtstrict believes that approval of this sub-
division will have a negligible immediate impact upon the water quality,
but conttnued urbanEzation at this density can be expected to have at
least moderate impact upon the water quality.
C, Water
Vera Irrigation District has stated it has the ability to serve the proposed
subdivision with both domestic and fireflows.
D. Schools
Central Valley School District believes that approval of thls subdtvision
should have a negligible impact upon their districtq.s facilities.
E. Parks
No county parks are currently avaLlable tn the area and the County Parks
Department has no present plan for either site acquisition or major
park tmprovements.
F. Fire Protection
Both mains and hydrants need to be installed to provtde for adequatE
fire protection.
III. Ei\TVIRQNMENTAL REVIEW:
The Staff of the Planning Department has reviewed the checklist as submitted
by the applicant and the Staff recommends that a declaratlon of Non-Stgnifi-:

WHEREAS, Edwin Joe Engalls did by letter request a special hearing before the
Board of County Commissioners to present evidence and testimony against the recom-
mendation of the Planning Commission to approve the above described preliminary plat
and zone reclassification, and
WHEREAS, the Board of County Commissioners did hold a public hearing on January 5,
1978 to consider the recommendations of the Planning Commission testimony and request
of the applicant, objectors, and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring 3nd those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County, having fully considered the
testimony given, the records and minutes of the Planning Commission, the environ-
mental assessment, and all other evidence presented, and having personally acquainted
themselves with the site and vicinity in question does hereby that the conclusions of
the Planning Commission were generally valid and sufficient. Now, therefore, the
Board of County Commissioners does conclude that the preliminary plat to be known as
Castle Court (File #PE-1151-77) and zone reclassification to the Single Family
Residential zone (File #ZE-181-77) should be, and hereby is, approved subject to the
conditions as contained in the Planning Commission minutes dated November 16, 1977
with the additional condition that a security fence be erected along the east, or
Sullivan Road, side of the preliminary plat. The Chairman is hereby authorized to
issue a Final Declaration of Non-Significance.

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
Joe Ingalls, South 1616 Adams Road, Veradale, Washington, for the above
captioned preliminary subdivision and zone classification upgrading; and
The Board having received the recommendation of the Spokane County
Planning Commission to approve the preliminary plat, subject to findings
and conditions as contained in the Commission's minutes dated November 16,
1978, and to approve a zone classification upgrade to Single Family
Residential; and
The Board having conducted its own public hearing on January 5, 1978, at the
request of Edwin Joe Ingalls, the sponsor, and after visiting the site
and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the recommendation of the Spokane County Planning
Commission to approve the preliminary plat, subject to findings and
c itions as contained in the Planning Commission minutes of November 16,
1978 AND with the additional condition that a security fence be erected
a g the east (Sullivan Road) side of the plat.
The Board also concurred in th2 Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Non-Significance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RC'JJ,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly

a. This project lies in a relatively flat area between Opportunitq and
Greenacres. Local drainage ways are insignif icant. It is located over
the Spokane Valley Aquif er .
b. Surface soils are classed as Garrison very gravelly loam with 0 to 5%
slopes. They have a septic tank filter field limitation of slight with
possible contamination of groundwater.
c. Geologically the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic structures yield moderate to very large
amounts of water.

d. The data from 6 Vera Irrigation District wells in the area shows
the wells are 140 to 175 feet deep and have static caater levels
varying from 87.5 to 145 f eet below the surface. The total nitro-
gen level was 1.21 ppm. to 3.42 ppm. The Vera Irrigation District
has indicated that it can supply domestic use water for the plat
upon completion of agreements with the developer.-
3. Impact discussion.
a. The plat sponsor has proposed 9 lots on 3.33 acres. Each lot is to
be served by a public water system and its individual on-site sew-
age disposal system. This raises the question of significance of
the impact on the groundwater in the area and possible alternatives
f or sewage disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd con-
sidexed typical soils, natural and sewage disposal recharge to the
groundcaater, and the eff ect of continued urban development in the
Spokane River Valley upon the quality of the groundwater. In summary,
he concluded that:
(1) In normal precipitation yeaxs subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All dissolved salts in sewage effluent will be carxied to the
groundwater. However, bacteria and detergents (phospahte
portion) are mostly removed by the deep soil layex above the
groundwater and "minor dissolved constituents such as phos-
phates, which are known ta react with soil particles, or
nitrates, which axe taken up by plant roots" will be less
than the total found in septic tank effluents.
(3) "The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background."---
"The analytical results of the forecast impact of year 2020
when compared with the present impact, both measured in terms
of leachate volume and dissolved solids cancentration, indi-
cate that the present impact on groundwater quality is already
asubstantial proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content of
the groundwater as in the range of 1.21 to 3.42 ppm. A projected incre-
mental increase using Dr. Todd's expected 8.6 percent would result in
ranges 1.31 ppm. to 3.71 ppm. Current Federal and State drinking water
standazds permit up to 10 ppm.

d. Alternative sewage disposal methods that would not recharge the ground-
caater have the following general characteristics:
(1) Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps
more to obtain a permit for the discharge from the Department
of Ecology. These systems are not currently economically
available f or this proj ec t.
(2) Sealed systems, whether indivfdual or community, depend on
evaporation for liquid removal. Some, such as lagoons have
safety hazards associated with them and relatively poor com-
munity acceptance.
4. Recommend that:
a. A public water system including fire flows serve each lot prior to sale
of the lot.
b. Each lot be authorized the use of an individual on-site sewage system.
c. An on-site sewage management system be created and approved by this
off ice prior to the signing of the final plat if more than a total of
eleven (11) dwelling units are authorized within the plat.

Dear Mr. Brinck:
This confirms a July 21 telephone conversation between Harold Scott,
a member of my staff, and Mr. Hal Barnes regarding housing projects
in the Spokane Valley-Rathdrum Prairie Aquifer area. The following
projects are considered acceptable and should not contaminate the
ground water to a level which would cause a significant hazard to
public health for those people using the Aquifer as a drinking water
source:

Z. Orchard Gardens First Addition, S.P. #356
3. Berg's Addition, S.P. #362
4. Malloy Addition, S.P. #361
5. Kissire's Addition, S.P. #364
6. Clumpner Addition, S.P. #367
7. Bayes Addition, S.P. #366 We are still reviewing the Farwell Estates Subdivision - S.P. #348.
The project is located in an area of higher nitrates. Also, EPA ~
approval for the Pines West Addition - S.P. #333 is being withheld
on pending additional information on the lawsuit.
The Westgate Village, S.P. #359 (190 lots) and Westgate Rim, S.P.
#358 (135 lots) projects are being held until receipt of additional
information from your office on the type of central sewer system.
It appears these two projects collectively (325 lots) could require
a Special Environmental Clearance (Threshold of_200 units or a mort-
gage of more than $5 million) according to the HUD NEPA regulations.
I also note with interest, the application for the Westgate Village,
S.P. #359 shows a line through the first listing of 211 lots which
was replaced by 190 lots and that 225 acres of adjacent land are un-
der control of the project sponsor. Does HUD plan to prepare a Spe-
cial Clearance for these two projects?
