Enclosed is the final plat dedication (copy) and a copy of that por- tion of the pla t map tha t include s Lot 1, Block 1. It is the opinion of Paul jensen, assistant subdivision administrator, and Robert McCann, county road engineer, that the legal building line for the lot in question is 25 feet back from the point where the cul de sac easement intrudes farthest into the platted lot, the highest point in the arc of the radius, in other word s . Any purchaser should be advised of this restriction and should also be made aware that no construction is allowed within the radius described as part of the cul de sac. This would include driveways. INTRODUCTION This matter having come before the Examiner Committee on March 29, 1979, and the members of the Committee present being Abby Byrne, Chairperson, John Culler, and Kenneth Kennedy. B. PROPOSAL ~ The sponsor, James E. Winner, is requesting approvaf of an Extension of Time and Zone Change, PE-1177-78, Fairacres Replat #3 and ZE-22-78, Agricultural fio Single Family Residential for subdivision of 2.14 acres into 7 lots for single family dwellings and there being present, the following applicant or represen- tatives : JAMES E. WINNER C. FINDINGS OF FACT 1. That the existing land use in the area is residential and vacant. 2. That the Comprehensive Plan designates this area as residential. 3. That the existing zoning of the property described in the application is agricultural. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 1 F No. PE-1177-78 ; Z E-22-78 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the proposed use is compatible with existing uses in the area. 8. It was not until Jan. 5, this year, thl!t Mr. Eads of that office asked for $350.04 for expenses to . . . build a fence, after wjhich there would be no restrictions from any source against completiha the project. That is only aboltt a month ago, but nearly a year since original application for plat. It is my very firm belief that as of now there are no further restrictions, nor will there be, against finishing the project. To date have had reasonable , assurance that the lots havr immediate sale value for building living qua.rters. Topography, soils and water. a. This project lies in a relatively flat area between Opportunity and Trentwood. Local drainage ways are insignificant. It is located over the Spokane Valley Aquifer. b. Surface soils are classed as Garrison gravelly loam with 0 to 5$ slopes. They have a septic tank filter field limitation of slight with possible contamination of groundwater. c. Geologically the soils are glaciofluvial deposits; stream-laid sand and gravel; contains some boulders in places; includes some undifferentiated glacial deposits. The lower terrace remnants have probably been reworked by streams. These geologic structures yield moderate to very large amounts of water. ~ ~ SCHD-ADM-118 v ~ Fairacres Replat #3 Page 2 March 15, 1978 d. The data from public and private wells in the area shows the wells are 50 to 235 feet deep and have static water levels varying from 27 to 106 feet below the surface. The highest total nitrogen level was 7.1 ppm. The Irvin Water District has indicated that it can supply domestic use water for the plat upon completion of agreements with the developer. 3. Impact discussion. a. The plat sponsor has proposed 7 lots on 2.4 acres. Each lot is to be served by a public water system and its individual on-site sewage dis- posal system. This raises the question of significance of the impact on the groundwater in the area and possible alternatives for sewage disposal. ~ b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he concluded that: (1) In normal precipitation years and subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. (2) All dissolved salts in sewage effluent will be carried to the ' groundwater. However, bacteria and detergents (phosphate por- tion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phos- phates, which are known to react with soil particles, or nitrates, which are taken up by plant roots" will be less than the total found in septic tank effluents. (3) "The calculated results at the downstream end of groundwater flow line indicate that the maximum range of (dissolved) sol- ids concentration expected at present (1975) is up to 93 mg/1 (milligrams per liter) above the natural groundwater back- ground of 155 mg/1. The forecast year 2020 maximum incremental concentration is 101 mg/1 above the natural background." "The analytical results of the forecast impact of year 2020 when com- pared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality is already a substantial proportion of the ultimate level." c. Currently, results of chemical analysis show the total nitrogen content of the groundwater is in the range of 0.9 to 7.1 ppm. A projected incre- mental increase using Dr. Todd's expected 8.6 percent would result in ranges of 0.97 ppm. to 7.7 ppm. Current Federal and State drinking water standards permit up to 10 ppm. Alternative sewage disposal methods that would not recharge the ground- water have the followirig general characteristics: (1) Collector and central treatment systems discharging to surface waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. These systems are not currently economically available for this project. (2) Sealed systems, whether individual or community, depend on evaporation for liquid removal. Some, such as lagoons, have safety hazards associated with them and relatively poor community acceptance. 4. Recommend that: a. A public water system including fire flows serve each lot prior to sale of the lot. b. Each lot be authorized the use of an individual on-site sewage system. c. I . GIlVFRA.L INFORMATION : A. Location Fairacres Replat #3 is located in the north central area of Spokane Valley, west of Bowdish road and north of Buckeye Avenueo B. Proposal The applicant proposes to subdivide 2/z acres into 8 lots a11 for Single Family Dwellings. Creating a density of about 3 units per acre with a typical lot size of 11,600 square feet per lot. C. Relationship to the Comprehensive Plan Fairacres Replat #3 is situated wlthin an area that has been designated as being suitable for residential development by the approved map of the Comprehensive Plan. Within that Comprehensive Pla.n however, no density designation have yet been determined. D. Existing Land Uses The site is presently vacant with no significant topogranhic features. The properties that generally suround this oroposal have developed over the years into several residential subdivisions including: Fairacres Replat #1 and #2, Sunnyvalley Acres, Mirabeau Ranch Addition and Fairacres Mobile Homes Subdivision. E. Compatibility With Existing Land Uses The Staff finds this proposal to be compatible with recent Planning Commission decisions in the area as well as being compatible Eaith the future intended uses for the area - higher density residential uses.. Some conflicts might result however,in short term regarding the possible conflicts between larger lo'Ll uses in the area and the smaller lot subdivisions. II. SPECIAL INFORMATION: A. Circulation The Engineer's Office has reviwed this proposal and thei?^ office finds that both the plat design is acceptable to their office and that 3dequate County Roads are now available to serve the prelimin.ary plat. Their office recommends however that as a condition of plat approval both paving and curbing of the roads in the proposal be L-equired. - 17 - 72 --z~ I I f II . PE-1177-78 - Fairacres Replat #3: Winner (Continued) B. Sewage Disposal The Health District has approved the use of individual on-site systems to serve this proposal. The plat is however situated over the Spokane Valley Aquifer where moderate impact upon ground water quality may be expected at some future date if continued urbanization at this density continues to occur. C. Water Supply The proposed Subdivision is situated vrithin the recorded service area of Irvin water District. That water district indicates that it does , have the ability to serve the site wlth both domestic a.nd iire flows. ~ D. Drainage The Staff finds that because of the relatively flat terrain of the site and that of the adjacent properties that no special drainage control methods would be required and standard techniques for storm water control could be employed. - E. Fire Protection The proposed subdivlsion is situated within the recorded service area of Fire Protection District #1o That district indicates that both mains and hydrants of sufficient size for fire protection needs should be required as a condition_for pl at approval. F. Parks No County parks are currently available in the area and the County Parks Department has no present plan for either site acquisition or major park improvements. G. Schools The proposed subdivision is situated within the bounda.ries oi the East jlalley School District. That distrlcts facilities are currently at capacity,levels. They,however,expect this problem to be mitigated someivhat when their current building progrnm is completed in 2 or 3 years time. III. ZONING ANA'LYSIS The staff finds that it would appropriate to upgrade this proposal to The Single Family Residential Zone because of the use and the character of the proposal as well as the use and character of surounding area. The szaff also finds that an upgrade to the Single Family Zone would be consistent with recent Planning Commission decisions. IV. ENVIRONMENTAL REVIEW: The staff has reviewed the environmental checkllst submitted by the applicant and we find that no significant adverse environrnental impacts would likely resolve - 17 A - PE-1177-78 - Fairacres Replat #3 (Continued) and a proposed declaration of nonsignificance should be issued. Slight adverse environmental impacts were however noted under the following questions: earth, air, water, noise, light and glare, land use, natural resources, population,. housing, tran.sportation, public services, energy and utilities. Specific conditions applicable to this plat are referenced below and found in the attached supplement entitled, "Standard Conditions for Approval of Preliminary Plats - August, 1977".
