The Planning Commission conducted a study session on STV-01-04 on April 8, 2004. BACKGROUND: RCW 35.79 (Street Vacations) specifies statutory procedures for the processing of street vacation requests by local jurisdictions. On January 20, 2004, the Spokane Valley City Council passed Ordinance 04-002 containing the City's street vacation policies and procedures. This ordinance specifies that the Planning Commission shall hold the required public hearing and shall forward a recommendation to the City Council on the street vacation request for its consideration. The Ordinance took effect on January 30, 2004. STV-01-04 is a request by Kurt and Mandee Vigessa, 1420 South Bettman Road (Parcel No, 352431041) and Gene and Lana Balch, 1506 South Bettman Road (Parcel No, 35243.014) to vacate a portion of the 15th Avenue public right-of-way abutting said parcels — the Vigessa parcel abuts the 15th Avenue public right-of-way on the north and the Balch parcel abuts it on the south. The portion of 15u' Avenue requested for vacation measures 60 feet wide by 192.5 lung fora total area of 11,550 square feet. This street vacation request was originally submitted to Spokane County in December 2002, prior to the City's incorporation, and was transferred by Spokane County to the City of Spokane Valley at time of incorporation on March 31, 2003. The request was placed on hold pending the City's development of street vacation policies and procedures. Staff from the Community Development Department Current Planning Division and Public Works Department Development Engineering Division will be in attendance to present the staff report and recommendation and address any questions or issues the Commission has regarding the proposal. RECOMMENDATION: Make a motion to recommend to the Spokane Valley City Council conditional approval of STV-01-04 pursuant to the recommended conditions of approval in the May 6, 2004 Staff Report and Recommendation to the Planning Commission. FINDINGS OF FACT AND CONCLUSIONS A. COMPLIANCE WITH THE STATE ENVIRONMENTAL POLICY ACT(SEPA): Finding(s): Applicable SEPA Regulation (s) Citation 1 SEPA Categorically Review Exempt from Required SEPA Review Interim Spokane Valley Environmental Ordinance X (Ordinance No. 48, effective March 31, 2003) Section 11.10.180 of the Spokane Valley Interim Environmental Ordinance adopts by reference Washington Administrative Code (WAC) 197-11-800 which identifies actions that are categorically exempt from a SEPA threshold determination by the City of Spokane Valley. WAC 197-11-800.2.h identifies that the vacation of streets or roads is a categorically exempt action. Conclusion(s): Staff conclude that the proposal is exempt from review under the City's adopted SEPA regulations pursuant to WAC-197-11-800.2.h. B. COMPLIANCE WITH ORDINANCE NO. 04-001 (STREET VACATIONS) Findings: 1. SECTION 2—INITIATION OF VACATION: Section 2 specifies of the Ordinance specifies that a street vacation application may be initiated by the owner of an interest in any real property abutting upon any street or alley through petition to the City Council. The applicants for STV-01-04 are Kurt and Mandee Vigessa, Parcel No, 352431041 further identified as 1420 South Bettrnan Road, Spokane Valley, Washington 99212 and Gene and Lana Balch, Parcel No, 35243.1014 further identified as 1506 South Bettrnan Road, Spokane Valley, Washington 99212. The Spokane County Assessor's Office Property Account Summary for the above referenced parcels issued on April 13, 2004 to the City of Spokane Valley Current Planning Division identify Kurt and Mandee Vigessa as the current owner of Parcel No. 35243.1041 and Gene and Lana Balch as the current owner of Parcel. No. 35243.1014. 2. SECTION 3 PETITION FOR VACATION: Section 3 specifies that a petition for street vacation shall be made on a form prescribed by the Community Development Director or designee and shall be signed by the owners of more than two-thirds of the property abutting the portion of the street or alley sought to be vacated, The applicants originally applied to Spokane County for the subject street vacation request on December 29, 2002 on County application forms. The application was tranferred to the City of Spokane Valley upon its incorporation on March 31, 2003, The City of Spokane Valley placed the application on hold pending adoption of City specific street vacation policies and regulations. The City of Spokane Valley City Council passed Ordinance No. 04-001 on January 20, 2004. This Ordinance became effective on January 30, 2004. The Current Planning Division began the processing of the applicants' street vacation request following the effective date of this ordinance. The Current Planning Division finds that the portion of 15th Avenue proposed for street vacation immediately abuts Parcel No, 35243.1041 on the north and Parcel No. $tafff Report and.Recommendation to he Planning Commission for STV-01.04 May G.2004 2 of 10 35243.1014 on the south. The Spokane County Assessor's Office Property Account Summary for the above referenced parcels issued on April 13, 2004 to the City of Spokane Valley Current Planning Division identify Kurt and Mandee Vigessa as the current owner of Parcel No, 35243.1041 and Gene and Lana Balch as the current owner of Parcel No. 35243,1014. The original Spokane County application was therefore signed by one-hundred (100) percent of the property owners abutting the subject portion of 15th Avenue. 3. SECTION 4—PETiTIOIN FEES: Section 4 specifies that petitions for street vacations shall be accompanied by a fee in an amount established by resolution of the City to defray a portion of the adminstrative costs incurred in processing the petition and publishing, posting and mailing notices. The applicants originally applied to Spokane County for the subject street vacation request on December 29, 2002 on County application forms and paid the Spokane County application fee of $100.00, The application was tranferred to the City of Spokane Valley upon its incorporation on March 31, 2003. The City of Spokane Valley placed the application on hold pending adoption of City specific street vacation policies and regulations. The City of Spokane Valley City Council passed Ordinance No. 04-001 on January 20, 2004. This Ordinance became effective on January 30, 2004, The Current Planning Division began the processing of the applicants' street vacation request following the effective date of this ordinance The City of Spokane Valley City Council passed Resolution No, 04-001 on January 20, 2004 that became effective on January 21, 2004. This Resolution comprised the City of Spokane Valley's 2004 Master Fee Schedule and established a street vacation application fee of $1,300.00. Upon consultation with the City Attorney's Office, the Current Planning Division determined that the Division could not legally charge the current application fee established by Resolution No. 04-001 because of the City's prior acceptance of the transfer of the street vacation application from Spokane County that occurred prior to the passage of the Resolution. 4. SECTION 5—SUBMITTAL REQUIREMENTS FOR PETITIONS: Section 5 specifes that street vacation applications shall consist of: 1) an Assessor's Map from the Spokane County Assessor's Office showing with a solid red line the portion of the street or alley sought to be vacated; 2). a vicinity map showing the general area of the proposed vacation; 3) a copy of the record of survey, if available, for the subject street and alley proposed for vacation and abutting properties and streets and alleys within 100 feet or all sides of the proposed vacation; 4) written evidence of any and all easements or allowances or reservations, public or private, pertaining to the street or alley proposed for vacation; and 5) a written narrative describing the reasons for the proposed street vacation, the physical limits of the proposed street vacation and the public benefit of the proposed street vacation. As previously noted, the applicants originally applied to Spokane County for the subject street vacation request on December 29, 2002 on County application forms and paid the Spokane County application fee of $1010.00. The application was tranferred to the City of Spokane Valley upon its incorporation on March 31, 2003. The City of Spokane Valley placed the application on hold pending adoption of City specific street vacation policies and regulations. The City of Spokane Valley City Council passed Ordinance No. 04-001 on January 20, 2004. This Ordinance became effective on January 30, 2004. Upon consultation with the City Attorney's Office, the Current Planning Division determined that the Division could not require compliance with the submittal requirements of Section based on the City's prior acceptance of the transfer of the street vacation application from Spokane County. Therefore, the Current Planning Division has processed the application based on the orignal information submitted to Spokane County on December 29, 2002. 5. SECTION$—SETTING OF HEARING: Section 6 specifies that upon determination of a complete application the City Council shall set by resolution the time when the petition will be heard by the City Council or a committee of the City Council. Section 10 of Ordinance No, 04-001 specifies that the City's Planning Commission shall conduct the required public hearing on the street vacation petition and shall forward a recommendation on the petition to the City Council_ On April 6, 2004, the Spokane Valley City Council passed Resolution No. 04-006 that establised the public hearing date for the Planning Commission's consideration of STV-01-04 for May 13, 2004. The Planning Commission's public hearing on the street vacation is scheduled to occur thirty- seven (37) calendar days after the City Council's passage of Resolution No. 04-006. 6. SECTION 7—STAFF REPORT: Section 6 requires that a staff report be prepared by the City's Community Development Department and Public Works Department. This Section specifies that the staff report shall address future transportation system needs and requirements relative to the requested street vacation and shall also address the criteria contained in Section ii of Ordinance No. 04-001. The Section also specifies that the Community Development Department shall solicit comments from the City's Police and Fire Departments and other governmental agencies and utility companies. The staff report and recommendation to the Planning Commission contains analysis by the Community Development Department and Public Works Department regarding the proposed street vacation request's compliance with applicable sections of Ordinance No, 04-001. The Current Planning Division distributed on April 7, 2004 the street vacation application to the: Spokane Valley Building Division; Spokane Valley Police Department; Spokane Valley Public Works Department - Development Engineering Division; Spokane Valley Public Works - Capital Projects, Spokane Valley Public Works - Operations and Maintenance; Spokane County Division of Utilities; Spokane Regional Health District; Spokane County Air Pollution Control Authority; Spokane County Water District No, 3; Spokane County Fire District #1; Spokane School District #$1; Spokane Transit Authority; Avista; Qwest; and Comcast, Ty Wick, General Manager, Spokane County Water District No. 3, submitted an electronic mail message on April 12, 2004 that indicated that the Water District would not be impacted by the proposed street vacation as there is no current water main within the proposed street vacation, Donald Copley, ESH II, Spokane Regional Health District, submitted a written comment letter on April 13, 2004 indicating that the Health District had no comment on the requested street vacations. Dawn Dampier, Permit Specialist, Spokane Valley Builidng Division submitted an electronic mail message on April 13, 2004 that identified that the Division had no comment on the street vacation proposal. Sandra Raskell, P.E., Assistant Development Engineer, Spokane Valley Development Engineering Division, submitted an electronic mail message on April 14, 2004 that indicated that South Bettman Road abutting the proposed street vacation on the immediate east was comprised of sixty (60) feet of public right-of-way, and that a six (6) foot border easement within the proposed vacated street abutting South Bettman Road. Priscilla Sprague, Real Estate Assistant, Avista Utilities, submitted a written comment letter dated April 14, 2004 that indicated that Avista had no facilities within the proposed street vacation. Kevin Miller, Deputy Fire Marshal, Spokane County Fire District No, 1 submitted a written comment letter on April 1e, 2004 that stated the District had no objections to the proposed street vacation. 7. SECTrrON 8—NOTICE OF HEARING: Section 3 specifies that upon the passage of the resolution fixing the time for hearing the petition or proposal for vacation, the City Clerk or the Community Development Director shall give not less than twenty (20) calendar days notice of the time, place and purpose of the hearing by: 1) posting of a written notice in three (3) conspicuous places in the City; 2) publishing written notice once in the City's official newspaper, 3) posting a minimum twenty-four (24) inch by thirty-six (36) inch notice sign in a conspicuous place at each end of the street or alley sought to be vacated describing the proposed vacation and the date, time and location of the public heairng; and 4) mailing written notice to all petitioners at the addresses on the petition and all owners of property abutting the street or alley proposed to be vacated, as shown on the records of the Spokane County Assessor, not to exceed ninety (00) calendar days from the date of the public hearing. This Section further specifies that the Director shall send the same written notice to the representative of the petitioners at the address on the petition. Staff Report and Recommendation to the(Planning Commission for STV-01-04 May 6, 2004 Col 10 Michael Turbak, Planning Intern, Community Development Department, posted a Notice of Public Hearing sign at the eastern portion of Fifteenth Avenue facing South Bettman Road as evidenced in the April 20, 2004 notarized Affidavit of Posting. On April 19, 2004, Kevin Snyder, AICD, Current Planning Manager posted written notice of the public hearing for STV-01-04 on the Public Notice Board in the City of Spokane Valley Permit Center, on the Community Information Board in the City of Spokane Valley City Hall Front Reception Area and on the Community Information Board of the Valley Library as evidenced by the notarized April 19, 2004 Affidavit of Posting. The City Clerk published an initial Notice of Public Hearing was published in the April 16, 2004 edition of the Spokane Valley-News Herald. Subsequent to its publication, the Current Planning Division discussed erroneous references in this Notice. The City Clerk published an amended Notice of Public Hearing in the April 23, 2004 edition of the Spokane Valley-News Herald. The initial and amended Notices were both published a minimum of twenty (20) calendar days in advance of the scheduled May 13, 2004 Planning Commission public hearing. As evidenced by the April 19, 2004 notarize Affidavit of Mailing, Gay James, City Receptionist, deposited on April 19, 2004 at the Opportunity Branch of the United States Post Office, written notices to the applicants for the street vacation and all owners of property abutting the street or alley proposed to be vacated. The Current Planning Division procured current property ownership information for this noticing from the records of the Spokane County Assessor as of April 13, 2004. This proprety ownership information will be thirty (30) days old as of the scheduled May 13, 2004 Planning Commission hearing, which is sixty (6b) days less than the ailowed validity period of ninety (90) calendar days between the issuance of this information and the date of the public hearing. In addition, regular notice of public hearing pursuant to the adopted procedures for the Planning Commission was published in the April 30, 2004 edition of the Spokane Valley-News Herald. 8. SECTION 9—PROTEST: Section 9 specifies that if fifty (50) percent or more of the abutting property owners file written objections to a City Council-initiated vacation with the City Clerk prior to the time of hearing, the City shal be prohibited from proceeding with the vacation. STV-01-04 is a non-City initiated street vacation application. The applicants for STV-01-04 are Kurt and Mandee Vigessa, Parcel No. 35243.1 041 further identified as 1420 South Bettman Road, Spokane Valley, Washington 99212 and Gene and Lana Balch, Parcel No. 35243.1014 further identified as 1506 South Bettman Road, Spokane Valley, Washington 99212. 9. SECTION 10—PLANNING COMMISSION REVIEW AND RECOMMENDATION: This Section specifies that the Planning Commission shall conduct the required public hearing on the street vacation request and shall render a recommendation to the City Council based on the criteria specified in Section 11.A-E of Ordinance Na. 04-0011. The following is staff's analysis of the proposal's compliance to Section 11.A-E: A. Whether a change of use or vacation of the street or alley will better serve the public. The applicants are requesting a vacation of a portion of the current public right-of-way for Fifteenth Avenue extending one-hundred ninety feet west and measuring sixty (60) feet wide of Fifteenth Avenue's current intersection with South Bettman Road, This portion of Fifteenth Avenue is located in the Bettman's Addition Plat that was orginally platted in 1990. This portion of Fifteenth Avenue was not improved prior to or subsequent to its original platting and currently is unimproved being comprised of dirt and loose gravel. The City of Spokane Valley Arterial Road Plan {August 20, 2CJ03) designates Fifteenth Avenue as a Local Access Road. Chapter 5 (Transportation) of the Spokane Valley Interim Comprehensive Plan describes a Local Access Road as roads that provide access to adjacent property For the record, the Current Planning Division notes that planning and engineering staff conducted a presentation on STV-01-04 to the Planning Commission during a scheduled work session on April 8, 2004 to introduce the proposed street vacation. Staff Report and i ecommertIlation to the Planning Commission for STV-01-04 May C.2004 5af10 and generally do not support through traffic, that are looted in urban areas and rural areas, and whose alignment and traffic control measures encourage a low, safe speed. The Spokane Valley Interim Standards for Road and Sewer Construction (2001) specify the design criteria for a Local Access Road. In summary, a Local Access Road shall be comprised of thirty-four (34) feet of public road right-of-way with a ten (10) foot to thirteen (13) foot wide border easement on either side, thirty(30) feet of asphalt, a two (2) wide curb and gutter, a seven (7) foot to ten (10) foot wide planter strip and a five (5) foot wide concrete sidewalk. The Public Works Department conducted an initial analysis of the street vacation request in October 2003 under the direction of the Public Works Director. The Public Works Department found at that time of initial analysis that the public interest would be served by approving the street vacation request. The Public Works based this determination on the current unimproved nature of the portion of Fifteenth Avenue being proposed for vacation and the lack of any current or future plans by the City to improve this portion of Fifteenth Avenue inclusive of not being an identified project on the City's existing Six-Year Street Capital Improvement Program. Further, the Public Works Department found the street vacation to be in the public interest based on previous decision-making by Spokane County on street vacation requests east and west of the current proposal prior to the City of Spokane Valley's incorporation on March 31, 2003. B. Whether the street or a11ey is no longer required for public use or public access. The portion of Fifteen Avenue proposed for street vacation is currently unimproved and does not provide authorized public street access to the properties abutting this portion as well as to the properties immediate west of this portion. Further there is an existing fence on the western edge of the current right-of-way of Fifteenth Avenue that further restricts accessibility to portions of existing Fifteenth Avenue lying further west of the proposed street vacation. Future extension opportunities for Fifteenth Avenue east and west have been limited by previous street vacation approvals issued by Spokane County prior to the City of Spokane Valley's incorporation on March 31, 2003. The Spokane County Commissioners approved Resolution No. 87-0213 on March 3, 1987 that approved the vacation of a sixty (60) foot wide section of Fifteenth Avenue from the eastern right-of-way of South Bettman Road to the western right-of- way of Dickey Street. This particular vacation of Fifteenth Avenue affected currently designated Parcel Nos. 35243.1055 and 35243.1067 immediately across South Bettman Road from the current portion of Fifteenth Avenue proposed for street vacation. This resolution also approved a street vacation of a sixty (60) foot wide section of Dickey Street from the northern right-of-way of Sixteenth Avenue northerly to the southern right-of-way line of Fifteenth Avenue. The Spokane County Commissioners approved Resolution No. 910728 on May 28, 1991.2 that approved vacation of Fifteenth Avenue between Blocks 10 and 11 of the original Bettrnans Addition plat from the eastern right-of-way of Fancher Road to the eastern property line of Lot 16, Block 10. This particular vacation of Fifteenth Avenue affected currently designated Parcel Nos. 35243.1045 and 35243.1027 C. Whether the substitution of a new and different public way would be more useful to the public. The surrounding properties are developed and built on with existing single-family residences and associated accessory uses. Spokane County previously authorized street vacations to portions of Fifteenth Avenue to the west and east of the current proposal that limits current and future east-west vehicular and pedestrian circulation opportunities along Fifteenth Avenue as a result of the return of these portions of Fifteenth Avenue to private ownership. The Current Planning Division finds that one parcel of land that is currently served by the portion of Fifteenth Avenue would be substantively affected by its vacation. This parcel is identifed as Parcel No. 3524,1048 and is located immediately west of and abuts Parcel No. 35243,1441. The April 13, 2004 a The Spokane County Commissioners approved an amending resolution (Resolution No. 93-1358) on November 2, 1993 amending Resolution No. 91-0728 to correct an erroneous description of the vacation in the original resolution. Staff Report and Recommendation#o the Planning Corn mIs jon for STV-01-04 May 6.20(14 et 10 Spokane County Assessor's Office Property Account Summary specifies that the owner of this parcel is Senn Family Living Trust, 1420 South Bettrnan Road and the taxpayer is Kurt and Mande Vigessa, 1420 South Bettman Road, one of the applicants for the street vacation request. The parcel measures fifty (50) feet wide by ninety (90) feet deep for a total lot area of 4,500 square feet. The parcel is currently zoned Urban Residential-3.5 (UR-3.5). Section 14.616.310 of the Spokane Valley Interim Zoning Code specifies that the minimum lot size in the UR-3.5 zoning designation is 10,OD0 square feet. Section 14.616.315 of the Spokane Valley Interim Zoning Code specifies that the minimum lot width in the UR- 3.5 zone is eighty (80) feet. The parcel is therefore a non conforming lot of record. However, because this parcel has legal lot status access to the closest adjacent public right-of-way should be maintained. Therefore, a minimum twenty (20) foot wide access easement from South Bettman Road to Parcel No. 35243.1048 should be provided within the portion of Fifteenth Avenue to be vacated and returned to Parcel No. 35243.104. This access easement shall be specified on the face of the required record of survey for the street vacation. D. Whether conditions may so change in the future as to provide a greater use or need than presently exists. There are no current land use actions in the immediate vicinity of the proposed street vacation that are directly or indirectly dependent for access on the portion of Fifteenth Aveue proposed to be vacated. This portion is currently physically unimproved to meet the minimum Local Improvement The Public Works Department determined that there was no anticipated change to the current unimproved nature of the portion of Fifteenth Avenue being proposed for vacation and the lack of any current or future plans by the City to improve this portion of Fifteenth Avenue inclusive of not being an identified project on the City's existing Six-Year Street Capital Improvement Program. Further, the Public Works Department found the street vacation to be in the public interest based on previous decision-making by Spokane County on street vacation requests east and west of the current proposal prior to the City of Spokane Valley's incorporation on March 31, 2003. E. Whether objections to the proposed vacation are made by owners of private property (exclusive of petitioners) abutting the street or alley or other governmental agencies or members of the general public. As of the date of thisstaff report and recommendation to the Planning Commission the Current Planning Division has not received any written objections to the proposed street vcation from owners of private property abutting Fifteenth Avenue. On Tuesday, April 20, 2004, Clyde Weyrauch, Parcel No. 35243.1027 further identified as 5908 East 15th Avenue transmitted an electronic mail message to Kevin Snyder, AICP, Current Planning Manager. Mr. VVeyrauch's property abuts the Balch parcel (Parcel No. 35243.1014) on its imrneidate west. Mr. Weyrauch's electronic mail message posed a number of questions regarding the street vacation request, but did riot specify any direct or indirect objection to the proposal. NJr. Snyder responded to Mr. Weyrauch's electronic mail message on Wednesday, April 21, 2004, Mr, Weyrauch responded back to Mr. Snyder on Wednesday, April 21, 2004 indicating his receipt of Mr. Snyder's message. Further, no members of the general public submit any written objections to the proposed street vacation at time of this staff report and recommendation, The Current planning Division distributed on April 7, 2004the street vacation application to Spokane Valley Building Division; Spokane Valley Police Department Spokane Valley Public Works Department — Development Engineering Division; Spokane Valley Public Works -- Capital Projects; Spokane Valley Public Works . Operations and Maintenance; Spokane County Division of Utilities; Spokane Regional Health District; Spokane County Air Pollution Control Authority; Spokane County Water District No. 3; Spokane County Fire District #1; Spokane School District #81; Spokane Transit Authority; Avista; ()west; and Comcast. Kevin Miller, Deputy Fire Marshal, Spokane County Fire District No. 1 submitted a written comment letter on April 15, 2004 that stated the District had no objections to the proposed street vacation, Sandra Raskell, P.E., Assistant Development Engineer, Spokane Valley Development Engineering Division, submitted an electronic mail message on April 14, 2004 that indicated that South Bettman Road abutting the proposed street vacation on the immediate east was comprised of sixty (60) feet of public right-of- Staff Recoil arra Recommendation to the Planning Gorr mis5icn for STV-C1-04 May 6.2004 7or14 way, and that a six (0) foot bordereasement within the proposed vacated street abutting South Bettman Road. Priscilla Sprague, Real Estate Assistant, Avista Utilities, submitted a written ccmnnent letter dated April 14, 2004 that indicated that Avista had no facilities within the proposed street vacation. Ty Wick, General Manager, Spokane County Water District No, 3, submitted an electronic mail message on April 12, 2004 that indicated that the Water District would not be impacted by the proposed street vacation as there is no current water main within the proposed street vacation. Cone!usion(s): The Current Planning Division concludes that STV-01-04 complies with the procedural requirements of Section 2-8 of Ordinance No. 04-001 as evidenced by the preceding findings of fact specific to these Sections. The Current Planning Division concludes that Section 9 of Ordinance No. 04-001 is not relevant to STV- 01-04 because the application was initiated by the abutting property owners and not by the City of Spokane Valley, The Current Planning Division concludes that STV-01-04 complies with Section 11.A of Ordinance No, 04-001 because the public interest is served by approving the requested street vacation. Specifically, the Community Development Department Current Planning Division and Public Works Development Engineering Division conclude that the public interest is served because the remaining portion of Fifteenth Avenue proposed for street vacation is not currently improved and is riot planned for improvement by the City of Spokane Valley. The Current Planning Division concludes that STV-01-04 complies with Section 11-B of Ordinance No. 04-001 because the portion of Fifteenth Avenue is not necessary for public use or public access.. Specifically, the Community Development Department Current Planning Division and Public Works Department Development Engineering Division conclude that this portion of Fifteenth Avenue has never been improved and used for vehicular access since its original inception in 1890, over 114 years ago. The Divisions conclude that there is an existing street system that has been developed around the portion of Fifteenth Avenue proposed for street vacation that serves the immediate and long-term transportation facility needs of the surrounding property owners and the City in general. Further, the Divisions conclude that Spokane County's previous approvals of street vacations of portions of Fifteenth Avenue both east and west of the current proposal substantively limit the ability tocreate a viable connected street system for the street within the immediate area of the current proposal. The Current Planning Division concludes that STV-01-04 complies with Section 11.0 of Ordinance No. 04-001 because there is physical inability to substitute a new or different public right-of-way existing built nature of the immediate surrounding area and Spokane County's previous street vacations approvals affecting In addition, the Divisions conclude that the development of the surrounding street network system subsequent the platting of the Bettman's Addition in 1890 have created a sustaining and operational transportation system that does not functionally require the presence of the portion of Fifteenth Avenue proposed for vacation nor the introduction of a new and/or different public right-of- way to serve the immediate surrounding area's or the overall community's mobility needs. The Current Planning Division concludes that only one (1) parcel of record will be immediately affected by the proposed street vacation and that this impact can be mitigated through the provision of an access easement to this parcel through the vacated street from South Bettman Read to preserve public street access. The Current Planning Division concludes that STV-01-04 complies with Section 11.D of Ordinance No. 04-001 because there are no current private land use actions or public improvement projects warranting the retention of this portion of Fifteenth Avenue as public right-of-way. Staff Report and Recommendation to the Planning Commission for 57V.01-04 May 6,2004 3of10 The Current Planning Division concludes that STV-01-04 complies with Section 11.E of Ordinance No. 04-001 because there have been no written objections to the requested street submitted to the City of Spokane Valley in response to the required public noticing by abutting property owners, governmental agencies or general members of the public. Based on the submitted comments, the Divisions conclude that easements for public access and/or utilities should not be required as a condition of City Council approval, except that a minimum six (6) foot wide border easement should be provided along the sixty (00) foot wide portion of Fifteenth Avenue immediately abutting South Bettman Road for future possible roadway improvements of this road. The required record of survey should specify the provision of the required minimum six (6) foot wide on the face of the survey and should reference it as a border easement to the City of Spokane Valley and/or other governmental agencies or private utility providers. II. STAFF RECOMMENDATION The Spokane Valley Community Development Department Current Planning Division and the Spokane Valley Public Works Department Development Engineering Division after review and consideration of the submitted application and applicable approval criteria recommend that the Planning Commission RECOMMEND CONDITIONAL APPROVAL of SW-01-04 to the Spokane Valley City Council subject to compliance with the conditions of approval specified herein; 1. Pursuant to Section 11 (City Council Decision) of Ordinance No. 04-001 if the City Council determines to grant the vacation, the action shall be made by ordinance with such conditions or limitations as the City Council deems necessary and proper to preserve any desired public use or benefit. Pursuant to RCW 35.79.040, the City Council in approving a street vacation request shall specify that the vacated portion of the street or alley shall belong to the abutting property owners, one-half to each, unless factual circumstances otherwise dictate a different division and distribution of the street or alley to be vacated. 3. Pursuant to Section 13 (Application of Zoning District Designation) of Ordinance Nc. 04-001 the zoning district designation of the properties adjoining each side of the portion of Fifteenth Avenue to be vacated shall be automatically extended to the center of such vacation, and all area shall included in the vacation shall then and henceforth be subject to all regulations of the extended districts. The adopting ordinance shall specify this zoning district extension inclusive of the applicable zoning district designations. The applicable zoning district designation for STV-01-04 shall be Urban Residential-3.5 (IJR-3.5). 4. Pursuant to Section 14 (Recording of Ordinance) of Ordinance No. 04-001 a certified copy of the ordinance vacating a street or alley or part thereof, shall be recorded by the City Clerk in the office of the Spokane County Auditor. 5. Pursuant to Section 15 (Compliance to City Council Conditions) of Ordinance No_ 04-001 all conditions of City Council authorization shall be fully satisfied prior to any transfer of title by the City. 6. Pursuant to Section 16 (Record of Survey Required) of Ordinance No, 04-001 following the City Council's passage of the ordinance approving the proposal to vacate the street or alley, a record of survey prepared by a registered surveyor in the State of Washington and including an exact metes and bounds legal description and specifying if applicable any and all easements for construction, repair and maintenance of existing and future utilities and services, shall be submitted by the proponent to the Community Development Director. Said record of survey shall contain the professional stamp and signature of the registered surveyor, shall contain signature lines for the City of Spokane Valley Community Development Director, City of Spokane Valley Public Works Director or designee, and the proponent indicating acceptance of the vacated street or alley. Said record of Staff Report and Recommendation to the Planning Commission for STV-01-04 May 6,2004 Sor10 survey shall also specifying location, dimensions and area of all parcels of land abutting and within one hundred (100)feet on all sides of the vacated street or alley. 7. On January 20, 2004. the Spokane Valley City Council passed Ordinance 04-002 containing the City's street vacation policies end procedures, This ordinance specifies that the Planning Commission shall hold the required public hearing and shall forward a recommendation to the City Council on the street vacation request for its consideration. STV-01-04 is a request by Kurt and Mandee Vigessa, 1420 South Bettman Road (Parcel No. 35243.1041) and Gene and Lana Balch, 1506 South Bettman Road (Parcel No. 35243.1014) to vacate a portion of the 15° Avenue public right-of-way abutting said parcels — the Vigessa parcel abuts the 15° Avenue public right-of-way on the north and the Belch parcel abuts it on the south. The portion of 15"' Avenue requested for vacation measures 60 feet wide by 192.5 long for a total area of 11,550 square feet. This street vacation request was originally submitted to Spokane County in December 2002, prior to the City's incorporation, and was transferred by Spokane County to the City of Spokane Valley at time of incorporation on March 31, 2003. The request was placed on hold pending the City's development of street vacation policies and procedures. Staff from the City's Community Development Department and Public Works Department will present information on the proposed street vacation request at the April 8, 2004 study session. RECOMMENDATION: Staff's presentation on STV-01-04 is in a study session format only and is intended to be the Commission's "first touch; on the request. The required public hearing is tentatively scheduled for May 13, 2004. Staff request that the Planning Commission identify any questions or concerns during the April 8, 2004 study session for staff to research and report back on prior to or on May 1e. WHEREAS,ROW 35A.47.020 provides statutory authority for cities to vacate public rights-of-way; Wt REAS, RCW 35.79 provides a general procedural framework for cities to vacate public rights-of-way;and WHEREAS, the City would like to have an ordinance that provides specific guidance to its citizens on the procedural requirements for vacating public rights-of-way. NOW, THEREFORE, TUE CITY COUNCIL OF THE CITY OF SPOIL VALLEY, WASHINGTON DOES ORDAIN AS FOLLOWS: SECTION 1 —Purpose and intent. The purpose of this chapter is to establish pracedrres,notice requirements and fees for the vacation of streets and alleys within the city. This chapter is intended to implement the authority granted to the city by Chapter 35.79 RCW and RCW 35A.47.020 and to conform to their provisions. In case of conflict between this chapter and tboae statutes,the provisions this Ordinance shall be controlling. SECTION 2—Initiation of Vacation. The owners of an interest in any real property abutting upon any street or alley who may desire to vacate the street or alley, or any part thereof, may petition the City Council. In the alternative,the City Ccu©cil may itself initiate a vacation by resolution. The petition or resolution shall be filed with the City Clerk. SECTION 3 — Petition for Vacation. The petition shall be in a form prescribed 'by the Community Development Director(hereinafter referred to as"the Director"or his or her designee)and shall be signed by the owners of more than two-thirds of the property abutting the portion of the street or alley sought to he vacated,. The petition shall also discuss the criteria set forth in Section 11 of this Ordinance. The sufficiency of the petition shall be governed by RCW 35A.01.040. SECTION 4—Petition fees. Every petition for the vacation of any street or alley or any part thereof, shall be accompanied by a fee in an amount established by resolution of the city to defray a portion of the administrative costs incurred in processing the petition and publishing, posting and mailing notices. The fees shall not be refunded under any circumstances. The amount of the petition fees shall be set by Resolution, and the set amouni shall be stated in the City of Spokane Valley Master Fee Schedule. SECTIONS-Submittal•Iteynirements for Petitions. Every petition shall be accompanied by: (1) an Assessor's Map from the Spokane County Assessor's Office showing with a solid red line the portion of the street or alley sought to be vacated, (2) a vicinity map showing the general area of the proposed vacation, (3) a copy of the record of survey, if available, for the subject street and alley proposed for vacation and abutting properties and streets and alleys within 100 feet on all sides of the proposed vacation; (4) written evidence of any and all easements or allowances or reservations, public or private,pertaining to the street or alley proposed for vacation; and (5) a written narrative describing the reasons for the proposed street vacation,the physical limits of the proposed street vacation and the public benefit of the proposed street vacation. SECTION 6 —Setting of Hearing. Upon receipt of the petition, the fee and all required documents, the City Clerk shale forward the petition and required documents to the Director, who shall determine whether the petition has been signed by the owners of more than two-thirds of the property abutting the part of the street or alley to be vacated. If the petition has been signed by the requisite percentage of such owners,the Director shall bring the petition before the City Council within 30 days of receipt of the petition,-and the City-Council shall by resolution fix the time when the petition will be heard by the City Council,or a committee of the City Council, which time shall not be more than 60 days icor less than 20 days after the adoption of the resolution. Where the City Council initiates the vacation by resolution, that resolution shall fix the time when the proposed vacation will be heard by the City Council or a committee of the City Council_ SECTION 7— Staff Report. The Director, in conjunction with the l'oblic Works Department shall prepare a report concerning the proposed vacation. The Public Works Department shalt be responsible for conducting a needs analysis of the street or alley proposed for vacation ie consideration of existing and future transportation system needs and requirements. The report shall address the criteria (see Section 11) to be considered by the City Council in determiaiag whether to vacate the street or alley, and such other information as deemed appropriate by the Director including but not limited to drainage requirements, street closure requirements such as the removal and replacement of concrete, asphalt,and placement of barriers limiting vehicle movements. In preparing the report, the Director shall solicit comments from the Police Department, the Fire Department and may solicit comments from other governmental agencies and utility companies having jurisdiction or'utilities within the boundaries of the City. The report shall be submitted to the Planning Commission and to the petitioner and his or her representative,not less than seven(7)calendar days before the hearing. SECTION$—Notice of Hearing. Upon the passage of the resolution fixing the time for hearing the petition or proposal for vacation, the City Clerk, or the Director, acting under direction and supervision of the City Clerk, shall give not less than 20 days' notice of the time,place and purpose of the hearing by (1)posting of a written notice in three (3) conspicuous places in the City; (2) publishing written notice once in the City's official newspaper, (2) posting a miniature twenty-four (24) inch by thirty-six (36) inch notice sign in a conspicuous place at each end of the street or alley sought to be vacated describing the proposed vacation and the date, time and location of the public heai--rng; and (3 mailing written notice to all petitioners at the addresses on the petition and all owners of property abutting the etreeti or alley proposed to be vacated, as shame on the records of the Spokane County Assessor, not to exceed ninety (90) calendar days from the date of the public hearing. The Director shall send the same written notice to the representative of the petitioners at the address on the petition. SECTION 9—Protest. If fifty(50)percent or more of the abutting property owners file written objections to a City Counoil-initiated vacation with the City Clerk, prior to the time of the hearing, the city shall be prohibited from proceeding with the vacation. .SECTION 10 Planning Commission- Review and Recommendation. The hearing on the petition or proposal shall be held before the Planning Commission upon the day fixed by resolution or at the time to which a hearing may be adjourned. In its consideratoin of the proposed vacation of the street or alley, the Planning Commission shall render a recommendation based an the criteria specified in Section I1.A-E. Following the hearing,the Director shall forward the Planning Commission's recommendation and the hearing minutes to the City Council at a regularly scheduled meeting. If a hearing is held before the Planning Commission,it shall not be necessary to hold a hearing before the City Council, provided that the City Council may at its discretion determine to hold a separate hearing on the proposal. } SECTION 11 — City Council Decision, Following the hearing and receipt of the Planning Commission's recommendation the City Council shall determine whether to vacate the street or alley. The determination shall include, hut not be limited to, consideration of the following criteria: A. Whether a change of use or vacation of the street or alley will better serve the public; - B.Whether the strut or alley is no longer required for public,use er public access; C_Whether the substitution of a new and different public way would be more useful to the public; D.Whether conditions may so change in the future as to provide a greater use or need than presently exists; and E. Whether objections to the proposed vacation are made by owners of private property (exclusive_ of petitioners) abutting the street or alley or other governmental agencies or members of the general public. If the.City Council determines to grant the vacation,the action shall be made by ordinance with such conditions or limitations as the City Council deems necessary and proper to preserve any desired public use or benefit, The ordinance may contain a provision retaining or requiring conveyance of easements for construction, repair and maintenance of existing and future utilities and services, Pursuant to RCW 35.79.040,the City Council in approving a street vacation request shall specify that the vacated portion of the street or alley shall belong to the abutting property owners,one-half to each,unless factual circumstances otherwise dictate a different division and distribution of the street or alley to be vacated, The City Council reserves the right to require compensation as a condition of approval of ordinance action, provided that such compensation shall comply with the requirements of RC W 35.79.030, and further, that any required compensation shall be paid to the City prior to the City's participaiton in required title transfer actions.. SECTION 12—Vacation of Waterfront Streets. A.The city shall not vacate a street or alley if any portion of the street or alley abuts a body of water unless: 1.The vacation is sought to enable the City to acquire the property for beach or water access purposes, or launching sites,park, public view,recreation, educational pu_poses, er otherpublic uses; 2.The City Council,by resolution,declares that the street or alley is not presently being used as a street or alley and that the street or alley is not suitable for any of the following purposes:beach or water access, launching sites,park,public view,recreation,or education; or 3.The vacation is sought to enable the City to implement a plan, adopted by resolution or ordinance,that provides comparable or improved public access to the same shoreline area to which the street or alley sought to be vacated abuts, had the properties included in the plan not been vacated, B.Before adopting an ordinance vacating a street or alley under subsection (AV) of this section, the City Council shall: I 1. Cause an inventory to becompiled of all rights-of-way within the city that abut the same body of water that is abutted by the street or alley sought to be vacated; 2.Cause a study to be conducted to determine if the street or alley to be vacated is unsuitable for use by the city.for any of the following purposes: launching sites,.beach or water access, park,public view recreation,or education; 3.Hold a public hearing on the proposed vacation in the manner required by Chapter 35.79 RCW and this chapter; and 4.Include in its written decision a fi_ndit.g that the street or alley sought to be vacated is not suitable for any other purposes listed under subsection (B)(2) of this section, and that the vacation is in the public's interest. C.Notice of the public hearing on the proposed vacation shall be provided in accordance with the notice provisions of Section g of this Ordinances provided, that the City shall also post notice of the public hearhig conspicuously on the street or alley sought to be vacated, which notice shall indicate that the area is a public access, that the street or alley is proposed to be vacated, and that anyone objecting to the proposed vacation should attend the public hearing or send a letter to the Director indicating the objection. SECTION 13—Application of Zoning District Designation. The zoning district designation of the properties adjoining each side of the street or alley to be vacated shall be automatically extended to the center of such vacation, and all area shall included in the vacation shall then and henceforth be subject to all regulations of the extended districts. The adopting ordinance shall specify this zoning district extension inclusive of the applicable Zoning district designations. SECTION 14 - Recording of ordinance. A certified copy of the ordinance vacating a street or alley or part thereof,shall be recorded by the City Clerk in the office of the Spokane County Auditor. SECTION 15— Compliance to City Council Conditions. All conditions of City Council authorization shall be fully satisfied prior to any transfer of title by the City. SECTION 16 — Record of Survey Required. Following the City Council's passage of the ordinance approving the proposal to vacate the street or alley, a record of survey prepared by a registered surveyor in the State of Washington and including an exact metes and bounds legal description and specifying if applicable any and all easements for construction, repair and mainteoance of existing and future utilities and services, shall be submitted by the proponent to the Director. Said record of survey shall contain the professional stamp and signature of the registered surveyor, shall contain signature lines for the City of Spokane Valley Community Development Director, City of Spokane Valley Public Works Director or designee,and the proponent indicating acceptance of the vacated street or alley Said record of survey shall also specifying location, dimensions and area of all parcels of land abutting anti within one hundred(IOC))feet on all sides of the vacated street or alley. SECTION 17 — Costs of Title Transfer to be Borne by Proponent All direct and indirect costs of title transfer of the vacated street or alley from public to private ownership including but not limited to title company charges, copying fees, and recording fees are to be borne by the proponent. The City will not assume any financial responsibility for any direct or indirect costs for the transfer of title. SECTION 18 Severability. If any section, sentence, clause or phrase of this ordinance, or any regulation, rule or order adopted pursuant to the authority thereof be determined invalid or unconstitutional, it shall not affect the validity or constitutionality of any other section,sentence,clause or phrase of this ordinance. SECTION 19—Effective date. This ordinance shall be in full force and effect five (5) days after publication of this ordinance or a summary thereof in the official newspaper of the City as provided by law. This process originally started with Spokane County. Due to incorporationFifteenth Avenue,now a City of Spokane Valley Road, is being petitioned to be vacated. The right of way is currently being utilized by Mr. Vigesaa and serves as a graveled driveway/parking area and a landscaped backyard. Mr. Vigesaa plans to continue to use the vacated right of way for parking and a driveway to his property. Future plans include the placement of a shop on said property. The proposed property is described as follows: Fifteenth Avenue - 60# wide, from the West line of Bettman Road, West to the portion vacated by County Amending Resolution 93-1368, trialed June 6, 1991 being the East line of Lot 16 Block 10 extended ofBettinan's Addition. Located in the Southwest Quarter(SW 1/4) of Section 24, Township 25 North, Range 43 EWM, City of Spokane Valley in the plat of Bettman's Addition. The property is approximately 11,550 Square feet more or less. Current City of Snakane Valley File Review In review of the current file on the 15tAvenue Vacation Mr. Vigesaa submitted to SpokaneCounty a Petition to vacate a County Road, an environmental checklist for non- project actions and a Bond of Petitioners for Vacation of a County Road. The Bond of Petitioners for Vacation of a County Road was signed on behalf of both Kurt and Mandee Vigesaa and Gene and Lana Balch. These are the two adjacent property owners to the proposed vacated right of way. County Road File Review Bett nan's Addition was filed with Spokane County in 1890. The right of way under consideration for vacation was never improved or opened to the public. In review of Spokane County road file number 2364 and 1267, County Resolution 93- 1368 stated that Fifteenth Avenue in Bettman's Addition between Blocks 10 & 11 from the East line of Fancher Road to the East line of lot 16, Block 10 extended in the Southwest Quarter (SW 1/4) of Section 24, Township 25 North, Range 43 E.W.M. was vacated on the 28Ith day of May, 1991 by the County Commissioners and fmaled by the County Engineer on 6th day of June 1991. It was also found that Fifteenth Avenue from the East right of way line of Bettnlan Road Easterly to the West right of way line of Dickey Street located in the Southwest Quarter (SW 1/4)of Section 24, Township 25 North,Range 43 E.W.M. in Bettman's Addition had been vacated per County Resolution 87-0213 on the 3rd day of March 1987. Conclusion Based on the information above, Fifteenth Avenue is unimproved right of way with the right of way to the East and West of the proposed vacation having been previously vacated. With these findings it is our recommendation that the described road right of way will not be opened in the future and would not have any benefit to the City or the public in general. Therefore we recommend the proposed vacation be granted upon the following condition: 1) Acquire and submit to the Public Works Director an appraisal on the value of the proposed vacated right-of-way from a licensed appraiser in the State of Washington.
