City of Spokane Valley's Regulation for the Rebuilding of a Non -Conforming
Structure pursuant to Chapter 19.20.060 (Non -Conforming Uses and Structures) of
the City of Spokane Valley Municipal Code (SVMC) effective October 28, 2007.
On March 6, 2013 information was requested regarding the City of Spokane Valley's
regulations for the rebuilding of a nonconforming structures located at 1713 N. Maurer
(Parcel No.: 45104.0326) which is currently zoned 0 (Office) Chapter 19.20.060 (Non -
Conforming Uses and Structures):
Legal non -conforming uses and structures include:
19.20.060(A)(1)SVMC: Any use which does not conform with the present regulations of the
zoning district in which it is located shall be deemed a nonconforming use if it was in
existence and in continuous and lawful operation prior to the adoption of these regulations.
With regard to the replacement of structures deemed nonconforming:
19.20.060(B)(8)SVMC: Any non -conforming structure damaged by fire, flood, neglect or act
of nature may be replaced if:
a. Restoration of the structure is initiated within twelve (12) months; and
b. The damage represents less than eighty percent (80%) of market value.

I am doing some financing on this property for a client and the lender is requiring a 100% rebuild letter. John
KC Properties spoke with you, and then faxed me your name and number and the section from a manual (19.
referring to Nonconforming uses and structures (item #5); which states that existing legally established single
residential uses located in any nonresidential zoning district shall not be deemed nonconforming and shall be
a legal use.
Can you fax or email me a rebuild letter based on this information?
