1. Reference: Subject file and final plat of subject.
2. The dedicatory language of the f inal plat contains the statements: "Lots
7 and 8, Block t are non-building sites until such time as the well site is
abandoned and destroyed to the satisfaction of the County Health District."
and "No drainfield will be placed within a 150' radius of the Vera well as
shown on this plat."
3. Mr. Robert Bethards, First American Title Company, now provides the following:
a. Information that since the f inal plat was f iled, Vera Zrrigation District
has decided to retain the well in its water system for the foreseeable
f uture .
b. Drawings showing there is,on both lots 7 and 8, Block 1, sufficient
space outside the 150-foot Zadius from the well to install a sewage
disposal system drainf ield with replacement areas for at least a two-
bedroom dwelling unit. Subject to approval of specif ic building and
plot plans for each lot we could authorize installation of on-site
sewage disposal systems and from our viewpoint permit building on the
lots.
4. Using the above information, could building permits be released or must the
dedicatory language of the plat be am ended? Since a sale closure on this
pronerty is pending, Mr. Bethards and we need a response as early as possible.

meeting, the Board adopted a policy such that any A-95 Review applications including
H.U.D. Subdivision proposals and zone changes not be presented to the Conference
for A-95 Review/Confirmation until clearance is received in writinq by the Conference
from the City or County PZanning Commissions and Iegislative bodies.
Therefore, after we have received written clearance from the County Plan Corrnnission,
the Conference will proceed with the A-95 review of the attached project (Subdivision
Feasibility Analysis for Silvey First Addition, Spokane Va11ey, Spokane County).

DECLAR.ATION OF RESTRICTIONS AND
CREATION OF A HOMEOWNERS ASSOCIATION
FOR
SILVEY FIRST ADDITION
ARTICLE 1
. 1. Purpose of the Association: The Associations
priraary function is the riaintenance anci oversight of the
management and the operation of the on-site sewage disposal
system. The system is defined and composed of: A. The
collecrive on-site building sewers, treatment systems and
disposal systems. B. The association may have a secondary
function(s) for other purpose(s) that the homeoc,mers may
cief ine and decide uPon such as beautif ication of the com-
mon road or other community oriented projects.
ARTICLE 2 1'. On-Site Sewage disposal syten Rules: The
Association shall: A. Contract with a licensed agent who
shall not less than once every three years, or if required,
more often,pumpout, inspect each on-site disposal system
and service the treatment facilities and system in acc-
ordance with accepted standards ana procedures, and, B,Cause
to be inspected and repaired componants of the system when
required by the Spokane County Iieal th Dis tric t. The Spol:ane
County Ilealth District may from time to time inspect the
systen for satisfactory function and cor_ipliance. Users of
the sYstera shall introduce into it no materials such as
paints, oils, solvents, and chemicals other than those and
in quantities normally used in the home.
ARlICLE 3
1. Limited Easement:
A. Ingress and egress to each lot in
Silvey First Addition for servicing the on-site sewage
disposal system.
B. Limited easer.ient: The easement is for
limited purposes only. The respective lot owners shall
erijoy full use and privacy from trespasses in every way
except as required f or the periodic, or emergency in-
spection and repair of the system. This paragraph does
not preclude the erection of fences such as chain link,
wood, or other materials that can be temporarily removed
for service or repair of the systera components.
ARTICLE 4
1. Assessments and Liens : Each homeoiqner whose
dwelling is connected to the sewage disposal system shall
be assessed by the association for his equal share of the
cost and maintenance and repair of their system. Such
costs shall be def ined and determined by the association
according to its rules and regulations so adopted. If
any homeowner shall fail to pay the required assessment
in the amount and time prescribed, the association may
declare the amount delinquent and place a lien against the
respective homeowner's respective property.
ARTICLE 5 ;
l. Dissolution of the Association: The association
may by a majority vote of the homeoi,mers be ciissolved ,
provided that:
A. All building sewer lines of all lots in Silvey
.First Addi.tionare connected to a municipal sewer line servic-
ing Silvey First Addition when and if built by Spol:ane
County or other 'Hunicipal Corp.
B. At such time as the treatment and disposal system
and its components are abandoned, the limited easement pro- viding for said system shall be vacated to or in part, such
parts being retained for continued and future use if required
and each parcel of said easement or Portions thereof shall
"revert cvith clear title and without charge to the respective
owners. Easements or parts thereof shall not revert to the
owners of'the lots until the SPokane County Health nistrict
sha11 have determined and agreed in writing that the easements
or portions t-hereof are no longer required for the operation
of any community of municipal sewage system serving

FINDINGS AND ORDER REGARDING PE-1148-77 SILVEY FIRST ADDITION ZE-178-77
AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL AND/OR TWO FAMILY RESIDENTIAL
WHEREAS, the Spokane County Planning Commission did after public hearing
on November 16, 1977 forward to the Board of County Commissioners a recommendation
concerning the preliminary plat to be known as Silvey First Addition (File #PE-1148-77)
and zone reclassification to the Single Family Residential and Two Family Residential
zone classification (File #ZE-178-77), and
WHEREAS, Carl J. Moore did by letter dated December 6, 1977 request a
special hearing before the Board of County Commissioners to present evidence and
testimony concerning the recommendation of the Planning Commission approving the
above described preliminary plat and zone change reclassification, and
WHEREAS, the Board of County Comrnissioners did hold a public hearing on
January 5, 1978 to consider the action of the Planning Commission and testimony
in request of the applicant, objectors, and other interested parties, and -
WHEREAS, at said hearing opportunity was afforded those favoring and
those opposing the above described preliminary plat proposal and zone reclassi-
fication, the Board of County Commissioners of Spokane County having fully considered
the testimony given, the records and minutes of the Planning Commission, the
environmental assessment, and all other evidence presented, having personally
acquainted themselves with the site and vicinity in question does hereby find that
the recommendations of the Planning Commission were generally valid and sufficient,
however, the number of duplexes within the proposed preliminary plat should be
?imited to not more than six and should be located at the northerly end of the
proposed preliminary plat so as to provide an appropriate buffer from the scattered
commercial uses and the railroad track located to the north of the preliminary plat.
IVow, therefore, the Board of County Commissioners does conclude that the prelimin-
ary plat to be known as Silvey First Addition should be, and hereby is, approved
and the zone reclassification to the Single Family and Two Family Residential zone
classification should be and hereby is approved subject to the conditions in the
Planning Commission minutes dated November 16, 1977, except that the condition

dealing with the zone reclassification is hereby deleted and the following condition
is hereby imposed:
That the plat be designed so as to permit the construction of not more than
six duplexes located in the northerly third of the proposed preliminary plat with the
balance of the proposed preliminary plat to be designated as Single Family uses that,

meettng on November 16, 1977 to consider the testimony and requests of several
applicants, objectors and other interested parttes concerning the below referenced
subdlvislons, zone classiftcation upgradings, extenstons of time and other Items
of business, and
WHEREAS, at said hearing opportuntty was afforded those favoring and those
opposing all items of business, and
VVHEREAS, Mr: McCoury, Mrs. Byrne, Mrs, Rawlings, Mr. 1Viain and NTro
Thomas were in attendance and constltuted a quorum, and
WHEREAS, the Spokane County Planning Commisston fully considered the
testimony given, the environmental review, and all other evidence presented,

report with revistons as presented. The report ts to be used ln conjunction
with other reports in the development of the Comprehensive Plan. The motion
would exclude a dfsclatmer clause. (Motion passed unanimou-sly..)

16. Tom Mosher of the Planning Department's Staff reported on:
I. The recently completed contract wlth Natlonal Heritage, Inc., Pullman,
Washington, which pulled together existing Informatton on the htstorical and
archaeologlcal resources of the County.
2. The Historical Preservatlon' Commlttee of the junior League where City
and county progress were discussed. An addtttonal topic of discussion was an
upcoming proposal to the City and County governments to work toward
establlshment of a City-County Landmarks Commtsslon.
3. A currently developing proposal to seek, wtth a cooperatlve agreement
with the City of Spokane.. A 50-50 matchtng grant from the State's Offtce of
Archaeology and Historic PreservatLon to Hfre a Preservation Planner and
subsequently expand the preservatton actlvfttes wfthin the County.
17. 1Vlr. Fred Dayharsh, L`irector of Planntng., brought to the Planning Commfssion':
ttentton a need to set ahead the fiting date for preliminary piats and zone changes. An
amendment to the Zoning Ordinance and a resolution by the County Commtsslom
will be needed tomake thfs change tn policy. A motion was made to direct the
staff to recommend amendments as to the cut-off date for zone changes and
plats, also all field work Is to be done prlor to the flling of the preliminary
zone changes and plats in the Planning Department Office.(Motton by Mrs.
Rawlings, seconded by Mr. Thomas. Vote was unanlmous.)
18. The members of the Planning Commtssion dlscussed the review period of the
Five-Mile Dragt EIS. A motton was made by Wirs. Rawttngs and seconded by
Mrs, Byrne that an exfienston of time of the comment period of the Draft EIS
for Flve-Mf le be extended to December I, 1977 .The Staff was dlrected to
wrtte a Ietter to the City to that effect. It was requested that a City Staff
member be present at further dlscusston. Ivirs. Rawlings was concerned about
not getting recommendatl.ons up from the Coordinatfng Committee, It was sugges
ted that on Friday's Planning Commission hearing that Staff and Planning
Commtssion member could have some observation on thafi item. Mr. McCoury
agreed that ft could be done. .
Mr. Maln excused hfmself from cilscusston and voting on Items No. 8 and 11, due
to a posslble conflict of interest.

1. GENERAL INFOR~'iATIORI:
A. Location
Silvey Flrst Addltion is Iocated west of Adams Road and North of
Fourth Avenue in the Spokane Va lley.
B. Proposal
The applicant proposes to subdlvide about #Ive (S) acres into 14 lots,
five (S) of which would be tor multtple famlly dwellings, and the
remainfng ntne would be for duplexes. The proposal would create a
gross denslty of about 10 units per acre with a typical lot size of
about lI, 600 square feet.
C. Relationship to the Comprehenstve Plan
Silvey First Addltion Is located withEn an area fihat has been deslgnated as
suttable for residential development by the Spokane County Comprehenslve
Plan o
D. Exlsting Land Uses
The stte 1,9 presently vacant with no sfgnificant topographfc features.
To the east is St. Niary's Catholic Church, whtle to the south and
west are several resldential subdivisfon. To the north Is located
several scattered commercial uses and a ratlroad track.
E. Compattbfl.ity with Extsting Land Uses
The staff questlons the compatibiltty of multlple family dwellings
In an area that has been established as suitable for single famfly and
duplex dwellings. Secondly, the sttes are located adjacent to railroad
tracks and are on a cul-de-sac, and they don't appear to be of suffic-
lent stze to accommodate both multfple famfly dwellings and off-street
parking factlfties. The Staff does find, however, that duplexes are
approprlate for the area a s they would provide an appropriate buffer fron
both the railroad tra-cks as well as the commercial uses to the north.

II. SPECLAL INFORMATION:
A. C trculation
Adequate county roads appear to be avallabie to serve the proposed
subdivlsion.
B o Sewage Dtsposal
The Spokane CountyHealth DistrEct has approved the s.Ue for on-site
sewage disposal. However, the proposed subdivision lies over the
Spokane Valley Aquifer. The Dlstrict believes that approval of this
subdivision will have a negligtble immediate impact upon the water
qualtty, but continued urbanizatlon at this density can be expected
to have at least moderate impact upon the water quality. A well Is
also situated in the northwest corner of the plat. Vera Irrtgation
tntends to establ lsh the weil as part of their system. Because of thfs
lots 3 and 4, Block 1, are both unbuildable due to the required 150 foot
setback between a drainfteld and a public well. Alternattves would
Include either a public sewer system or abandonment and destruction
of the wel.l to the satisfactton of the Health Distrlct.
C. Water
Vera Irrlgation has stated f.t has the ablllty to serve the proposed
subdivision with both domestic and fireflows.
D. . , Fire Profiection
Both mains and hydrants need to be installed to provide for adequate
flre protectlon.
E , School s
Central Valley School District believes that approval of this subdivision
would have a negligtble lmpact upon their distrtct's faciltties.
F. Park s
No county parks are currently available ln the area and the County
Parks ]Jepartment has no present plan for either sfte acqulsition or
maj or park improvements.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCVV,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals, The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affectfng the quality of the environment. ThP
purpose of this checklist fs to help the agencies involved deterrnine whether or not a
proposal is such a major action.
Please answer the following questions as complPtely as you can with the information
presently available to you. Please ariswer questions as "yes" or "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the deqree of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers are required, or where you
believe an explanation would be helpful to government decision--makers, include your
explanation in the space provided, or use additional paqes, if necessary. You should
include references to any reports or studies of which you are aware and which are
relevant to the answers you provide. Complete answers to these questions now will
help all agencies involved wfth your proposal to undertake the required environmental
review without unnecessary delay.

2. Topography, soils and water.
a. This project lies in a relatively f lat area between Opportunity and
Veradale. Local drainage ways are insignif icant. It is located
over the Spokane Valley Aquif er.
b. Surface soils are classed as Garrison gravelly loam with 0 to 5% slopes
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.
c. Geologically the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace remnants have probably been reworked
by streams. These geologic structures yield moderate to very large
amounts of water.

d. The data from 8 Vera Water and Power Company wells fn the area
shows the wells are 140 to 175 feet deep and have static water
levels varying from 110 to 158 feet below the surface. The
highest total nitrogen level was 3.42 ppm with the average being
1.73 ppm. The Vera Water and Power Company has indicated that
it can supply domestic use water for the plat upon completion
of agreements with the developer.
3. Impact discussion.
,
a. The plat sponsor has proposed 14 lots on 5 acres. Each lot is to
be served by a public water system and its individual on-site sewage
disposal system. This raises the question of signif icance of the
impact on the groundwater in the area and possible alternatives for
° sewage disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd con-
sidered typical soils, natural and sewage disposal recharge to the
groundwater, and the effect of continued urban development in the
Spokane River Valley upon the quality of the groundwater.
In summary, he concluded that:
(1) In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All the dissolved salts in sewage effluent will be carried
to the groundwater, However, bacteria and detergents (phos-
, phate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents
such as phosphates, which are known to react with soil parti-
cles, or nitrates, which are taken up by plant roots will
be less than the total found in septic tank effluents.
(3) "The calculated results at the downstream end of groundwater.
flow line indicate that the maximum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background."---
"The analytical results of the forecast impact of year 2020
when compared with the present impact, both measured in terms
of leachate volume and dissolved solids concentration, indi-
cate that the present impact on groundwater quality is already
a substantial proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content
of the gxoundwater as in the range of 1.22 to 3.42 ppar►. A projected
incremental irncrease using Dr. Todd's expected 8.6 percent would result
in ranges from 1.32 to 3.71 ppm. Current Federal and State drinking
water standards permit up to 10 ppm.

d. Alternative sewage disposal methods that would not recharge the
groundwater have the following characteristics:
(1) Collector and central treatment systems discharging to
surface waters would require at least tertiary treatment
and perhaps more to obtain a permit for the discharge
from the Department of Ecology. These systems are not
currently economically available f or this pro3ect.
(2) Sealed systems, whether individual or community, depend
on evaporation for liquid removal. Some such as lagoons,
have safety hazards associated with them and relatively
poor community acceptance.
4. Recommend that:
0
a. A public water system including f irP flows serve each lot prior to
sale of the lot.
b. Each lot be authorized the use of an individual on-site sewage system.
C. An on-site sewage management system be created and approved by this
/ office prior to the signing of the final plat if more than a total
of eighteen (18) dwelling units are authorized within the plat.
.
d. Lots 3 and 4, Block 1 are unbuildable due to the required 150 foot
setback between a drainfield and a public well. Alternatives would
include either a public sewer system or abandonment and destruction
of the well to the satisfaction of the Health District.
