reBiclential develvpment in the area. The +vppvnants
cvntended that various problems wouid resul# from auch
develogment, notably traf fic an+d parkf ng problems,
prcablems of fnsufficient recxaatian space raithin the
developm$nt M and problemQ resulting fram the placement
of buildings too claso tQ residontial buildings on
adjac~nt grioperty.

After your meeting yesterday with my representative, Art Noll, I understand that
you need several issues addressed concernfng the site plan for the 12 unit apart-
ment at S. 414 University.
1. Replacement area for the Northern drainfield will be provided under the pre-
sent paved area (West side), and if replacement is needed the replacement field
will be grassed over and the existing field paved to provide parking. I under-
stand that tbis will allow the Northern drainfield to be installed on 8 foot

County Air Pollution Control Authority in regards to the 12 unlt
apartment building at S. 414 University, I would like to state
that the following will be done
1. Appropriate measure will be taken, during construction (exca-
vation, etc.), to control dust emissions. This will probably
entail the use of water sprays.
2. Should dirt be deposited on paved surfaces ftom unpaved sur-
faces, that dirt will be cleaned off of the paved surfaces.
3. The west access and parking area will be coated with a light
bituminous surface treatment. The Southern unpaved portion
of the East parking area is to be used for drainfield and will
be grassed.
I hope that thip letter adequately addresses Ms. Caine's concerns.

I would like to thank you and Mr. Cuthrie for reviewing your present building
and expansion plans for Mr. Guthrieta 4th Avenue and University Road property. As
you know from our discussion with you, the development of the remaining property
originally zoned under ZE-22-62 will be reviewed by our Department for building per-
mit purposes.
The County's Road Construction Program has contained for a number of years a
project to widen IIniversity Road from 4th Avenue south, eventually to Che Dishman-
Mica Road. To date, no construction funding has been approved for the project and at
least for one state funding program, administered by the IIrban Arterial Board (UAB),
it will not be again considered until the 185-187 biennium. Never-the-less, we know
traffic demands on south Universitq Road will continue to grow and we will continue
to seek fwnding necessary to construct the needed improvement.
Therefore, in planning for a widened roadway on University R+oad, we would recom-
mend that qour design locate the building and its associated drainfield with as much
phqsical setback from the existing road and right-of way se poseible. That type of
design would be much more compatible with a future widened University roadway.
Again, I would like to thank you for discussing your plans with us and for your
cooperation in considering our future widening plans on University Road in your final
plan design. If you have any questions, please advise.

identified severa] issues that are of an environmental concern.
At the time of your earlier contact with the Environmental
Health Division of the Spokane County Health District, you
submitted photographs which revealed that an existing "burning
barrel" was being utilized.
These photos were given to the Spokane County Air Pollution
Control Authority for investigation and followup according to
their regulations and operating procedures.
On separate occasions this year, the EnvTronmental Health
Division staff have observed the University Manor Nursing Home
property to find no evidence of an on-going problem whereby
sewage waste materials are being allowed to discharge onto the
,ground surface. We'11 continue to monitor this situation as
deemed necessary.

Universlty and Fourth Avenue. Your letter reiterates many of the conversations
we have had in the past, and I have the following comments to offer.
As you understand, most of your concerns are of a civ11 nature which cannot be
handled by the County. I will forward coptes of your letter to the agencies
that I feel might be affected. The following are detailed comments from the
Planning Department.
' The issue of your use of land that is owned by Mr Guthrie cannot be
addressed by the Planning Department as we are not the arbitrator in thls
issue. "
• The issue of the retaining wall and the pie-shaped berm as a method of
supporting your house foundation is again not an issue of the Planning
Department This issue is being forwarded to the Building and Safety
Department to determine if they might be involved.
• The erosion and weed filled embankment which you have cared for in the past
is a private matter between you and the adjacent owner
• The issue of burning of hospital wastes in the incinerator is being forwarded
to the Spokane County Air Pollution Control Authority
• The issue of adequate sewage disposal systems and soggy ground Zs being for-
warded to the Health District for their review.
• The details of the site development plan for the 12-unit apartment complex,
as you recall, does comply with the minimum requirements of the Spokane
County Zoning Ordinance and has appropriately been issued a building permit.
Parking in your opinion may be inadequate; however, it does comply with the
minimum requirements of the Zontng Ordinance.

Dear Steve:
After our conversation the other day, I would like to respond to sorne of the
comments that you made concerning our proposed apartments adjacent to the nurs-
ing home at 1-iiliversity and Fourth Avenue.
It is my understanding that one neighbor has repeatedly contacted the Planning I
Department and other Spokane County agencies about this proposal. You have re-
iterated some of his "fears" to me. I would like to point out that this parti-
cular neighbor has Eor several years utilized a portion of our property for his
garden anct also, as you can see from the site plan, placed a fence on our prop-
erty. We have contacted him with regards to this encroachment several times. I
feel that perhaps all of the "fuss" he is making is in reality a fear on his part
that we will make him remove his fence and tear out his garden. I have discuss-
ed this many times with Mr. Guthrie, and it is his feeling that if we c':o not
need the property for any specific purpose, that we let the fence and the gardeti
remain. Of course we wish to retain the ownership, and have that area consider-
ed a portion of the site for density purposes, etc.. In our conversations with
the water purveyor, Modern Electric, we even took this encroachment into consid-
eration. That is why we are routing our water main on the front side of Univer-
sity Manor Convalescent Center. This will. increase otir cosrs, hUt vou might put

I understand that there }ias been some yuestions as to the Iieight of tl-ic proposed
apartment structure. I think that the plans will answer that question. As you
can see, we are proposing a one story structure, that is in architectural har-
mony with the existing nursing home. Also from the plans and site plan, the new
building floor elevation and existing building are the same. I refer you to phota
#3. This picture was taken Iast year from the Southeast corner of the property.
Picture #2 is taken from across University and looking to the Southwest corner.
In photo #2 the area of encroachment can be seen on the left side of the picture
(A). You can see the relative elevations of the neighbors home and University
Manor. Photo #3 will give you a view of University Manor and an idea of how the
proposed apartment will be viewed from the home to the South. As I said before,
the proposed 12 unit structure will be in architectural harmony with the existing
structure. It will appear as an extention of University Manor.

You have mentioned to me your concerns about a landscape plan £or trie proposed
apartment. I refer you to the overlay that I prepared for your files. You will
note Junipers, Evergreens, and Maples located around the building. I show a coup-
le of typical planting schemes. I would also Iike to refer you to photo #'s 3,4,
5,6,7, and 8. These show the present landscaping around University Manor. We plan
on carrying on with this basic scheme for the proposed 12 unit apartment. The ex-
isting lower areas will be executed to the South prope_rty line and sprinkler sys-
tems installed.
I think a little history might be illuminatiilg. University Mdnar Convalescent Cerit-
er has been in operation for 16 years. It is licensed by the Department of Social
and Health Services for 115 "skilled care" beds. (copy enclosed) We have been re-
peatedly approached by patients, patients relatives, and others aware that we are
involved in the health care industry, to provide a level of care that allows for
privacy, companionship and security for elderly persons. One of the greatest con-
cerns of the elderly, is the rapid availability of health care in case of a medi-
cal emergency. Another problem area is the loneliness that the elderly are sub-
ject to when they live im their own home. They value their "private moments" and
the freedom to choose when they want to be with others. The apartments we are pro-
posing will meet these needs and help address these concerns.
I personally can think of no other site that is as well situated for this purpose.
First, it is directly adjacent to an existing health care facility. Second, it is
within walking distance of a major shopping center (University City) that can meet
all of the shopping needs of the tenants. Third, it has readily available public
transportation. Fourth, it maximizes the use of existing facilities to inexpensiv-
ely provide a level of care to elderly citizens. The cost of constructing a total-
ly new operation, providing the sarne level of care as the symbiotic relationship
between the existing nursing home and proposed apartments that we are advocating,
would necessitate much higher rental rates. You can appreciate the effect these
higher rates would have on persons with either fixed or limited incomes.
The original zone change, ZE-22-62 was approved by the Planning Commission because
they realized a need for multi-family dwellings close to the central "core" shop-
ping area of the Spokane Valley. That need still exists. We are responding to the
specific needs of the elderly who wish to be close to this "core" shopping area and
wish security, etc., as I outlined before. You have expressed some concern about
the compatibility of the existing and proposed land uses with the originally approv-
ed site plan for ZE-22-62. You indicated that the original zone change would allow
for about 62 apartment units. (Site area, 124,565 sq. ft.; divided by 2000 sq. ft./
dwelling unit, per Section 4.07.060 of the Spokane County Zoning Ordinance.) By de-
finition, Spokane County Zoning Ordinance, a dwelling unit means, one or mo~- I
rooms, in a dwelling....... designed for living or sleeping purposes and having onl:
one (1) kitchen." (Section 4.03.020 paragraph #21.) The Zoning Ordinance does not
limit the number of bedrooms for an aparCment "dwelling unit". (Section 4.03.020
paragraph #6.) Thus an apartment could have ore bedroom, two bedrooms, three bed-
rooms, four bedrooms, etc. Therefore, sixty-two (62) apartments could mean sixty-
two bedrooms, or 124 bedrooms or 186 bedrooms, or 248 bedrooms. (1/dwelling, 2/
dwelling, 3/dwelling, 4/dwelling) I engage in the above exercise, to address anotheT-
concern of the neighbor who has been encroaching on our property. He apparently feel~
that a nursing home with 115 beds and a twelve unit apartment with ten one bedrooms

with several two or three story apartment buildings, per the original site plan
for ZE-22-62, with a 50/50 mixture of two and three bedroom family units which
would mean 155 bedrooms (persons). In fact Steve, the proposal for a 12 unit
apartment fits more closely to the original zoning approval for ZE-22-62 which
envisioned six apartment buildings of one or more stories.
You also mentioned a concern about adequate parking for the nursing home apart-
ments. At present the 26,000 sq. ft. nursing home is required to have 1 space/
1000 sq. ft.. It has 38 spaces, thus an excess of 12 spaces. The apartment re-
quires 12 spaces/dwelling, or 18 spaces. This leaves a net of six spaces addi-
tional required for the apartments. I have indicated ten added spaces along the
West property line, directly North of the area of encroachment on the overlay.
Our neighbor to the Southwest apparently has concerns about increased traffic on
Fourth and University. I find it interesting in that his home is 300(+) feet from
University and his access is on Fifth Avenue. But, to address that anyway, Univer-
sity is an arterial, and collects traffic from Dishman-Mica and the Ponderosa area
North. Just North of Fourth Avenue, Spokane Transit has established a park and ride
facility. I assume that if increased vehicular traffic was really a concern, that
this neighbor would have violently abjected to this. Did he? Also, the clientele I
that we are projecting for the apartments will most likely utilize to a maximum the
readily available public transportation facilities rather than their own vehicles.
I very seriously doubt that 10-14 vehicles more or less on University will greatly
affect the traffic flow. The present vehicle counts for Fourth and University are
1300 to the West and 1200 to the East. There are no traffic counts for University
at Fourth, but at 8th they are 7300 for the North and 7400 for the South. At Spra-
gue the counts are 6700 for the North and 9800 for the South. Taking the figures
for 8th; I don't see that the extra traffic generated by 12 units will hardly af-
fect a total count of 14,700 vehicles per day or on Fourth of 2500 vehicles per da_y.

You indicated to me that the site plan did not give you dimensions for building set
backs. I have added these to the overlay. You will note the set back on the rear
yard is 65 ft. to our property line and 43 ft. to the area of encroachment, only 25
ft. is required. We are 30 ft. from the existing building, 25 ft. from the South
property line and 90 ft. from the centerline of University. All of these are in
excess of, or in compliance with Section 4.07.130 of the Zoning Ordinance.
I don't feel that there has ever been any question as to the suitability of apart-
ments in the existing zone or of a nursing home. Both uses are permitted under
Sections 4.07.060 and 4.07.080 of the Zoning Ordinance. Nor do I feel that you ob-
ject to the location of the proposed apartments within an urban area. They actually
act as a"buffer" or transition from the commercial uses to the North and the resi-
dential uses to the South. The proposed apartments will meet a grave need that ex-
ists in the Valley area. The Department of Social and Health Services has not seen
fit to issue a certificate of need for "congregate care" beds in the Valley, but
need does exist. We, in the private sector, have been repeatedly approached abo,
this. Perhaps, other "congregate care" proposals have envisioned rnuch larger op -
ations and greater costs. We are proposing the utilization of existing facilitie ,
putting a much lower demand on resources and a much ~

I can only assume that the unreasonable and unreasoned objections of clur neigl-1-
bor to the Southwest have prompted a delay in the issuance of a building permit
for this 12 unit apartment. As I have pointed out, he has a vested interest,
because of his encroachment upon our property. We have tried to be good neigh-
bors, even going so far as to take the area of encroachment into consideration
with our design plans.
He has complained about inadequate parking, we have addressed that. He has com-
plained about increased traffic, we addressed that. He has complained about a
multi-storied structure, we have addressed that; and pointed out that the ori-
ginal plot plan for ZE-22-62 would have allowed multi-storied structures. He
has cornplained about density, we have addressed that, and pointed out that the
original site plan would have allowed for a much more intense land use than what
exists and is proposed.
The questions that you had concerning landscaping and building setbacks have
been answered.
A question of capatibility of the proposal to the original zone change, ZE-22-62,
is mote. The Planning Commission agreed that there was a need for multi-family
housing in the area. The need still exists and we are proposing to answer a
specific facet of that need with 12 apartments for the elderly. The closest fa-
cility 4f this type is located East of Pines Road on Mission, very removed from
the "core" retail area of the Valley.
The proposal makes sense and is not detrimental to the public health, safety and
welfare. Any further delay in releasing the building permit will result in an
economic liardship. Your prompt action i.s requested on this matter.
