A RESOLUTION OF THE BOARD OF COMMISSIONERS OF SPOKANE COUNTY
WATER DISTRICT NO. 3, SPOKANE COUNTY, WASHINGTON, AUTHORIZING
EXECUTION OF AN AGREEMENT FOR PARTIAL RELINQUISHMENT OF WATER
LINE EASEMENTS WfTH JACK W. CARPENTER AND VICKI L. REYNOLDS-
CARPENTER, NUSBAND AND WIFE, FURTHER DESCRIBED ON SAID
AGREEMENT.
BE IT RESOLVED BY THE BOARD OF WATER DISTRICT COMMISSIONERS OF SPOKANE
COUNTY WATER DISTRICT NO. 3, SPOKANE COUNTY, WASHINGTON, as foilows:
WHEREAS, Spokane County Water District No. 3(hereafter, the DISTRICT) is a municipal
corporation duly organized under the laws of the State of Washington; and
WHEREAS, the property at 9623 East 43rd Court is located within the boundaries of the
DISTRICT and the owners, Jack W. Carpenter and Vicki L. Reynoids-Carpenter, husband and
wife, are desirous to construct a portion of a garage within an unused portion of an existing water
line easement; and
WHEREAS, the Board of Commissioners deems it to be in the best interest of the
DISTRICT to relinquish the eastern ten (10) foot portion of the existing thirty (30) foot wide water
line easement and to record this partial relinquisfiment of these easements, now, therefore,
BE IT FURTHER RESOLVED by the Board of Spokane County Water District No. 3
Commissioners, as follows-
The General Manager is hereby authorized and directed to execute the attached and
incorporated "Agreement for Partial Relinquishment of Easements" identified as Exhibit "A".
ADOPTED BY THE BOARD OF WATER COMMISSIONERS OF SPOKANE COUNTY WATER
DISTRICT NO. 3, SPOKANE COUNTY, WASHINGTON, AT A REGULAR OPEN PUBLIC

UPON THE RECOMMENDATION of the Spokane County Division of Building and
Planning the plat alteration is approved with the exception that public rights-of-way
dedicated in this plat will not be established for maintenance purposes until the County
Engineer has certified that the roads have been approved to County standards and
approved by a separate resolution of the Board of County Commissioners.
ADDITIONALLY, until the final plat document is filed in the Spokane County Auditor's
Office, this subdivision has only preliminary plat status and is subject to expiration and
null and void status if not periodically granted an extension of time consistent with the
policies and procedures of the Division of Building and Planning.

Dear Mr. Reynolds,
As per your request, please find enclosed Section12.100.122 of the Spokane
County Subdivision Ordinance which describes the process for finalizing an
approved alteration to a final plat.
Section 12 100.122 states, "Following the approval of an alteration, the applicant
shall produce a revised drawing of the approved alteration of the final plat, which
shall be signed by the legislative authority and filed with the County Auditor to
become the lawful plat or short plat of the property".
Please provide an altered plat map which meets the below listed mapping
criteria. Also, please find an example of similar altered plat for your review.
1. The altered plat shall be legibly drawn, printed or reproduced permanent map,
twenty four (24) by thirty-six (36) inches. A two (2) inch margin shall be provided
on the left edge, and one half (1/2) inch margin shall be provided at the other
edges of the altered plat
2. The name of the subdivision; location by section, township and range shall be
shown
3 The scale shall be fifty (50) or on hundred (100) feet to an inch.
4. A distinct wide boundary line delineating the boundary of the property
included within the altered plat.
5 The location and width of streets located adjacent to the subject property
6 The lot and block number of the subject property and adjacent properties
7. Street names
8 Street address of the subject property
9 A Washington State licensed land surveyors stamp, certificate and signature
10. A signature block for the Spokane County Commissioners
11 Auditor's Certificate block
12 Date of drawing

14. Please include the following notes on the altered plat map-
1. The plat alteration was prepared by for the purpose
of illustrating the alteration to Lot 3, Block 3 of Ponderosa Acres 7`n
Addition. The alteration reduced the width of the utility easement located
adjacent to the west and northwest property line of from thirty (30) feet in
width to twenty (20) feet in width. No survey was completed nor any pins
set.
2. Except for the alteration to reduce the width of the utility easement from
thirty (30) feet in width to twenty (20) feet in width as provided herein, the
final plat of Ponderosa Acres 7`" Addition being recorded in Book 14, page
60 of Plats, shall remain in full force and effect with all requirements and
conditions associated with such plat still binding.
3. This plat alteration does not represent any lot corners, dimensions or
survey monumentation, bearings etc. Refer to the original plat of
Ponderosa Acres 7'h Addition for those items.
Once the altered plat map illustrating the information described above is
submitted to the Division of Building and Planning and reviewed for approval, the
altered plat map will then be submitted to the Board of County Commissioners
for their review and approval. Upon signature of altered plat map by the Board
of County Commissioners, the Division of Building and Planning will record the
map with the Spokane County Auditor's Office and the process for altering the
plat will be complete. Please be advised that the Spokane County Auditor's
office does require a fifty-four dollar ($54.00) recording fee. This fee must be
submitted to the Division of Building and Planning prior to recording.

On May 14, 1997, after tallcing with Francine regarding the above mentioned project and
after several conversations she's had with Dennis. Reynolds, I talked with Dennis
Reynolds and told him I would send him, via mail, his Notice of Application packet with
assessors maps to complete the envelopes , etc. required of the applicant to complete in
order to send the mailing out. He assuxed me that he would have no problem working
with the title company to attain the necessary information need and signatures needed,
even though he is in Longview, Washington. I aslced him to read the instructions
thoroughly and let me know if he should have any questions. I even highlighted various
portlons of the instructions to malce sure they were not missed.

organized under the State of Washington, in consideration of one dollar ($1.00) and
other valuable considerat+on, in hand paid receipt of which is hereby acknowledged,
does by these presents hereby reiinquish, quit claim and discharge to Jack W.

WATER DISTRICT NO. 3, SPOKANE COUNTY, WASNINGTON, AUTHORIZING
EXECUTION OF AN AGREEMENT FOR PARTIAL RELINQUISHMENT OF WATER
LINE EASEMENTS WITH JACK W. CARPENTER AND VICKI L. REYNOLDS-
CARPENTER, HUSBAND AND WIFE, FURTHER DESCRIBED ON SAID
AGREEMENT.
BE IT RESOLVED BY THE BOARD OF WATER DISTRICT COMMISSIONERS OF SPOKANE
COUNTY WATER DISTRICT NO. 3, SPQKANE COUNTY, WASHINGTON, as follows:
WNEREAS, Spokane County Water District No 3(hereafter, the DISTRICT) is a municipal
corporation duly organized under the laws of the State of Washington; and
WHEREAS, the property at 9623 East 43rd Court is located within the boundaries of the
DISTRICT and the owners, Jack W. Carpenter and Vicki L. Reynolds-Carpenter, husband and
wife, are desirous to construct a portion of a garage within an unused portion of an existing water
line easement; and
WNEREAS, the Board of Commissioners deems it to be in the best interest of the
DISTRICT to relinquish the eastern ten (10) foot portion of the existing thirty (30) foot wide water
line easement and to record this partial relinquishment of these easements, now, therefore,
BE IT FURTHER RESOLVED by the Board of Spokane County Water Districf No. 3
Commissioners, as follows:
The General Manager is hereby authorized and directed to execute the attached and
incorporated "Agreement for Partial Relinquishment of Easements" identified as Exhibit "A".
