The area of the proposed zone change is the North west
corner of Sprague and University.
The area is practically surrounded by business noW, with
a boat works and salvage yard west of the property, super market, besuty salon,
doctors and dentist offices, barber shop, greenhouses south and south eatt
of property. From a land use standpoint the property co~_:ld not be used
properly for what it is zoned for.
You will find enclosed a petition requesting zone ch ange
signed by 21 property owners adjacent and near the property in question.
The petitmon represents the thinking of the property oNners affected by
such a change.

The Agricultural Zone by very definition includes more area than any
other type of zone and is a zone where the uses of the land a re freqwently
closels related to the resources of the soil. In irriting the Zoning Ordiaances
it was recognized that many areas i,nclwded in the Agricultural Zone would

ie not constant and Ie frequently related to demand in the vicinity whic,h
may or may not be created, it was not cons3dered practical to nnalyze every
pieoe of land in the County to determine whether or not its grea.test potential
in terms of serviag the community liea in the development of a gcavel pit or
rock qvarrq It was recognized, however, tha.t add3,tional pits and qvasries
would be needed from time to tinng e The rock qvarry, sand pi$ end gravel pit
zoae was therefore pravided with the expectat3on that it would be necesdasy
to class3.fy la.nd in a.n Agricultural Zone for this purpose Thhis zone clt1esi--
fica,tion vras created in addition to the Manufacturing zonep which includes
pit operation as a normal use, because it was anticipated that there woul.d be
many place a within the County where land wai,tld be needed for this one purpose
but which w ould be unappTOpriate for general ma.nufacturing usea In e atablishing
thia ]and use clas sif 3.cat ion = however , 3t was de emed advisable to enumerate
eertain etandarda of operat9.on to protect the general publico It was believed
that failure to comply with these stancla.rds would have an adverse effect oa
the general public and a,djacent property ownera.

applicants have demonstrated a need for the uee of this lAnd and the use of
the land for pit and related uses do not appear to be uuduly incomgatible

After znvestigation and public hearing the Planaing Commission finds that
the Morrison-Snudsen 8ompany and 3.te eubcontractors have been operating a pit,
equipment and cement and asphalt mucing plants in viola.tioa of the law It
is admYtted by the Morrison-$audsen Company that such activity is contraxy to
law but the Morrison-4Cnudsen Company contends that the violation was establi-
shed without knowledge of the Z4;ftxng QrdYnance The Morrxeon-Knudsen Company
agreee to comply i.n every respect wfth the la,x-T and if the zone change ie
effected to Dermit the use the pxt wi11 be operated in every reapect in
accorda,nce vrith the standar ds of the z one
The Planning Commxssion has further found that the Morrison-Knudsen Com-
pany is rr aa ting a dust hazar d and nui san.ce along the Caunty Roa d a.nd t he
additional road between the pit and Fairchild Ai.r Foree Base It is specifi--
cally recommended that prior to making the change in the zonirg aap, the
Nlorrison-gnudaen Company be reauared to pave with asphaltic pavement or concrete
the roadways, public and private, between the ps.ts and Fazrchild Ai.r Force
Base. The heavy traffic generated by the pit operation is not only creating
4 dust nw.sance but is breaking down the construction and usefulness of the
County road used by the heavy equipmento 4ther Firms ha,ve willxngly complzed
with auch a standaxd of operation and it is the opinxon of the Planning Com--
mission that the Morrison-Knudsen Com~a,ny wxll likewise wYsh to give eaual
protectzon to the public Failure of the Comgany to comply would reQUire

to Sectfon 149 para,gra,h 31 c, reQV.irxn,g action to control dust created on
roads and SectYOn 14, garagraph 3, x, authorizing the Board of Cownty Com-

to Rock Qua,rry, Sand and Gravel Pit Zone in the Nk' of NB,-l of Sec 14--24-42

upon further investxgation other loca.tiona suitable for a quarry could not be
found that the matter would be reconsidered upon a, $horring that such is the
case and tha.t the operation toill be limited and conducted in such a manner
ae not t o be unduly detrxmental to adjacent pronerty and out of ha.rmony with
the character of the a.rea The burden of proof for the zone cha,nge rests
with the applicant Fifteen property oVfnQrs of the Marehall Valley argued
tlat they had requeated that the area be zoned Agrlcuitural to preserve the
character of the area and that they did not see the necessity of Mking thie
cbange which might become the entering wedge for a substantial change It
was further argued tY1at the incrPa$ed truck traff ic would dama.ge the condztion
of the highway and that the blast rng would endanger the water supply Mr.
L L Ora.ard, a professiona,l geologist, testified that thA b3.asting could be
