PROTECTIVE COVENANTS WYATT'S ADDITION
Restrictions and Easements which are imposed in the dedication of the
Wyatt's Addition and filed for record October 12, 1978 as document
Number 7810120307 are as follows:
1. Al1 lots shall be residential and no structures shall be erected,
placed or permitted to remain on any portion of this tract, other than,
a single family dwelling and a private attached garage, except lots 1, 2,
3, 4, S in Block 2, Duplexes are permitted.
2. No dwelling, house or any part thereof shall be erected on any
site within 25' of the front line of each lot, nor within S' from the
side line of any lot nor within 15' of any side or flanking street.
3. No dwelling may be constructed or placed upon any lot herein with
less than 1008 square feet of floor space in a single story structure,
and less than 948 square feet on the ground floor of a split-level or
multiple story structure, not including any uarage, covered patio or
porches.
4. No structuze of a temporary character - trailer, basement, tent,
shack, barn or other outbuildings shall be used on any lot, at any time
as a residence, either temporarily or permanently. .
5. Said premises or any building erected thereon shall not at any
time be used for the purpose of any trade, business, or manufacture.
No sign of any kind shall be displayed to public view on any lot, except
one sign of not more than 8 square feet, advertising the property for
sale or rent or signs used by a builder to advertise the property during
the construction and sale.
6. Camping trailers, camping vehicles, boats or trailers of any type
shall not be stored in the front yard of any lot within the plat.
7. No fence erECted along any side lot line or rear ].ot line herein,
shall exceed a height of 6' and any fencd erected from the front line

8. No nauseous or offensive activity shall be carried on upon any
lot nor shall anything be done thereon which may be or may become an
annoyance or nuisance to the neighborhood.
9. An occupant, or resident, may keep or maintain for his own personal
enjoyment household pets, but shall not keep or maintain other animals or
livestock.
10. Domestic water will be provided for each lot herein prior to sale,
as shown in the dedication of the recorded plat.
11. A 5' easement is hereby provided on the lots as shown and shall
be used for utility purposes as shown on the plat.

12. These covenants are to run with the land and shall be binding
upon all parties and persons claiming under them for a period of
twenty years from the date these covenants are recorded, after which
time said covenants shall be automatically extended for successive
period of ten years, unless, an instrument signed by two-thirds of
the then recorded owners of the lot in the addition has been recorded
agreeing to change same in whole or in part.
13. Easements For drainage are reserved over a 5 foot wide strip
along each side of interior lot lines and over the rear five feet
of each lot. taithin these easements, no structure, planting or other
material shall be placed or permited to remain which may change the di-
rection of flow of drainage channels in the easements, or which may
obstruct or retard the flow of waterthrough drainage channels in the
easements. The easement of each lot and all improvements in it shall
be maintained continuously by the owner oi the lot, except for the
improvements for which a public authority or utility company is
responsible.

2. Togography, soils and water.
a. This project lies in a relatively flat area between Opportunity and
Trent Avenue. Local drainage ways are insignificant. It is located
, over the Spokane Valley Aquifer.
b. Surface soils are classed as Garrison gravelly loam with 0 to 5% slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.
c. Geologically the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace remnants have probably been rewoxked
by streams. These geologic structures yield moderate to very large
amounts of water.

d. The data from five Modern Electric and private wells in the area show
the wells are 50 to 158 feet deep and have static water levels varying from
40 to 125 feet below the surface. The highest total nitrogen level was
5.5 ppm. The Modern Water District has indicated that it can supply domestic
use water for the plat upon completion of agreements with the developer.
3. Impact discussion.
a. The plat sponsor has proposed 15 lots on 7.4 acres. Each lot is to be
served by a public water system and its individual on-site sewage dis-
posal system. This raises the question of significance of the impact
on the groundwater in the area and possible alternatives for sewage
disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In summary, he concluded that:
(1) In normal precipitation years subsurface disgosal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All dissolved salts in sewage effluent will be carried to the
groundwater. However, bacteria and detergents (phosphate par-
tion) are mostly removed by the deep soil layer above the
groundwater and "minor dissolved constituents such as phos-
phates, which are known to react with soil particles, or
nitrates, which are taken up by plant roots" will be less
than the total found in septic tank effluents.
(3) "The calculated results at the downstreatn end of gxoundwater
flow line indicate that the maxamum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background."---"The
analytical results of the forecast impact of year 2020 when com-
pared with the present impact, both measured in terms of leachate
volume and dissolved solids concentration, indicate that the
present impact on groundwater quality is already a substantial
proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content of
the groundwater is in the range of 0.8 to 5.5 ppm. A projected incre-
mental increase using Dr. Todd's expected 8.6 percent would result in ranges
of 0.87 ppm, to 6.0 ppm. Current Federal and State drinking water standards
permit up to 10 ppm.

d. Alternative sewage dispasal methods that would not recharge the ground-
water have the following general characteristics:
(1) Collector and central treatment systems discharging to
surface waters would require at least tertiary treatment
and perhaps more to obtain a permit for the discharge
o from the Department of Ecology. These systems are not
currently economically available for this project.
(2) Sealed systems, whether individual or community, depend
on evaporation for liquid removal. Some, such as lagoons,
have safety hazards associated with them and relatively poor
community acceptance.
4. Recommend that:
a. A public water system including fire flows serve each lot prior to
sale of the lot.
b. Each lot be authorized the use of an individual on-site sewage system.
c. An on-site sewage management system be created and approved by this
office prior to the signing of the final plat if more than a total
of twenty-six (26) dwelling units are authorized within the plat.

l. Purpose of the Association: The Associations

system. The system is defined and composed of: A. The
collective on-site building sexvers, treatment systems and
disPosal systems. B. The association may have a secondary
function(s) for other purpose(s) that the homeowners may

mon road or other community oriented proj ects .
ARTICLE 2 1. Un-Site Sewage disposal syten Rules: The
Association shall: A. Contract with a licensed agent who
shall not less than once every three years, or if required,
more oFten,pumpaut, inspect each on-site disposal system
and service the treatment facilities and system in acc-
ordance with accepted standards and procedures, and, B.Cause
to be inspected and repaired componants of the system when
required bv the Spokalze County liealth District. The Spol:ane
Count.y ltealth llisfirict may from tiMe to time inspect the
systu:i for satisfactory function and compliance. Users of
the sysceri shall introduce into it no materials such as
painLs, o71s, solvents, and chemicals other than those and
in quantitie5 normally used in the home.

A. Ingress and egress to each lot in
Wyatt Addition for servicing the on-site sewage
disposal system,
B. Limited easer:lent : 'i'he easement is for
' limited purposes on1y. The respective lot owners shall
etijoy full usc and privacy from trespasses in every way
except as required for the periodic, or emergency in-
spection and repair of the system. This paragraph does
not preclude the erection of f ences such as chain link,
wood, or otlier materials that can be temporarily removed
for service or repair of thE system components.
ARTICLE 4
l. Assessments and Liens :Each homeoiJner whose
dcaelling is connected to the sewage disposal system shall
be assessed by the association for his equal share of the
cost and maintenance and repair of their system. Such
costs shall be def ined and determined by the association
according to its rules and regulations so adopted. If
any homeowner shall fail to pay the required assessment
in the amount anci time prescribed, the association may
declare the amount delinquenC and nlace a lien against the
respective honleo-v,rner' s respective property.
A.RTICLE 5
1. Dissolution of the Association: The association
may by a majority vote of the homeocaners be dissolved ,
provided that :

Addition are connected to a municipal sewer line servic-
ing Wyatt Addition when and if built by Spol:ane
County or othcr Municipal Corp.
B. At such time as the treatment and disposal system
and its compollents are abandoned, the limited easement pro-

parts being retained for continued and future use if required
and caeh parcel of said easeMent or Portions thereof shall
revert with clear title and without charge to the 1espective
owners. Easements or parts thereof shall not revert to the

Introducti.on: The State Environmental Policy Act of 1971, Chapter 43.21c, RC LN,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also reqLaires
that an Fnvironmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. Thc
purpose of this checklist is to help the agencies involved determine whether or not a

Staff findings regarding PE-1174-78, irJyatt Addition No. 1.
I. GIIVERAL INFORMATION :
A. Location
Wyatt Addition is situated on the floor of the Spokane Valley and is
locatied north of Boone Avenue approximately 600 feet east of University
road.
B. Proposal
The applicant proposes to subdivide about 7.5 acres into 15 lots.
Eight of those lots are planned for duplexes, with zhe remaining seven
being planned for Single Family Dwellings. The proposal would create a
gross density of about 4 units per acre, with the typical lot slze of
about 11,250 sq,. ft. per lot.
C. Relationship to the Comprehensive Plan
Wyatt Addition is s-tuated within an area that has been designated as
being suitable for residential development by the approved map of the
Comprehensive Plan. Within that Comprehensive Plan however, neither
density designations nor locations for higher density residential
use s are indicated at ths. s time.
D. Existing Land II se s '
Presently located on the site is a single family residence located zn
the southeast portion of the plat. The balance of the plat proposal is
Dresently in active pasture land vegetation. The properties trat generally
suround this proposal have developed over the year s into several residential
subdivisions including Field's Addztion, Mam-rell's Subdivision, Marion
Addition and Berean Addition.
E. Compatibility With Existing Land Uses
The applicants proposal, the subdivision of about 7.5 acres ::.nto 15 lots
` 7 are ldhzch are planned for duplexes appears to be compatible with the
existing uses in the areao As was described above, the area 'nas developed
over the years into several residential subdivislons where the typical lot.
size in the area appears to be 12,000 square feet per lot wi.th duplexes
being scattered throughout the area.
II. SPECIAL IVFORMATION:
A. Circulation
The Engineer's office has reviewed this preliminary plat and they find that

adequate County roads are now available to serve the proposal and secondly
that the plat design is acceptable to their office. Their office does
recommend however, that as a condition of plat approval that all roads
within the preliminary plat be paved and curbed to the specifications of
the County Engineer.
B. Sewage Disposal
The Health Distrzct has approved the use of indi vidual on-site systems
for this proposal. The plat is however, situated over the Spokane
Va11Py Aquifer where a moderate impact on ground water qua,l.ity may be
expected at some future date if continued urbanization at this density
ocurrs in this area. If approval were granted at the plat density proposed
by the plat sponsor a sewage management system would be required as a
condition of plat approval.
C. Water Supply
The proposed subdivision is situated within the recorded service area of
the Modern Electrzc Water Company. That company indicates that it does
have the ability to serve the site urith both domestic and iire floti,rs.
D. Drainage
The staff finds that because of the relatively flat terrain of the site
and that of the adjacent nroperties, that no special dra=nage control
methods would be requlred~and standard techniques for storm water control
cauld be used.
- E. Fire Protection
The proposed subdivi-sion is situated withln the recorded service area
of Fire Protectlon Distrlct #'i. That district indicates that both mains
and hydrants of sufficient size for fire protectzon needs should be required
as a condition for plat approval.
F. Schools
The proposed subdivision is situated within the boundaries of the Central
Valley School District, where the districts facilities in this area are
presently not at capaclty levels.
G. Parks
Located to the north and east of thls plat proposal is situated Valley
Mission Park, a County owned and operated park facllity.
III. ZONING ANALYSIS
The staff finds that a zone reclassification to the Two Family Residential
Zone Classifzcation for those lots proposed ior duplexes by the plat sponsor
would be appropriate given the fact that scatterecl duplexes are siiuated throughout
the immediate area of the plat in question. The stafi further finds that a zone

I V. ENVI RONMENTAI, 1RE=~V :
The staff has reviewed the Ehvironmental Checklist submitted by the applicant and
we find that no significant adverse Environmental impacts would likely resolve from
this proposal and a proposed declaration of nonsignificance should be issued.
Slight adverse Environmental impacts were however noted under the followi.ng
q•aestions: earth, air, water, flora, noise, light and glare, natural resources,
population, housing, transportation, public service, energy, and utilities.
